DOVER — The state attorney general is objecting to requests from Foster's Daily Democrat and two other New Hampshire newspapers for the court to release documents that relate to the murder of Elizabeth Marriott.

As the search continues for the body of Elizabeth 'Lizzi'' Marriott, authorities in New Hampshire are due to return to court Monday regarding the release of documents in the case.

However, a probable cause hearing for the defendant in the case that was scheduled at the same time Monday will not be held. Seth Mazzaglia, 29, of Dover, N.H., who is charged with second-degree murder in connection with Ms. Marriott's death, has waived his right to the hearing, according to Assistant Attorney General James C. Vara.

At 10 a.m. Monday in Dover District Court, a judge will hear arguments from media outlets regarding the release of documents in the case, including search and arrest warrants. The state attorney general's office has said the investigation could be jeopardized if the documents are made public.

Volunteers continue search for Marriott's body

PORTSMOUTH — Volunteers with the New Hampshire League of Investigators and the Mission for the Missing brought four dogs trained in detecting human remains to Peirce Island on Sunday in hopes of finding evidence in the Lizzi Marriott case.

Investigators have used a variety of tools in the search for Marriott's body. Boats, cadaver dogs, aircraft and divers have all aided in the search, as have some locals disturbed by the facts surrounding the case.

Among those locals are twin brothers Conrad and Perry McKinney, who have walked tirelessly up and down the coast along Peirce Island and New Castle looking for evidence. Conrad is a private investigator and, on Sunday, he and his brother were joined by approximately a dozen volunteers with the N.H. League of Investigators and the Boston-based nonprofit Mission for the Missing to continue their efforts.

DOVER — A Dover trial court judge is weighing whether to release court documents relating to the killing of University of New Hampshire student Elizabeth Marriott.

Judge Stephen Morrison on Monday heard arguments from Foster's Daily Democrat and the New Hampshire Union Leader, which are asking the judge to unseal all or part of the documents in the case.

The Portsmouth Herald has also petitioned the court for access to those records, which include the arrest and search warrants obtained during the investigation into Marriott's death and any supporting police affidavits.

Judge Morrison heard arguments by media outlets for the release of court documents relating to the killing of the University of the New Hampshire student Monday.

The judge reached a decision yesterday and announced this afternoon that he had denied release of the documents.

Morrison also denied a request for a redacted version of the records.

PORTSMOUTH, N.H. —A second arrest has been made in the disappearance and death of a University of New Hampshire student.

Michael A. Delaney, New Hampshire attorney general, Dover Police Chief Anthony F. Colarusso Jr., and Col. Robert C. Quinn of the New Hampshire State Police made the announcement on Monday.

The officials said that Kathryn McDonough, 19, of Portsmouth, was arrested Monday and charged with two felony counts in connection with the disappearance and death of Elizabeth "Lizzi" Marriott, 19, whose body has not been found.

McDonough is charged with hindering apprehension or prosecution and conspiracy to commit hindering apprehension or prosecution.

PORTSMOUTH — The attorney for the girlfriend of a man charged with killing a University of New Hampshire student said Friday he has no plans to waive a probable cause hearing scheduled for Wednesday.

Exeter lawyer Ryan Russman also disputed earlier reports that his client, Kathryn "Kat" McDonough, 19, of Portsmouth had been bailed out of jail following her arraignment on felony charges of hindering apprehension or prosecution and conspiracy to hinder apprehension or prosecution. Russman said McDonough's family is still trying to "marshal funds" necessary to post her $35,000 cash or corporate surety bail.

An employee at Rockingham County House of Corrections told the Portsmouth Herald on Wednesday night that McDonough was no longer an inmate at the jail. However, Russman said, it was likely that she had been transferred to another facility.

An employee at the jail confirmed Friday morning that McDonough had been transferred to Hillsborough County jail in Manchester. He could not elaborate on the reasons behind the transfer.

State prosecutors have until the end of February to bring an indictment against a Dover man charged with the murder of University of New Hampshire student Elizabeth "Lizzi" Marriott.

A Strafford County Superior Court judge recently granted state prosecutors extra time to build their case against 30-year-old Seth Mazzaglia, according to Foster's Daily Democrat.

Mazzaglia was arrested in October and charged with Marriott's murder which authorities say occurred on Oct. 9 after the UNH student went to his apartment to visit a friend. Authorities have searched the Piscataqua River in Newington and Portsmouth but have not yet found Marriott's body.

Five weeks into her first semester at the University of New Hampshire, the sophomore and 2011 graduate of Westboro High School planned to attend a Tuesday-night lab class that would end at 9 p.m. She wouldn’t have to hurry — she was staying with her aunt and uncle only about a half-hour drive from the campus where she had transferred to study marine biology.

At 8:55 p.m., the 19-year-old sent a text saying she was going to visit a new friend, a co-worker at a department store near campus.

Less than two hours later, the former prom queen died with a rope around her neck.

CONCORD, N.H. — Kathryn McDonough sat at the defense table — sometimes stoic and sometimes sobbing — as nearly a dozen members of Elizabeth “Lizzi” Marriott’s family berated her for betraying Marriott’s trust and luring the 19-year-old University of New Hampshire sophomore to her death.

McDonough, 19, had just pleaded guilty Thursday to hindering the prosecution, tampering with a witness and conspiracy for lying to investigators after Marriott’s family reported her missing last year. She had told investigators her new friend never showed up at the Dover apartment McDonough shared with 30-year-old Seth Mazzaglia as planned the night of Oct. 9.

McDonough was sentenced to 1.5 to 3 years in prison and taken into custody at the end of the two-hour hearing.

Mazzaglia, who is being held without bond, is due in court Wednesday and his trial is scheduled to start in May. McDonough’s plea agreement calls for her to testify against Mazzaglia. Prosecutors have yet to say what transpired that night or what McDonough’s role was. DOVER — In letters to his ex-girlfriend and codefendant in the killing of University of New Hampshire student Elizabeth “Lizzi” Marriott, Seth Mazzaglia discussed framing and killing a witness to the alleged crime, new court documents say.

Those revelations are among the information detailed in court documents filed by prosecutors and defense lawyers that provide insight into how both sides are preparing their cases.

According to documents filed in Strafford County Superior Court, the state recently came into possession of letters Mazzaglia wrote to Kathryn “Kat” McDonough, 19, of Portsmouth. DOVER, New Hampshire (NEWS CENTER) -- The attorneys in the Seth Mazzaglia murder trial laid out their cases for jurors.

Mazzaglia is on trial for the 2012 murder of University of New Hampshire student Lizzi Marriott. The 19-year old's body has never been found. Investigators believe it is lost at sea after being dumped in the Piscataquis River.

The prosecutor told jurors it is a case about sex, domination and violence that the victim was unknowingly lured into. He wasted no time pointing his finger at the defendant Seth Mazzaglia.

He portrayed Mazzaglia as the Lord Master and girlfriend Kat McDonough as his slave who obeyed Mazzaglia's every command. He told jurors Mazzaglia demanded McDonough find him another female to sexually dominate. McDonough chose co-worker Lizzi Marriott. When Marriott rejected Mazzaglia's advances the prosecutor said he could not tolerate the rejection.

PORTSMOUTH, N.H. – One by one jurors looked over the cliff's edge to where Seth Mazzaglia allegedly dumped the body of Elizabeth "Lizzi" Marriott after her murder in 2012.

The body fell some 20 feet before it hit the water, and has never been found.

Lower on the ledge at Peirce Island in Portsmouth, some hair evidence was discovered, Prosecutor Geoffrey Ward said to the jurors May 27, the first day of the Marriott murder trial.

As jurors viewed the scene, Mazzaglia stood aside with his defense team, his arms crossed, staring straight ahead and across the Piscataqua River to the Portsmouth Naval Shipyard.

DOVER — A jury seated for Seth Mazzaglia’s murder trial learned Wednesday that it will have to decide whether he killed Elizabeth “Lizzi” Marriott by strangulation, or whether his girlfriend smothered Marriott to death as part of a sex act.

Seated in Strafford Superior Court, the jury heard opening arguments Wednesday from prosecutor Peter Hinckley, who said Mazzaglia strangled the University of New Hampshire student from behind, before raping her and plotting to dispose of her body, her belongings and evidence.

Mazzaglia’s defense attorney Joachim Barth countered it was Mazzaglia’s girlfriend — Portsmouth’s Katherine “Kat” McDonough — who killed Marriott during a sex act she called “breath play.” McDonough, Barth told the jurors, placed her thighs around Marriott’s head, while Marriott was restrained and had “limited ability” to resist.

The prosecutor began the first day of Mazzaglia’s trial by describing Marriott as friendly and trusting when she agreed to go to Mazzaglia’s apartment by invitation from McDonough. A teenager at the time, McDonough was Mazzaglia’s live-in roommate, “sexually submissive slave” and had been following his orders to find him a new “play thing” when she lured Marriott to her ultimate death, Hinckley said.

Barth countered that it was McDonough who “drove” the couple’s sexual and personal relationship, that she boasted she was the dominant of the two and had advertised herself as “a switch” on S&M, or sadomasochism, Web sites, meaning she would engage as both a dominant and submissive sex partner.

“Seth didn’t introduce Kat to S&M, she came that way,” he told the jurors.

In opening statements, prosecutors said Mazzaglia choked Marriott with a rope and raped her when she denied his sexual advances. But defense attorneys said it was Mazzaglia's girlfriend, Kat McDonough, who caused Marriott's death.

Dover police Detective Shawn Mask was the first and only witness called on the first day of testimony. He described cellphone records and read a deleted text message he said Mazzaglia allegedly sent McDonough telling her to find a friend he could have sex with and who would die.

"This was the exercise of power and control and a clear expression of intent to do very wrong in the very near future voiced by a 30-year-old dominant to his much younger submissive, who he began to groom and control when she was only 17 years old," said Assistant Attorney General Peter Hinckley in his opening statement.

NH jurors visit crime scenes in Lizzi Marriott case

DOVER, N..H. — Jurors in the Seth Mazzaglia murder trial learned Tuesday that they will be hearing from a witness living in an apartment complex across the river from where 19-year-old Elizabeth "Lizzi" Marriott was killed who says she heard a woman scream on the night Ms. Marriott became a missing person in 2012.

The jurors also learned that they will hear from a witness who saw "drag marks" on the trail heading toward an outlook on Peirce Island in Portsmouth shortly after prosecutors claim Mr. Mazzaglia, 31, of Dover, and his live-in girlfriend, Kathryn "Kat" McDonough, 21, dumped Ms. Marriott's body wearing nothing but a pair of blue, thong-style underwear and some jewelry into the Piscataqua River.

Mr. Mazzaglia is facing two counts of first-degree murder, charging that he purposely or knowingly killed Ms. Marriott by strangling her with a rope during a bondage, domination and sadomasochism threesome with Ms. McDonough in his bedroom at 1 Mill St., Apt. 341, on Oct. 9, 2012. He has also been charged with second-degree murder for recklessly causing Ms. Marriott's death with an extreme indifference for human life, conspiracy to commit tampering with witnesses and informants, conspiracy to commit falsifying physical evidence and criminal solicitation.

Thank you Alessandra for your very thorough updates on Lizzie Marriott. I just finished reading about this case, and it gave me the chills, heebie-jeebies or whatever others call it. This was a planned murder of a lovely young and innocent college student. I feel so sad for this victim's family having to listen to the chilling testimony from their daughter's co-worker. Bad enough betraying somebody, but this girlfriend was criminally involved in bringing a victim to him and watching her die. Okay. I know, I know,..... she took a plea deal, but still..... She sounds like a dangerous person to turn loose, not much better than the male who is being charged with murder and rape. I hope the jury is very attentive on this case, and that some sort of justice will be achieved.

This is a horrible case, I feel terribly sorry for Lizzi's family and friends, no one deserves to go through what she went through and die as she did. Mazzaglia is a sick monster who deserves to spend the rest of his life in a place where he cannot hurt anyone else.

I agree with you on the issue about the plea deal with Seth's girlfriend, Kat. He used her to lure Lizzi to his apartment where he was planning to kill her, he was looking for a victim to experience "the ultimate pleasure" of killing someone. Kat is equally guilty and morally depraved, but the prosecution had to make a deal with the devil to have her testify against him at his current trial.

The prosecution told the jurors that there won't be "a Perry Mason moment", if Seth's girlfriend decides to recant her story on the stand, when she testifies against him, she will be charged with murder because she will be on violation of the plea agreement, and even though she is now a witness for the prosecution, she was a willing participant in the murder of Lizzi Marriott.

I also hope some kind of justice will be served in this very sad and disturbing case.

DOVER — During a second day of a trial for Seth Mazzaglia — who is charged with the Oct. 9, 2012 murder of University of New Hampshire student Elizabeth “Lizzi” Marriott — prosecutors presented evidence through a series of witnesses, including Marriott’s girlfriend, and a woman who said she heard a “blood curdling scream” near the alleged murder scene.

Marriott’s girlfriend, Brittany Atwood, testified that she had been in a romantic relationship with Marriott since the spring of 2012 and that it developed into an exclusive relationship that endured until the day Marriott died. She described Marriott as caring, trusting, bubbly, goofy, silly, hardworking and determined.

Atwood also described Marriott as someone who was “experimental” and who was excited about having made a new friend who, like herself, was bisexual. That friend was Kathryn “Kat” McDonough, Mazzaglia’s girlfriend who is serving a prison sentence for conspiring to coverup Marriott’s death.
Atwood described how the couple text messaged each other frequently and how her last text to Marriott, on the night she was allegedly murdered, went unanswered.

Testimony continues in Mazzaglia murder trial

DOVER, N.H. —The aunt and girlfriend of a University of New Hampshire student killed in October tearfully testified Thursday about the days before the 19-year-old's death.

Prosecutors in the Seth Mazzaglia murder trial called six witnesses Thursday. Diane Rebecca Hanna, the aunt of victim Lizzi Marriott, and Brittany Atwood, Marriott's girlfriend, testified about Marriott's loving, upbeat character.

Marriott was living with Hanna in Chester while she went to school and worked. Hanna broke down in tears when she was shown Marriott's class schedule at UNH.

"This was Lizzi's fall schedule at UNH," Hanna said. "I wrote across the top for her to fill it in."

Hanna said Marriott was responsible about keeping her in the loop, including on the last day of her life. She read from a note Marriott left her.

DOVER — Prosecutors and defense attorneys continued to lay their groundwork Thursday morning in the murder trial of Seth Mazzaglia, charged in the 2012 death of Elizabeth "Lizzy" Marriott.

Mazzaglia, 31, faces multiple counts of first-degree murder – based on alternate legal approaches - a second-degree murder charge, and charges of conspiracy and criminal solicitation in Marriott's death.

His former girlfriend, Kathryn “Kat” McDonough, who is currently serving 1½ to three years in prison for hindering prosecution, is expected to testify against Mazzaglia as part of a negotiated plea deal.

On Thursday morning, prosecutors called several witnesses, including Nathan McNeal, of Portsmouth, who worked with Marriott at Target in Portsmouth, and Marriott’s girlfriend, Brittany Atwood, now of Hudson, Mass.

On the stand, McNeal said he and Marriott remained friends after he left Target to work at Barnes & Noble. He said they would talk – via text during online games – about silly stuff like "plans of world domination and octopuses."

"She was a nerd like I was," McNeal said, adding they both enjoyed playing games, like World of Warcraft and Dungeons & Dragons.

DOVER — Judge Steven Houran denied a defense motion for a mistrial after a former friend of Seth Mazzaglia who was called to his apartment after Elizabeth “Lizzi” Marriot was killed in 2012  testified Friday that when left unchecked, Mazzaglia’s alleged persona “Doomsday” could kill people.

Mazzaglia's lawyers objected twice during the testimony, with their first objection overruled and the judge ordering a brief recess after the second before hearing arguments regarding the objection and a motion for a mistrial.

After deciding the previous rulings stand, Houran determined the objections about the testimony were “inadequate for a mistrial.”

Friday morning, prosecution witness Roberta Gerkin, of Rochester, who previously worked as a psychic and tarot card reader, said she first met Mazzaglia – who introduced himself as “Lex” - during a “Haunted Halloween” event at the Governor’s Inn in Rochester during the fall of 2011.

Gerkin said Mazzaglia was “one of the actors” at the event while she served as a psychic and read tarot cards. She added they became friends after having “a very spiritual, intellectual conversation” for a few hours at the event.

As a result of the connection, Gerkin said they had “a short sexual relationship at the very beginning,” but it only lasted a few days or less than a week. She added it served as “a release” for Mazzaglia, who she described as being like an electrical devise which would overload.

A woman testified Friday that she saw Lizzi Marriott's body in Seth Mazzaglia's apartment on the night of Marriott's death.

Roberta Gerkin is a tarot card reader who testified that Mazzaglia regarded her as his spiritual adviser. She said she was the woman who he and his girlfriend, Kat McDonough, called in the moments after Marriott died.

Gerkin said she went numb when she and her friend Paul walked into Mazzaglia's apartment on the night of Oct. 9. She said she saw a body on the floor next to the bed. She would later learn the body was Marriott's.

"The body itself was naked, with the exception of underpants," Gerkin said. "The head was covered in a grocery bag."

Gerkin was asked what was her first thought.

"We need to get these bags off," she said. "Could she be alive? Although in the back of my mind, I knew she was not."

Gerkin testified that after the bag was removed, she noticed a pale purple line around Marriott's throat. She said she remembers only Mazzaglia talking.

DOVER — “As I'm walking in, there's a body on the floor,” Roberta Gerkin testified Friday, recalling what she saw when she went into Seth Mazaglia's apartment on Oct. 9, 2012.

“There's a body on the floor, right next to the bed,” Gerkin told a jury. “My reaction was to go numb.”

Gerkin's testimony came during the third day of a trial for Mazzaglia, who is charged with the killing of University of New Hampshire student Elizabeth “Lizzi” Marriott, then conspiring to dispose of her remains. The nearly nude body Gerkin saw in Mazzaglia's apartment was Marriott, according to prosecutors.

Gerkin's testimony filled the entire trial day Friday.

She said she urged Mazzaglia to remove a plastic grocery bag from Marriott's head in case she was still alive. Once he removed one bag, Gerkin said, she saw a second one under it.

Marriott's face was purple, she said, but her body was white. Mazzaglia was “calm” and explained that he'd blacked out and when he came out of it, Marriott was dead with the bags already on her head, Gerkin told jurors.

“It was framed like it was an accident,” is the way she described Mazzaglia's explanation for having a dead woman in his apartment.

His girlfriend, Kathryn “Kat” McDonough, was seated on a floor nearby with her knees to her chest, Gerkin said.

A former psychic and friend of Seth Mazzaglia's has testified that she saw the body of Elizabeth "Lizzi" Marriott in his bedroom with two plastic grocery bags over her head.

"We were convinced he was going to do the right thing," she said.

What unfolded the night of Oct. 9, 2012 was anything but. Mazzaglia, along with his then girlfriend Kat McDonough, wrapped the body in a tarp and drove to Peirce Island in Portsmouth, where the body was dumped into the tidal river, never to be found again, according to his arrest warrant.

Defense attorney Joachim Barth, who has already told jurors that McDonough was the one responsible for Marriott's death, continued to pick apart Gerkin's testimony in Strafford County Superior Court in Dover, N.H.

Gerkin testified earlier that Mazzaglia was the "dominating force" in his relationship with McDonough.

"The relationship seemed very much to be damsel in distress and rescuer," Gerkin said. And once McDonough was rescued, she was trying to stay in Mazzaglia's good graces, she said.

Barth asked her, "You have that power to predict future events?"

The start of a murder trial against Seth Mazzaglia last week captured much media attention, including from the national television shows "Dateline" and "48 Hours."

It also included unreported testimony about fetish fairs in Portsmouth, attracted a so-called photo bomber and was attended by Mazzaglia's self-described spiritual adviser.

Mazzaglia's trial began Wednesday in Strafford Superior Court where his lawyers defended against charges alleging Mazzaglia strangled, then raped University of New Hampshire student Lizzi Marriott, on Oct. 9, 2012, after she said no to a threesome with his girlfriend Kathryn "Kat" McDonough.

Prosecutors and defense attorneys said the couple was involved with sadomasochist sexual activity, sometimes involving third parties. During his opening arguments on Tuesday, defense attorney Joachim Barth told jurors that Mazzaglia and McDonough enjoyed role playing through theater, gaming and "even in their sex lives."

Together they'd gone to "BSDM conventions," he said, including one "at the Frank Jones Center in Portsmouth."

While Barth hasn't mentioned the Portsmouth convention again, online archives document a "fetish fair" at the Frank Jones Center on June 29, 2013, and another one there a year earlier. "Produced by the New England Leather Alliance," last year's fetish fair featured more than 35 vendors with "fabulous toys, gear, erotica," as well as "mini classes and demos," it was advertised. The Portsmouth event was promoted as a chance to "mix and mingle with your fellow kinksters."
