Life in the balance: Jodi Arias' possible fates

" Jodi Arias’ fate is hanging in the balance as jurors listen to closing arguments and prepare to deliberate whether she is guilty of murdering her ex-boyfriend Travis Alexander, but her trial may not end with the verdict.

There may be a lot left for the jurors to decide even after they declare their verdict.

If Arias is found guilty of first-degree murder, the jury will also have to decide whether she should die via lethal injection.

Depending on the jurors' decision, here are some other scenarios Arias could face.


Not guilty

If the jury decides the prosecution didn't prove its case, and they return with a not guilty verdict, Arias will be a free woman. She could then resume her dreams of becoming a professional photographer and starting a family.


Hung jury

There’s also a possibility the jury will not be able to reach a unanimous decision, in which case there would be what is called a hung jury. If the judge declares a mistrial because of a hung jury, Arias could face a retrial.

However, if jurors think Arias is guilty, they will have more decisions to make.

First-degree murder

The jurors have two paths they can take to reach a first-degree murder conviction.

They can unanimously decide Arias is guilty of premeditating Alexander's murder. Arizona defines first-degree murder as when someone plans or premeditates killing another person and carries out their plan.

The jury can also convict Arias of first-degree murder with the legal theory called felony murder. If they find Arias caused Alexander's death during the course of committing a dangerous felony such as aggravated assault, they can also convict her of first-degree murder.

In order to find Arias guilty of first-degree murder, the jury must unanimously agree that the prosecution has proven first-degree murder, but they all don't have to agree on which first-degree murder legal theory was proven -- classic premeditated first-degree murder or felony murder. Therefore, the jurors have two paths to first-degree murder.

If Arias is convicted of first-degree murder, the case then moves to the aggravation phase, which will be like a miniature trial.


The prosecution will have a chance to present additional evidence in an attempt to prove Alexander’s death was caused in a cruel manner. Arizona law defines cruel manner as when the victim suffers physical pain or mental anguish and the defendant knew or should have known that the victim would suffer.

The jury would then deliberate for a second time to determine if the aggravating factor of cruelty is proven beyond a reasonable doubt.

If the jury does not find her guilty of cruelty, the case ends and the judge sets a sentencing date within 30 to 60 days. At the sentencing, the judge decides whether to sentence Arias to life in prison without parole or life with parole eligibility after 25 years.

But if the jury decides cruelty is proven beyond a reasonable doubt, the case moves to the sentencing phase.

This is the defense’s opportunity to ask the jury for leniency and present evidence to support why Arias should be spared the death penalty. Witnesses may include Arias’ friends and family. Arias could also make a statement to the jury pleading for her life to be spared.

The jury then deliberates for a third time to determine whether Arias should be sentenced to life or death. Their decision must be unanimous. In the case of a deadlock, a mistrial would be granted and a new jury would be chosen for this phase only.

If the jury votes for the death penalty, Arias would be sentenced immediately, and she is likely to be sent to death row within hours.

If the jury chooses a life sentence instead, the judge will set a sentencing date within 30 to 60 days. At that time, the judge will sentence Arias to life in prison without parole or life with eligibility for parole after 25 years.

Second-degree murder

If the jury rejects first-degree murder, but finds her guilty of the lesser charge of second-degree murder, the judge will sentence Arias to no less than 10 years and no more than 22 years in prison.

Arizona law defines second-degree murder in two different ways that apply to this case.

Second-degree murder is when a person intentionally or knowingly causes the death of another person without premeditation.

In the alternative, second-degree murder is also defined as when the defendant shows extreme indifference to human life, and recklessly engages in conduct that creates a grave risk of death, and causes the death of another person.

Manslaughter

If the jury rejects first-degree murder and second-degree murder, but finds Arias guilty of the lesser charge of manslaughter, the judge will sentence her to no less than seven years and no more than 21 years in prison.

Arizona law allows the jury to reach a manslaughter verdict multiple ways. Here's what applies to Arias' case:

If the jury believes Arias recklessly caused Alexander's death, they could convict her of manslaughter.

Here is where the manslaughter charge gets complicated. In Arizona, if someone intentionally or knowingly kills a person without premeditation, the defendant could be charged with the crime of second-degree murder. However, if the jury believes the victim attacked the defendant, and if it was enough to incite the defendant's actions, then the intentional killing would fall under the lesser crime of manslaughter.

Don't confuse manslaughter with self-defense. If the jury believes Arias' self-defense claim, and her actions were reasonable under the circumstances, then they could acquit her."

Faith was an integral part of Alexander's life. The professed son of methamphetamine addicts, Alexander was raised in Riverside, California, with three brothers and four sisters. His grandmother introduced him to Mormonism as a child.

After he graduated from high school he went on a two-year mission in Denver. He later moved to Mesa because of the strong Mormon community and became a motivational speaker and businessman. He also authored a book titled, "Raising You."

Arias was living in Yreka, California when she met Alexander at a business convention in Las Vegas in September 2006. That November, he baptized Arias into the Mormon faith, a ceremony Arias said was followed by anal sex.

Arias became his girlfriend two months later, she testified, and they dated for less than a year.

They broke up in the summer of 2007 and Alexander began dating other women. There were claims that Arias would stalk him, peering in his windows at times. Still he and Arias continued to hang out on several occasions until, disenchanted Arias says, she moved back to northern California. They continued to communicate.

The prosecution's case

Alexander's naked body was found crammed in a stand-up shower after he missed two appointments, prompting friends to go to his house. He had been stabbed 27 times in the back and torso and shot in the head. His throat was slit from ear to ear.

Does Jodi Arias love the spotlight?

Arias initially told an investigator, "I heard a lot of rumors, and that there was a lot of blood." She later claimed she killed him, albeit in self-defense.

Deputy Maricopa County Attorney Juan Martinez has accused Arias of playing the victim when, in fact, he alleges she staged the crime scene to make it look like self-defense and has actively sought to profit from the media attention.

Prior to Alexander's killing, Martinez said, Arias stole her grandparents' .25-caliber pistol, rented a car in Redding, California, turned off her cell phone and brought along cans of gas so there would be no record that she was in Arizona.

"The only reason to keep this whole thing a secret, which is what she tried to do, is because she was going to kill him, and she's making preparations," the prosecutor said.

Finally, according to Martinez's closing argument, after she killed Alexander, she hooked up with an out-of-state romantic interest so she would have an alibi.

"She continues on to Utah into his waiting arms. Gosh, you can almost hear the violins making their sound as she goes up to him, gives him that first kiss. Isn't that romantic?" Martinez said.

Arias' defense

Defense attorney Jennifer Willmott has said Arias was the victim of a controlling, psychologically abusive relationship and that Alexander considered Arias "his dirty little secret."

Before Arias killed her ex in self-defense, Willmott claimed, she was subjected to rough vaginal sex. After she dropped Alexander's new camera, he became violent, the defense said, and had Arias not defended herself, investigators would've found Arias, not Alexander, dead in the bathroom.

Arguing the prosecution's position that Arias was obsessed with Alexander and stalking him, another defense attorney, Kiki Nurmi, has said it didn't add up because Arias was active on a Mormon dating site.

"Jodi ... wasn't so locked in on Travis that she wasn't looking for other men," Nurmi said.

As for the allegation that Arias attempted to surreptitiously slip in and out of Arizona without a trace, Nurmi pointed out that Arias went to the Redding, California, airport to rent her car for the trip.

"An airport with security cameras and security all around," the defense attorney said, "not some rental car agency on the outskirts of town -- an airport. That doesn't make any sense if you're on a covert mission."

Nurmi also questioned the merit of the prosecution's gas can argument, saying Arias could have avoided a paper trail simply by paying with cash. She didn't need cans, he said.

Did Arias change her story? Sure, Nurmi said, but that's not what she is standing trial for.

"If Jodi Arias were accused of the crime of lying, I could not stand before you and say she's not guilty of that crime, but nowhere in your jury instructions are you asked to convict Jodi Arias of lying," Nurmi said. ... "

“Why would deadly physical force be necessary after she stabbed him in the heart?” the bulldog prosecutor asked the jury regarding the butchering of Travis Alexander. “Because her intention was to kill, not to defend herself.”

Martinez’s return to the center stage of the Maricopa County Courtroom came after the morning had been dominated by Kirk Nurmi, arguing that the premeditation theory didn’t make sense because why would his client feign memory loss?

“The problem is if she were lying about this stage of events…wouldn’t she actually make up a lie where she remembered?” he asked, as he introduced the options of second degree murder or manslaughter.

While the prosecution steered away from the smut to focus on the facts, Nurmi aimed to remind the jury of Travis’ dark side by playing the explicit phone sex tape to the court, where he talked about wanting to rape Jodi, and tie her to a tree in the woods for a sexual act...."

Jodi made sure that Travis did not go gently. She made sure he went nude. She planned it in his home where he was secure, it was joy, etc.... He was unaware of what was going to happen to him. (Nurmi objects-Approach) Jodi stabbed him the chest-the heart. We don't know if Travis saw the knife, but we know he felt it. As he is seated there, the knife comes at him. He knows the person doing it to him. It hurts when a knife hits you in the chest. Using Jodi's standard of her attempt of suicide, she knows it was painful when she got the papercut. Travis is feeling like he's having a heartattack. Jodi is in a superior position. He grabs the knife and gets more pain. He can't get away. Travis is now suffering. He hurts. He's bleeding. He's trapped. Jodi didn't let go of the knife. Travis gets out of the shower and get away- What's Travis thinking about-the grandmother that Jodi sent flowers to? (OBJECTION yelled by Nurmi and an approach)

What was Travis thinking about? Must seem like a long walk to the sink for Travis. Travis was expereinces terror and pain. EX 98 shows Travis made it to the sink. He's over the sink, and he's alive. He could see in the mirror. He sees himself for the first time. What a reflection he seen in that mirror. Do you think he was quite as a church mouse? He's starts getting stabbed in the back of the head. Travis can see Jodi stabbing him in the head. It's painful to get a knife in the head hard enough to leave a divet. 2 minutes of pain and terror. JM has the court room sit for 2 minutes. Silence in the room. (hands down-the most powerful moment)

Now...he got his throat slit. It was a long time.
Travis tried to leave down the hallway. He didn't have the strength anymore. He went down. He was alive. The last thing Travis saw was Jodi with a blade coming to his throat. The last thing he felt before leaving this world was pain. Travis suffered enough on June 4th for 2 lifetimes. Those 2 minutes seemed like an lifetime for him. Travis suffered pain and mental pain. We know Jodi slit his throat. Jodi knows Travis suffered. Any reasonable person would know if you stick a blade in somebodys chest it's going to hurt. Jodi meant to spill blood and cause death. She knew every step of the way. This is a woman with a high IQ. She knows what she is doing.

Now they are talking about how Jodi didn't know what was going on-lets talk about that- Jodi deleted photos. Jodi moved the body away from the door to cover the smell. She cleaned up. She changed clothing. She put the licence plate back on. The defense has a weak argument. JM is basically saying Nurmi thinks the jury is stupid and he doesn't want to talk about what actually happened. EX 193- why don't we talk about these? Why don't we talk about EX 204-the throat. Travis suffered. You already know about Dr. Samuels track record? Jodi knew if you take a knife, you are going to hurt somebody. In those 2 minutes, Travis suffered. Only death relieved it.

She, Patty, was not more than two feet away when she passed me and I watched her approach down the aisle from the court well as she headed out towards the witness room. I was looking for signs that she was zoned out and detected nothing. Just a stressful frown! I noticed nothing inappropriate about her dress. The blouse she wore was a bit sheer and she might have had something off the shoulder on underneath. If I recall correctly, it was tucked into a grey skirt. Darrell was in the area and quite animated as this was going on and I was checking out his slim build and facial features at about the same time to confirm that it was indeed the same person I had seen in previous pictures. When I next saw Patty, it was through the slotted window of the witness room door. She was seated facing the door and her posture indicated to me that she was stressed. I'm sure I would have noticed Daisy Duke shorts if she was wearing them. If I'm mistaken, blame it on the moment and the aged brain. There was a lot to take in during those few seconds.

P.S. The class act in the room, with respect to dress and demeanor, were the Alexander sisters, Tanisha and Samantha. Tanisha wore an appropriate vertically striped closely fitting dress that showed her voluptuous figure to advantage. Samantha wore a more conservative and looser blue dress totally appropriate for the occasion and the task that she had to perform. They both know how to walk in high heels and did so confidently and purposefully. The whole Alexander family, (spouses included) raised the bar in that courtroom and held it there. "
