Defense Brady presenting mitigation witnesses:

Dr. Jeffrey Metzner
Has testified before, June 8th. Prosecution witness then.
Looking at his resume. Psychiatry. Forensics psychiatry. Works with state mental hospital. He was qualified for psychiatry and forensic psychiatry.

He had not met any of the attys before. Appointed by court. Court requested an expert and he was referred. He is paid by the state hospital. Judge gave him the instructions to evaluate JH for mental disease or defect. That is what will be discussed today.

Witness believes JH suffers from mental illness on the day of the shooting.
He has reviewed tens of thousands of documents relating to JH and interviewed JH directly. After he testified, he has continued to review the documents and discuss with others, including JH's parents. It is his opinion JH suffers from a serious mental illness currently, before the shooting, during the shooting. Said he has a mental disorder with reality, a psychotic disorder with functional dispairments.( Dr. names many mental illnesses I can't spell!)

Said JH is genetically loaded. Both grandfather and a maternal aunt have been hospitalized and treated for mental illness.

(Said JH suffers from lack of motivation.... huh???)

IF you are delusional, it is a psychotic condition.
He believes he is delusional. Said Dr. Fenton had same concerns.
Said the notebook and email chat were important to him.
Said it showed he has psychotic.
(Everything is "very important" according to this doctor...!)

Re jail cell vid:
Dr. said it showed JH with a serious mental illness; smearing of feces is either not mentally ill but doing it to annoy; the other types is a mentally ill person. Dr. feels it was mental illness; same with licking of the walls; somersaulting with cup balanced on his penis.

He found others in the field also believed JH was psychotic.

He said anti-psychotic medication corrects some of the imbalances to put illness into remission or make it less apparent. Medication is not a cure; it controls symptoms, not people. Varied results. JH did not difference between right or wrong but the delusional thinking attributed to his actions of July 20th.

Hatred of mankind played a minor role. Had it for a long time. Developed a delusional belief that drove him. Need for notoriety had nothing to do with the event. JH was mentally ill and not driven as desire for attention. Break up with gf had nothing to do with this. There are a number of triggers that could have set it off; break up with gf, graduate school would help him; performance in grad school could have triggered it... might not have triggered it. Doctor does not believe ANY of those were triggers but could have triggered the psychosis of delusions and that was the cause.

Why now? From convos with Dr Fenton: No clue.
JH said he lost his fear once he started seeing Fenton, Zoloft caused him to experience manic feelings and got courage to act out. Felt the symptoms made him worse. Dr. said the delusion was not due to Zoloft but JH may have felt worse for a time.

Dr. says he is more than shy or introverted buy more autistic.
Can't compare mental illness between people but there is a commonality.
Perhaps, hearing of voices... but the content, range, and frequency is different.

JH was very disturbed by his delusions. He was attempting to resolve this with his graduate work, according to the doctor. Feels JH is very intelligent.

Mitigating factors:
JH's actions were directly related to mental illness.
Narrow definition of knowing wrong/right....
Causation not sanity issues.
Mental illness impaired his actions despite knowing difference between right and wrong.
Impairment of someone with Alzheimer is not aware of his level of impairment...
same as with JH.

Judge to court explaining Juror 673 is not a deliberating juror...so judge feels it is okay to keep her. He states he did not tell the alternates to NOT read/hear info on this trial or any other trial. So. Judge feels the juror did NOT violate any of his instructions since he did not give her instructions...

The Latest: Colorado Shooter’s Father Noticed Changes In Son

CENTENNIAL, Colo. (AP) — The latest in the sentencing phase of the Colorado theater shooting trial:

5:15 p.m.

The father of Colorado theater shooter James Holmes says he noticed his son had an odd facial expression about seven months before the attack, and he was reminded of it later when he saw his son’s mug shot.

Robert Holmes testified Tuesday that in December 2011, he noticed his son smiling, grimacing and smirking, and having a hard time making eye contact. Immediately after the testimony, the defense showed the mug shot of James Holmes smirking.

Robert Holmes says he has seen James Holmes in jail only three times because his son typically does not allow visitors. During his first visit, Robert Holmes said his son “was clearly really messed up” with his eyes bulging and his pupils dilated.

The father of Colorado theater shooter James Holmes isn’t showing much emotion as he testifies in an effort to spare his son from execution.

Robert Holmes has been answering questions briefly Tuesday and occasionally looking over at his son. Neither father nor son has smiled at each other.

Arlene Holmes, seated two rows behind her son, hasn’t visibly reacted to photographs and videos showing her family’s holiday gatherings, soccer games and trip to Disneyland.

Some of the images have elicited chuckles from the courtroom but not from the victims’ portion of the gallery. Unlike previous days, it is largely empty.

A jury is considering whether James Holmes should serve life in prison without parole or be executed for the July 20, 2012, attack that left 12 people dead and 70 injured.

Lawyers for Colorado theater shooter James Holmes are showing images of him as a baby and a young boy as his father testifies in an effort to save his life.

Robert Holmes said Tuesday that he still loves and supports his son, who was an “excellent kid.” He has attended every day of his son’s trial along with his wife, Arlene, but this is the first time he is testifying.

CENTENNIAL, Colo. (AP) – James Holmes came home on winter break from graduate school looking haggard and making odd facial expressions, but his father didn’t suspect at the time that he was descending into mental illness.

Months later, Robert Holmes recalled that look when his son flashed a wide-eyed smirk in a jail booking photo after opening fire on the audience in a darkened Colorado movie theater, killing 12 people and injuring 70 others.

District Attorney George Brauchler pointed out while cross-examining Robert Holmes on Wednesday that the bug-eyed, smirky mug shot wasn’t taken immediately after his arrest, because his hair was no longer comic-book red. Brauchler suggested that Holmes could have been posing to make himself appear crazy.

Robert Holmes deflected Brauchler’s suggestions, saying he didn’t know anything about how the photograph was taken.
