Casey Defense To Argue Mistrial, Wind Down Its Case

ORANGE COUNTY, Fla. -- Casey Anthony’s murder trial could bring several new developments on Wednesday as the defense is on the verge of wrapping up its case.

Wednesday marks day 42, including jury selection, of Casey's trial. Casey's accused of killing her 2-year-old daughter, Caylee Marie Anthony.

There are only a handful of witnesses left to call, and the public may find out whether Casey will be one of them. But before testimony on Wednesday, Casey’s attorneys are expected to argue that the whole trial should be thrown out and started over with a different jury.

The court will hear defense arguments about a new death penalty ruling that will happen with a member of the defense team on the record by phone. The defense said this new appeals case out of south Florida means the current jury should be re-seated.

The defense is expected to call a grief expert to the witness stand on Wednesday.

On Tuesday, Casey’s defense team said they have only a half dozen witnesses left to call.

Mr Ashton might have just gotten the grief expert to seal KC's fate on death row.

She said she testified as an expert in the Susan Smith case and opined that sometimes mothers who believe they have a bad life will kill their kid so the kid won't have to live a bad life. This was her explanation as to why SS killed her kids....however, we all know Susan Smith said she killed her kids because she wanted that new boyfriend! OMG!

Well a lot of good it did them to file that motion yesterday, since none of her 3 atty's were in court @ 8:30 like JP ordered. Only Ann Finnell was there, and she was talking on the phone, so JP had to direct his response to KC, that he would rule on that motion at the end of testimony in this trial. She said that was fine.

I'm sure JP was blowing smoke out his ears when he entered the courtroom and no clowns for the duhfense team except for the Death Penalty Atty.

Darn it mama, i missed all of that. I'll have to catch the re-run! I heard on the news that kc answered for herself and that ca read bozo the riot act in the hall for not being there. Sheesh!

Somebody said the entire d team was waiting to get on the elevator but it was slow....what did they do? Wait till 5 minutes before 8:30 to arrive at the elevator?

Well, at least KC got to really act like the lawyer she has been pretending to be all this time....and SHE didn't forget to turn on her mic! LOL

I might have heard wrong...but I thought that case that was just decided was unconstitutional was based on that in the case in question the prosecution didn't identify the mitigating circumstance that led to the dp sentence....and the jury had to assume one and that is the part that is unconstitutional. I only heard this once and then the media started just saying the whole Florida dp statute was unconstitutional. I hope I heard right...otherwise this case might end in mistrial....which is not going to make me or the tax payers of Florida very happy....well, ok maybe I won't be so unhappy as long as I get to watch Baez go round two.

That grief counsellor was a fraud, at best, a dud, at least.

She was asked if she had any peer reviewed papers on her work and she mentioned Barnes and Noble. Ashton asked if she knew what a peer reviewed journal was-she said, yes.

There is a grief counsellor as a juror, btw.

If Casey takes the stand tomorrow, the trial will probably last another two days. I want her to take the stand soooo bad! lol

Did anyone see one tear roll down George's face? I sure didn't and I was watching as close as possible. Maybe someone with a huge HD screen TV can let me know.... cause It looked like alot of nose wiping and facial expressions from here. Thanks

I almost split a gut when she said that about Barnes and Noble! Don't forget Parent's Magazine (or whatever mag that was)...she had no idea what peer reviewed meant.

I saw the red face, pained expressions, furrowed brow, lot's of nose/face wiping, but did anyone see "tears" or wet eyes... I sure didn't. I thought it was a big act.

I agree with you, mama. George was really crying....he was whimpering too...you can't fake that.

And what about that Casey while he was so upset over Caylee? She just sat there stone faced...but they said she smiled when he left the stand. Is she so hung up on her story she believes George made points for her side? Or was she taking acting lessons to use when she gets on the stand?

I've been a hard ass when it comes to all the Anthonys...I haven't hardly cut them a break at all before...but today with George, I do believe now he is and has been sincere all along.

I would love to know what she says to.... everyone on HLN and In Session is going on and on on poor George breaking down on stand.... I just don't buy it.... if there arn't any tears... you arn't crying, at least in my book. I actually thought he was mimicking Cindy's actions.... head down, hand to mouth. Maybe she coached him.

Jury Could Have Case By Monday

ORLANDO, Fla. -- Casey Anthony’s defense plans to rest its case Thursday, defense attorney Jose Baez told the judge late Wednesday.

After it rests, the state will then present rebuttal evidence and testimony. That process could begin Thursday as well.

Judge Belvin Perry it’s possible closing arguments could take place Saturday or Sunday, meaning the jury would be deliberating on or before July 4.

George Says He "Failed" Caylee In Tearful Testimony

ORLANDO, Fla. -- Casey Anthony's father, George Anthony, wrote in a suicide note that he had unanswered questions about what happened to his granddaughter, a revelation that undercuts defense claims that the toddler drowned accidentally and he helped cover it up.

Casey is on trial for murder. She is accused of suffocating her daughter, 2-year-old Caylee Anthony, with duct tape in the summer of 2008. Caylee's remains were found in the woods in December of that year.

Defense attorneys, who have been trying to paint the Anthony family as dysfunctional, say Caylee drowned in her grandparents' backyard pool and Casey's father, George, disposed of the body.

Wednesday marked day 42, including jury selection, of Casey's trial. Casey was in court just before 8:30 a.m. on Wednesday, wearing a pink, long-sleeved shirt. She had her hair pulled back in a ponytail.

George broke down in tears as he talked about the discovery of Caylee's remains. This is the fifth time since the trial began that he has testified. Casey sat stone-faced during his testimony.

"I was hysterical, I was upset, I demanded answers and I would still do that today," George said.
