DECATUR, Ga. -- Andrea Sneiderman pleaded not guilty to all charges against her during a new arraignment Friday.

Sneiderman faces 15 charges, including perjury stemming from statements she made on the witness stand in the trial for her husband's murder.

Hemy Neuman was found guilty and sentenced to life in prison without parole for the November 2010 shooting death of Rusty Sneiderman.

It seems if the coople has money and kids and a murder happens it is all over the news. But if both sre poor and the kids are grown it was by the way side, Glad we are poor and the kids grown ad both od our old jeep are paid for cause you will never know my and my husbands name and we will just die in pease. These people need to confess and get it over with cause there are so many others out there that need more attention. I am watching this one too but they keep adding too many more players.

The 9 a.m. arraignment hearing before DeKalb Superior Court Judge Gregory Adams was over before 9:30 a.m., with her plea talking about 3 minutes.

The rest of the time was taken up with a motion to add Dunwoody attorney Esther Panitch to those lawyers who are under a court-imposed gag order and a discussion involving when the lawyers on both sides would get to view discovery items and would exchange witness lists for the trial.

A DeKalb County grand jury re-indicted Sneiderman last month on the 16 counts in connection with her husband Rusty's death—seven of them for perjury, four for allegedly making false statements and one each for malice murder, felony murder, aggravated assault, hindering the apprehension of a criminal and concealment of material facts.

Sneiderman’s defense attorneys waived having the 16-count indictment read in court Friday and entered the plea of not guilty. Judge Adams then gave both the defense and prosecution attorneys 10 days to file any motions of response and set a hearing time for any new motions of April 4 at 1:30 p.m.

Sneiderman Drops Civil Suit Against Brother in Law

But she can refile her claim against Steve Sneiderman in six months if she chooses

Andrea Sneiderman dropped a civil suit on Monday against her brother-in-law regarding statements he made that implicated her in her husband's shooting death, according to the AJC.

Sneiderman was claiming libel, defamation and slander, among other things, against Steve Sneiderman, brother of her late husband, Rusty Sneiderman, who was shot to death outside a Dunwoody preschool in 2010.

On Monday, Andrea Sneiderman's claim were dismissed without prejudice. That means Sneiderman has six months to refile the counterclaim, if she chooses.

Attorneys for Andrea Sneiderman on Monday filed a motion to dismiss 13 of the 16 counts contained in a reworked indictment against their client, arguing prosecutors failed to specifically address allegations she lied to police and concealed evidence that could have led to the capture of her husband’s killer.

Rusty Sneiderman was fatally shot in November 2010 by his wife’s boss, Hemy Neuman, who was sentenced to life in prison last March. Andrea Sneiderman has denied any involvement in her husband’s death.

According to the Dunwoody widow’s lawyers, the seven perjury counts against her are “vague, uncertain, indefinite and devoid of the specificity required by the due process clauses” of the state and U.S. constitutions.

DEKALB COUNTY, GA (CBS ATLANTA) - Lawyers for Andrea Sneiderman, accused of conspiring to kill her husband, have asked a DeKalb county judge to consolidate or dismiss some of the charges against her.

John Petry, a lawyer for Andrea Sneiderman, said many of the counts against his client are too vague.

"The indictment fails to notify her what she is alleged to have done," Petry said.

The charges, especially those of perjury and making false statements, are not clearly worded, preventing Sneiderman's legal team from forming an adequate defense, Petry said.

Sneiderman's legal team claimed some of the charges are too vague during a hearing Thursday.

Prosecutors claim Sneiderman plotted with Hemy Neuman to kill her husband Rusty outside a Dunwoody daycare center in 2010. Neuman was found guilty last year and sentenced to life in prison without parole.

An additional hearing was scheduled for Apr. 10 at 1:30 p.m.

Logs chronicling phone calls and texts between Andrea Sneiderman and her boss on the day of her husband’s killing were erased from the Dunwoody widow’s blackberry, an investigator with the DeKalb County District Attorney’s Office testified Wednesday.

Conversely, investigator Mark Potter said calls and texts to and from Hemy Neuman before Nov. 18, 2010 — when Rusty Sneiderman was gunned down outside a Dunwoody daycare facility — had not been deleted from Andrea’s handset.

DeKalb District Attorney’s Office investigator Mark Potter testified April 10 that phone calls and text messages between convicted murderer Hemy Neuman and Andrea Sneiderman on the day her husband was murdered were erased from Sneiderman’s Blackberry handset.

A record of the calls does exist, however, in logs kept by AT&T, Potter said during the continuation of an April 4 hearing on a defense motion to have 13 of the 16 counts of the new indictment dismissed against Sneiderman, principally on the basis of lack of specificity in the charges.

Assistant District Attorney Anna Cross said the AT&T logs do not show exaction when the calls and text messages were deleted, nor does the handset. Cross also told the court that Sneiderman concealed her relationship with Neuman and her concern that Neuman shot her husband, Rusty, consistently during interviews with police on Nov. 19 and 24, Jan. 4 and 5 and during the entire period between.

Judge Adams gave attorneys on both sides 10 days to file written arguments to the court and said he will take it under advisement and rule on the matter shortly after the 10-day filing period.

The attorneys for a Dunwoody widow implicated in her husband’s death scored a legal but non-binding victory Tuesday when DeKalb County Superior Court Judge Gregory Adams dismissed four of the non-murder charges against her.

But those charges against Andrea Sneiderman — for allegedly giving false statements to law enforcement — aren’t going away. Prosecutors, likely sensing that Adams would rule in the defense’s favor, filed a revised 16-count indictment last week, fine-tuning some of the language called into question by Sneiderman’s attorneys.

Sneiderman Wants to Block Neuman from Testifying at Trial

Andrea Sneiderman, the Dunwoody widow whose husband was shot and killed outside a Dunwoody daycare in 2010, wants to block her former boss from testifying at her upcoming trial.

Sneiderman’s lawyers say that if Neuman gets on the stand, he will likely exercise his Fifth Amendment rights, which they feel would prejudice the jury. Additionally, her lawyers want any statements Neuman made in his trial barred if he pleads the Fifth, according to a report from Headline News.

Her lawyers have requested that they be permitted to copy the hard drives of computers in the prosecutors’ possession because they could contain information that would be used at trial, and they want an expert reviewing the information.

All of these requests are to be addressed at Sneiderman’s pretrial hearing on Tuesday, June 18.

In the final pre-trial hearing before jury selection, lawyers representing the Dunwoody widow accused of plotting to kill her husband said the charges against their client remain too vague.

“What is she supposed to have done?” argued John Petrey, an attorney for Andrea Sneiderman. “The state has only said she is party to a crime.”

Evidence suggests Sneiderman defense strategy

Discovery evidence submitted last week by Andrea Sneiderman’s attorneys indicates the defense will portray its client as another victim of the fatal shooting that took her husband’s life nearly three years ago, who took no part in the killing.

Sneiderman, who faces malice murder and felony murder charges, denies Dekalb prosecutor’s claims that she encouraged her former boss and alleged paramour, Hemy Neuman, to kill her spouse. Neuman was sentenced to life in prison in March 2012 for murdering Rusty Sneiderman outside a Dunwoody daycare facility.

Neuman, according to the defense evidence, was stalking the Sneidermans in the weeks leading up the shooting. Specifics of that evidence will remain under wraps until her trial begins later this month.

Ms. Sneiderman is yet another piece of work.  She doesn't want the key witness against her to testify?  Yeah, good luck with that!  And here we go again with the alleged murderer/conspirator being portrayed as a victim, ala Jodi Arias. Hope that defense works as well here as it did there - NOT!  

Does anyone know yet whether or not this trial will be broadcast or live-streamed? I had heard a while ago that the judge hadn't decided whether or not to allow cameras, but haven't heard anything since.

Robert James, Prosecution:

Robert James is the district attorney for DeKalb County, Georgia. He was sworn in in November of 2010. Before being elected, James was elected solicitor general in 2007, a position that focuses on misdemeanor offenses.

Prior to his arrival in DeKalb County, James was an assistant district attorney and a special prosecutor in Rockdale County, Georgia. As a special prosecutor, James worked with the Crimes Against Children Unit.

J. Tom Morgan, Defense:

J. Tom Morgan is a defense attorney representing Andrea Sneiderman. Prior to going into his private practice, Morgan was the district attorney for DeKalb County for 12 years. Morgan was with the District Attorney’s Office for more than 20 years.

Morgan has tried more than 100 trials in front of juries and started his own practice in 2007. According to his website, Morgan has the “highest rating issued by the Martindale-Hubbell Law Directory and has been recognized as a Georgia Super Lawyer in general litigation by his peers.”

Thomas S. Clegg & John H. Petrey, Defense:

Thomas S. Clegg and John H. Petrey are law partners and are also representing Andrea Sneiderman. With a focus on criminal defense, Clegg & Petrey have a combined 70 years of experience.

Petrey and Clegg were both assistants to J. Tom Morgan when he was district attorney in DeKalb County. They prosecuted former DeKalb County Sheriff Sidney Dorsey in a highly publicized murder-for-hire case.

Channel 2 Action News has learned the DeKalb County district attorney may drop some of the most serious charges against Andrea Sneiderman.

Court sources told Channel 2 investigative reporter Jodie Fleischer that prosecutors are considering dropping the three most serious charges against Sneiderman just days before her trial. They include felony murder, malice murder and aggravated assault.

The above article was the only one that I was able to find that is alleging that the murder charges against Andrea Sneiderman might be dropped. I remember the judge dropped four of the non murder charges, the prosecution refiled the charges, re-indicted her, she was re-arraigned and pleaded not guilty for the third time.

DECATUR, Ga. -- Prosecutors say Andrea Sneiderman conspired with Hemy Neuman to kill her husband Rusty outside a Dunwoody day care in November 2010. But the case against her is circumstantial and weak, says former Dougherty County district attorney Ken Hodges.

"So far, I don't know of any emails or any documents or anything between Mr. Neuman and Mrs. Sneiderman or anyone else that indicates she was in on the homicide," Hodges said. "Certainly, no eyewitness to her doing anything in the furtherance of it."

HLN affiliate WSB is reporting that prosecutors are considering dropping the most serious charges against Andrea Sneiderman. Rumors are swirling in DeKalb County, Ga. this week after a local TV news station aired a piece questioning the strength of charges against Andrea Sneiderman.

WXIA-TV aired an interview Monday with a former district attorney who said that the murder charges against Sneiderman were "circumstantial and weak" and speculated that the charge could be dropped.

The attorney, who has no connection to the case, added that he might drop the charge if it were his case.

Soon after the interview aired, WSB-TV reported that "court sources" told the station that prosecutors are considering dropping the murder charges.

A Facebook group run by "Justice for Rusty" members called the news stories rumors.

Sneiderman murder trial to begin Monday

DEKALB COUNTY, GA (CBS ATLANTA) - A DeKalb County judge has scheduled a hearing Friday in the Andrea Sneiderman murder case.

Sneiderman is accused of conspiring with her boss, Hemy Neuman, to kill her husband Rusty in November 2010 outside a Dunwoody day care.

Neuman is serving life in prison for the shooting death. He and Andrea Sneiderman were reportedly having an affair.

Prosecutors have asked the judge to allow Melanie White to testify when Andrea Sneiderman's trial starts on Monday. White was Neuman's former realtor and friend. She testified during Neuman's trial that he told her he had an affair with Andrea Sneiderman.

"It's a pretty far leap from the fact that there was an affair to the conspiracy to kill him, but it's one step in that direction and that's why the state would want to introduce that evidence," said former prosecutor Ken Hodges.

DEKALB COUNTY, Ga. - Channel 2 Action News has confirmed prosecutors intend to dismiss the three most serious charges against Andrea Sneiderman, including murder.

Multiple sources told Channel 2 Action News prosecutors sent notification to Sneiderman's defense team Tuesday, saying felony murder, malice murder and aggravated assault will be removed from her indictment before the start of jury selection next week.

Sneiderman was accused of helping plan the shooting of her husband Rusty outside of a Dunwoody day care back in 2010.

The gunman, Hemy Neuman, is already serving life in prison.

Sneiderman still faces 13 additional counts, including perjury, stemming from her testimony at Neuman's trial and false statements she's accused of making to police.

With jury selection in the Andrea Sneiderman murder trial set to begin next week, a hearing is scheduled for Friday to determine if jurors will hear conversations regarding whether the Dunwoody widow had an affair with the man convicted of killing her husband.

Meanwhile, media reports that DeKalb County District Attorney Robert James is considering dropping murder charges against the mother of two continue to circulate. The Atlanta Journal-Constitution has sought to confirm these reports but neither side will comment, citing a gag order imposed by Superior Court Judge Gregory A. Adams.

I'm getting more confused as each day passes, lol.
There is a gag order on this case so how is the media getting info on it? Aren't people afraid they'll get into trouble if their passing around stuff that would fall under the gag order?

This is extremely odd. I wonder who is "'leaking" the information.

The prosecution had a year to prepare for this case but "at the eleventh hour" they (allegedly) decided to drop the most serious charges against Andrea for her role in the murder of Rusty Sneiderman, the rumors are that "the prosecution case is imploding because Hemy Neuman won't testify against her". ???....

Hemy Neuman was convicted and sentenced  to life in prison, he is appealing his conviction, the prosecution knew from the start that even if they call him, Neuman can assert his  rights under the Fifth Amendment to decline to answer any questions because of his pending appeal.

This doesn't make sense.

This reminds me of the Caryn Kelley case, the woman in Florida who was acquitted in the murder of her boyfriend, Phillip Peatross. She was initially charged with first degree murder because there was evidence that they had an argument and when he was leaving her house she told him "don't come back, I have a gun, it is loaded and I know how to use it", she also gave the police several inconsistent statements about the shooting;  "she thought he was an intruder", "she thought he was someone else she had problems with", "he attacked her and she acted in self defense, "they fought for the gun and the gun went off accidentally", "he had shot himself".

There was a pool of blood on the bed but when the police arrived, his body was crouched on the floor, between the bed and the nightstand. It looks like he was in the bed when she fired the shot.

The first degree murder charge against her was downgraded to second degree murder, a week before the trial the second degree murder charge was changed to manslaughter. After her acquittal a reporter asked her, “what are you going to do next", her answer to the question was "'I'm going to Disney World".

DEKALB COUNTY, GA (CBS ATLANTA) - CBS Atlanta News has learned that DeKalb County District Attorney Robert James plans to drop the murder charges against Andrea Sneiderman.

Sources told CBS Atlanta News the DA still plans on prosecuting Sneiderman on perjury and making false statements.

Jean Casarez is saying that the prosecutors didn't decide to endict Andrea Sneiderma on a whim, that the evidence show that Andrea was communicating with Hemy at crucial times when Rusty was murdered. What has changed in the evidence since she was indicted?

This is so disappointing!  What JVM just said is that they have a lot of evidence of an affair between AS and HN, but most, if not all of it, is in the form of communications from HN, not her.  How did they not figure out until recently that they didn't have enough evidence against her?

Also, there was a motion filed by the defense asking to not allow HN to testify, but I never heard the ruling on that motion. Has anyone heard?

The media is saying that the remaining charges are for perjury and inconsistent statements Andrea gave to the police, Andrea Sneiderman was also charged with racketeering and insurance fraud and all of these  charges stemmed from the murder charges.  I don't understand why the prosecution wants to go on with the trial on the remaining charges, after they the drop the three murder charges, they don't have too much of a case against her.

Hemy Neuman will not testify against her now, because he is asking for a new trial. I think that is why the DA decided to drop the murder charges. Without his testimony, they don't have a case.
