A phalanx of about 20 reporters and photographers greeted attorneys Joel Brodsky and Steve Greenberg as they entered the Will County courthouse in Joliet about an hour before the start of jury selection.

Brodsky said the defense team, made up of Chicago based attorneys with little experience in the Will County courts, had "the ultimate jury consultant" in their client.

"Drew was a cop in Will County," Brodsky said, and knows the character of county residents.

Jury selection in the trial of Drew Peterson for the alleged murder of his third wife began today in Joliet, Ill., but the former cop's attorney predicted that the judge will throw out the case after the prosecution concludes its case.

"We have always said, and this has never changed: They simply don't have any evidence. They have conjecture, rumor, speculation, hearsay, but they don't have any evidence. Even a predispositioned jury is going to want to hear evidence, and they don't have any," Peterson's attorney Joel Brodsky told ABC News.

Brodsky acknowledged that the jury may be "predispositioned" because of Peterson's notoriety.

Jury selection in Drew Peterson trial could go into Monday night

Jury selection for Drew Peterson’s long-awaited murder trial was moving in slow motion Monday, with no jurors selected by 5 p.m. after more than five hours of preliminary questioning.

Will County Judge Edward Burmila and attorneys on both sides of the case had questioned only about half of the 39-person jury pool called in Monday for the first day of jury selection.

Burmila indicated he still plans Monday to question about a dozen more prospective jurors, though he allowed another eight to leave the courthouse and return Tuesday.

I just read where DP addressed the jury pool with "Good Morning Ladies and Gentleman, I am Mr. Peterson"

12 jurors selected in Drew Peterson murder trial

After a marathon jury selection session Monday that lasted more than 10 hours and seated a total of eight jurors, the process of seating eight more people to stand in judgment of Drew Petersonin the murder of Kathleen Saviobegan this morning.

By noon today, 12 jurors had been selected with four alternates still to be selected.

Jury selection is complete in the Drew Peterson trial.

A panel of 12 jurors and four alternates will decide whether or not Peterson, a former Bolingbrook police sergeant, is guilty of drowning his third wife, Kathleen Savio, in her bathtub in 2004. Opening statements are scheduled for July 31.

Meet the Drew Peterson murder trial jury

The seven-man, five-woman jury that will decide Drew Peterson’s fate is a diverse group that includes:

A Hispanic man in his 20s who studies broadcasting at Columbia College and earlier attended Bolingbrook High School while Kathleen Savio’s oldest son, Tom, also was at the school. His brother serves in the Army, while his parents both work at Will County high schools.

A Plainfield man who formerly owned a construction company, now works as a consultant and plans to retire Sept. 1. He’s married with two grown children and takes flying lessons.

This one might fall for the "CSI effect", expecting there to be hard evidence in a highly circumstantial case. She alone could cause a hung jury.

I know what you mean: Pinellas Part Deux. Another one that gives me some reservations is the juror who is against the DP. That's all good and fine, but I always wonder why some judges seem to feel that they have to "force" the issue, as it were, by arguing with the prospective juror. I've seen Perry do it, and also remember this happening a lot--albeit for other causes--when I was in the jury pool for a civil case. Seems to me that it's counter productive and could lead to possible resistance/resentment on the juror's part. Wonder why judges don't simply let it go with an ok thx bye and call the next candidate instead of doing what amounts to hectoring someone who obviously wants out of jury duty?

On the plus side: I really like these two jurors: the poet/crime reader (secretary) and the mystery whodunit solver (crossing guard). :)

All in all, not too bad I guess?

From what I have read elsewhere, it seems that this greeting and cheery-face stuff is fine during the selection process but is forbidden during the trial itself. I don't know really--seems it should not be permitted period unless the defendant is on the stand. jmo

This case scares me. I want Peterson to pay but I don't think it'll happen. *sigh*

Not sure why putting Stacey's name on the witness list is supposed to be reasonable doubt. She's not there because Peterson probably did something to her.

This trial scares me too. Unless the prosecution has some pretty strong evidence of something...I'm afraid he will walk. He is very manipulative and not a dummy, I totally believe he did what he said he would do. Set it up to look like an accident and he walks.

I remember his engagement to Christina. I know many fathers don't like their daughter's choice in men, but Drew Peterson would be any father's worst nightmare by far.

Charles Manson and Scott Peterson, among other convicted murderers, are often able to convince women of their innocence and receive a lot of gifts and marriage proposals in prison. Luckily they will probably never get out of prison and the women aren't in danger. thanks to each and every one of you for keeping me up to date on this Drew Peterson trial. I never knew anything before about Cristina. After watching the video ...she seem a tad slow, doncha think? Or maybe - just being so careful of what she says.

Laughing I have NO clue about her or the case either, I'm just getting caught up too. But, boy, were there some uncomfortably long pauses after the questions. I bet whatsherface was thinking 'come on, lady, SPEAK!'.

Here are some of the hurdles to getting a jury to convict Drew Peterson that were pointed out in the article.

  • No eyewitnesses or confession.
  • No DNA evidence, fingerprints, hair or tissue samples.
  • The prosecution case depends largely on hearsay statements by Kathleen Savio and Stacey Peterson.
  • Prosecutors may have a tough time convincing jurors that Kathleen Savio was murdered since her death was initially ruled an accident before being changed to a homicide after a new autopsy.
  • If jurors buy that Savio was murdered, they still may not believe there is enough evidence to prove that Peterson was the one who killed her.

Thanks J4A, have been having a small snicker here...thinking maybe most of the strange-odd dummies might be in Pineallis county. So - maybe Illinois is a lot different. I can hope.....

Hopefully Illinois is different Summer. The Pinellas jury is a good example of a jury not believing the victim's death was a homicide.

Being from Illinois, I sure do hope it will be a jury that considers everything carefully. My fear is that he won't be convicted since there was no investigation into Kathleen's death on that night-which leaves out alot of evidence that should have been collected.

No sir, I don't take the newspaper, it has nothing but bad news in it so I don't want to read it.

oh my estee, I'm sorry I painted you with the same paintbrush as those jurors from that trial. I wish you'd been on that jury too. I think you'd still be the reason the dessert lady was coming by daily. I'm not kidding, I'll sleep better knowing that there is actually one smart cookie in that county. Drew Peterson Murder Trial Could Hang on Words of Two Absent Women

Kathleen Zellner, a Chicago attorney who has been following the case, noted that the prosecution is expected to try and use statements that Stacy Peterson made to her minister before her disappearance, in which she said that Peterson had admitted to killing Savio. If the judge admits the hearsay statements of Stacy Peterson, the testimony could be damaging to Peterson, she said.

"What the judge is going to do is he's going to wait and make individual rulings each time the prosecution tries to introduce hearsay, not give a blanket ruling, but listen to see if they open the door in some way that makes the hearsay admissible. He'll make this a day by day ruling on these different pieces," Zellner said.

"Essentially we've got Peterson confessing the murder of Savio to his fourth wife, but we still have the question of whether that will come in," Zellner said.

Here is more hearsay that may be admitted.

  • Stacey Peterson's statement to her minister about Drew coming home with women's clothing around the time of Kathleen's death.
  • Kathleen Savio's statement to her sister that Drew threatened her with a knife and said he could make her death look like an accident.

Besides the hearsay evidence, the case hinges on whether the jury gives more credibility to the the prosecution experts or the defense experts regarding Kathleen's death. The defense experts will say that her death was accidental while Larry Blum will testify for the prosecution and explain why he changed the cause of death to homicidal drowning.

In the Sandusky case we heard from a juror who stated Sandusky's demeanor during the trial was something he noted. In the Peterson case we watched a nonchalant, flamboyant play to the camera's, mockingly seeking the camera to seemingly say "catch me if you can". We soon realized Stacey Peterson was not just missing, she was dead.

What will the jury see to bring them to convict this former detective of the murder of the wife before Stacey,.. who evidently thinks he learned his trade so well he could outsmart the system? JMO
