SANFORD, Fla., July 8 (Reuters) - A Florida judge ruled that
defense lawyers can introduce evidence in the second-degree
murder trial of George Zimmerman that Trayvon Martin had the
active ingredient of marijuana in his system when he was shot
dead.

In a defeat for the prosecution, Seminole County Judge Debra
Nelson said her reading of case law was that "to not allow that
testimony would be reversible error."

Toxicology showed slight residue of THC in Martin's system.

Medical Examiner Shiping Bao initially reported the level
was too slight to affect Martin, but Bao testified outside the
jury's hearing last week that his further research in
preparation for the trial indicated the drug might have had a
slight but unknown effect.

as I have stated several times I do not watch speculation about this on the tv or read online much except what is shared here.. I also stated in a ciomment above that it is my opinion ALL males fight at some point in their lives. Don't believe I have ever said it was absolutely impossible TM started the altercation.

I also want to make it CRYSTAL clear that I do not believe anything TM may of texted  or said to his friends AT ANY TIME is even relevent to what happened that night. In the same vein I do not believe anything GZ may of texted or posted online or said to any of his friends is relevant to what happened that night.
My interest in this case is based upon what happened that night between two human beings..I don't know nor ever have known either one of em so my opinions about them both are based upon my own knowledge of how people in general behave.
Also while I do not feel GZ's social networking history is relevent I do believe any criminal history he had is and I also feel his behaviour AFTER the shooting is relevant as well.
George Zimmerman was as adult Auman..Trayvon Martin was not but it is my opinion that if he was half the worthless hood some seem to believe he was then by 17 he should of already had a rap sheet.

I have not seen any evidence to tell me TM had any sort of history with fighting.......

Trayvon Martin's father took the stand today and challenged the testimony of two police officers who had testified that he said it was not his son screaming for help on 911 tapes.

Two police officers described today how Tracy Martin, the slain teenager's father, listened to the tapes of the 911 calls two days after his son was killed. The screams for help could be heard in the background.

The father said , however, that he did not deny it was his son's voice.

"[I] shook my head and said I can't tell," Tracy Martin told the Florida court. "I never said that no, it was not my son's voice."

Tracy Martin later concluded that it was his son, he said, after listening to the tape about 20 times.

"I was listening to my son's last cry for help. I was listening to his life being taken. I was coming to grips with Trayvon was here no more. It was tough," he said.

A couple of comments:

1. GZ possibly have gun drawn PRIOR to any "confrontation" with Trayvon:
--- Pollack, the gym owner/instructor, was one who confirmed GZ was "soft". Almost all the def witnesses have stated how soft GZ was. GZ indicating apprehension, at best, prior to following Trayvon.
IF we are to believe GZ' concerns re "these punks always get away" and the other words he stated to NEN, yes, he would have LOGICALLY have drawn the gun before Trayvon even met him. IMO, GZ wanted that notch on his gun belt. Now, following the pattern of his life, he is wanting a free pass on his actions. Just like with the assault on the ATF officer... get the charges dropped from a felony to a misdemeanor. Well, Daddy isn't always going be there, GZ. At some point, you WILL have to take responsibility for your actions. (I spose you can blame it on the drugs YOU are taking, right?)

2. GZ "Screaming like a little girl" ....
---In the JA trial, the dteam tried to make this sound like horrors of horrors! How would Travis have known how a little girl screams? He must be a pedophile! So what does that say about GZ' sposedly screaming like a little girl? IMO, the voice was of a much younger male. That would make it Trayvon. And, the screams stopped abruptly when the gun shot was heard. Whoever was screaming was NOT holding that gun~ if it had been GZ, he would have continued to scream, "Call 911! I just shot someone!!!" And he did not.

3. Trayvon's father not immediately recognizing the screams as those of his son, Trayvon:
-- I can see this. IF I had been informed my child had been killed feet away from the residence I had taken him to, I would be in denial trying to accept just the death of my child, making funeral arrangements, overwhelmed with guilt for taking my son to where he ultimately met his death. I, too, would have been shaking my head and saying no just because I would NOT have been capable of clearly recognizing and ADMITTING this was my son's last communication--- he screamed for help so many times and I was NOT there to assist him.

Zimmerman didn't look "obese and out of shape" when he killed Trayvon. He is certainly obese and out of shape now. How did he manage to gain over 120/125 pounds in less than a year?

Dteam will be allowed to introduce a toxicology specialist re the THC ME BAO reported was found in Trayvon's system. This is sposedly to show how Trayvon would have been able to defend himself... right.
(Then let's bring in the drugs, hard core RXs GZ has been using... for years. It helps to explain WHY GZ may have been feeling a bit "paranoid" the night he killed Trayvon...)

Dteam wants to bring in their "reconstructive maps" of the crime scene...

And. Donnelly. His testimony will stand despite his lying on the stand re WHEN he FIRST heard the 911 tapes played... Dteam FAILED to share this info with the State....

Dteam wants a witness on the stand who is former PD; wants that officer to explain how it impacts an officer when they shoot someone, the psychological damage that is done.... Like, GZ can't take the stand and tell us because "the trauma of the event" is too great? MOM states to the judge HE doesn't believe the jury can't make that determination on their own...Same with the toxicologist being able to explain the impact upon a person using pot; that GZ acted upon a great amount of fear; Allowing this witness (Rue) would be bolstering the credibility of the defendant; Would introduce self serving statements to the defendant; Can't testify GZ used restraint in using deadly force against Trayvon; Can't testify GZ was reasonable in his use of deadly force; Can't testify GZ did NOT violate any Florida statues in use of deadly force.

State is to meet with Shoemaker prior to court;
state said they made changes to a time-line of phone calls;
wants the handwriting cleaned up; agreed by judge.


State points out the current version of the info in question was JUST provided to the State minutes before; State said they had just found out for the revision Dteam offers is a few days ago, the witness had spoken with another dteam witness and changed animation based upon what the OTHER witness had told him; NONE of this was disclosed to State by Dteam; State says they are once again being given new info without time to prepare.

State needs more time to re-interview TWO witnesses due to the Dteam's failure to disclose. Judge asks WHY do we need to question witnesses IF animation is acceptable to BOTH parties?

State is going to take time to open up the deposition with Shoemaker prior to court in AM. Judge wants the early recess so the deposition is taken...

Dteam states they have a second hearing they need first thing in AM.

Good Lord! All this making fun of George's weight sounds like a bunch of bullies to me. It's making me a tad sick really. Anyone here of perfect weight? I know I'm not.

Lottie I dont care for it either BUT it is actually an acceptted form of discriminatory behaviour here in America.Discrimination of overweight people happens all the time..which btw America has the most numbers of..is done all the time..in schools..at work..on tv..in resteraunts..in airports..etc etc..it is done and nobody but those who are the target ever seem to mind. My sister is grossly obese..my husband is as well and yet they both are guilty of doing the very same thing.

DiDi stated that term is used by people in her neighborhood all the time to describe unsavory white people..(my words not hers cuz I cant member exactly at the moment) That makes perfect sense to me and I dont feel the fact that certain word made TM a racist anymore than I feel Paula Deen using the n-word while descibing the man who held a gun to her head makes her one.. It makes them ALL human beings IMO.

He says there is not a lot of opportunity to have audio in the creation, which he says helped with the timeline.

Schumaker says the discovery was used, including photos, witness statements and Total Station data.

He made to visits to the scene, he says.

He used the motion capture suit during the second week of May.

He says there were seven points that were labeled as windows, but weren’t in the right position.

He says a measurement of a second story window actually measured some tree branches instead.

He says he used Matterport scanner at the scene to take photos and infrared photos for distance purposes.

He says it helped capture slope and positioning.

He lists the California counties where his reports have been used.

Mantei says he has supplemented his motion this morning. He says the reason is the animation is to fit the witness’s theory and the state now believes there is a Daubert issue.

He says it is an animated depiction of the theory Dr. Di Maio discussed with the witness Saturday.

He says the hearing needs to be expanded to include Daubert issues and they need to fleshed out based on the changes.

Mantei says during last night’s deposition the witness indicated he had additional materials prepared.

Dr. Di Maio says it must be dried out and packaged in paper. He says the bacteria begins multiplying in plastic and leads to mold.

“That’s standard practice,” he says.

He says most lab problems are reported by the lab itself.

Dr. Di Maio describes his academic positions.

He has published four books, multiple articles and book chapters.

His first book was “Gunshot Wounds: Practical Aspects of Firearms, Ballistics, and Forensic Techniques.

A third edition is due at the publishers in a week.

Range and nature of the weapon can be determined by the wound, he says.

He worked as a consultant outside the medical examiner’s office he worked for in mostly civil cases.

He has been in private practice since January 2007.

He says he started his firearms research while in the military.

Dr. Di Maio explains microflash as something very quick to capture fast moving objects.

He explains what happens when a gun is fired.

This is a highly publicized case, the marches and protests against the Sanford Police Department for allowing to walk the killer of an unarmed black teenager garnered international attention. I suspect that more than one juror know why Zimmerman was not initially arrested and why a special prosecutor was assigned to the case.

Witness: Dr. Vincent Di Maio - Expert on gunshot wounds

11:31 a.m.

Dr. Di Maio says the photographs show a contact discharge of a weapon against the clothing. At the time of discharge the gun was against the clothing, the gas tore the clothing, soot deposited all around it, he says.

He says the wound in the chest shows a different picture.

He describes the area of powder tattooing, or marks on the skin from powder rings of the gun.

He says the powder tattoo marks indicate powder hit the skin and the person was alive at the time.

He says it indicated the gun was not against the skin by more than an inch. He says the muzzle of the gun was two to four inches away from the skin, based on the marks.

“The clothing itself had to be two to four inches away from the body at the time Mr. Martin was shot,” Dr. Di Maio says.

Dr. Di Maio shows a photo of the gunshot wound to the jury and points out the marks showing the powder tattoo marks.

The first time powder tattoo marks are seen when the muzzle is a half inch away. He says the area of tattooing gets bigger the farther away the gun is.

11:25 a.m.

Dr. Di Maio lists evidence in the case he reviewed.

He says he did have the opportunity of Zimmerman reenacting the shooting for police.

Dr. Di Maio says the nature of the case is more about determining if the physical evidence is consistent with Zimmerman’s account.

He says witness statements vary greatly and the easiest way is to evaluated the physical evidence and compare it with Zimmerman’s statements.

He says the most important things are the autopsy report, including the photos of the wound, and the reports by the firearms examiner.

Secondary are the photos of the scene.

He calls the firearms examiner’s report excellent.

West asks Dr. Di Maio’s opinion on how long Martin might’ve been alive and conscious.

Dr. Di Maio says they would be different for alive and for conscious.

He says he had access to photos taken by the Sanford Police Department.

West asks about the gunshot and the mechanics involved.

West asks about the gas that comes out of the gun first.

Dr. Di Maio says it is like a column of gas and air being pushed straight ahead that tears a hole in the clothing, and then the bullet gets to the clothing, and then the soot follows.

Dr. Di Maio says a gun with a blank cartridge could still kill someone in a contact wound.

He has written about head trauma. He is a chief editor for a journal.

He testified for the U.S. Attorney’s Office about a police shooting in New Orleans.

He also testified for the Marine Corps in the prosecution of someone charged with war crimes.

He says he also testified for the British Government and United Nations.

He says he has testified in most states, along with Canada, South Africa, Israel, and more.

Dr. Di Maio says he is aware Zimmerman said Martin was straddling him and he had his gun in his right hand.

He says the medical evidence is consistent with Zimmerman’s statement because the simplest thing is the gun being in his right hand.

“The most important point is the nature of the defect in the clothing and the powder tattooing,” he says, adding that when someone leans over the clothing sits away from the chest.

He says it is consistent with someone leaning over and their clothes being two to four inches away.

Dr. Di Maio says wet clothing is heavier and something in the front would pull it away from the body.

He says the wound’s gap and powder tattooing indicates consistency with Zimmerman’s account that Martin was over him leaning forward at the time he was shot.

Dr. Di Maio says the ability to move is determined by the amount of oxygen in the brain in reserve, which is 10 to 15 seconds at minimum.

He says some people immediately collapse and others don’t know they’ve been shot.

With a through-and-through hole of the ventricle of the heart and a hole in the lung, he says blood is being lost.

He says the heart rate increases when involved in a struggle. He says if Martin lost a tablespoon of blood every time the heart beats, it would be about a quarter of his blood supply in one minute.

Assuming those conditions, he would be dead in one to three minutes after being shot, Dr. Di Maio says.

Dr. Di Maio says he has seen cases where someone with similar injuries could talk and move, describing one man that ran 65 feet before collapsing.

The prosecution simply hasn't emphasized that George confronted Trayvon.


This whole case is a joke. George will walk. Riots will ensue this week. And Trayvon is forever gone.

The other type of brain injury is called axonal. He says when the brain moves, the axons stretch. If the movement is violent, they stretch causing injury to the wall. Mild movement is repaired by the axon, he says.

He says the force in an automobile accident is so great the axons cannot be repaired. He says impacts of the head on a hard surface can create intracranial bleeding.

So many people say to put yourself in GM's situation, but what about putting yourself in TM's situation. I mean really think about it from his perspective of being followed, actually pursued and then confronted by some strange man. People say race has nothing to do with this case but being a black male, TM probably had more fear being followed by GM, than your average white person might feel. I think that TM had a right to defend himself against GM, not the other way around. You don't get to put someone else in fear for their life, for no reason other than you think they look like they are up to no good, and then kill them when they defend themselves against you.

West asked Di Maio if he was aware that the police found an unopened beverage can inside the front pocket of Trayvon's shirt, and if it could have contributed to the separation of the fabric from the skin, Di Maio said that it could have and that it confirms that Trayvon was leaning over Zimmerman when he fired the shot.

In my opinion, the can of Arizona Iced Tea inside the pocket of Trayvon's hoodie was what contributed to the separation of the fabric from the skin, it does not confirm Zimmerman's story that Trayvon was leaning over him when he fired the shot.

Naw. IMO, GZ grabbed the front of the hoody and pulled Trayvon into him. This means, Trayvon was backing up or attempting to flee. As he pulled Trayvon in, GZ said, "You are going to die tonight, " or something like that. Trayvon tried to pull away and when he could not, Trayvon began screaming.

The holes in the clothing were perfectly aligned with the chest wound EXCEPT they were off by two inches. No amount of soda or tea would have caused that much of a sag in the garments. Let alone BOTH garments.

The injuries to GZ' head are the attempts to justify the killing of Trayvon. Dteam is making too much ado over nothing--- I had worse injuries as a child when I fell roller skating on the sidewalk!

As for the nose: I will accept the PD pics. Dr DM wants to put down ANY and ALL pics that do not support his version hence he calls them "poor quality"... Well, the medical doctor for GZ, called by the State, pointed out GZ' injuries were superficial. End of subject. And that grotesques pic of the one side of GZ' nose twisted appears to be be overlay to create the HUGE bulbous nose injury NOT seen at the PD.... nor in ANY other picture. It is ridiculous the amount of photo-shop done by some amateur.

IMO, part of jury instructions should read:
When this trial is over, would you be amiable to the defendant moving into the house next to yours, joining your work force team, attending your church, etc. ?

GZ's head is NOT perfectly smooth.
It is irregular with bumps and twists.
Even my kids had bumpy spots on their heads;
look at balding men and find the bumps on THEIR heads!!!

I am not buying this Dr. DM's testimony.

BTW, there has been NO testimony ANYONE "pushed" GZ's nose back into place!!!
Can you imagine having a real nose injury or broken nose and letting someone "push it back into place" for you?
Hello! I would be screaming for... A DOCTOR. ER. PAIN MED. ANESTHETIC.

The following morning, when GZ took the voice analysis test he really did not SHOW any indication the nose was troublesome for him. He made a COMMENT he needed to drink water... hmmm. Didn't say it was tender. Didn't reach up at any time to gently touch the outside of it... That would have been natural.
