Day 97: Police believe they found Elaina's remains

Day 97 - Sept. 6, 2013:

Toledo police held a press conference to reveal results after searching near Steven King's home. Police Chief Derrick Diggs says they believe they have found the remains of missing baby Elaina Steinfurth.

"We wanted to find the body and we wanted to find that baby and we did," said Diggs.

Police said at the press conference that the area was "tough to search," and the box was located in the far corner on a shelf in rafters. Cadaver dogs were brought to the scene, but due to the condition of the property, dogs were not allowed to go inside.

Police say they found "immature skeletal remains."

Following an autopsy, Dr. Diane Scala-Barnett and Dr. Julie Saul, from the Lucas County Coroner's Office, released the following statement:

"The box, recovered from the upper level of the garage located at 704 Federal, contains immature human skeletal remains. Because the skeletal remains are so immature, it is not possible to determine the sex of the deceased therefore DNA is necessary.

When 1-year-old Elaina Steinfurth was reported missing in June, the community came together and started conducting searches in addition to police searches.

One of the volunteers at that time spoke out Thursday evening, saying she had asked police to search the garage near Steven King's home months ago.

Cundick said after her search group was warned to stay away from the garage many weeks ago, they went back to that area with a search dog.

"[The dog] started hitting on the fence and started jumping up in the air, and was really close to the garage and we just knew something did not feel right," she said.

Again. the step-grandfather has said he was in the garage during a search. He said that everything was checked, including the rafters. No box there. Someone moved the body around. Just like Florida and the Anthony case. She was found in an area that had been extensively searched. "

EAST TOLEDO, OH -- A quick list of some of the people involved in the case of missing toddler Elaina Steinfurth include Julie King, the mother of Steven King, who says her son pointed authorities to the girl's body.

Steven King is the ex-boyfriend of Angela Stenifurth, Elaina's mother.

Julie owns the Federal St. house where baby Elaina was last seen, and where Steven lived before being arrested on a charge of obstructing justice. The home is also where Angela was temporarily staying, along with her two children, prior to Elaina's disappearance.

Toledo Police have confirmed that "immature human remains" were removed from the garage located behind the house on 704 Federal St. during a search Thursday. The family of Steven King tell WNWO that police found the remains because Steven, while in custody, told them exactly where to look.

TOLEDO, OH (Toledo News Now) - Since Elaina Steinfurth went missing in July, family, friends and the community have gathered weekly at the house on Federal Street where she was last seen for a vigil.

Those vigils were usually held on Wednesdays and Saturdays, but an additional vigil was held Friday evening for everyone to come together after the latest developments in the case.

"After yesterday, I now feel we are moving to where we're going to get our answers, quicker than what we thought," said Terry Steinfurth, Elaina's grandfather.

TOLEDO, OH (Toledo News Now) - As law enforcement provides updates on investigation into the disappearance of baby Elaina Steinfurth, neighbors in east Toledo are reacting to their announcement on possibly finding her remains.

It's a very somber scene Friday. Many, including Elaina's father, are waiting for confirmation to know for sure if body discovered belongs to the toddler, who has been missing for more than three months.

The signs of hope are still up in east Toledo. While many believe it is Elaina's body, which is now being examined by the coroner's office, Elaina's father says hope is all he has right now.

In a written statement, Lucas County Deputy Coroner Dr. Diane Scala-Barnett said the remains from 704 Federal are so immature it's not possible to determine the sex of the remains.

A DNA sample has already been sent to the state's Bureau of Criminal Investigation lab in London, Ohio; a BCI spokesman said test results should be available early next week.

Hundreds march demanding justice for Baby Elaina (Video)

Hundreds took to the streets in Downtown Toledo on Sunday demanding justice for Baby Elaina Steinfurth.

The marchers said they wanted to "rock the jailhouse" and their voices were heard loud and clear as they marched to the Lucas County Jail.

Elaina's grandfather Terry Steinfurth, Sr. said, "We wanted to rock the jailhouse. I know that when we march around the jailhouse they can hear you inside. When I cam across in front of that jail and heard the pounding on those walls and windows, I know they heard us. They know we're here. They know we're not going anywhere."

The event had originally been planned as "bring Elaina home" demonstration. But that changed after the skeletal remains of a child were found in a box inside the garage of the home at 704 Federal Street that Elaina disappeared from on June 2.

TOLEDO, OH (Toledo News Now) - Steven King, who is facing obstruction of justice charges in the case of Elaina Steinfurth, will appear in court Thursday morning.

King had been set to go to trial facing an obstruction of justice charge Monday morning. That trial date was vacated Wednesday and a hearing has now been set for 8:30 a.m. on Thursday.

Thursday will be the first time King will appear in court since the remains of 1-year-old Elaina were found. A box containing her remains was discovered in an east Toledo garage on September 5.

TOLEDO, OH (Toledo News Now) - As the community continues to mourn the death of east Toledo toddler Elaina Steinfurth, there are still many unanswered questions.

Just 24 hours after police confirmed DNA results from the remains found in a box last week belong to baby Elaina, Steven King requested a continuance of the trial that was scheduled to start Monday. He asked for a new pretrial, which will happen Thursday morning. There are no new charges against King at this time.

The Lucas County Prosecutor's Office along with the Coroner's Office is expecting to have more information within the next few days about the cause of death. The autopsy is not complete because the coroner only had bones to work with.

Once the cause of death is determined, police will be able to build a strong case against the responsible party.

He appeared in court Thursday morning just days before his trial was set to begin. However, the judge pushed back the trial date. It was suppose to be the final pre-trial before he went to trial next week. But the judge has pushed back to October 7th.

My heart sank as I read a text message telling me that the Toledo Police were executing a search warrant at 704 Federal St. My heart broke minutes later when I received another text stating, “Coroner confirms human remains found in box.” I had came to a logical conclusion in June that “Baby Elaina” Steinfurth was probably dead. I am a glass-half-full kind of guy, so I was holding on to a glimmer of hope that it was a custody thing; maybe she was alive, possibly staying with a distant relative or friend.

It looks like I was wrong. Evil happened. We now know the ugly truth. Elaina’s life ended too soon.

Officials reportedly found her in a box in the detached garage behind the home where Steven W. King (Elaina’s mom Angela Steinfurth’s ex-boyfriend) and his family reside. This residence has been the centerpiece of countless search parties, prayer vigils and national media attention. This home, with its feces-covered floors and that stained mattress, is now burned into the permanent memory of everyone who has seen that video. I do not live on that street or in that neighborhood, but I am tired of looking at that run-down property. I’m tired of seeing people sitting on that porch.

The house and garage need to go as soon as possible. We as a community need not be reminded of the evil that took place behind those walls. We need to tear down this house. We as Toledoans need to raze 704 Federal St.

It was an emotional day for Elaina Steinfurth's family. The community said their goodbye to the toddler Friday. The 18-month-old's remains were found in a box in a garage in east Toledo.

Hundreds gathered at Eggleston Meinert and Pavley funeral home to remember Elaina. Some wore T-shirts with pictures of the baby. The toddler's father was too emotional to talk and was comforted by family and friends.

"I really didn't say a whole lot. I hugged him and told him I loved him, and I'm so sorry for what's happened," says Elaina's cousin Ginger Smith. "Of course he said to me he wished things could be so much different. God, we all know that."

The community showed up in full force. There were pictures of Elaina scattered throughout the funeral home. Family and friends touched her tiny white casket and vowed to get justice for her.

The Ohio Attorney General's Office says the Bureau of Criminal Investigation has completed its testing in connection to the case of Toledo toddler Elaina Steinfurth.

Steven King's trial pushed back to November

Steven King's attorney asked for a continuance, for further investigation. The trial is set for November 4th. The final pretrial is set for Oct. 29th.

He appeared in court Monday morning, as his trial was supposed to begin.

Steven King has pleaded guilty to aggravated murder in the death of Baby Elaina Steinfurth. The toddler disappeared from an East Toledo home in June. King is the ex-boyfriend of Elaina's mother, Angela.

In court today, King pleaded guilty to aggravated murder, abuse of a corpse and tampering with evidence.

In court Tuesday afternoon, King told a judge he found Elaina injured in a bedroom on June 2nd. He said he tried to perform CPR and cover the little girl's mouth and nose. King did not say how the toddler got hurt. He then admitted to putting Elaina's body into a bag.

Angela Steinfurth is expected to appear before a judge later today. She is facing a murder charge in connection to the baby's death.

Prosecutors say an agreement has been reached on Steven King's sentence. For the aggravated murder he'll be sentenced to life, for tampering with evidence he will receive 2 years, and for abuse of a corpse he swill serve one year. The sentences are all to run consecutively. The life sentence will make him eligible for parole after 25 years.

TOLEDO, OH (Toledo News Now) - An east Toledo mother and her ex-boyfriend have taken plea agreements in the murder of 18-month-old Elaina Steinfurth back on June 2.

Angela Steinfurth entered an Alford plea to one count of murder on Tuesday. An Alford plea is not an admission of guilt. A defendant entering an Alford plea agrees to be found guilty without admitting he or she committed the crime. In exchange for her plea, Steinfurth will serve a life sentence with the possibility of parole after 18 years.

Steven King pleaded guilty to aggravated murder, tampering with evidence and obstruction of justice charges in the case Tuesday. As part of the deal, King will be sentenced to life in prison with the possibility of parole in 25 years.

Lawyer says Angela went to her then boyfriend Steven King for help hiding what she had done. King then killed Elaina and hid her body in the garage, according to prosecutors.

King confirmed at least part of that story in a statement in court Tuesday. King said he found baby Elaina injured and attempted to perform CPR on the 1-year-old, but says blood came out of her mouth. King said at that point he panicked and put his hand over her mouth and nose. King says Elaina suffocated as a result. He said he then wrapped her body in a blanket, put it in a bag and hid the body in the garage of his Federal Street home.

TOLEDO, OH (Toledo News Now)- Angela Steinfurth entered an Alford plea to a murder charge in her 1-year-old daughter Elaina's death. Steinfurth will be sentenced to a life sentence with the possibility of parole after 18 years.

An Alford plea is not an admission of guilt. A defendant entering an Alford plea agrees to be found guilty without admitting he or she committed the crime.

More than six months after Toledo toddler Elaina Steinfurth was first reported missing, her mother Angela and Angela's ex-boyfriend Steven King were sentenced to life in prison with the eligibility of parole.

Tuesday, we learned the toddler died because she wouldn't stop crying. Steven King admitted his role in the toddler‘s death in court. He told the judge he found Elaina in a bedroom. She was injured and having trouble breathing.

He said he knew it was the wrong thing to do.

"I gave police misleading and false information about Elaina on that morning and on a number of days after June 2," he said.

Judge Ruth Ann Franks called King a coward

"You had the opportunity to seek medical treatment intervention that possibly could have saved that little baby girl's life, and you put your own wellbeing first, your own fears of what would happen to you, and with cold calculation you smothered that little girl. You took the last breath from her," the judge said.

She sentenced King to life with the eligibility of parole after 25 years.

A short time later, Angela Steinfurth cried and declined to speak at her court appearance. She entered an Alford plea, in which she denied committing a crime but admitted there is enough evidence to find her guilty.

The prosecutor said Elaina was killed because she was crying too much and made Steinfurth mad.

Alford, 400 U.S. 25 (1970), a criminal defendant is not required to admit his guilt, but consents to being punished as if he were guilty to avoid the risk of proceeding to trial. . . . The entry of a guilty plea under the Alford doctrine carries the same consequences as a standard plea of guilty. By entering such a plea, a defendant may be able to avoid formally admitting guilt at the time of sentencing, but he nonetheless consents to being treated as if he were guilty with no assurances to the contrary. State v. Faraday, 268 Conn. 174, 204-205 (Conn. 2004).

Finally, a guilty plea under the Alford doctrine is . . . the functional equivalent [to an unconditional] plea of nolo contendere". State v. Palmer, 196 Conn. 157, 169 n.3 (1985); which itself "has the same legal effect as a plea of guilty on all further proceedings within the indictment. . . . The only practical difference is that the plea of nolo contendere may not be used against the defendant as an admission in a subsequent criminal or civil case." (Citations omitted; internal quotation marks omitted.) Town of Groton v. USW, 254 Conn. 35, 49 (2000). It is clear, however, that a nolo contendere plea also constitutes a waiver of all nonjurisdictional defects in the same manner as a guilty plea. State v. Madera, 198 Conn. 92, 97 n.5 (1985); cf. Lott v. United States, 367 U.S. 421 (1961). See also Conn. Gen. Stat. § 54-94a.

TOLEDO, OH (Toledo News Now) - The final chapter in the grisly murder of Elaina Steinfurth was closed Wednesday as demolition began on the house where she was killed in east Toledo and now the rubble is gone.

The city of Toledo began demolishing the house at 704 Federal Street around 10 a.m. Wednesday because of the home's deteriorating state. By 10:30, the house was reduced to a pile of rubble. The Toledo-Lucas County Land Bank says that rubble should be cleaned up within 10 days. At that point, the neighbors on either side of the home have agree to split the lot between them. Each will pay $100 for half of the lot.
