The judge has denied the state's request to call a rebuttal witness, and in so doing, the defense's request to then offer testimony. It appears the state would have called Lisa Greenwaldt... and it appears they would raise the issue of the dates that didn't match up... that she says she visited Mazzaglia on the 14th but was not listed by the jail as having been there. That it would impact her credibility. The judge says its not directly relevant... and he declines to head down that path, of what would be a trial within a trial... says it would be confusing and distracting.

Closing arguments expected today in Mazzaglia murder trial

DOVER, N.H. — Public defender Joachim Barth rested his case in the defense of Seth Mazzaglia at 12:15 p.m. Tuesday just after a long-time friend of testified that Mazzaglia told him about a woman named Natasha who “died in his arms” during college.

Robert Andrew Mitchell, of Hillsborough, told Assistant Attorney General Peter Hinckley that Mazzaglia, 31, of Dover, was in love with a woman who passed away while he was an undergraduate at Rensselaer Polytechnic Institute.

“My understanding was that she was a woman he had loved while at Rensselaer and he said she had died in his arms. I assumed he was being more dramatic,” Mitchell said of Mazzaglia, on trial for murder at Strafford County Superior Court.

“I thought that she probably existed. It seemed unlikely to me that she died in his arms,” Mitchell said.

DOVER — State prosecutor Geoffrey Ward ended the Seth Mazzaglia murder trial on Wednesday by asking a jury to send Mazzaglia the message “that you’ve seen through the lies” and know “he is a cold-blooded killer.”

“Deliver the justice he has tried for so long to avoid,” Ward told the jury, which begins deliberations on Thursday, following instructions from Judge Steven Houran.

Ward’s closing arguments to the jury focused on evidence, after defense attorney Joachim Barth spent most of his hours-long argument talking to the jury about the credibility of Mazzaglia’s ex-girlfriend and state witnesses Kathryn “Kat” McDonough.

Barth began his arguments by his pointing out multiple lies McDonough has told since Marriott died. He ended with a plea for the jury to remember what McDonough told witness Roberta Gerkin when she didn’t know Gerkin was secretly recording the conversation for investigators.

At that time, Barth reminded, Gerkin told McDonough that Mazzaglia was “throwing you under the bus.” To that, Barth said, McDonough candidly answered, “It was sex and ropes and an accident and a seizure.”

Jurors who will decide the fate of the man charged with raping and killing a University of New Hampshire student were given two markedly different scenarios to weigh in closing arguments yesterday.

Prosecutors cast Seth Mazzaglia as a cold-blooded killer who manipulated and dominated his former girlfriend and became enraged when the woman she lured to their apartment – 19-year-old Elizabeth “Lizzi” Marriott – rebuffed his sexual advances.

Defense attorneys argue that Mazzaglia’s girlfriend, Kathryn McDonough, manipulated Mazzaglia and the truth of what really happened that night to save herself. They claim McDonough suffocated Marriott during rough sex involving restraints and a panic-stricken Mazzaglia helped dispose of the body in the ocean to protect her.

Mazzaglia was found guilty of one count of first-degree murder that stated he strangled Marriott "before, after or while" sexually assaulting her. He also was convicted of conspiracy to falsify evidence and conspiracy to tamper with witnesses.

DOVER, N.H., June 27 (UPI) --A 31-year-old man convicted Friday of killing missing University of New Hampshire student Elizabeth Marriott can expect to spend the rest of his life behind bars.

A jury found Seth Mazzaglia, 31, guilty of two counts of first-degree murder and two counts of conspiracy involving tampering with witnesses and physical evidence. He was led from the courtroom in handcuffs immediately after the verdict.

No date was set for sentencing. Mazzaglia faces life with no parole.

After murder conviction in Strafford County Superior Court , Mazzaglia waits for final words

A Dover man convicted of killing a University of New Hampshire student and dumping her body into the Piscataqua River awaits a sentencing that has already been decided.

Seth Mazzaglia, 31, automatically faced life in prison without the possibility of parole once a jury convicted him Friday of two counts of first-degree murder in the death of Elizabeth "Lizzi" Marriott, 19. Still to be determined is Mazzaglia's punishment for conspiring to falsify physical evidence and to commit witness tampering.

The jury - seven women and five men - reached its verdict at Strafford County Superior Court shortly before 12:30 p.m., just minutes after posing a question to Judge Steven Houran related to the conspiracy charges.

A sentencing hearing will give Marriott's family an opportunity if they choose to address the court directly after having sat through weeks of emotionally grueling testimony.

DOVER, N.H. (WHDH) - The man convicted of killing a UNH student is facing new charges.

Investigators say Seth Mazzaglia tried to hatch an escape plan from prison.

Mazzaglia is awaiting sentencing after a jury convicted him of rape and murder.

Investigators want him back in court accusing him of enlisting a former cellmate to help him break out of jail; a felony.

Convict will be tried on escape plot charge

DOVER, N.H. — The man convicted of raping and killing a University of New Hampshire student in October 2012 will be sentenced in August.

Prosecutors said Wednesday they also intend to prosecute Seth Mazzaglia of Dover, 31, on a charge that he enlisted a cellmate to help plot his escape.

Prosecutor Peter Hinckley told WMUR Wednesday (http://bit.ly/1n7LEFv ) that he does not consider it a waste of resources to pursue the charge of criminal solicitation, "because he committed the crime."

Mazzaglia escape try trial set for Nov. 3

DOVER — Convicted murderer Seth Mazzaglia was back in court Wednesday morning for a status conference on a criminal solicitation charge which relates to his alleged attempt to break out of the Strafford County House of Corrections in 2012.

In court Wednesday, Hinckley told Judge Steven Houran, who sat on the bench during Mazzaglia's murder trial, that the state is tentatively planning to proceed on the criminal solicitation charge against Mazzaglia.

“At this point we would ask for a trial,” Hinckley told Houran. He said the trial should last approximately two days.

Based upon the court's schedule, Houran selected Nov. 3 for the start of jury selection, with the trial to begin that week.

Whether or not he is convicted on the criminal solicitation charge and barring a successful appeal, Mazzaglia will spend the rest of his natural life in prison without the possibility of parole because state law mandates that for criminals convicted of first-degree murder.

DOVER, N.H. —The convicted of killing University of New Hampshire student Lizzi Marriott was back in court Friday morning to plead guilty to attempted escape charges.

Seth Mazzaglia was charged with criminal solicitation involving a plot to break out of jail after he was arrested for Marriott's killing.

Mazzaglia is already serving a life sentence for killing Marriott. He decided not to fight the attempted escape charges and was sentenced to an additional 3 1/2 to seven years in prison.
