PHOENIX - With her son still missing, Elizabeth Johnson could walk out of jail.

Since 'Baby Gabriel' vanished the day after Christmas in 2009, Elizabeth Johnson has refused to say what exactly she did with the boy.

PHOENIX (CBS5) -
We are just hours away from knowing if Elizabeth Johnson will be a free woman. Her sentencing is Friday. Johnson was convicted of unlawful imprisonment and custodial interference last month in the disappearance of her son, Gabriel.

Gabriel's father, Logan McQueary, won't be physically in the courtroom tomorrow, but he's going to call in and make sure the judge hears what he thinks before Johnson gets her sentence.

"I'm just going to be explaining what we've done for the past few years and how much pain it's put a lot of people through in my family and I don't think she should get off lightly," McQueary said.

Whereas the Judge did not "forbid" her to write a book or further profit from this "incident", he strongly advised her not to, at least until the hearing in February as anything she did like that could impact her probation. TS leaned over and whispered to her attorney in what seemed to be her asking him for clarification before court was dismissed. Sooooooooooo, my inference is that she very well intends on writing a book (who can shut her up) to PROFIT from Gabriel's stolen life.

And I know it scarcely matters, but TS got a hair make-over...wish I knew how to post a screenprint...

Weeziethm- Thanks for the information. I guess anyone can write a book at some point, even TS, but it amazes me how self absorbed some of the writer's are and have to wonder if even enough books sold in some cases pay for the cost of publishing.

I am referring to Riley Hunter, the baby mama of John Edwards. She wrote a book disparaging dead Elizabeth Edwards and her affair, it sold 7,500 books. A real opportunist imo, why would anyone care about the thoughts of a participant in an affair w/a married politician running for President who gives birth to a child? But 7,500 people did purchase the book but I wonder how many books have to sell to pay for the publication?

The point is, why would anyone outside TS's church care what she has to incessantly run her mouth about, who would her audience be? Surely not anyone genuinely wanting to adopt a baby legally. A real piece of work TS is, a real menace to society imo.

I am curious about her make over, maybe Ann-Tx or Alessandra will post her new do.

I hear ya, Art-Tart... the Judge made a point of specifying "speaking engagements" as well, so perhaps the State had some information as to TS' future aspirations...we all know how she loves to TALK NON-STOP. Perhaps she fancies herself as going on the speaking circuit of daytime talk shows and put herself out there as some sort of "??". Dunno.

She is her same ol' smug smirking self. The "do" is a sleek pin straight bob with highlights. At least she left the bow at home.

PHOENIX (CBS5) -
Elizabeth Johnson, the mother of missing baby Gabriel Johnson, was sentenced to 5 1/4 years in the Department of Correction in a hearing punctuated by Johnson's admission that she deserved the maximum penalty, and the emotional pleas from the family of the baby's father that she receive the harshest sentence possible.

Judge Joseph Kreamer issued the sentence after a long afternoon of testimony. Kreamer said she would be given credit for the 1,062 days she has already served in jail, meaning she will spend just shy of three years in prison. She was also given four years of probation upon her release.

Kreamer sentenced Johnson to three and a half years for the custodial interference charge, and one year and nine months for the unlawful imprisonment charge, bringing the total sentence to five years and three months. Kreamer said Johnson would be credited with the 1,062 days she has already served, leaving her about two years to complete behind bars. Upon her release, she must also serve four years probation, Kreamer said.

A 3 hour + sentencing hearing and ANOTHER opportunity to say what happened to her BABY and we get....CRICKETS.

All those words of (hollow) sorrow, and crocodile tears; wringing of hands saying she wasn't HEARD at trial, poor poor me, it's only about my son, etc. Keeping quiet knowing there was a finite number of years to pay was the gamble EJ was willing to take.

No harm, no foul (in her eyes)... BITCH.

This really bums me out, there is never going to be JUSTICE for another precious child, BABY Gabriel. I agree, I am not moved by Elizabeth's attempt to show remorse, too little too late. She is so young, destined to have many more children upon her release, that scares the hell out of me.

Thanks Ann for TS's picture. Of course it shows the cross around her neck. To think she could make a dime off this case gives me a headache, I can't believe it.

Where is Baby Gabriel, why isn't there JUSTICE for Baby Gabriel? When will Baby Gabriel's rights be equal to those of his mother?

PHOENIX - A judge has sentenced Elizabeth Johnson, the mother of missing "Baby Gabriel", to 5.25 years in prison followed years of probation, minus time served.

The judge said just after 5 p.m. Friday that Johnson has already served 1,062 days, so she will serve the remaining 2 1/3 years in prison.

Per the reporters in above videos from ABC15, Elizabeth Johnson could be out of prison in as little as one year and two or three months (1 year - 2 or 3 months).

The Arizona Department of Corrections (per the reporter), gives credit for good behavior, etc.

The only thing that looks the same to me is her nose up in the air, like she still thinks she's better than everyone else. That hasn't changed.

PHOENIX (AP) -- An Arizona woman who was convicted in her young son's disappearance nearly three years ago was sentenced Friday to 5 1/4 years in prison after tearfully telling the judge she thought she deserved the maximum of 9 1/2 years.

Elizabeth Johnson, 26, was convicted in October of custodial interference and unlawful imprisonment in the Christmastime 2009 disappearance of her then-8-month-old son, Gabriel. The jury failed to reach a verdict on a kidnapping charge - the most serious count against her.

New Lead on Missing Baby Gabriel

"....But just a few months ago McQueary got a call that made him believe not everything was being done to find Gabriel.

"We got a new case worker on Gabriel's case a little less than a year ago. She called me and asked for my DNA and I said 'Don't you guys already have it?' and she said 'No, we don't," explained Logan McQueary.

McQueary thought that was unbelievable, because he says he gave DNA to SAPD back in 2010.

NCMEC sent McQueary to the Sidney Police Department in Sidney, Ohio to have his DNA collected once again, which will be put into a national data bank.

That will make it available if DNA is collected from "X", a child whose picture was sent to the family via Facebook in August of 2014. Logan says the picture gave him butterflies because he believes that child could be Gabriel.

The family also says they forwarded the picture to SAPD's Lead Detective, Jesse Salame.

"He was supposedly looking in to everything that we had sent him," Logan claimed.

Six months later in February of 2015, McQueary got an email from Salame that gave him hope on two fronts. Salame wrote that there was a relationship between the child in the picture and Tammi Smith. Smith was a woman who had wanted to adopt Gabriel. She was convicted along with Gabriel's mother, Elizabeth Johnson, of being involved in custodial interference. Both women served prison sentences.

As for his opinion about child "X", Salame wrote "the NCMEC also did analysis and while they noted the visual similarities of child 'X' to McQueary, they cannot make a positive determination based on photographs alone."..."

Look at vid marker 1:51. That unknown baby certainly has baby Gabriel's eyebrows!
The one brow has a "tweak" in it where the brow curves.
You can see it in the known pictures of Gabriel as well as that of the unknown child seen at 1:51.
(The father, Logan, also has the tweak in one of his eyebrows.)

Exciting news! Glad to see the DNA going forth.

Thanks for posting this latest news, Freckles. A glimmer of hope. I have not yet had a chance to view the video, but I will....I always think about precious baby Gabriel.

The update does NOT include recent pics.
The one that is referred to from the "unknown" child is an older pic that has been cropped to leave Tammi ( the "adoption maker") out of the picture. LE state the pic shows Tammi KNEW where the baby was because of that picture. Now, connecting the dots, LE HAVE located the child in the pic at 1:51...and believe it is of Gabriel. LE, wanting to make sure of everything at this point, asked the father for his DNA to cross check their info. LE ARE withholding a lot of info at this point so I fully expect this case to pick up momentum.

And, again, IMO, THAT is the same child!

Wow! I really hope that it is baby Gabriel.

I wonder if Tammi and Elizabeth can be prosecuted for a different charge if the child is proven to be Gabriel?

I captured it at 1:52.  Oh my gosh, if I have the right picture, I agree!  This really, really looks like Gabriel.  Indeed, this could turn out to be wonderful news, but it's jaw dropping, too; in that law enforcement was aware of this for years and never used DNA to confirm?

Same eyebrows, same mouth, it's Gabriel.

I hate to get bummed out... The pic you shared? IMO, it is the same as the 1:51 vid shot.
Look at the hair tendrils on his forehead... fall exactly the same way.

LE stated BASED upon the 1:51 pic, the child they have knowledge of (6 yrs later) MAY be our missing Gabriel, and (based upon the same pic) Tammi was fully aware of where Gabriel is/was. Something about the pic lead LE to assert that and then ask the father for new DNA.

I hope it doesn't take forever for the DNA results...

She is sassy, rude, and disrespectful.  I hope her derriere lands back in lock-up, but I doubt that will happen.

At the very least, she should be assigned a new parole officer--she has learned how to manipulate the one she currently has.

JMO. I see her as acting out more and more, becoming more daring and care-less in her actions. Brazen. Is this a result of what transpired between her former husband AND (the first acting out) what happened with Gabriel? Or is she progressing with a mental illness?

What are the maximum sanctions the courts could take?
I don't recall how long her sentence was or how long the probation was.

PHOENIX - Elizabeth Johnson is out of jail again.

The mother of "Baby Gabriel" was released from a Maricopa County jail on Thursday morning.

Johnson was captured and returned to Arizona in March after she admitted she skipped town and traveled out of New Mexico, which is a violation of her probation.

Johnson had served 5 years for custodial interference. She admitted that she took her son, known to the general public as “Baby Gabriel,” to Texas and gave him to a couple at a San Antonio park.

Police were never able to confirm her story or find Gabriel.

Johnson will be under probation until July of 2018.

A judge warned her that if she violates any more terms of her condition of probation then she could face fines and prison time.
