Remains found near site of 2009 search for missing Jamison family from Eufaula

TULSA - Oklahoma State Bureau of Investigation officials say human remains have been found about three miles from where a Eufaula family disappeared in 2009.

An OSBI spokesman said deer hunters discovered the remains around 5 p.m. Friday in a mountainous area of northern Latimer County and called law enforcement officials.

Investigators found the skeletal remains of two adults and one child over a two-day search.

Officials say they did not find any clothing or other artifacts to confirm the identify of the remains, but the remains were found near where the truck of a missing Eufaula family was found in 2009.

The Oklahoma State Bureau of Investigation was on the scene Sunday a few miles away where deer hunters found skeletal human remains in Latimer County.

OSBI Assistant Special Agent in Charge Gary Perkinson told News On 6 it will be a while before positive identification is made, but they appear to be partial remains of three people.

According to Perkinson, the remains were found a few miles south of Kinta, near Red Oak, where a vehicle belonging to a couple and their 6-year-old daughter was found abandoned in 2009.

Remains found in same area as abandoned pickup truck belonging to missing Eufaula family

LATIMER COUNTY, Okla. —The skeletal remains of two adults and one child were discovered over the weekend in Latimer County, according to the Oklahoma State Bureau of Investigation.

OSBI acting spokesman Gary Perkinson said Saturday that deer hunters discovered the remains around 5 PM Saturday and called authorities. Since then, local and state agents have combed the rugged terrain near the town of Kinta, hoping to find for more evidence.

Perkinson said officials could not identify the remains but the bodies were found in the same area as a pickup truck which belonged to a missing Eufaula family in 2009.

Bobby and Sherrilyn Jamison, along with their daughter, Madyson, 6, disappeared in October, 2009. They had reportedly been looking to buy land in the mountainous area near Red Oak.

HE LATER CALLED TO TELL ME THAT HE DID MEET WITH COLTON AND HIS FATHER AND TOLD HIM OF THE TWO ADULT AND ONE SMALL CHILD REMAINS FOUND YESTERDAY JUST 2 MILES NORTH OF WHERE THIER TRUCK WAS FOUND 4 YEARS AND ONE MONTH AGO, TODAY. QUINTON - The Oklahoma State Bureau of Investigation is investigating after three bodies were discovered in a grave near Quinton, Oklahoma in rural Pittsburg County.  

The location of the grave was just a few miles from Panola mountain.  That's the site where the Jamison family's truck was found abandoned four years ago.

Family and friends of the Jamisons say investigators told them the bodies were of two adults and one child.  Bobby and Sherilynn Jamison and their daughter Madyson were last seen near Red Oak Oklahoma in 2009.  

The Latimer County Sheriff, whose county has the original missing persons case, confirms bodies were found but said the OSBI is in charge of the case.

In the McStay case:
While there were comments the family was having a tough time financially, wit the "small" home they had been living in, the family (apparently) had been saving their money and talents to purchase in Fallbrook a rather nice home. And they paid cash with substantial money left in the bank. So talk of how poor they were or how they must have been selling drugs is all smoke screen, IMO.

In the Jamison case:

Early on there had been rumors of witchcraft, evil astrology, and even drug running. There were rumors of the family being unhappy and wanting to move, answering a "Craig's list" to see some mysterious property not yet identified (although I am sure there are county records of ownerships) and the family being broke. The vehicle, however, appears relatively new; they had cellphones and @ $36,000 in cash under a seat ... which rules out meeting up with drug lords. (I do wonder if they had answered an ad to see a property, told the person they met they needed to "go get the cash " as something made them feel uneasy... )

Talk of both these families running off to Mexico makes me think something rather stinks. Both families sposedly broke.

A lot of PR smoke trying to make us the reader believe things which were far from the truth. And it was the authorities who fed the misinformation to the public.  What's up with this?

With the Jamison case:
They did have dogs in the area, search parties on several occasions both on foot and horseback. Oddly, no prints or tire tracks around the vehicle... One report I read today states the bodies were found @ one mile away while another report stated they were found @ 3 miles away. So still the info is not appearing valid. Why the difference? And if that area had been searched, which I believe it had, is it possible the bodies were placed there AFTER the searches?

Didn't the Jamison family own or were buying their home??? That would have indicated outside cash and stability....

McStay:
One does not lay out $320,000 in cash IF they are planning on skipping the country/area a few weeks later. Common sense, Sheriff Gore!

Having the cash on hand does not surprise me.
Not everyone has all the faith in banks specially after declaring bankruptcy. I doubt the drug connection but do think they were "hiding" the assets, perhaps it is as simple as putting the money aside in the proverbial sugar bowl... As for sposedly not paying the landlord: According to the newer tenant, the McStay family was in arrears. And, not surprisingly, the landlord has died. The story is too convenient. Landlord cannot be questioned so it is all hearsay, IMO.

IF the McStays HAD withheld money from the landlord, perhaps it was due to the landlord not fixing something in the rental unit.

As the McStays had come out of a bankruptcy, they would be held accountable for ANY and ALL unpaid debts for the next 7 years... they were not going to be able to run out on any debt they owed which is why I am skeptical of the "report" given by the newer tenant, the former US Marine.

During the 3 years the McStay's were missing, part of me felt that the McStay's met with foul play, but the other part of me didn't.; I think the latter may have been naive, and full of the childlike optimism and hope that tends to cloud my judgement.; Although the surveillance video of the family crossing the border was impossible to see who it really was, I still wanted to believe it was them and they had decided, with reasons only known to them, to begin a new life elsewhere.

But, there was one part that couldn't be ignored, that I couldn't shake, that I became aware of regarding withdrawals from Joey's bank account made through Paypal transactions.; The withdrawals were being done by one person, per Patrick and I thought it could be possible that person might have been withdrawing it and sending it to the McStay's.; We now know that probably never happened.

On Friday, police said the manner of death has been ruled homicide, however, they declined to comment on the possible cause of death, or whether the family may have been targeted by a drug cartel.

When detectives entered the family's home in 2010, they found rotten eggs on the counter and the family's two dogs in the backyard. Police later found the family's vehicle abandoned near the U.S.-Mexico border, prompting authorities to wonder whether they had crossed into Mexico.

Baker said he thinks the evidence points not to a drug cartel, but an amateur attempting to stage the crime, so it would appear to be a drug-related cartel hit on McStay and his family. He said the Isuzu Trooper found near the scene -- along with the scene at the family's home -- was staged.

McStay Family Update: Joseph McStay's father says he suspects three people in family's 2010 disappearance, murders

(CBS) - The father of Joseph McStay says he has a list of three people he suspects may have had something to do with the disappearance and murders of his son, daughter-in-law and two young grandchildren.

"I have exhausted and have so much information on three possible persons of interest," Patrick McStay told CBS News' Crimesider over the phone Friday. "All have a motive."

McStay says that while these three individuals are "totally separate," one of them stands out above the rest due to a long criminal history that includes charges of attempted murder, assault with a deadly weapon and burglary.

"He has money, was in prison... He absolutely had a motive," McStay said.

McStay says he's felt all along that multiple people were involved in the February 2010 disappearance of his son, Joseph; Joseph's wife, Summer; and their children; 3-year-old Joey and 4-year-old Gianni, from their home in Fallbrook, Calif.

Family members say McStay's business partner is a metal worker and welder named Chase Merritt, whose birth name is Charles Ray Merritt, age 52.

Merritt is an ex-con according to court records, who also was one of the first persons to notice the McStay's were missing.

Department of Corrections records show Merritt served time in prison for a burglary conviction in 1978. He was then sent back to prison in 1987 for receiving stolen property, according to State records.

An acquaintance who knew Merritt in the 1980s told News 8 he has a checkered past.

"I think police should look at him and anyone associated with him," the female acquaintance said. She asked not to be identified.

Reached by cell phone Monday, Merritt declined to discuss his criminal past and told News 8, "I would just prefer to have no comment to any press right now. We want to find Joseph."

Sheriff's officials say Merritt is one of several people they are speaking with and at this time he has not been named as a suspect in the case.

Much appreciate the updates, AD.

IMO, it is not looking good for the former business partner.
I have read the blurbs on the book released in Jan. 2013 and, IMO, I believe the author based his info on Merritt. Merritt seems to have adverse feelings re Summer. (I doubt she was as "insanely jealous" as Merritt is stating. Further, it is impossible for her to have killed her husband, her two young sons, and then herself; further complicating this would be Summer lugging them in/out of a vehicle
for burial and then burying herself as well. One would suspect some sort of blood evidence and perhaps a gun at the burial site.)

Curious as to what else he may tell in future weeks.

Edit: I am curious as to who took money from the McStay's bank acct and then was refused access.
If we knew who that was it would help. Not only did that person have access to security codes (perhaps a "trusted" person who helped with banking or had obtained the info from computer, etc.) but they may have been using the banks in the area.

I do think the photo of the 4 crossing the border is of the family. That however, was a false lead. They may have parked their car, walked across, met someone who drove the family back over the border, etc. Regarding passports: everyone in SoCal knows you do not have to have a passport to cross into Mexico. This was a false flag intentionally put on the computer. Not sure what McStay was doing but he was hanging out with some unsavory persons.

neighborette8, Kenosha, United States, 2 hours ago They found Bill Wheeler's (Another missing person) burned truck about two miles from the Mcstays bodies. Bill Wheeler disappeared a few months after the McStays, I find it interesting in all the possible miles of desert that two different cases would end up so close to each other. It feels like it became a dumping zone, and although Bill Wheeler has not been found, I am thinking he is out there in that desert near Victorville too. I think the person who did this to the McStay's also did this to Bill Wheeler. It seems both were in need of a handyman to help them with their properties. I am interested in the who was the first McStay painter? Did he come and do some painting, and then not show up for a while? Most people eat eggs for breakfast, so that tells me that something may have went wrong between morning and afternoon. Did the painter show up? Where did they find this guy? Craigslist? I can only hope they still have the McStay vehicle, as it may have some DNA in it. wrote:

Doves were released and four crosses were erected at an informal memorial for the McStays on Wednesday, Nov. 20, 2013, at the site outside Victorville where the family’s remains were found. (Credit: KTLA)

A small public memorial was held Wednesday afternoon in honor of the McStay family, a couple and their two young sons whose bodies were discovered last week in the Mojave Desert.

The family had been missing since February 2010, when they mysteriously vanished from their home in San Diego County.

Volunteers who live in the remote area northeast of Victorville where the bodies were found in a shallow grave helped Michael McStay, brother of victim Joseph McStay, in his request to erect crosses on the site.

Dozens of doves were released as Michael, his wife and the volunteers gathered.

“At least we can start the next phase in the process, Michael McStay said. “What was hidden was brought to light, out in the open, and now we can catch the individuals who did this.”

VICTORVILLE — Crosses were put up Wednesday on the remote desert site where the remains of a missing Fallbrook family were found in two shallow graves.

Attending the small ceremony north of Victorville marked the first time Mike McStay stood at the ground where his brother, Joseph McStay, sister-in-law, Summer, and two children — presumed to be the couple’s young sons — were found last week.

The discovery of their remains was “providence,” said Mike McStay, coming three years and nine months after the family vanished. He said finding them was the hand of God.

Bobby, Sherilyn, and Madyson Jamison were reported missing in October 2009. Their pickup was discovered near the San Bois Mountains in Latimer County.

Hunters discovered the family’s pickup about a week later — Oct. 17 — at a remote well pad site near a 40-acre plot the family was considering buying.

Latimer County Sheriff Jesse James said the remains were found about 5 p.m. Saturday by a deer hunter.

James said the remains were found 2.7 aerial miles northwest of where the pickup was located in 2009.

Given the location of the bodies, it would seem that whoever is responsible would at least want investigators to think McFadden was involved. As a self-proclaimed mountain bike “racer”, McFadden has participated in several bike events in various locations all along the Route 15 Mojave corridor. wrote:

The water tower where pics were taken... it probably could be seen from a distance. IIRC, their vehicle was located near it. IF lost they would have been able to find their way by using the tower as a marker...

Victorville, California (CNN) -- Mike McStay has come to this remote swath of Southern California desert to say goodbye.

To his brother, Joseph McStay. His sister-in-law, Summer. His two nephews, 4-year-old Gianni and 3-year-old Joseph Jr. All four ended up here, in an unincorporated area north of Victorville, in a pair of shallow graves, for reasons no one has been able to explain.

There's no bringing them back. But Mike McStay promises they will get justice, once their killers are found.

"You guys are cowards," he said. "And all of America is coming after you. And we're going to find you. And we're going to prosecute you."

Authorities say, the Jamison's were out looking at 40 acres of land near Red Oak . ... Hunters on four wheelers found the truck near Panola Mountain.

QUINTON - The Oklahoma State Bureau of Investigation is investigating after three bodies were discovered in a grave near Quinton, Oklahoma in rural Pittsburg County.  

The location of the grave was just a few miles from Panola mountain.  That's the site where the Jamison family's truck was found abandoned four years ago.

The news by different media sources that were published immediately after OSBI announced that three bodies were discovered in Latimer County by deer hunters clearly stated that the skeletal remains were found in a grave.

Using the different maps leaves me a bit confused.
On one of the maps, would you identify where the pickup truck was last seen and where the bodies were found?Was the truck located at C and the bodies were found at B?

Because the bodies were found in grave(s) it is obvious this is murder and not accident. I am speculating now the last known pic of the child .... that pic was taken by cell phone BUT the phone was found in the truck. So whoever took the pic returned the cell phone to the truck before locking the truck doors... They then "swept" the area of footprints and of tire tracks.

Just recently I learned the truck had apparently been turned around to face leaving the area...

I am curious as to the time of day the family was in the area...
Because it is mountainous and it is October, the shadows would grow long earlier in the day...

In March 2010, shortly after the entire McStay family vanished from Southern California, I along with Tim Miller from Texas Equusearch, were met by Mike McStay, the younger brother of Joseph McStay to try to piece together what happened to his brothers family. Joseph, along with his wife, Summer, and their 2 children, Gianni, 4, and Joseph, 3. vanished from their home Feb 4th and have not been seen or heard from since. We were joined by Kenneth Aranda, the younger brother of Summer, who flew in from Hawaii, where he lives. They allowed us inside the McStay family home. The brothers then take us to the location where the family's car was found — just minutes from the Mexican border — all in hopes of digging up answers as to what happened to the McStays.

Clue: Joseph McStay's brother informed detectives of these track marks - 67 inches apart - near the grave sites. He believes they were made by a small earth moving digger used possibly by the murderers

The remains of two children found in shallow graves in the Mojave Desert on Nov. 11 are the young sons of Joseph and Summer McStay, authorities said Friday.

DNA testing confirmed what San Bernardino County Sheriff John McMahon said investigators already believed: The skeletal remains belonged to Gianni, 4, and Joey Jr., 3.

The California Department of Justice notified the Sheriff’s Department of the results about 3:30 p.m. Friday.

It is more likely than not that the remains of two adults and one child that were discovered over a week ago in Latimer County are belong to Bobby and Sherilyn Jamison, and their 6 year old daughter Madyson.

I wonder why we haven't heard anything yet about the identity of the skeletal remains.

There is stark contrast between the manner in which the California authorities and the Oklahoma authorities are handling the discovery of the remains of these two families.

Within a few days from the time the skeletal remains of two adults and two children were found in Victorville, CA, the San Bernardino County Coroner identified the remains as Joseph and Summer McStay through their dental records, less than a week later the remains of the two children were identified through DNA tests.

The Jamison family mysteriously disappeared four months before the McStays vanished without a trace, I have read reports stating that it might take months, or even years, for the skeletal remains that were found in Latimer County, Oklahoma, to be identified.

An off-road rider on Monday noticed bones exposed in the desert about 50 yards off a dirt road near Stoddard Wells Road, north of Victorville. The graves may have been disturbed by animals digging in the desert, according to authorities.

San Bernardino County Sheriff John McMahon said the two graves were one to two feet deep in a remote stretch of the desert, but still visible from Interstate 15.
The Latimer County Sheriff stated that the three skeletons were found together. I'm wondering what are the conditions of the skeletal remains.  

We haven't been able to see any pictures of the scene of the crime in Oklahoma, no even one picture showing yellow tape surrounding the area where the remains were found has been published, where are the FOIA request from the media to have the pictures released to the public, other than the Police brief that followed the discovery of the remains, there haven't been other reports.

There has been a lot of speculation about the disappearance of both families; drug cartels, witness protection programs, financial problems, marital problems, murder/suicide, wichtcraft (involving the Jamison),  but the media coverage is completely different in these two cases.

The media can be a double adged sword, however, in many instances it can be a very powerful tool to raise awareness and to put pressure on the authorities to conduct an open and thorough investigation.

GRACE: Right. Everybody, you are taking a look at the Jamison family. The young girl, Madison, just 6 years old. Parents, Bobby and Cherilyn. We are taking your calls. With us, cult expert Rick Ross.

Rick, Cherilyn`s mother is convinced a cult is responsible for the family`s disappearance. What do you think?

RICK ROSS, CULT EXPERT: Well, Nancy, in my experience, and I`ve dealt with families struggling with a cult problem for many years. They -- the family would know the name of the group. They would know the name of the leader. And when families have a problem with a particular cult, they can identify that cult, and the mother`s kind of ambiguous reference to would- be Satanic cult, it`s not very specific, and the idea that there would be Satanic cult activity in one particular part of Oklahoma, you know, it isn`t specific enough. It`s vague, and it seems to me --

GRACE: But is their disappearance, is it consistent with a cult activity for the whole family to just disappear and no one knows what happened?

ROSS: No. Nancy, that is absolutely not consistent with a family dealing with a cult. There would be a process of family estrangement, there would be knowledge of the family of the cult group, and the entire family disappearing like that, it isn`t consistent with my experience dealing with cults.

MARK KLAAS, KLAAS KIDS FOUNDATION: Well, I think that your last guest made a great analysis, and I think if that were true, there would be some kind of -- there would be some telltale signs as to who that cult was and there don`t seem to be any.

I`ll tell you what I think is much more possible. Now, as I understand it, he was -- he had been spending quite some time looking for land in that area, and that there was a considerable amount of money with them when the truck was found. So I suspect that the possibility exists they were just scouting locations for land to purchase, and at some point came upon a criminal enterprise. Either a pot farm or a meth lab, and they were simply killed to hide that evidence.
