Cobb police: Much has changed about toddler’s death

The death of 22-month old Cooper Harris is not as simple as another kid being left in a hot car. Or at least that’s what Cobb County police are hinting at as their investigation continues.

The emotional response is growing, and defense attorneys are weighing in about the death the child’s father called an accident.
“It seems like it's a rush to judgment in this situation. I think a lot more evidence could be developed before inflicting this on the family,” said defense attorney Kim Keheley Frye.
But Cobb County police say there was no rush in their investigation.

A Georgia father has been charged with felony murder in the death of his 22-month-old son after the boy was left inside a mini-SUV for hours on a sweltering day.
The man's family claims it was an honest and tragic mistake. But police disagree - and Justin Ross Harris, 33, now faces heightened charges in Cooper's heat stroke death, a case that has drawn outrage from people who believe the man has already suffered enough.

In Harris' case, police feel strongly about the murder charge, ABC's Chief Legal Affairs Anchor Dan Abrams said.
"We don't know exactly what evidence they have, but they've executed a search warrant. And it's not uncommon for computer-related searches to yield information," Abrams said. "Whatever the evidence is, the authorities believed it warranted bringing charges very quickly."

Cobb County Police Chief John Houser said Wednesday that he understands tragic accidents happen, but evidence indicates a "more serious crime" has been committed. He didn't elaborate on what the evidence was.
"The chain of events that occurred in this case do not point toward simple negligence and evidence will be presented to support this allegation," Houser said in a message released by the department.
The Cobb County Medical Examiner's Office said Wednesday that toxicology results are still pending but that it believes the cause of death was hyperthermia and the manner of death was homicide. Hyperthermia is a condition in which the temperature of the body spikes due to the heat.
The new warrant filed late Tuesday also downgrades one charge against Harris from first-degree child cruelty to second-degree child cruelty. First-degree cruelty to children requires that a person "willfully deprives the child necessary sustenance," while second-degree cruelty to children is caused by "criminal negligence" under Georgia law.

HONOLULU (AP) — The ex-boyfriend of a Maui woman who was five months pregnant when she disappeared in February has been indicted on charges of killing her and torching her SUV to cover up the crime.

Family members last saw Scott in February at her sister's Haiku home. The Makawao woman's burned 1997 Toyota 4Runner was later found on the island's north shore.
Capobianco also was indicted on an arson charge.
Before the vehicle was located, police found Scott's dog in the nearby community of Nahiku.
Police later began investigating her disappearance as a homicide.
Capobianco has told Hawaii News Now he saw Scott on the night that her family says she vanished, but had nothing to do with her disappearance.

HONOLULU —The ex-boyfriend of a missing pregnant Maui woman has been indicted on a murder charge in the case.
A Maui grand jury indicted Steven Capobianco on a second-degree murder charge in the death of Carly Scott. She disappeared in February and was never found.
A person familiar with the investigation says Capobianco will be served with an arrest warrant Monday at the Maui Community Correctional Center. The person wasn't authorized to talk publicly about the case and spoke on the condition of anonymity
Capobianco has been jailed on $500,000 bail since last month in an unrelated case.

Carly "Charli" Scott, a pregnant woman who went missing on the Hawaiian island of Maui, is now being considered a murder victim by the Maui Police Department.
On March 7, MPD released the following statement:
The 27 year old reportedly went missing the night of Feb. 9, after helping her ex-boyfriend and the father of her unborn baby, Steven Capobianco, pull his car out of an area off the Hana Highway. Her mother filed a missing persons report the following day.
Days later, Scott's SUV was found stripped, turned over and torched at a remote surf spot known as "Jaws" in Peahi. During the initial investigation, several items identified as Scott's were also discovered, including a blanket and clothing, which Maui News Now reports, were located around 25 to 30 miles apart.

HONOLULU (AP) — The ex-boyfriend of a Maui woman who was five months pregnant when she disappeared in February has been indicted on charges of killing her and torching her SUV to cover up the crime.

Family members last saw Scott in February at her sister's Haiku home. The Makawao woman's burned 1997 Toyota 4Runner was later found on the island's north shore.
Capobianco also was indicted on an arson charge.
Before the vehicle was located, police found Scott's dog in the nearby community of Nahiku.
Police later began investigating her disappearance as a homicide.
Capobianco has told Hawaii News Now he saw Scott on the night that her family says she vanished, but had nothing to do with her disappearance.

HONOLULU —The ex-boyfriend of a missing pregnant Maui woman has been indicted on a murder charge in the case.
A Maui grand jury indicted Steven Capobianco on a second-degree murder charge in the death of Carly Scott. She disappeared in February and was never found.
A person familiar with the investigation says Capobianco will be served with an arrest warrant Monday at the Maui Community Correctional Center. The person wasn't authorized to talk publicly about the case and spoke on the condition of anonymity
Capobianco has been jailed on $500,000 bail since last month in an unrelated case.

Carly "Charli" Scott, a pregnant woman who went missing on the Hawaiian island of Maui, is now being considered a murder victim by the Maui Police Department.
On March 7, MPD released the following statement:
The Missing Persons case involving Carly J. Scott has been re-classified as a "Homicide Investigation" by the Maui Police Department's Criminal Investigation Division. The family has been notified of the change in classification.
As the investigation is active and on-going, no further information will be released at this time.
The 27 year old reportedly went missing the night of Feb. 9, after helping her ex-boyfriend and the father of her unborn baby, Steven Capobianco, pull his car out of an area off the Hana Highway. Her mother filed a missing persons report the following day.
Days later, Scott's SUV was found stripped, turned over and torched at a remote surf spot known as "Jaws" in Peahi. During the initial investigation, several items identified as Scott's were also discovered, including a blanket and clothing, which Maui News Now reports, were located around 25 to 30 miles apart.

Mother and daughter saved from carjacking by strangers
A woman and her young daughter are safe this morning after strangers stopped a carjacking in San Diego, CBS News correspondent Bigad Shaban reports.
A carjacker broke into the driver's seat of their minivan and took the keys while the mother and daughter were still in the vehicle, but a group of bystanders jumped in to stop him.
Aaron Leaf shot it all on his cell phone.
"I see a guy in the backseat choking out the driver," Leaf said. "And there were a couple other people at the window that were grabbing the keys from him."
Seconds later, Ismael Hernandez was dragged from the vehicle and wrestled to the pavement.
"Get your ass down, get down," one of the good Samaritans yelled.

But why did this particular domestic homicide case grab the attention of the media and the public? What made it different from the many other domestic homicides that occur? And how prevalent is intimate partner homicide in Australia?

In 2013, the National Homicide Monitoring program released data that showed that 36% (or 185) of all homicides in Australia between 2008 and 2010 were domestic-related.
Of those, 66% (122) were classified as being committed by an intimate partner. However, there has been a 16% decrease in domestic homicides since 2007-08. Unsurprisingly, 143 domestic homicides took place in a residential setting, most often the victim’s home.
The most common causes of death in domestic homicides were stab wounds (43%), beatings (36%), gunshot wounds (10%) and strangulation (9%). Of interest are the motives present in domestic homicides. In 49% of domestic homicides a domestic argument was the apparent motive. Other motives, to a far lesser extent, are jealousy (2%), money (1%) and termination of the relationship (5%).

Wife killer Gerard Baden-Clay will almost certainly appeal his conviction and sentence, a Queensland criminal law expert says.
Professor Heather Douglas from the University of Queensland says Baden-Clay's legal team will be poring over transcripts of his 21-day trial to find grounds for an appeal.
Baden-Clay has 30 days to lodge an appeal, or apply for grounds to seek an extension of time to lodge an appeal, following his life sentence on Tuesday for the murder of his wife Allison in 2012.

DAVENPORT, Iowa – Jurors convicted an Iowa man Thursday of killing his pregnant wife after his third time on trial, rejecting his claims that an unknown intruder shot her while he was in the shower.
The jury found 23-year-old Seth Techel guilty of first-degree murder and nonconsensual termination of a human pregnancy. The former volunteer firefighter who once hoped for a long career in law enforcement now faces a mandatory sentence of life in prison without parole.

Four teenagers were arrested in Thursday's deadly attack on a USC graduate student as he walked home from a study group, with police saying the incident was one of at least two robberies the group attempted that day..
Xinran Ji, a 24-year-old graduate student from China, was allegedly hit on the head with a baseball bat by at least one of the suspects, according to two law enforcement sources. Detectives are probing whether other weapons were also used, the sources said. The suspects range in age from 16 to 19.
"He was literally beaten to death," said LAPD Cmdr. Andrew Smith. "I don't know why a group of young people would go on a crime spree as terrible as this."
Despite his injury, Ji managed to make it back to his 30th Street apartment, where his body was found around 7 a.m. by a roommate. Detectives followed a bloody trail from his home to where they believe he was attacked, near 29th Street and Orchard Avenue.

LOS ANGELES (CBSLA.com) — The beating death of a Chinese USC graduate student, who was attacked while walking home and was found hours later inside his apartment, has led to a “series of arrests”, according to authorities.
A late-afternoon news conference took place at 4:30 p.m. at LAPD headquarters, at which some details of the arrests were announced.
Xinran Ji, a 24-year-old electrical engineering graduate student at the University of Southern California, was found dead at about 7 a.m. on Wednesday, July 24, in the City Park apartments, located in the 1200 block of West 30th Street.
Ji was actually attacked at around 12:45 earlier that morning while he had been walking home near 29th Street and Orchard Avenue, according to Los Angeles Police Department Lt. Andy Neiman.

SYDNEY (Reuters) - The Australian biological parents of twins caught up in a surrogacy scandal in Thailand wanted both babies but the surrogate mother threatened to involve the police and they feared she would keep both children, they said on Sunday.
David and Wendy Farnell were speaking publicly for the first time since the story broke more than a week ago of 7-month-old baby Gammy, who has Down's syndrome and is being cared for by his surrogate mother in Thailand.
The couple told Australian television they felt they had little choice but to leave Thailand with Gammy's healthy sister.

(In my opinion, they are lying, they didn't want the little boy because he has down syndrome and he also has a very serious heart condition. I hope the little boy can remain with the surrogate mother, she has been taking care of him and seems to really care.)

The sight Lacey found when she got to Ava's school was a parents' nightmare: her face swollen, cut, and bruised beyond recognition.
Lacey rushed Ava to the family pediatrician, who burst into tears upon seeing the Ava's battered visage. Fortunately, the doctor determined that it is unlikely that Ava would have any permanent physical damage. Mental and emotional damage is another story altogether.
AvaLynn informed Lacey that she was assaulted by another student: that she was kicked repeatedly in the face until she fell off of the slide on the school's playground. The school informed Lacey were no teachers present when the incident occurred, and because of that, no one could prove whether or not another student had harmed Ava.
After days of Lacey, friends, and family members reaching out to local news stations and to Facebook and other social media bodies, the school finally released a statement: AvaLynn was injured as the result of an accident, one that involved no other children. Although a police report was filed, Pascagoula Police Department states that they are not investigating the situation.
The school basically claims that Ava injured herself, as all the photos depicting her injuries will debunk. The local PD claims that there has been no criminal act, which the injury photos also disprove.
So now we've taken this to Facebook, asking everyone out there to please share this page, to please share AvaLynn's story. Florida Man Kills His Daughter and 6 Grandchildren in Murder-Suicide

A man who spent time in prison a decade ago for the shooting death of his young son killed six of his grandchildren, including an infant, as well as his adult daughter and himself in a rampage at a home in Florida that authorities said they had been called to in the past.
The shooter, 51-year-old Don Spirit, called 911 Thursday afternoon to say he might harm himself or others, Gilchrist County Sheriff Robert Schultz said at a news conference. When a deputy arrived, Spirit committed suicide and authorities then found the seven gunshot victims "all over on the property," Schultz said.

LITTLE ROCK, Ark. — As family and friends continue to search for a real estate agent four days after she was reported missing when she failed to return from showing a home, police said the man wanted in connection with her disappearance is in custody.
The Pulaski County Sheriff's Office said 33-year-old Aaron Michael Lewis is in custody in the disappearance of 51-year-old Beverly Lyn Carter. He was apprehended by the Little Rock Police Department on Monday morning, but authorities have not shared any more information regarding his arrest.
Carter is originally from Montgomery County, Texas and is a graduate of Splendora High School.
An arrest warrant was issued for Lewis on Sunday on the charge of kidnapping.

The man accused of kidnapping and killing Arkansas real estate agent Beverly Carter said today she was targeted because she was "a woman that worked alone."
Arron Lewis, who remains in police custody, is the sole suspect in the grandmother's murder, law enforcement officials said today. He entered a not guilty plea earlier this morning on charges of capital murder, robbery and kidnapping and is being held on $1 million bail.
The motive for the attack remains under investigation though Pulaski County Sheriff's Office Capt. Simon Haynes said that Lewis "was a stranger to her" who investigators believe saw her as "a target of opportunity." Haynes said that Carter met with Lewis at the empty home because she believed he was a prospective buyer.

On Monday, October 7th, Misty’s father filed a missing persons report with the Auburn, Washington Police Department after the 32-year-old had not been seen or heard from since October 5th. Law enforcement officials say that prior to her disappearance, she had been staying at a family member’s apartment on the Muckleshoot reservation near Auburn.

2 Babies Found Dead in Filthy Massachusetts Home Could Have Been Alive for Some Time: Authorities

At least two of the three babies whose skeletal remains were found in a filthy, vermin-infested Massachusetts home may have been alive "for some period of time" before they were found, a prosecutor said in court Tuesday.
Both bodies were found wearing diapers and one-piece infant outfits in closets in the Blackstone home, Assistant District Attorney John Bradley said during a bail hearing for Erika Murray in Uxbridge District Court.

EAST STROUDSBURG Pa. (Reuters) - A 10-year-old boy was held without bail on Tuesday after being charged as an adult in the killing of a 90-year-old woman who was held down with a walking stick and beaten at her caretaker's Pennsylvania home.
... The boy, Tristen Kurilla, said he pinned Novak down on her bed with a walking stick on her throat and punched her “numerous times,” after she yelled at him, according to court papers.
“I killed that lady,” the boy said, the court paper states.
“Were you trying to kill her?” a trooper asked.
“No, I was only trying to hurt her,” the boy replied, according to the criminal complaint.

UPDATE:
at 1 p.m. a body had "been found in a wooded area near Forest Ridge Dr. in Auburn…at the bottom of a 150 embankment near the White River." Stocker's statement included: "A purse containing identification of Misty Upham was at the scene, however, at this time the medical examiner has not made a positive identification nor a determination of cause of death."
