I thought that when a witness is supposed to testify, that they weren't allowed to sit in on the hearing until being called in to testify???? Why are G & C sitting in on the hearing?

i think it may be because their have been so many efforts to thwart him talking to LE.. they do not even know what he has/ has not done..

they will never put a witness on.. if they dont know what they are going to say..

as for the defense,.. they are the ones trying to KEEP him from talking, so they are obviously NOT going to call him..

I was thinking the same thing about G&C~ Why are they not sitting in the hallway and told not to discuss their testimony with anyone (like usual?)......... same thing with their 'private' visits with Casey........ as witnesses for the State, why would they be allowed to discuss anything with Casey in private? kh

so is she trying to say that the state cannot ask to have the DP in ANY CASE that there has not been proof without a reasonable doubt..

so they cannot ask for the DP until AFTER the defendant has been convicted?? because proof beyond a reasonable doubt is for a JURY to decide.. NOT THE COURTS let alone BEFORE the trial..

Well, while she thinks the "heinousness" and question of "prolonged suffering" is subjective and "not proveable"...... one cannot ignore the fact that an aggravating circumstance is the young age of the victim. She can't argue that away. kh

how can she argue what the evidence shows, when the evidence has NOT been presented??

This woman is TRYING to prove her case, when the prosecution has not even presented any evidence.

i think they are shooting themselves in the foot here, by coming out on their own, and singling out aggrivating factors that are present in this case.. WITHOUT the prosecution ever mentioning these factors.
