Another trial involving a Florida man who fatally shot an unarmed black teen

CNN’s Ryan Smith on Monday highlighted an upcoming trial in Florida that is eerily similar to the Trayvon Martin case. In both cases, an unarmed 17-year-old black male was left dead.
“I’m not an eye for an eye type person where I think he should be killed,” Ron Davis, the father of Jordan Davis, told CNN. “I don’t believe in capitol punishment. I believe every life is precious. You took my son’s life. That doesn’t mean anybody else should take his life. I think he should spend the rest of his life in prison because of the fact that you have to think about what you’ve done not only to Jordan but to his family, his friends, people that cry for him every day.”
Michael David Dunn, 45, told police he shot and killed Davis at a gas station last year because he feared for his life. Dunn had told Davis and his friends to turn down their loud music. He claimed the situation escalated and the teens began threatening him. Dunn started shooting because he thought they had a shotgun.

Suspect in loud music murder ordered pizza after gas station shooting
JACKSONVILLE, Fla. -- Action News has obtained new video of Michael Dunn speaking with police less than 24 hours after Jordan Davis was shot and killed at a gas station in November.
"I've never been so scared in my life," Dunn tells police in the video. He insists he wasn't looking for a fight when he pulled next to the teen's SUV. Dunn says he was on his way to a Jacksonville hotel after his son's wedding in Orange Park.
"Their music starts and I roll down my window, and I thought I was polite, and asked them nicely, hey would you guys mind turning that down?"
Dunn says the teens did at first, but through a closed window, he could tell one of them was upset. That's when he says things started to heat up.
"I thought they were singing, but [then they said] you're going to die [expletive removed]. Then it started getting a little louder. That's when I popped my window down and was like, 'You're talking about me?' And they was like you're dead. You're dead [expletive removed]!"

Video of police interview of Michael Dunn's girlfriend released
JACKSONVILLE, Fla. -- Action News has obtained newly released evidence in the Michael Dunn case. The State Attorney's Office released new DVD's of surveillance video taken near the crime scene, as well as an interview with Rhonda Rouer, Dunn's girlfriend.
The surveillance video from Nov. 23, 2012, shows Rouer inside the store at the Gate station on Southside Boulevard and Baymeadows Road. You can see her carry a bottle of wine toward the register. Then, you hear someone in the store shout, "Look, he's shooting! He's shooting out of the car, I swear to God."

TALLAHASSEE, Fla. - State Attorney Angela Corey is once again taking heat, this time with a civil rights group asking for her to be taken off one of Jacksonville's most high-profile cases.
The Florida Civil Rights Association set a letter to Gov. Rick Scott saying that Corey and her prosecutors need to be removed from the case against Michael Dunn, who's accused of killing 17-year-old Jordan Davis in a dispute over loud music.
On Thursday, people were standing up for the state attorney, saying she's the right person to do the job. Among them is Gov. Rick Scott, whose office said despite calls for a special prosecutor, Corey will remain on the case.

At scores of marches across the United States this weekend, protesters brandished placards emblazoned with the name of an African-American teenager gunned down by a white man in Florida, even though he himself was unarmed.
That name was Jordan Davis.
The rallies were mostly a response to the acquittal one week before of George Zimmerman, the neighbourhood watch captain in Sanford who shot dead 17-year-old Trayvon Martin early last year. But the marchers were looking forward, too.

Dunn is charged with murder in the death of Davis during in a dispute over loud music outside a Gate station last November.

Dunn's attorney asked for a continuance in the case and it was unopposed by the state attorney's office. Defense attorney Cory Strolla said he has to interview about 100 witnesses to get ready for the trial.

Dunn told police that he asked Davis and three other teens, who were parked next to him at a gas station, to turn down their music. Dunn claims he heard threats from the teens and saw a gun in their car. He says he feared for his own safety, and that's why he grabbed his gun and fired into the vehicle.
Police say they found no guns inside the teens' vehicle and that Dunn fired his gun eight or nine times.

He looks like an evil *&*&%$#. I hope they throw the book at him. If this ends up another Zimmerman, I will just give up on our justice system. Florida needs to get a grip on itself, its a hell hole on the map. It breads this type.

Jailhouse letters from Michael David Dunn making derisive comments about blacks and Jordan Davis — the 17-year-old he shot in a dispute over loud music — have heightened concerns of getting a fair trial in Jacksonville.
Circuit Judge Russell Healey said Thursday he is worried that the release of the letters might require a change of venue. He expressed frustration he didn’t know anything about the letters until he saw news reports and told lawyers on both sides that from now on nothing will be made public in the case until he reviews it.

Local media organizations are asking a Jacksonville judge to reconsider his plan to review all material in the upcoming murder trial of a Brevard County man before it can be released to the public.

In a motion filed Monday, the Times-Union and First Coast News asked Healey to set aside that decision because it did not follow Florida public record laws. WJXT TV-4 will be filing a similar motion, said attorney Edward Birk.

But Jon Kaney, general counsel for the First Amendment Foundation, said Healey’s ruling restricts access to public records because releasing them now has to be justified.
Usually not releasing them is what has to be justified.
Arguing that records need to be protected now to seat a jury is also questionable because a lot of information in the case has already been released, Kaney said.

A judge has revised his order on how material will be released to the public in the high-profile murder trial of a Brevard County man who killed a 17-year-old Jacksonville teenager.

Thursday the judge modified his order and said all material would be released to the public within 30 days of being handed over to him if the prosecution and defense don’t file a motion arguing that it should be kept confidential. If either side objects to releasing information, a hearing will be held to consider the situation.

Judge Russell Healey told the pool he expects jury selection will go in to Wednesday. He says the trial could begin as early as Wednesday afternoon or Thursday. Healey says his role now takes more of a back seat in selection, as attorneys use a limited number of “strikes” to eliminate jurors for any reason they choose or petition to eliminate for a certain cause. Was Michael Dunn in fear for his life whenh he shot and killed 17-year-old Jordan Davis in the parking lot of a Florida gas station, or was he just angry over being disrespected?
That is the question at the center of the first-degree murder trial that began in Jacksonville Thursday.
Dunn, 46, is accused of firing at least 10 shots into the red Dodge Durango that the 17-year-old Davis and three other teen boys were riding in on the day after Thanksgiving 2012. He is charged with one count of first degree murder, three counts of attempted first-degree murder, and one count of shooting into an occupied vehicle. Dunn has pleaded not guilty and maintains that he shot at the teens in self-defense.

JACKSONVILLE, Fla. — Nearly seven months after a jury acquitted George Zimmerman, whose shooting of an unarmed black teenager made him synonymous with Florida’s so-called Stand Your Ground law, the state’s latest drama involving a fatal burst of gunfire and a claim of self-defense began to play out Thursday in a courtroom here.
And while race is woven into the background of the first-degree murder trial of Michael D. Dunn, 47, a white software developer who said he killed Jordan Davis, a black teenager, in a November 2012 confrontation about loud music, the trial appears likely to focus less on race and more on the mechanics of Florida’s self-defense laws and how juries apply them.
In their opening statements on Thursday at the Duval County Courthouse, a prosecutor and a defense lawyer presented divergent theories about the motive for what took place at a convenience store on Southside Boulevard after Mr. Dunn stopped with his fiancée, Rhonda Rouer, for wine and potato chips.

(CNN) -- Michael Dunn killed Jordan Davis. That's not in dispute, but according to attorneys' opening statements Thursday in Dunn's murder trial, almost everything else is.
Assistant State Attorney John Guy, speaking for the prosecution, painted a picture of four innocent teens who stopped at a Jacksonville, Florida, gas station for gum and cigarettes amid a day of "mall hopping and girl shopping" over Thanksgiving break in 2012. Dunn asked the teens to turn down their music, and Jordan disrespected him, saying "F*** that n****r" -- nothing more -- and for that, Dunn opened fire, hitting Jordan three times.
It was a markedly different account from that of defense attorney Cory Strolla, who told jurors that the music was so loud, it was rattling the windows of the teens' SUV, and when Dunn politely asked one of them to turn it down, Jordan uttered the three-word explicit phrase, demanded his pal turn the music back up and began jawing with Dunn.
