With a January trial looming in the defamation lawsuit brought by Zenaida Gonzalez, attorneys for Casey Anthony want a judge to block any testimony or evidence related to the last time their client was in court — for her murder trial.

In a motion filed late last week, Anthony's attorneys ask Circuit Judge Lisa Munyon to block "any evidence, comment, or other reference by counsel of any witness in this case concerning" Anthony's highly publicized murder prosecution and trial.

"The criminal proceedings are not relevant to any issue in this case," Anthony's defense argues in their motion. "Moreover, any evidence, comment, or reference to the criminal proceedings would inject collateral issues into this matter and would be unduly prejudicial to Ms. Anthony."

To me this is so dumb because if it would not have been the case of Caylee going missing then she would not have told the police that Caylee was with a babysitter Zenaida Gonzalez. Of course the people on the jury will not know who Casey Anthony is and that she was charged with murder of her child. I guess he thinks there will be cavemen sitting on the jury.

Jurors shouldn't have heard testimony about Anthony's lies, her defense argued, because she hadn't been advised of her rights, despite having been briefly handcuffed and put in a deputy's vehicle, before she was questioned by detectives.

Anthony's attorneys argue that her four convictions violate the constitutional double-jeopardy protection. The four lies she was charged with, they say, were really just one "single offense."

The defense also argues Perry incorrectly ruled against an objection to part of the jury instructions about perjury, rendering the only charges Anthony was ultimately convicted on "unconstitutionally vague."

In its answer, filed Thursday, the state countered that Anthony was not officially in custody when she lied to investigators and her appellate brief "failed to show a double jeopardy violation" or prove an issue with the instructions.

The appeal has a substantial impact on several lawsuits Anthony faces in connection with her daughter's death, including a defamation suit brought by Zenaida Gonzalez, who says she was defamed when Anthony told authorities a nanny with a similar name had kidnapped Caylee.

jmo, apparently KC thinks she is going to CASH IN on the murder of Caylee and knows a BIG judgement in ZG's favor, in addition to the monies she owes the IRS and the State for the investigation, the skank isn't going to see much money, if ever. It surprises me that her attorney's continue to work PRO BONO.

Judge denies Casey Anthony's request to toss punitive damages from civil trial

A judge has denied Casey Anthony's attempt to severely limit the potential damages she could be ordered to pay in the defamation lawsuit set for trial early next year.

Circuit Judge Lisa Munyon ruled that Anthony's motion to strike Zenaida Gonzalez's claim for punitive damages in the lawsuit was not filed according to proper procedure.

Munyon denied the request "without prejudice," meaning Anthony's lawyers could ask the judge to revisit the issue on different legal grounds.

Obviously Casey walked "free" although she committed filicide. She executed Caylee in order that she herself would live a better life.

She spends much time in isolation. She surfs the web. Certainly she reads all about herself all over the internet. She wanted to choose in a brand, but she didn't understand, she had already been branded a babykiller.

These upcoming civil trials, are in my humble opinion a positive move forward pursuing Justice For Caylee. These upcoming trials are Justice For Caylee because these imminent civil trials are scuttling Casey's Bella Vita. Morphing her Bella Vita into her very own Hella Vita....

I sincerely doubt the Anthonys ever baptized Caylee. Cindy has stated, "The Anthonys always win, because the Anthonys are Christians...." What did Caylee win?

Casey Anthony's civil trial in a defamation lawsuit is set for January, but on Tuesday, attorneys for Zenaida Gonzalez filed a motion to reschedule the trial to a later date. Casey Anthony's attorney, Charles Greene, says he wants to keep the current trial date for January 2 and has been working hard to file motions based on that date.

This is all about timing. Greene says the appeal in Casey's criminal case is scheduled for court on January 8, six days after the civil trial. The defense is appealing the criminal conviction that Casey lied to officers, by telling them her daughter Caylee was kidnapped. Because of the appeal, Casey is protected from talking about the case under the Fifth Amendment, as her criminal trial takes place.

Casey Anthony re-files request to throw out punitive damages

Attorneys for Casey Anthony are again seeking to limit the damages Zenaida Gonzalez can pursue in her civil defamation lawsuit.

Circuit Judge Lisa Munyon denied Anthony's previous attempt to throw out Gonzalez's claim for punitive damages, ruling that defense attorney Charles Greene hadn't filed the proper type of motion. Munyon left open the possibility of Greene refiling his pleading, and the defense did that last week.

"Based on, among other things, the fact that neither party knew the other, had a history of ill will towards the other, or was otherwise even aware of the other's existence, [Gonzalez] cannot present sufficient evidence to satisfy the specific and mandatory requirements" for pursuing punitive damages, the new motion says.

Casey Anthony: Prosecutor says 'foolproof suffocation' search prompted WKMG report

A highly promoted local television report set to air this evening will center on Internet searches that authorities didn't know about during the high-profile trial of Casey Anthony, according to the lead prosecutor in the case.

Prosecutor Linda Drane Burdick confirmed in an email to the Orlando Sentinel that someone used the Anthony family computer to search for "foolproof suffocation" on June 16, 2008, the day Casey Anthony's father said she left the family's home with Caylee for the last time.

Burdick wrote that the Orange County Sheriff's Office has confirmed "there was a computer search on 'foolproof suffocation' on 6-16-08 that they did not find." Burdick stressed that this information "is not 'new,'" as it was already published in Baez's book months ago.

However, she confirmed that she "did not know about it before or during trial."

Nothing like kicking us while we're down... Let's turn the knife a little more... I don't think there is a day that goes by that I don't think about Caylee and the sad story that became her life and death. It still pisses me off to no end that the POS got away with it and to know there is more evidence to prove it as if there wasn't enough already... I hope there tear her up in the civil cases...

Wrongful death, perhaps? Dunno. Not really following the case.

*** Can't charge on any of the old evidence but if there is NEW evidence or evidence not introduced in the first trial, that can be used for a new trial. Many times evidence IS withheld for that very reason--- retry especially if an appeals throws out the verdict and some of the evidence that convicted is now not admissible. And while evidence may not be included at the first trial, so many times there is never a second trial. Just "wasted" in too many cases, IMO. Nothing says the prosecution has to introduce every single bit of evidence to CONVICT. However, in many states, prosecution IS required to turn over ANY and ALL evidence that would point away from the defendant. Fine line at times, IMO.

For some reason, I believe there was a third adult in the home that morning--- one we have not heard from.

Do you remember the mini-vids out on the web?
One really bothered me.
It was the one of the child in her high-chair eating dry cereal" or finger food. And the camera went under the the high-chair tray to vid the child's legs and "private" parts. Caylee even asked the person,"What are you doing, ___insert name______?"

Too many of these vids with Caylee talking to the camera person and that person not responding or interacting. It became most haunting.

Casey Anthony: Arguments made in appeal; ruling will come later

Anthony is appealing four convictions for lying to law enforcement.

Attorneys for Casey Anthony returned to court this afternoon, to try to convince a three-judge appellate panel to throw out her four convictions for lying to law enforcement during the search for her daughter.

Anthony did not attend the 1:30 p.m. hearing, which was completed with an half hour. The outcome of Anthony's appeal is notable in part because it will likely impact her testimony in several pending lawsuits.

The only issue that was discussed in the hearing was whether Casey Anthony was in custody when she lied to police in the Summer of 2008 just after her daughter Caylee Marie was reported missing.

Winter Park defense attorney Lisabeth Fryer made arguments on behalf of Anthony; Assistant Attorney General Wesley Heidt made arguments on behalf of the state.

What Casey's lawyers are asking the appeal court is basically to overturn Judge Perry's ruling, they are alleging that the statements that she made to the police investigators at Universal Studios shouldn't have been admitted into evidence because she was put in handcuffs, and placed in the back of a police car without being mirandized.

If the Appeal Court agrees, her conviction for the four counts of lying to the police will be vacated.

I don't think this is what is going to happen.

NeJame predicted it would be several weeks before the three-judge panel rules in the appeal. He noted the matter-of-fact way the judges treated the Anthony appeal. “Just because this garnered a lot of press attention, they’re going to make it a point to treat it like every other case,” NeJame said.

On the defamation suit, NeJame explained that the civil case had stalled because Anthony has Fifth Amendment privileges in the appeal. Once the appeal is over, Anthony won’t have any Fifth Amendment protections, NeJame added.

A Florida appeals court has thrown out two of the four convictions that Casey Anthony faced for lying to law-enforcement during the investigation into her daughter's disappearance in 2008.

Anthony's attorneys argued that double jeopardy principles precluded her from being convicted for more than a single violation, because her various lies constituted a single offense.

The state argued that each of Anthony's false statements constituted a separate offense, and so there was no violation of double jeopardy.

On Friday, the Fifth District Court of Appeal ruled that it rejected both parties' arguments.

The appeal court found that Anthony could properly be convicted of two counts of providing false information to a law-enforcement officer.

Based on Mason's comment that they are reviewing the option of a rehearing, does it mean that if a rehearing is granted that she can still plead the 5th during the Zenaida trial?

I know there are people out there such as Jeffrey Macdonald who kept on appealing appeals and dragged the process out for decades, but surely there comes a time when enough is enough and the courts deny new motions and appeals.

ORLANDO -- Casey Anthony has filed for bankruptcy.

The woman acquitted in the murder of her 2-year-old daughter in 2011 filed with the Middle District of Florida Bankruptcy Court on Friday, the same day two of her convictions for lying to law enforcement were thrown out by an appeals court.

The attorney representing Zenaida Gonzalez in her defamation case against Casey Anthony, Matt Morgan, called the filing a delay tactic in a posting on his Twitter account.

Casey Anthony, facing a mountain of debt and three civil lawsuits related to the disappearance of her daughter in 2008, filed for bankruptcy protection in Orlando late Friday.

Anthony owes nearly $800,000 but only has $1,084, according to a petition filed in U.S. Bankruptcy Court for the Middle District of Florida.

"This is the next step towards closure for me," Anthony, 26, told a Phoenix TV station late Friday.

Attorneys set to move forward in Casey Anthony civil cases despite bankruptcy

ORLANDO -- A new chapter has been filed in the Case against Casey Anthony. It's now chapter 7 after she said she has no money and filed for bankruptcy.

The filing could delay civil cases she’s still involved in since a jury found her not guilty of murdering her 2-year-old daughter, Caylee.

We spoke with the attorneys representing clients in two defamation cases.

They said even though their cases are put on stay until the bankruptcy court judge rules on this bankruptcy filing, they will move forward to get some restitution from Anthony.

I truly hope that the lawyers representing those who have civil cases against her can get it right to get their cases heard, and if successful, can claim from future earnings.

In fact, it's typical of kc ant. She wants and needs closure and yet has given no thought to the people whose lives she ruined in the quest for self-preservation.
