I don't think this appeal will matter and I don't think it will delay the trial. Casey's right to a fair trial supercedes the media's need to know ahead of time where the jury selection/trial will be. Unless Jose drops dead this weekend, jury selection will begin on Monday. kh

It looks anybody who plans on attending the trial better plan on waking up early. People will be allowed to start lining up at 5:30 am each morning and the available seating passes for the day will be distributed starting at the front of the line.

Retired Circuit Judge O.H. Answer: A witness who is evasive or uncooperative can be declared “hostile” by the court. That means the rule disallowing leading questions on direct examination is waived, and the witness can be cross-examined by the lawyer calling the witness to the stand. One of the ways a witness can be “impeached” is to confront the witness with a prior inconsistent statement. This technique is very effective if the inconsistent statement contradicts a crucial point in the case. The lawyer who impeaches the witness with an inconsistent statement cannot argue the witness told the truth in his prior statement and lied on the witness stand. The argument is, because the witness made the inconsistent statement, he should not be believed at all. Very interesting.........so would this mean that every bit of evidence and sworn testimony in regards to an impeached witness would be stricken from the record since they can't be believed at all?

ORLANDO, Fla. -- In the case against Casey, the defense filed a motion on Thursday objecting to the Anthonys' move to try to sit through the entire trial, even before they testify.

Legal analyst Bill Sheaffer said that's confirmation of the story WFTV broke weeks ago, that the defense could be planning to pin Caylee's murder on someone else in Casey's family, possibly her father George.

Even the Anthonys' lawyer admits they're getting that indication.

In late news Monday, WKMG reported that Anthony’s lawyers had turned over some of the station’s 2008 footage of George Anthony to prosecutors. The footage shows George with duct tape that apparently matches duct tape found with his granddaughter’s remains.

The defense’s action seems to suggest they will use the WKMG footage at trial to defend Casey Anthony, DeForest said, adding, “but how they plan to use it remains unclear.” George Anthony’s lawyer “adamantly denied” that his client had anything to do with the child’s death, DeForest said.

I think they have proved over and over that they are willing to muddy the waters any way they can, and have been doing so for nearly 3 years. What gets me is they still haven't figured out that they were next on Casey's "to do" list! kh

A jury selection consultant is a person who helps trial attorneys choose their jury. Casey's defense team is now scrambling for a new consultant just three days before jury selection is scheduled to start.

Was the allowance of the Anthonys in the CR on the condition that they won't be needed to testify again? Was it for after they testify and are waived from being called to the stand again?

The A's attorney cited other case laws that supported them being there. The State does not object. The defense failed to live up to their burden of showing how this would prejudice their client/case. I think it's on the up and up

Mason stated that he was sure the Anthony's will be called back to the stand many times...

Sherry, they are allowed to veiw all testimony. Judge Perry made it clear there would be a sign at the door in regards to facial expressions, head nodding yes or no and that goes for the counsel as well. He said they will be removed - no warnings. I don't know how Cindy will be able to stand it. I really don't see her making it very long. George mumbles stuff, too.

I say that George will be ousted as he listens to Baez' opening statement or Cindy will be ousted listening to the state's opening statement especially if "Linda" makes it. First lawyer ousted for facial expressions will be Baez-he can't help himself.
