#JodiArias Update 11/6

The motion filed requests two separate issues. One is #Joinder and the other is for an #OmnibusHearing. Let's deal with the easy one first. The Omnibus Hearing on Motion to Dismiss the Death Penalty is the defense requesting an opportunity to present all new and old reason why #JodiArias should not be eligible for the death penalty. Omnibus simply means a multiple of theories will be presented.

As for the #joinder issue, this one can be many different things. My initial thought is the defense is seeking the joinder of the #media attorney in seeking a stay of the proceedings until the COA decision is reached. Nurmi may be seeking some help in not moving forward and presenting their witnesses out of order. It can also be many other things possibly dealing with multiple motions related to the sealed testimony and witnesses. We will have to wait to find out.

There should be a Minute Entry posting today that may give us some insight

OMGosh, could this trial get any more tiresome? It amazes me that there are so many loop holes for JA to slink through. Where does this circus caravan stop? It never runs out of gas and I swear it needs to be stopped. It is absolutely ridiculous and a waste of time and money.

I totally agree. It is pretty stunning. I've never seen a trial so out of control. Somebody needs to hold Nurmi in contempt for refusing to continue, contrary to the overruling court's decision. And someone needs to get this judge off the bench; she's total inept. When will it end, indeed!

Kirk Nurmi has requested to join multiple parties in a motion to dismiss the death penalty, citing the State erred in giving proper notice when seeking the death penalty. On Judge Stephens' docket, two new dates have appeared in January and February of 2015. These dates are related to this multi-party motion.

This is not expected to affect the current retrial penalty phase. Parties will be back in the courtroom Wednesday morning where the defense has been told they had better be ready to have a witness on the stand. Will they comply?

The JUDGE is the one however who is supposed to be keeping some modicum of control. I am with everyone who wishes it could be Judge Judy up there, lol.
I saw someone's tweet the other day who mentioned something I have thought about and wished for a long time; They mentioned how it would be great if only one or several of her colleagues---judges in her district---could take her aside and give her a serious talking to. Perhaps it would have helped. I have no confidence in JSS and I think most seem to now be feeling that way.

I am a kind of glass half full girl… it is my hope that she is giving all of this latitude in an effort to be able to say that there is no reason for an appeal as she was given more than a fair chance … but yes I am very tired of how this trial/circus has been going on and wonder how long they can stall and come up with new and more tedious stalls.

JMO but I have to wonder...is this being done to determine IF she still has an audience, and if she does, how large or vocal is it? Can't claim media interference when the media is not interfering, the audience is sufficiently diminished, and the jury has NOT been impacted.

The latest filings by Squirmy Nurmi have been released, now he's asking for no cameras at all because someone took a pic of Hodi and the mitigation specialist and it was published. He wants to extend the ban on photos of the defense to include DeLaRosa, who is not an attorney. Grasping at straws is what I call it. That poor jury, being jerked around like this.

The motion alleges that a computer forensic expert hired by the defense discovered that thousands of files, mostly of pornography, were deleted from victim Travis Alexander's computer while the computer was in custody of Mesa police.

...Mesa police personnel have testified more than once in Arias' 2013 trial and in her current trial in Maricopa County Superior Court that there was no pornography on Alexander's computer.

I saw the story and decided to pass on it.

This is a case of blaming the victim for causing his own death.
Ugly and immoral accusations, IMO.

JA, according to her assorted male companions, and her own testimony, enjoyed anal sex. SHE was the one into the kinky crap, not Travis. SHE was the poison in the well of which our parents and community leaders worn against; she was the scarlet letter.... even Travis told others she was just too obsessed with sex. I am sure she was offended by the comments there was more to life than... on her back with sex. Hence, she had to strike out and destroy the very person of Travis because he just would NOT play her game the way she wanted it played. She tried so hard, schemed, planned, sneaked about, spread rumors, claimed HIS friends, HIS church, etc., as her own just to try to get... to the top of the "respectable" pile even if it meant playing by dishonest means. And when it did not work, she could not face telling others SHE had been found out and was rejected! She had to destroy him for when she was done with anything in her life, she burnt that bridge... !

The main trial is OVER.
IF an appeal is desired, use the proper court.
Stop trying to mess up the procedure or delay this short trial of sentencing.

When this is all over, NONE of the def attys and persons will be desired to ever work again in this town. They have slunk to new lows...even for an atty.

If the shoe fits, JA, wear at well until it is down at the heels... where you are!

Hi, I am kind of that way too, and I understand all about the appeal and trying to protect the conviction but I do think this judge has gone too far the other way and that some of her decisions have infringed on the right of Travis and his family to have justice.
I do wish that a few of her associates there could have talked to her privately about some of her conduct/decisions in this case. I think it HAS spiraled needlessly out of control both ethically and financially.

I just read the post by Curious Portlander (after this one) with the documentation of the actual motion to dismiss… If indeed there were files that were erased/deleted I would then have to think that there was someone investigating that was aware of the position that Travis had in the assembly and that they wanted to protect that position. That would assume that the person who did this was then part of the same religion that Travis was.. not that this would be impossible, just improbable as doing so would be tantamount to deception and not acceptable in their "culture" These supposed files even if they did contain pornography and even if Travis participated in Lewd and Lascivious behaviour (and I am not saying he did) how does that mitigate the fact that Jodi went to great lengths to plan, act upon and cover up the brutal and horrific murder that she spent hours to get to.. this was not a split second decision.. premeditation only requires seconds but she literally took days .. at any point she could have realized the consequence and became "clear of mind" and not followed through on her plan… I am sorry I truly believe that she needs the death penalty. there is no rehabilitation, there is not a restitution found in housing her the rest of her life. She ended Travis' life and there was no thought as to what he could have accomplished.. why do we give jodi that benefit.. this is nothing more than a "hail Mary pass" by the defence… or a "throw enough s--T against the wall and something is bound to stick" kind of thinking. Usually this would be just my opinion but in this case I should be called trying to make sense of it all!

This is the ugly side of our legal system.

Nurmi and the defense's SOLE PURPOSE is to muck up the system with so much and so often that it comes to a standstill. Using legal techniques - ie, filing motions, has become the weapon of choice. And it doesn't matter how ludricrous the motion is...all motions must be heard and a decision rendered - Nurmi knows this.

Delay is their holy grail and what we've seen so far in the re-trial is only the tip of the iceberg. IMO.

He has got the court by the b*lls. Checkmate.

Is there legal precedence to stop this abuse of a defense strategy? Time will tell.

Within a matter of hours, it was verified that each one of those sites were known viruses called a "Trojan horse" virus. I have doubled checked each site named in the motion with known "Trojan horse" viruses and every one is listed.

Excellent! Good for you! I was just about to post that this latest defense accusation is undeniably FALSE. In the first place, as I was told, all these supposed 'visits' happened in the week AFTER Travis' call to Jodi saying she ruined his life and to leave him alone, and AFTER his murder!!!
In addition to this, these police and the prosecutors office would NEVER EVER have jeopardized a case by destroying evidence of any kind. I think the record shows that the police, prosecutor, forensic people, etc. did their level best to preserve all evidence and to clearly convey what all of it was to the jury. Do you seriously think ANY of them would have jeopardized THEIR CAREERS just to cover up Travis' visiting porn sites? IT'S A MYTH!! This man did not have porn on his computer. The state was unequivocal about that, with several witnesses substantiating it.
This is a case of Jodi again using nefarious and devious methods to manufacture mythical 'evidence' to blacken Travis' name and bolster her heinous accusations against a dead man.
The defense is just desperate enough and sleazy enough to go along with it. Haven't they more than proven that??? We all saw it time and time again in the first trial for Gods sake!
I am not worried about this latest from that smarmy Nurmi; I think that issue will be dispatched soon, and the judge will order them to continue tomorrow with their case.
Honestly this latest Jodi/vis a vis Nurmi filing is so ridiculous that it is not worth the powder to blow it up!

Nurmi is trying to retry the case in chief by insisting it had been "polluted" with dishonesty and illegal activities by the PD and sources attached. He wants this done before the sentencing is concluded, AND he wants to delay the sentencing as long as possible in hopes of tiring the system in favor of his client.

Here is this problem:
Was the computer illegally tampered with by the PD or its affiliates before or after forensics were conducted by the prosecution to produce evidence in favor of the prosecution? IF this was done, then an appeal of the trial in chief is in order and the sentencing would be delayed until the appeals were heard, a mistrial ordered, a new trial ensued, etc..

I checked with a friend who has considerable knowledge of the computer. This is what I was told:
1. Forensics would have copied the computer activity log (the META DATA);

2. A copy of this log would have been provided by the independent forensics company to the prosecution, the PD and to the defense with the original being retained by the forensics' company;

3. If the copy given to the defense (Nurmi) has been hacked or altered, including adding and then deleting information, it would show as a more recent entry; it could possibly be bypassed but that would be difficult as ALL other entries before/after the alteration would be impacted, ie, say Travis used the computer to register a purchase and used a credit card that had NOT at that time been issued with said numbers now showing on the metadata.... or Travis had written a speech on the computer at a specific time and date but the metadata shows he did not do that; the NEW metadata shows Travis was purportedly viewing child porn at that time. So this now becomes evidence of a problem;

4. The biggest problem: When the def claims the computer had erasures outside the normal ad deletion while browsing, ALL the other copies and the original would be identical in reporting this. IF the def copy varies, it is the def copy which has been altered.
