There has been talk of jury members emailing/talking to friends during the trial. I don't know what will come of this. I think Judge Bronson was made aware of it, but apparently he felt it wasn't a concern, if there was one to begin with.

Its as if the odds were stacked against Ryan from getting a fair trial! Sure, the State has the burden of proof but should they be able to make that burden so heavy that the defendant can't lift it off of himself? I couldn't believe that the defense could not tear apart what one of Ryan's accusers, Braley, dug up against him. This was the most lop-sided trial I have ever seen or heard.

Sherry, I truly disagreed with Judge Bronson's ruling on Braley in this third trial. Braley sat at the prosecution table in trial 1 and 2. And he's still employed..........

LEBANON — The jury in the Ryan Widmer trial based its decision to convict the Warren County man based on the dry bathroom scene found and his fateful 911 call, a juror said.
The juror, who asked not to be identified, said she also based her decision on the fact that Widmer didn’t testify. The jury was cautioned numerous times by the judge that Widmer had a Constitutional right not to testify.
It was a tough choice for the jury, according to the woman.
“It was the hardest decision any of us ever had to make...,” she said. “We tried every way to find excuses for Ryan and there was none.”
The juror said they went witness by witness, all 44 who testified, and dissected everything before they took one vote — guilty of murder.
“I couldn’t say there was any particular credible witness,” she said. “The fact that we couldn’t hear Ryan’s side of the story was bad.”

Thanks for the video of the 911 call, Piper.
One thing that really stood out to me was that Ryan made the comment, "She falls asleep in the bathtub all of the time." (not verbatim)
I wonder what Peter Hyatt, Statement Analysis, would have to say about this 911 call, especially the above statement. It was not necessary for Ryan to throw that comment in.

Also, it's being said that at least one of the jurors posted on Facebook Sunday night. The judge asked them to refrain from using Facebook, and definitely prohibited researching the case on line.
Hmmm....it will be interesting to see where the "Ryan not testifying" statement will go!

HAMILTON TWP. — Officials here agreed to hire an independent attorney to further probe the alleged fraudulent records in the personnel file of the lead detective in the Ryan Widmer case.
A day after Widmer was found guilty of murder, township trustees voted Tuesday night to hire attorney Doug Miller of Donnellon, Donnellon and Miller to start an independent investigation into the alleged fraudulent records in Lt. Jeff Braley’s file.
“He will review all the disputed documents and interview any witnesses or employees that he thinks appropriate, to determine whether or not there should be a pre-disciplinary hearing for Lt. Braley,” Law Director Warren Ritchie said.
Since Braley is a union member, the township has to follow the proper channels, such as the pre-disciplinary hearing.
In January, a brief report was issued by forensic scientist Rebecca Barrett of the Ohio Bureau of Criminal Identification and Investigation. She noted she inspected Braley’s files and compared them to his confirmed signature.
Barrett confirmed it was Braley’s signature, but said “a lack of evidence does not prove that only one ink pen was used or that no alterations could have occurred.
Ritchie said the BCI finding prompted trustees to take the next step.
“They would be remiss if they didn’t follow up to determine whether in fact those documents were misstated by Lt. Braley and if so, whether that’s a matter for disciplinary action,” Ritchie said.
Braley said despite what the BCI report says, he believes someone is out to get him and did tamper with the documents. He has said in the past he believes the documents were pieced together.

Thanks Sherry.......I notice they also are using his original date of 04/06/2009 for admission from the first trial in that first section. Then further down they post the 2/16/11. He served about 5 1/2 months I think the first time.

2025-that's 14 years away but I am praying for another mistrial and that the new prosecutor will drop the case. I saw a poll on one of the news sites posted here at RC yesterday that showed that the majority of the people think Ryan is innocent.
2025-that's 14 years away but I am praying for another mistrial and that the new prosecutor will drop the case. I'm on my knees too...This young man has been in my prayers for a while now...I feel that somehow there will be a mistrial proclaimed...at least I hope there will be...The jury should be scrutinized, as to their texting, e-mail and blogging if they did so...Surely the contents of which can be found...

But Widmer’s lawyers have no recourse unless they can legally substantiate that jurors disobeyed orders, experts say.
Even so, the topic is worthy of public debate, “because we’re seeing an increasing trend of jurors disregarding judges’ simple instructions,” says attorney Mike Allen, a former Hamilton County prosecutor and municipal court judge.
Judge Neal Bronson clearly explained to the jury during Widmer’s 17-day trial:
• The defendant doesn’t have to prove he’s innocent; he’s presumed innocent and the prosecution must prove his guilt “beyond a reasonable doubt.”
• The defendant’s decision not to testify cannot be considered for any purpose.
• “Murder” is an intentional killing while “involuntary manslaughter” would be an assault that unintentionally caused a death.
Yet one juror, quoted by WKRC-TV, Channel 12, said, “It’s just the evidence, to us, did not prove innocence.”
Another juror, quoted in the Western Star, a Warren County newspaper, said: “The fact that we couldn’t hear Ryan’s side of the story was bad,” indicating he should have testified.
The Enquirer quoted a juror who said, “We think something happened and he just snapped,” a scenario that defense lawyer Mark Krumbein says appears to fit the legal definition of involuntary manslaughter, not murder.
Widmer’s jurors were given involuntary manslaughter as a choice, at the prosecutors’ request. That charge is less serious than murder and would have carried a maximum five-year prison term rather than 15-to-life.
After two mistrials, Widmer, 30, was convicted of murder Tuesday in the 2008 drowning of his wife, Sarah, 24.

I can't believe there won't be a mistrial, there are 2 jurors that said that one of the reasons they found him guilty was because he didn't testify.. If there isn't, I will have lost all confidence in the justice system. I will say again, I don't know if he did it, but I do know there is reasonable doubt all over this case. And I watch one of the jurors on T.V., now mind you, I am not trying to be judgmental of this lady, but she didn't seem to be the sharpest tool in the shed. She did speak well and I think she got caught up in the hype and just went along with what ever the other jurors said, but that is just my opinion..

Hi mel! I agree, no one knows what happened in that bathroom, but I think reasonable doubt is all over the place, just my opinion! Too many unanswered questions on how young Sarah died......tragic situation all the way around for everyone involved.

Piper, I have never supported someone who has been accused of a violent crime. I have always thought that the justice system works. However, in the last few years I have seen some great injustices happen in this county. I am going to buy a tee shirt just to support this kid's cause. Like I said, I have never supported someone who has been accused of a crime like this but the old saying goes "it is better to let 9 guilty men go free than to convict one innocent man" If I would have been on that jury, we would still be sitting there because I would have refused to be swayed into voting guilty. I am shocked how many supporters he has and yet they were able to convict him... And I am so happy that we have this forum to discuss it!!!!

Sherry, I hope he will be in Lebanon too, so his family can visit him. Now I have heard that he has a child on the way.. I don't know if that is true but if it is, it would be nice for him to be close enough to see the child. Of course people are judging him about that as well, but how long is acceptable before it is "ok" to go on with your life. I think it probably wasn't smart to have a child when you have a murder charge hanging over your head but I think he truly thought he would be found not guilty.

Mel, your words "violent crime" speaks volumes in this case. I just don't see where the state proved Sarah died from a violent crime.....there were no defense wounds, whether it was in the bathtub or the toilet. There would have had to have been signs of a struggle, and it's just not there, as far as what's been presented. It's just never made any sense to me......

mel, I'm with you and Piper concerning Ryan being falsely accused, and of a violent crime at that. As for his child, if the rumor is true, it may have happened due to this woman bringing Ryan a great deal of well needed comfort rather than him believing he would be found not guilty. I was taken aback by those who thought it didn't make Ryan look good having a relationship with the two women who testified at his last trial. So what? He was hurting and had the whole State of Ohio against him and accusing him of a horrible crime. Why couldn't he talk to those who upheld his innocence? Its as if there was some rule book on how one should react in a 911 call, and look in a courtroom, and behave after the death of one's spouse and Ryan did not abide by one rule so he's guilty. I can see, to an extent, where one's behavior could scream guilt, but I did not see that in anything Ryan did or didn't do according to some people's rule book. I saw innocence and the reactions of an innocent man.
On a somewhat side note: I've been so cynical of the justice system lately that I fear that Drew Peterson, one who, imo, is guilty of the bathtub murder of his wife, Kathleen Savio, will go free as not guilty. Ryan, an innocent man is incarcerated while Drewpy goes free....~humph~

LEBANON, OH (FOX19) - Ryan Widmer's defense team has filed a motion for a retrial, alleging one of the jurors made a bias statement and should have been removed from the jury.
Widmer, 30, was found guilty of murder on Feb. 16 in the drowning death of his wife, Sarah.
A motion filed by defense attorneys Jay Clark and Lindsey Gutierrez alleges they received phone calls from family members of one of the jurors, "D.E." during the second day of the trial. The family members said D.E. had visited her best friend, "S.L." a few days before the trial began, telling her, "Don't worry about the Widmer case, we have all talked about it and we know he is guilty. He (Ryan Widmer) is going to rot in hell."
The defense team brought this statement to the court's attention, and D.E. was brought into the judge's chambers. She said her only recent conversation with S.L. had been about S.L.'s health, and that S.L. had asked about the trial, but D.E. said she wasn't allowed to say anything.
D.E. was dismissed from chambers and an instruction was given to the rest of the jurors regarding anyone approaching them about the case or speaking to anyone about the case.
The court determined D.E. would remain on the jury because she was honest about her conversations and had not made the statement.
The same week, defense attorneys sent a private investigator to talk to S.L., who told them she and D.E. were like sisters, and that D.E. was the executor of her estate. S.L. denied that D.E. had made the statement, but she had told her the jurors were able to go out for lunch and they would probably be sequestered during deliberations, which had not been discussed with jurors in open court.
The motion alleges that D.E. lied about the nature of the relationship with her best friend, so, "it is difficult to believe she was honest and sincere about the statement."

Thanks for the updates, Fysty. I have a feeling he won't get a new trial, just my opinion. While I don't know if Ryan drowned Sarah, I feel he didn't receive a fair trial. I know the state of Ohio doesn't have to prove a motive, but they tried to do that and it made no sense. I don't see a motive and it appeared to me, after following three trials, that Sarah didn't fight being drowned. There were no defense wounds, again...it just doesn't make sense to me.

Widmer's lawyers say they have reason to believe a juror may have been dishonest when Bronson questioned her about her alleged mid-trial statement to a friend: "Don't worry about the Widmer case. We have all talked about it and we know he is guilty. He is going to burn in hell."
The juror denied making the remarks, so Judge Bronson took her at her word. He rejected defense lawyers' request to have her kicked off the jury and replaced with one of three alternate jurors.
When told about a posting by the "burn-in-hell" juror on her personal Facebook page, Krumbein said, "That sort of adds fuel to the fire."
The juror's Facebook entries had been visible to anyone who typed in her name.
On Jan. 10, after being notified she was a potential juror but before the trial started Jan. 18, she posted a comment that her legs were tired from walking, so she "took a bath in a tub so big you could easily drown."
For a potential juror in an alleged bathtub-drowning case to make such a remark may not have directly violated any rules, but it doesn't look good, Krumbein said.
