Hernandez attorneys ask judge to throw out phone call evidence

Attorneys for former New England Patriots star Aaron Hernandez are asking the judge in Hernandez’s murder trial to throw out recordings and transcripts of a number of Hernandez’s jailhouse telephone calls, including two calls in which he spoke to NFL player Michael Pouncey.

The attorneys said in a motion filed Wednesday that the statements made by Hernandez, who is on trial in Bristol Superior Court for a 2013 murder in North Attleborough, were “innocuous remarks to friends and family.”

“The telephone calls are irrelevant, prejudicial, and constitute inadmissible hearsay that does not fall within any relevant hearsay exception,” the defense attorneys said in a filing.

IMO, the limited amount of time I have spent reading this trial, it appears the STATE is pandering the case into a mistrial....Judge is catering way too much for the defense.

Very interesting thoughts, Freckles.

I know for a fact that the Assistant District Attorney, William McCauley, have appealed some of the judge's ruling in this trial and wanted her to recluse herself from this case because of some disagreements between the two of them in a previous trial. But I also know the judge, E. Susan Garsh, has denied nearly every one of the motions to suppress evidence the defense have filed during the trial. I actually think that she has made some rulings against the defense that can open the door to an appeal if Hernandez is found guilty.

Aaron Hernandez splashed in the swimming pool with his young daughter less than 12 hours after Odin Lloyd’s slaying.

Jurors in Hernandez’s murder trial on Thursday watched more than an hour and 20 minutes of video from June 17, 2013, that was captured by the NFL star’s home surveillance system. And in it, they saw Hernandez and two alleged accomplices, Carlos Ortiz and Ernest Wallace Jr., hanging out in his basement, playing with his baby, lounging around his pool, and sitting at his kitchen table.

At one point, Hernandez handed his daughter, then 7 months old, to Wallace. In all of the footage, Hernandez and his two alleged accomplices appeared relaxed.
