NBC NEWS - The jury began deliberations Wednesday in the Aurora theater shooting trial after two-and-a-half months on testimony. The three year anniversary of the shooting is Monday, July 20.

James Holmes is accused of killing 12 people and injuring 70 others after opening fire on a crowded movie theater during a midnight knowing of "The Dark Knight Rises." His defense team says he was insane at the time of the shooting. He faces 165 counts.

Theater shooting jury's questions reveal focus on expert psychiatrists' evaluations of James Holmes

Their request for a guide or index was denied.

"It’s not appropriate for the Court to instruct the jury as to how it should evaluate the evidence, or to provide any type of guide or roadmap," said 7NEWS legal analyst and attorney Rick Kornfeld. "The jury has a lot of work to do, and unfortunately for the jurors, they must work through the evidence on their own without any help or guidance from the judge."

Their third note revealed what they were looking for.

Jurors are tasked with deciding if the shooter is guilty or not guilty by reason of insanity, and that third note reveals they are targeting their inquiries to the mental health examinations that are at the core of this case. They asked specifically if the notes or reports from psychiatrists who testified as court experts are available to them during deliberations.

District Court Judge Carlos Samour had to inform them that those documents were not admitted as case evidence. Therefore, the jury will need to rely on their memories or notes from the doctors' testimonies.

"Expert reports remain hearsay documents and generally are not admissible since the experts have testified in court and are subject to cross examination," Kornfeld explained.

For me, the question is whether his brain was sufficiently altered/influenced (by what ever factors inherent internally or environmentally) to render his thinking either improbable or unable to resist. Did he need drugs? Why the delay in obtaining the drugs IF he really needed them? And, if needed and delayed in receiving medication, why was he not followed more closely? I believe he DID know the difference between right and wrong but IF he committed these shootings, I would question his ability to control his actions.

I would think so.
The government has been working on mind control of the masses since at least the 1950s when they tacitly approved Dr. Timothy Leery's LSD "banquets" up at Big Sur... Oddly. Leery was NEVER arrested for the distribution of drugs or influencing minors despite it being a felony at that time.

Here’s what Holmes recalled about two years after the shooting to court-appointed psychiatrist Dr. William Reid. The victims were “numbers,” Holmes said in a taped interview, “a conglomerate mass.” Not people, but things.

“I knew it was legally wrong,” Holmes said. “You get punished for killing people.” But his victims, he told Reid, were “not real people. It was just kind of amorphous people who were going to get hurt.” He said that killing strangers this way increased his own personal “value.”

“If you take away a life, it adds to your own value.” He said anything his victims were or had accomplished, “gets canceled out and given to me.”

That’s insane. And if at least one juror believes that, then he could be deemed innocent due to his insanity.

However, because of who sits on the jury, that seems highly unlikely.  For each juror to be chosen to this panel, they had to guarantee they would impose the death penalty if all the needed criteria were met by the state. It seems to me that someone who has no problem with the death penalty would almost certainly have a less-flexible, less-tolerant standard for what constitutes being insane. My guess is that most, if not all, of these jurors will buy Brauchler’s argument that Holmes is a mentally ill psychopath, but not an insane schizophrenic.

This is a really good article, AD. Thank you for posting it.

I have to say that I agree with the author on many of his points. JH's "human capital" delusion and the idea that killing someone cancels out all that they have accomplished and gives it to him is a pretty insane delusion. But, it does not meet the standard for legal insanity, IMO. Like the author of the aforementioned article, I do not think that I can stomach a not guilty by reason of insanity verdict. I am hoping the jury finds him guilty. I am also hoping that JH is sentenced to LWOP instead of the DP. I know that this might be an unpopular position with some because JH's crime was absolutely horrible and others have received the DP for less. I also know that many of the victims/families would like for JH to receive the DP. However, while I believe that JH is legally sane and knew what he was doing was wrong, I also cannot dismiss the fact that he is quite mentally ill. JH told Dr. Reid that the DP was not looking so bad now that he has come to the realization that being in jail is really boring. Well, for that reason I would like to see JH sit in prison for the rest of his life being bored. Hopefully, he will in time come to realize that his "human capital" delusion is a delusion and then have to come to grips with the senseless death and terrible injuries that he inflicted on other persons all for a ridiculous, selfish bid to increase his own self worth. If he is given the DP then he will likely die still believing that his actions were justifiable and worth it to him.

At 1:23 p.m. on Thursday, public information officer for the Colorado Judicial Branch Rob McCallum tweeted the jury had reached a verdict and that it would be read at 4:15 p.m.

There are 24 murder counts for 12 victims. Each murder is being charged twice, under two different legal theories: "with deliberation" and "extreme indifference."

If Holmes is convicted, the trial will enter a sentencing phase in which the jury must decide between life in prison or the death penalty.
