Prosecutors have charged that the two were more than just coworkers -- that they conspired together to kill Mrs. Sneiderman's husband Rusty, outside a Dunwoody day care in November 2010. But with Mrs. Sneiderman's murder trial due to start in 19 days, one of Neuman's attorneys tells us that prosecutors have not interviewed Neuman to gauge his potential value as a witness.

"The indication would be that the state does not intend to call him," said Ken Hodges, a former district attorney. Attorneys in the Sneiderman case are under a gag order. Hodges says Neuman's absence from the prosecution's witness lineup could hurt the state's case against Mrs. Sneiderman.

On the eve of the high-profile Andrea Sneiderman trial, observers will be watching closely to see what happens at a pretrial hearing scheduled Friday afternoon.

Earlier this week, sources with direct knowledge of the Andrea Sneiderman case confirmed to CBS Atlanta News that her attorneys had presented evidence considered to be a blow to the prosecution. Sources said the evidence was enough to convince DeKalb County District Attorney Robert James to drop the murder charges against Sneiderman.

If that happens, Sneiderman would still face charges of lying in court and to police.

Jury selection is scheduled for Monday.

I was listening to talk radio last night.
They mentioned while she may have been overcharged now,
IF info comes out at the trial, she could be charged then and it would NOT be double jeopardy as the original charges were not prosecuted.

Seems like grasping for straws, IMO, but if that is the best they have...

DECATUR, Ga. (AP) — A woman accused of arranging for her husband to be killed outside a suburban Atlanta preschool is set to appear for what is likely her last pre-trial court hearing.

Andrea Sneiderman is due to appear in court Friday afternoon for a hearing on whether the state will be allowed to hear about out-of-court statements that the man convicted of killing her husband is alleged to have made to a confidant.

Word that prosecutors plan to drop murder charges against Andrea Sneiderman today, on the eve of trial, has sparked ire from some lawyers in the criminal defense arena and applause from others.

"The whole thing smells," said Steve Sadow, special counsel for high-profile criminal defense at Schulten Ward & Turner.

Sadow said he has seen serious felony charges against defendants dropped approaching trial when a plea bargain has been negotiated or when prosecutors suddenly lose a key witness. There have been no reports of either in this case, he noted.

The DA's office earlier this year dropped the racketeering and insurance fraud charges, and if all goes as anticipated today, only the lesser charges of perjury, false statements and obstruction will stand.

I didn't know that the DA's office had dropped the racketeering and insurance fraud charges earlier this year. These charges were related to the question of motive.

The hearing is set to start at 3:00 PM ET.

Well that explains a lot.  In this article that Alessandra posted above (http://dunwoody.patch.com/groups/editors-picks/p/neuman-not-yet-added-to-prosecution-witness-list-in-sneiderman-trial) it says:

"However, the defense requested in June that if Neuman gets on the stand, he'll likely plead the Fifth Amendment, which would prejudice the jury." And that prosecutors don't even have HN on the witness list.

How did the prosecutor ever think he had a case against her for murder if HN was never planned as a witness?

You're welcome!  I've been thinking about the murder charges, and kind of think it's a good thing.  First of all, she can't be acquitted of these charges if they hadn't been dropped and couldn't be proven.  Second, if the prosecution ever comes up with more evidence, they can still charge her down the road. Hopefully she'll be put away for a long time on the remaining 13 charges.

Glad to see Castro plead guilty, too.  Doesn't happen often, but when it does, it is refreshing! And could you imagine a jury having to decide on a thousand charges?  Yikes!  I'll bet every potential jurist in Ohio is thanking their lucky stars they won't be called for that case!

In March 2012, Hemy Neuman was convicted of murdering Rusty Sneiderman, 36, in the parking lot of Sneiderman's son's day care center in Dunwoody, Ga., and sentenced to life in prison.

But anyone who thought that was the end of the story had another thing coming.

Rusty Sneiderman's friends and family said after Neuman's trial that they could not rest until Sneiderman's widow, Andrea, the object of the infatuation that got her husband killed, was brought to justice.

"We don't know how she's involved, but she's involved," said Steve Sneiderman, Rusty's brother. "How can we have any peace when we don't know the truth?"

Some on the jury that sent Neuman to prison have said they suspect Andrea Sneiderman was hiding something.

"She was really looked at among my fellow jurors and myself as to the possibility -- what [the district attorney] Mr. James said in his closing argument -- the co-conspirator," Cynthia Rivers told ABC News affiliate WSB.

Channel 2 investigative reporter Jodie Fleischer sat down with Rusty's parents and brother.

Steve Sneiderman said Andrea is covered in Rusty's blood and there are not enough rabbis in the world to wash it away.

The Sneidermans spoke with Fleischer for 2½ hours about the case, and said most of all, they want everyone to know Rusty was a wonderfully devoted father.

"I knew coming down here that this was going to be horrible and it's been far worse than I ever imagined," Steve Sneiderman said.

When Steve lost his only brother he was devastated. But the pain he felt in November 2010 is just as raw now, after what he calls the ultimate betrayal by his sister-in-law, Andrea.

What happened that day is that a friend called me to ask me if I could give her a ride to the vet clinic to pick up her dog, her car was in the shop and her husband was tied up with a client, the location of the vet clinic is kind of out of the way.

@hello clarice --Good for Beth! This is wonderful news to me. Now if we could just get JVM and NG out of prime time (or gone), maybe TruTV could go back to more like it used to be (CourtTV and not Lizard Lick Towing).

This Sneiderman trial should be quite interesting as the Prosecution tries to get something, anything, in to let them re-charge her with murder charges x4 (I think x4?). I'm patient, Andrea seems very chatty, so we'll see.

As an aside, whenever their trips to Greenville, SC are mentioned, a company that I used to work for leased the 2nd floor of that building for the folks assigned to a project task force (mid-70's I would guess). I was transferred to the actual site of the project so, of course, I had to call a local and see if it was the same bldg as I thought; Google was basically accurate for things like that. I could gag a maggot just thinking about it. ~~C

Claire, it's absolutely wonderful news about Beth! and as you say if we could just get rid of the 'screamin' demon' (JVM) and the other one (who I personally think is a manhater) from prime time TV...... maybe we should start a petition here at RC ? Jury selection advanced quicker than expected Monday in the much-anticipated trial of Andrea Sneiderman, who is no longer facing murder charges in the 2010 shooting of her husband, Rusty.

Back in the same DeKalb County courtroom where her former boss, Hemy Neuman, was convicted and sentenced to life in prison last year for killing Rusty Sneiderman, attorneys qualified 22 jurors on Monday from a pool of 283. DECATUR, Ga. -- After the first day of jury selection in her trial, Andrea Sneiderman is no longer under house arrest.

The judge removed Sneiderman's GPS ankle bracelet.  The $250,000 cash bond she posted was returned.  The $250,000 property bond remains in effect.

Jury selection began Monday morning for the long awaited trial of Andrea Sneiderman.

Last Friday, DeKalb County District Attorney Robert James agreed to drop the serious charges – murder and aggravated assault – against Sneiderman. James said that he's not 100 percent she's guilty of murder.

"I believe that it would be unjust and unethical for the D.A.'s office, for the state, for the district attorney of this county to go forward on a charge that I am not 100 percent sure of someone is guilty of," James told DeKalb County Superior Court Judge Gregory Adams.

ATLANTA — A friend of a Dunwoody widow accused of lying about an affair with the man who killed her husband says she's outraged by the allegations against Andrea Sneiderman.

"Anyone who knows her knows she's absolutely incapable of hurting anybody or anything in this world," Steffi Miller said.


Prosecutors accuse Andrea Sneiderman of having an affair with her former boss, Hemy Neuman, a man later convicted of killing her husband, Rusty Sneiderman.
