The family of Josh Powell is asking a judge to declare that Susan Powell was dead before May of last year.

Terrica and Alina Powell — Josh Powell’s mother and sister, respectively — filed a complaint Friday in 3rd District Court against Chuck Cox, Susan Powell’s father and conservator of her estate.

In that complaint, the Powells argue that Cox amended the trust in May 2013, and listed himself as the sole beneficiary of the trust that Josh and Susan Powell set up in February 2009.

The Powell’s attorney, Joshua Lee, said in a prepared statement Friday that Cox should not have been able to amend the trust, and it should have become irrevocable upon Susan Powell’s death — which he said likely occurred before May 2013.

TACOMA, Wash. — Steven Powell was re-charged and re-arrested Monday and is headed back to court.

A bench warrant was issued for Powell's arrest Monday by the Pierce County Superior Court. Powell, who was released from prison in March after serving 30 months for his conviction on multiple counts of voyeurism, was arrested at his home in Tacoma, prosecutors say.

The warrant comes on the heels of a decision by a Washington appeals court that a judge erred two years ago in dismissing a charge of child pornography that had been filed against him.

...If convicted on this new charge, Powell could be sentenced to up to five years in prison.

Steven Powell, the father-in-law of missing Puyallup native Susan Cox Powell, poses “a significant risk to public safety” because he refuses to undergo court-ordered sexual deviancy treatment, a state official contends.

Community corrections officer William Sheppard has recommended that Powell, 64, serve a sanction of 60 days in jail for violating the order, according to a report he filed Tuesday in Pierce County Superior Court.

“Regarding supervision, Mr. Powell continues to place the community at risk,” Sheppard wrote in his report. “Mr. Powell has made no attempts or shown any desire to comply with requirements of supervision or change his behavior.”

...It also noted that Powell's actions and lack of cooperation with officials since being released from prison haven't allowed corrections officials to ‘thoroughly monitor his activities in order to maintain the safety of his victim(s) and the community.

‘Mr. Powell's adjustment to supervision can only be described as extremely poor,’ the report says, while further noting that his behavior ‘constituted an obvious risk to officer and community safety.’

...A pretrial hearing on the refiled charge is scheduled for Wednesday and if convicted Powell could be sent back to prison for another five years.

...In May, Powell was given a Sexual History Disclosure Examination polygraph and some of his responses were determined to be 'not truthful,' according to the report.

His parole officer determined he was being 'manipulative,' and he was sentenced to 'three days confinement.'

Judge: Steven Powell in violation of court order, porn trial set

TACOMA, Wash. - A judge has found that the father-in-law of missing Utah woman Susan Powell is in violation of a court order for failing to get mandated sexual deviancy treatment and has been ordered to spend an additional 40 days in jail.

The ruling was handed down at a Wednesday morning hearing in Pierce County Superior Court.

A state corrections officer earlier reported that Steven Powell continues to put the community at risk by failing to comply with court-ordered treatment. The officer recommended that Powell spend 60 days in jail.

Steven Powell heads back to jail for refusing sexual deviancy treatment as he awaits his child porn trial


Steven Powell, the father-in-law of missing mother Susan Powell, has been sent back to jail for refusing to get sexual deviancy treatment as he awaits child porn charges, it has emerged.

A Washington state judge ruled that the 64-year-old, who is from Tacoma, must go back to jail for at least 40 days, RadarOnline reported.

Saturday will mark five years since his daughter-in-law Susan vanished in Utah, which means she will be declared legally dead. Her husband, Josh Powell, was long considered a person of interest in her disappearance but was never charged in the case.

...On his release from prison, Powell was ordered to complete a sexual deviancy treatment program and undergo a psycho-sexual evaluation.

He was also ordered to stay away from places where juveniles are typically found such as pools, parks, playgrounds and schools.

In July, police found Powell in a Jack in the Box fast-food restaurant and he was sentenced to nine days in jail for visiting an establishment frequented by minors, according to police reports.

...In August, Powell's counselor 'terminated treatment' because Powell refused to cooperate with the psychosexual evaluation, according to the report.

His parole officer determined he was being 'manipulative,' and he was sentenced to three days in jail.

Powell again refused to answer questions about his sexual behavior during treatment in October, according to the report.

A Utah judge on Friday denied an emergency motion seeking to prevent the parents of Susan Powell from spending $1.15 million in life insurance proceeds sought by Powell’s mother-in-law.

The hearing, scheduled on less than 24 hours notice, was the latest wrangling over the estate of the missing West Valley City mother and her late husband, Josh Powell.

Susan Powell’s parents, Chuck and Judy Cox, control $2.3 million in life insurance proceeds in a family trust and a related conservatorship. A lawyer for Josh Powell’s mother, Terrica Powell, on Thursday filed a request for a temporary restraining order that would have prevented the Coxes from spending half that amount.

But 3rd District Court Judge Mark Kouris denied the motion.

The fifth anniversary of Susan Powell’s disappearance was supposed to be a milestone — the date when Utah law allows the missing wife and mother to be declared dead and add a measure of closure to the saga.

But as the anniversary arrives Saturday, when Powell died has turned into one more legal fight between her parents, Chuck and Judy Cox, and the family of her late husband, Josh Powell.

West Valley City police believe Susan Powell was kidnapped and killed by her husband, Josh Powell, on Dec. 6, 2009 — the last day the 28-year-old woman was last seen alive.

But in court papers, the Coxes and the Powells are arguing over whether a judge should find Susan died sometime prior to May 10, 2013, a legally significant juncture that could mean millions of dollars for one side of the family or the other.

Appeals court tosses Susan Powell estate battle

SALT LAKE CITY — The Utah Court of Appeals has tossed an estate battle involving missing West Valley City mom Susan Cox Powell.

In a ruling handed down this week, the state appeals court dismissed an appeal from Josh Powell’s mother and sister, challenging a judge’s decision to award control of the estate to Susan’s father. The appeals court said nothing has been settled in a lower court, so it would not consider the case.

Court battle settled over Susan Powell insurance money

Court records show that two sides reached an agreement in Salt Lake City Thursday resolving the dispute over some $2.3 million in life insurance proceeds.

Details about the settlement were not publicly disclosed in court records.

Judge's ruling clears way for new Steven Powell vouyerism trial

TACOMA, Wash. — A judge on Tuesday rejected a motion by Steven Powell to throw out the 2011 search of his Puyallup, Washington, home by West Valley police and all the evidence seized because of it, thereby clearing the way for a new trial to begin next week.

Powell, 64, is charged with possession of child pornography in Washington's Pierce County Superior Court for allegedly taking inappropriate pictures of two neighbor girls, ages 10 and 8, using a telephoto lens from his bedroom peering into their home.

The charge was originally part of his 2012 trial when he was convicted of 14 counts of voyeurism, but it was tossed out at the start of the trial. An appeals court later ruled, however, that the charge was wrongly dismissed.

Earlier this month, Powell filed a 127-page motion claiming the search warrant issued by a judge, allowing West Valley police to enter his home, was made under false pretenses. Powell contended that he had been cooperating with law enforcement to that point and a search warrant wasn't necessary.

TACOMA, Wash. - Testimony has begun in the child pornography trial for Steven Powell.

Powell was convicted of voyeurism in 2012 and served 30 months in prison for shooting photos and video of two young neighbor girls using the bathroom. Pierce County prosecutors reinstated a child pornography charge against Powell that had been dismissed during the 2012 trial.

On Tuesday a jury was selected and opening statements were delivered. Powell is acting as his own attorney.

A woman identified only as "D.C." told jurors in the child pornography trial of Steven Powell she was first approached by Pierce County sheriff's detectives in 2011, who showed her explicit pictures of her 8- and 10-year-old daughters using a family bathroom.

Prosecutors said they were taken secretly by Powell, 64, from the bedroom window of his South Hill home.

“That’s my youngest daughter,” D.C. responded as deputy prosecuting attorney Bryce Nelson showed her still pictures of the girls using a family bathroom nearly nine years ago.

While investigating the disappearance of Steven Powell’s daughter-in-law, Susan Cox Powell, detectives found what they said was thousands of images of nude girls.

“For the sake of society and for himself,” Graves said, “I think it’s better if he just remain behind bars. I’d like to see that outcome.”

The father-in-law of Susan Powell, a Utah woman who went missing six years ago, has been found guilty of possessing child pornography.

Steven Powell was on trial since last week for possessing explicit images of two neighbor girls. Jurors returned a unanimous verdict against the 65-year-old Monday afternoon.

Powell was ordered held without bail until his Aug. 21 sentencing, The News Tribune reported ( http://bit.ly/1HrWbHd ). He faces up to five years in prison.

Powell was convicted in 2012 on 14 counts of voyeurism for shooting video and still pictures of the girls, ages 8 and 10, from a window as they used a family bathroom. A judge threw out the child porn charges before the voyeurism trial, but they were reinstated by an appeals court.

Powell is the father of Josh Powell, who killed his two sons and himself in February 2012 while under investigation for his wife's 2009 disappearance that gained national attention.

He is getting off too easy, IMO. His "child porn" kills the innocence of a child and devastates a family. The dynamics change when the parents now must actively guard against neighboring creeps.

Family of Susan Powell sues state



TACOMA, Wash. — A federal judge said when Josh Powell was ordered to undergo a psychosexual evaluation and a lie detector test on February 1, 2012, he walked out of court looking like a caged animal.

Four days later he killed himself and his sons Charlie, 7, and Braden, 5, beating them with a hatchet before setting a match to his gasoline-soaked home during a visit supervised by state Child Protective Services.

Chuck Cox, the boys’ grandfather, father of their mother, Susan Cox Powell, claimed he called and warned CPS this could happen two days before the murders.

“He was cornered and I was concerned for the safety of the children at that time, and I made that known to the social worker,” Cox said.

Cox is suing the state, claiming Child Protective Services and the Department of Social and Health Services didn't act on warning signs Josh Powell was a threat.

The state is asking a federal judge to throw out the case, saying CPS is immune because case workers were simply obeying a judge's order to carry out the visit.

Yep. My thots, too.
1. It is logical the grandparents were very concerned with the well being of the boys.
2. Grandparents had been custodians of the boys.
3. Grandparents wanted continued custody of the boys.
4. Grandparents never got an explanation for their missing dau, Susan.

I DO believe they called authorities MANY times with their concerns.
Court MAY have ordered a "welfare check" on the boys BUT that does not negate the grandparents calling and urging immediate checks on the home.

The telephone companies WOULD have records of the phone calls.
Cox' family may have those on their own electronic services.
Gov't could deny having access/knowledge of the calls AS IT SERVES THE GOV'T NEEDS TO PROTECT ITSELF FROM LAWSUITS.

No brainer...
They only care about the dollar and the public impression...
They take the dollar, siphon it off to pay the upper management, and complain if they have to work or become accountable. Like they did not know when they were hired?

BTW, it is NOT up to the grandparents "to notify" the authorities.
That duty fell TO the authorities.
And why release the boys BEFORE the psychosexual evaluation rather than AFTER the test if it was satisfactory. Putting the cart before the horse, IMO.
Same with the lie detector test.
It should have been done BEFORE child placement.

Sue the judge, too. Certainly make sure he never sits a bench.

Judge dismisses lawsuit against state in death of Susan Powell’s boys

A federal judge has dismissed a lawsuit brought against the state in the wake of the deaths of Charlie and Braden Powell, ruling that social workers were not at fault for the boys’ deaths at the hands of their father, Josh Powell.

...But Leighton ruled that social workers who worked on the boys’ case enjoyed “absolute immunity” from liability in their deaths.

“To ensure the judiciary and those who further its efforts can engage in the pursuit of justice without fear of vexatious retribution, federal law provides them absolute immunity,” Leighton wrote.

I am glad that he is trying again from another angle.  Bless Mr. and Mrs. Cox -- they have been through so much.

I clearly see liability, here.  The powers that be absolutely knew that Josh was as dangerous as his father.  Plus, he had finally been named a suspect in the disappearance of Susan!

Still, he was allowed to have "supervised" visits with his children--while undergoing "testing" that he knew he would never pass.

I am not blaming the unfortunate social worker who was assigned the case--I saw some of her interviews, and believe her to be a lovely woman who was as horrified by what happened as everyone else.

The problem was with the higher ups and it will remain a problem for a 2nd case, if they continue to refuse to investigate to see how laws may be adjusted to prevent this from happening again.

It's the very least of what is owed to Mr. and Mrs. Cox.  The very least.

This is what is forgotten when a few sit in their ivory towers and review the law:

The judge (and perhaps the system?) were in too big a hurry to award custody time to the father. They did not wait for a proper review of the case. Had they waited, the outcome may have been different. Especially when it was later released all the porn on the father's computer...

Hogwash! While he has the right to not incriminate himself, any evidence brought forth showing a pattern of intrusion upon others in an UNLAWFUL manner should be allowed in court. He had/has a propensity for sexual deviance that includes denying OTHERS their rights. Because it was unsolicited, and because some of his choices involved violating the rights of children, I would have allowed this in.
