5 p.m. 'I will not testify,' Peterson says

Drew Peterson told Judge Edward Burmila he will not take the witness stand. Burmila, who had told Peterson on Tuesday about his right to testify or not testify, asked Peterson if he had reached a decision.

"I will not testify," Peterson responded.

"You will not?" Burmila said.

"That’s correct," Peterson said.

After jurors were brought back in, defense attorneys rested their case.

Burmila then reminded jurors to ignore any media reports about the case.

Court is adjourned until Thursday at 9 a.m.

4:15 p.m. Son questioned about mom's bath habits

Thomas Peterson said his mother sometimes liked to take hot baths and sometimes left her hair down in the bath, something prosecutors claim she never did. Kathleen Savio’s hair was down when her body was found.

On cross examination by the prosecution, Thomas Peterson said he did not recall telling a June 2008 grand jury that he didn't know his mother's bath habits.

He was asked on redirect by the defense if his mother ever took baths in the morning.

"That sounds highly unlikely, but I wouldn't know that either," he said.

4 p.m. 'I believe my dad is innocent'

Thomas Peterson said he noticed nothing unusual about his father's demeanor on the weekend his mother’s body was found in the bathtub.

"There was nothing out of the ordinary, I would remember if there was, but there was nothing out of the ordinary to my recollection."

When Kathleen Savio didn't answer the door Sunday evening, Thomas said his father "was a little bit concerned."

"I think we came to the conclusion that it was a three-day weekend. We'd forgotten it was a three-day weekend, so we figured she went out to dinner with a friend, so we went home."

Drew Peterson’s teenage son testified on his behalf, but Peterson’s missing fourth wife indirectly offered an explosive claim that the former Bolingbrook cop killed his third wife, Kathleen Savio.

Earlier, one of the witnesses called by Peterson’s defense team told jurors Stacy Peterson confided to him four days before she vanished that Peterson had killed Savio.

The hearsay evidence offered by divorce attorney Harry Smith marks the first time in the nearly five-week-long trial that jurors have heard someone testify that Peterson killed Savio.

Smith told jurors Stacy Peterson gave him that information during an Oct. 24, 2007 phone call in which she asked him to represent her when she divorced Peterson.

“She wanted to know if, in my opinion, that the fact he killed Kathy could be used against him in the divorce proceeding,” said Smith, who had represented Savio in her divorce from Drew Peterson before she died.

You are so right Wondering Why ! and I am thinking these young men have a warped view on women in general, I am only speculating. I get what you are saying about the Dr. but I was wondering how many children do believe the dad ? two cases come to mind of course I can't remember the names ! One was mom died of carbon monoxide poisoning which was pumped through the house, dad married before a year was up, son believes in dad's innocence. The other a "alleged" attack on mom in a park, mom and dad in the park together but mom further ahead on the path ?? Three adult children all believe in dad's innocence ! Dad's convicted in both cases.
I really believe dp is completely guilty of killing Kathleen and Stacy but I am afraid he is going to walk...
I didn't catch the name of a psychologist on In Session which I dvr'd today, but she had dp pegged !, controling, manipulating young woman, etc ! Maybe he should hook up with casey when he is free, she's not too o;d yet !

Earlier Wedensday, a long-anticipated defense witness might have helped the prosecution’s case when he told jurors Peterson’s fourth wife, Stacy, had said Drew killed Savio.

CBS 2′s Mike Puccinelli reports divorce lawyer Harry Smith was called as a witness for the defense, but calling the attorney who had consulted with Stacy Peterson put Drew’s missing fourth wife front and center at his murder trial on Wednesday. It’s something that hadn’t happened in the previous 18 days of testimony.

Smith testified about a phone conversation with Stacy Peterson. Smith said, “She wanted to know if, in my opinion, if the fact that he killed Kathy could be used against him in the divorce proceeding.”

When Smith testified Stacy told him Drew actually killed Savio, defense attorneys confronted him with testimony from pretrial hearings that they said contradict that claim.

The defense said he committed perjury. Peterson attorney Steve Greenberg said Smith has testified several times, and never said Stacy told him Peterson actually killed Savio.

Defense attorney Joel Brodsky confronted Smith with previous testimony that Stacy asked him “could we get more money if we threaten to tell the police how he killed Kathy?”

Yes, it is so hard for us to even imagine that a mother or father could take the other parent's life. Taking a child's mom is unthinkable. I think murder of a fathers has much lower statistics. I remember the Fred Jablin case, where the nutcase ex wife Piper came from Texas to Virginia to kill him. I also remember when HM was up and running, Val had articles about the Dark Triad and Eraser killers. Drew fits the profile to a T ! psychopathy, narcissism, Machiavellianism ! His best friends could be scott peterson, oj, matt baker, tom capano, mark hacking, etc. These guys are so narcissistic and egotistical they think they can't even be doubted. They are smarter than everyone else. They are master manipulators ! It just blows my mind that they believe their "story" is just so much better than the guy before them. Don't they watch the news ? How many woman just walk away one day and leave their kids behind and can't be found ? no paper trail or they don't tell anyone ?? it's beyond bizarre ! If it wasn't so tragic it is almost laughable. I really am afraid he may walk. I love our judicial system it's the best in the world, but jurors, as we have seen can be surprising. After Caylee, I will believe anything. We shall see .

In the latest bizarre twist in the Drew Peterson trial, a defense attorney called a witness who testified that Peterson's fourth wife told him Peterson murdered Kathleen Savio.

The move, made hours before the defense team rested its case, overshadowed its much-anticipated final witness, Peterson's teenage son Thomas, who told jurors he never believed his father killed his mother.

Wednesday's stunning testimony came after Peterson attorney Joel Brodsky decided to call Savio's divorce attorney Harry Smith against the advice of other members of the defense team.

"It's a gift from God," State's Attorney James Glasgow was overheard saying outside the courtroom after Smith finished testifying.

Apparently the defense filed a motion to preclude his testimony.

Alessandra, I didn't realize Baden was testifyiing but I am glad Savio's family had contacted him & I am glad he didn't charge Kathleen's family for his autoposy. Although I am not a big fan of Baden, I guess it's because he usually testifys for $$$$$$$ for defendant's, this is good news as he is nationally known.

I am a little confused, why wasn't Baden called as part of the State's case before they concluded their case except for the rebuttal?

If I am not mistaken, Baden was in Joliet ready to testify for the prosecution when they presented their case in chief. I think they couldn't call him at the time because there were legal matters involved with the hearsay testimonies that needed to be resolved before they could clear the path for Baden to testify.

This morning before the trial started, the defense was putting into doubt Baden's testimony today, "he will testify, if the judge allows him to testify".

In many instances the prosecution doesn't call witnesses to testify during their case in chief because they want to use their testimonies in their rebuttal case.

It is a good thing that Baden was allowed to testify after Dr. Jentzen and Dr. DiMaio testified for the defense, they opened quite a few doors during their testimonies.
