In a rare move, Michael Thomas Gargiulo—the Santa Monica man accused in the stabbing deaths of two Los Angeles women, including an aspiring fashion designer who dated Ashton Kutcher—will represent himself at his murder trial without a lawyer.
Gargiulo made his first court appearance Wednesday morning in downtown Los Angeles as a pro se defendant, a Latin phrase meaning "on one's own behalf." At the short pretrial hearing, Gargiulo said he would file a motion asking the courts for funds to hire an expert witness.
Held without bail since his arrest in the spring of 2008, the 36-year-old faces seven counts of murder and burglary charges in the 2001 slaying of Los Angeles Fashion Institute of Design and Merchandising student Ashley Ellerin, 22, in the Hollywood Hills and the 2005 killing of Maria Bruno, 32, in El Monte.

Last spring, "48 Hours Mystery" reported on the 1993 murder of a young woman named Tricia Pacaccio. Now, because of that broadcast, we can report that there is finally a breakthrough for a family that has been waiting nearly two decades for justice.
The bright lights of Hollywood have always attracted the young and the beautiful. Ashley Ellerin, 22, was no exception.
For this small-town girl from northern California, life in Hollywood in 2001 was a whirlwind of work, friends and fun.
At the center of Ashley's world was a core group of close friends - Justin Peterson, Jennifer Disisto and Chris Duran.
"She was amazing. You know, just amazing," Peterson told "48 Hours Mystery" correspondent Maureen Maher.

Ashton Kutcher will testify next year in the trial of alleged serial killer Michael Gargiulo, who is accused of murdering the actor's former girlfriend.
In 2001 Ashton was dating 22-year-old Ashley Ellerin, a student, model and part-time stripper, when she was stabbed to death in her Hollywood apartment.
Ashley had tried to organise a night out – which Ashton fatefully turned down – before she was attacked and killed in her home that evening.
After trying to call her several times, the young actor drove to his girlfriend's house later that night but she didn't answer the door. According to his testimony, he peered through the window and saw what he thought was a pool of split red wine on the floor.
He left, thinking that his date was angry with him and punishing him for not wanting to go out.

The man on the phone sounded friendly enough, and more importantly, willing to help with Cook County Sheriff Det. Lou Sala's case.
It was 2002 and since 2000 Sala had been assigned to investigate the killing of Tricia Pacaccio, a 18-year-old girl repeatedly stabbed outside her Glenview home in 1993.
Strong leads were few in the cold case, and Sala was calling a list of names previous detectives already had spoken to when he found Michael Gargiulo, a former neighbor of Pacaccio who had moved to Los Angeles.
Their conversations were cordial and Gargiulo seemed cooperative, until Sala suggested Gargiulo submit his DNA for testing.
"That's when (Gargiulo) backtracked; that's when he got kind of funny," said sheriff's spokesman Steve Patterson.
The conversation was among the first steps in the chain of events that shored up a key connection in the case against Gargiulo -- a DNA match linking him to the evidence found under Pacaccio’s fingernails.
To be sure, Cook County State's Atty. Anita Alvarez said Thursday that the case against Gargiulo only reached the standard for charges after two witnesses came forward to say Gargiulo admitted to them that he killed Pacaccio. A DNA match linking Gargiulo to the crime, she said, was critical to the case, but in the end it was no "silver bullet."

Police in Los Angeles are seeking the whereabouts of a young woman seen in photographs with a suspected serial killer.
The woman in the pictures is hugging and kissing Michael Gargiulo, who is facing court over the knife murders of three women and the attempted murder of a fourth.
One of the victims, 22-year-old Ashley Ellerin, who was stabbed to death in her Hollywood home in 2001, was the one-time girlfriend of Hollywood star Ashton Kutcher.
The unidentified girl in the photos is in her early twenties, and the photos were taken around 2001 or 2002 - roughly the time of Ellerin's murder.

"On Wednesday, a Los Angeles detective told the Chicago Sun-Times that Gargiulo may have killed 10 women. Gargiulo has been in the Los Angeles County Jail since 2008, when he was charged in the 2001 and 2005 murders of two California women--including actor Ashton Kutcher's ex-girlfriend. He was also charged in a 2008 knife attack in which the victim survived--ultimately leading to his arrest.
Los Angeles County sheriff's homicide detective Mark Lillienfeld told the Sun-Times that Gargiulo referenced the murders of 10 women while in prison, which puts even more heat on Cook County for failing to charge him earlier.
"We just can't understand why they didn't do anything sooner when they had the DNA," Diane Pacaccio told TribLocal this week. Though Gargiulo was finally charged in her daughter's murder after new witnesses came forward, the family is still unhappy about the way the case was handled"

Gargiulo was born in 1976 and grew up with six siblings, including several sisters, and he lived 100 yards away from the Pacaccio family. He wasn't the most popular kid in the neighborhood. Bloggers on A&E's "Cold Case Files" discussion board recalled him unfavorably, according to a truecrimediary.com story:
"My family and I lived 3 houses down from Mike and his family. He always was the odd one out from his family, who were all very nice people. He was just always angry, and taking it out on others, usually by bullying them."
And this: "My older brother remembers Michael...and remembers him as being quite angry and violent."
Diane Pacaccio, Tricia's mother, remembers Gargiulo playing with one of her two sons as they grew up. However, unlike other neighborhood kids, Gargiulo would never come inside the Pacaccio home for lunch.

It was an unseasonably temperate and foggy early morning in suburban Chicago as Pacaccio arrived home sometime past 1 a.m. She walked up to the side door of her family home and stuck her key into the lock.
The 18-year-old Pacaccio would never make it past the doorstep.
Hours later, as her father Rick headed out the door to his van for work, he spotted a pair of tennis shoes sticking skyward. He walked over for a closer look.

The Pacaccios were frustrated. No one had been arrested and charged in her murder.
"My daughter's death is not going to be a cold case," vowed Diane. "We know who killed her, but nobody will charge him."

Ashton Kutcher is preparing to take to the witness stand to testify against the man charged with the grisly murder of the actor's then-girlfriend.
Michael Thomas Gargiulo stands accused of murdering three women, including Ashton's then-girlfriend, 22-year-old Ashley Ellerin, on February 21, 2001.
And ahead of the trial new court documents have revealed the full horror of the killings.
Ashley, who lived just 400ft away from Gargiulo in Los Angeles, was attacked while she was showering and stabbed 47 times.

Ashton Kutcher might seem like a happy-go-lucky sort of guy, but few people know about the catastrophic tragedy that devastated the star's early 20s as he was just beginning to rise to fame.
Back in 2001, Kutcher's casual girlfriend Ashley Ellerin was brutally stabbed to death by a serial killer in her own home and the young Kutcher came within a hair's breadth of discovering her body.
Ashley Ellerin was only 22 when she was killed
On the night of the murder, Ashely had called Kutcher to arrange a date, but the up-and-coming actor declined the offer. Later, after having a change of heart and being worried that his calls were going unanswered, Kutcher visited Ellerin's home behind the the famous Grauman's Chinese Theatre, but there was no answer when he rang the doorbell.
Concerned that Ellerin's car was in the drive and all of the lights were on in house, Kutcher knocked on the window and called out his girlfriends name, but to no avail. When he peered into the house, the then 23-year-old Ashton saw what he thought was a puddle of red wine on the floor and assumed Ashley had been drinking and left.
