Judges take skeptical tone over Aaron Hernandez’s cellphone

A legal battle over Aaron Hernandez’s cellphone has the state’s top judges questioning just how far the attorney-client privilege goes and whether potential evidence handed over to a lawyer should be protected forever.

At least two Supreme Judicial Court judges seemed skeptical yesterday about Hernandez’s argument that his phone — which may have evidence relating to the 2012 Boston double murder he stands accused of — should be kept from prosecutors because he handed it to his attorneys for legal advice.

“We’re talking about getting your computer to your lawyer fast if you’ve been committing crimes on it,” Justice Robert J. Cordy said.

FALL RIVER — A jury is now deliberating whether an associate of Aaron Hernandez was a willing participant with him in a 2013 murder in the North Attleboro Industrial Park or just an obedient friend along for the ride.
 
The jury heard both versions of Ernest Wallace during closing arguments Wednesday in his murder trial after eight weeks of testimony in Fall River Superior Court about the June 17, 2013, slaying of Odin Lloyd.

Much of the testimony and evidence was the same that was used to convict Hernandez last year. The former New England Patriots football star is now an inmate for life without parole who is still awaiting trial for a Boston double murder in 2012.

Prosecutors allege Wallace, 44, of Bristol, Conn., was part of the plan, and accompanied Hernandez to pick up Lloyd, 27, at his Boston home and drive him back to a secluded spot in the industrial park about a half-mile from Hernandez’s $1.3 million Westwood Estates home in North Attleboro.

FALL RIVER — It was “Aaron Hernandez and Aaron Hernandez alone” who killed Odin Lloyd, said a defense attorney representing the former NFL star’s former right-hand man.

“Whatever caused Aaron Hernandez to violently and brutally execute Odin Lloyd was everything to do with Aaron Hernandez and nothing about Ernest Wallace,” attorney David Meier said during closing arguments Wednesday morning in Fall River Superior Court.

Wallace, 44, a quasi-homeless man who often stayed in a basement in Hernandez’s North Attleborough mansion, has been on trial for murder since mid-March. He was charged in a joint venture case where prosecutors allege he knowingly participated in the June 17, 2013, fatal shooting of Lloyd in the North Attleborough Industrial Park.

Ernest Wallace, who was with Aaron Hernandez the night the former NFL star shot and killed Odin Lloyd, was found not guilty of murder. Wallace was, however, found guilty of being an accessory to the murder of Lloyd.

Wallace, who has been jailed since June 2013, was immediatley sentenced to 4½ to 7 years in prison. He will be credited with time served, meaning he could be out as soon as next year.

The verdict, handed down Thursday by a jury of 12 who began deliberations Wednesday, is a victory for Wallace.

An associate of former New England Patriots player Aaron Hernandez was acquitted of murder Thursday in the 2013 slaying of Odin Lloyd, but he will remain behind bars because he was convicted of a lesser charge.

A Bristol Superior Court jury cleared Ernest Wallace, 44, of first-degree murder, which would have carried a life sentence, after a 10-week trial and about eight hours of deliberations over two days. He was convicted of being an accessory after the killing for helping to cover it up and sentenced to 4 1/2 to 7 years in state prison.

FALL RIVER — The last of Aaron Hernandez’s codefendants in Bristol County may not go to trial.

According to court records, prosecutors and attorneys for Carlos Ortiz have scheduled a change of plea hearing for June 27 in Fall River Superior Court. Two status review hearings previously scheduled for this month have been cancelled.

Contacted by phone Friday, Ortiz’s lawyer, John J. Connors, confirmed that the parties are discussing a possible plea deal, but he declined to say what Ortiz may plead to.

NORTH ATTLEBORO — There might not be a trial for a friend of former New England Patriot Aaron Hernandez charged along with Hernandez with the murder of a man found dead in the North Attleboro Industrial Park in 2013.
 
Carlos Ortiz is in talks with prosecutors to reach a plea deal, rather than take the case to trial.

Court records indicate a change of plea hearing for Ortiz has been scheduled for June 27 in Fall River Superior Court.

A friend of former New England Patriots star tight end Aaron Hernandez pleaded guilty on Monday to accessory after the fact for helping the NFL player after he shot a man to death in 2013.

Hernandez was convicted in Massachusetts last year for the June 17, 2013, killing of Odin Lloyd, who was dating his fiance's sister. He is serving life without the possibility of parole, although has said he intends to appeal.

The reason for the killing remains unclear. At the time, Hernandez had a $40 million contract with the Patriots.

Carlos Ortiz, 30, of Bristol, Connecticut, changed his plea to guilty on Monday in Bristol County Superior Court in Massachusetts as part of a deal with prosecutors, who dropped murder charges against him. He was sentenced to 4 1/2 to 7 years in prison.

Ortiz and Ernest Wallace were with Hernandez the night of Lloyd's death. Prosecutors used surveillance video and other evidence to show that the three men traveled to Boston together, picked up Lloyd, and then brought him to a deserted industrial park near Hernandez's home. He was found shot to death at the park hours later.

Both Ortiz and Wallace were initially charged with accessory after the fact and later charged with murder. Wallace was tried earlier this year and convicted of the accessory charge, but found not guilty of murder. He also was sentenced to 4 1/2 to 7 years in prison.

During Monday's hearing, Superior Court Judge Susan Garsh led Ortiz through a series of questions asking whether he understood the changes and understood the consequences of a guilty plea...

Jose Baez, whose name you might from when he represented Casey Anthony back in 2011, is the attorney for Aaron Hernandez as his double murder trial inches closer (the trial gets underway in February next year). But it got off to a bit of an inauspicious start when, during a hearing to set the date for the trial, Baez accidentally referred to his client as "Aaron Rodriguez" before the judge.

Aaron Hernandez's attorney is forced to give up cell phone for prosecutors to examine for evidence in the ex-Patriots star's double murder trial


".... Prosecutors will be allowed to examine a phone owned by former NFL star and convicted murderer, Aaron Hernandez, for possible evidence in his upcoming double murder trial, the Supreme Judicial Court in Massachusetts ruled Friday.

The former New England Patriots tight end gave the phone to his former attorney in 2013 when he was being investigated in the killing of Odin Lloyd.

He's since been convicted in that case and is serving a life sentence.

In its ruling, the Supreme Judicial Court found that once Hernandez's attorneys downloaded the contents of the phone, they had 'no legitimate purpose' for keeping it. ...."


"....Hernandez, who showed up in court Tuesday laughing and joking, with his gang-linked neck tattoo displayed, is now awaiting trial in the 2012 killings of two men, Daniel de Abreu and Safiro Furtado, whom he encountered at a Boston nightclub.

Prosecutors say Hernandez was angry that one of the men accidentally bumped into him at the club and caused him to spill his drink.

Hernandez is also accused of shooting and wounding a friend, Alexander Bradley, to keep him from talking about the killings. ...."

BOSTON (AP) — Former New England Patriots player Aaron Hernandez will stand trial early next year in the 2012 fatal shootings of two men outside a Boston nightclub, a crime prosecutors say was prompted by Hernandez’s rage over a spilled drink.

A judge set the Feb. 13 trial date Tuesday after Hernandez’s new attorneys said they could not be ready by this fall.

Hmm, wonder what old AH had to say in those calls? And, dang, when is he going to finally go on trial for the Boston murders?

How do we know AH did not blab info re the case to another inmate ?
When the inmate got out (or had a visitor) the inmate told someone to get the info to media?

To cover his butt and seeing opportunity knocking, AH now makes claim the phone was hacked...

Not a surprising, if true. The degree of smugness on AH's face irritates me every time I see his picture. He looks as if he never has a bad day. Makes me wonder if his pride is so great that he pretends he doesn't mind being in prison, or, if he is just so completely stupid that he actually doesn't mind being in prison? Never mind, I'm pretty sure I know the answer...

He thinks he is king of the #hithill. Like he is some big,bad dude or something because he could "own" another person's life and death. And get paid millions for doing it!

I prefer owning someone with quiet little deeds that bring smiles and warm fuzzies...
too easy the other way.

"....The Massachusetts Department of Correction describes the two inmates as high-ranking members of two gangs in the prison.


Corrections officers were trying to secure the inmates in their cells, but another fight broke out and the remaining inmates refused to return back to their cells.

The officers were then pulled out of the unit, leaving the inmates who then started destroying the unit.

'There are some first and second degree murderers in that unit,' said Department of Correction Commissioner Thomas Turco on Monday night. 'It was a riot, yes.'

Officials say the inmates broke off sprinkler heads and also destroyed camera and computer systems. ...."

Former New England Patriots star Aaron Hernandez is set to go on trial next month for a 2012 double murder

On Tuesday, a Suffolk County, Massachusetts judge ruled that prosecutors could use Hernandez's tattoos as evidence in the trial

The first tattoo shows a six-shot revolver with five bullets in the cylinder and one empty chamber next to the words 'God Forgives'

The second tattoo shows a semi-automatic pistol and a spent shell with a wisp of smoke coming from the casing

Prosecutors say the first tattoo is in reference to the 2012 double murder

They say the second one is a reference to a 2013 incident, in which he shot another man in the face

That man, former friend Alexander Bradley, is expected to testify at trial
Hernandez is currently serving a life sentence for the 2013 murder of Odin Lloyd

Hernandez's attorneys are trying to get the text messages he sent to his agent after the double murders thrown out, on the basis of attorney-client privilege, but the judge has not ruled on that issue yet. ...."

I don't understand why the surviving witnesses cannot identify AH as the shooter. Do any of you know the answer?

I don't know. Could be he did not see him, has a mental block, or is afraid?

I find it interesting the use of "letting the tats tell the story" because one tat leads to another.... and he has an entire crime playbook written on his arms and his neck. I can' wait until the tats all degrade into one carpet of smudged black... No message to be read but an arms' length of his has beens....
