A SAFETY audit of Sydney Road is slated to come before Moreland City council tonight, with more CCTV and better lighting around the strip to be considered.

It follows the emotional response to the death of Jill Meagher, a 29-year-old Irish national, who went missing from Sydney Road last month.

Coburg man Adrian Ernest Bayley, 41, is set to face the Melbourne Magistrates Court in January charged with her rape and murder.

Abusive partners face crackdown

TOUGHER penalties for abusive men, relationship education in schools and intervention programs for violent adolescents are part of a Baillieu government bid to reduce family violence.

The state government yesterday launched an ambitious action plan to stamp out violence against women and children, with Premier Ted Baillieu paying tribute to Jill Meagher and Sargun Ragi.

''We can't [launch the plan] without reflecting on the unspeakable violence that has been perpetrated [on] women and also children in our own community, particularly in recent weeks,'' he said.

Safe public spaces have been in focus since the death of Jill Meagher but it’s usually more familiar dangers that threaten women. Violeta Politoff on what shapes community concern about violence against women

Australians have been deeply affected by death of Jill Meagher. Community reactions to this tragedy have been overwhelmingly caring and emotional; and the people of Melbourne have shown their unwavering support for Jill, her family and for the safety of women and girls in our communities.

The public outcry and media coverage of this case has held particular interest for me as I work researching media coverage of violence against women, and recently co-authored a report with Professor Jenny Morgan and published by VicHealth, on the past 20 years of coverage of the issue.

Witnessing the Jill Meagher case unfold, I could see that this tragedy had the power to bring Melbourne’s communities together over the issue of violence against women. But as the story developed it became clear that what happened to Jill wasn’t being linked to the broader issue of violence against women. Instead, personal safety has taken centre stage.

Suppression order sought in Meagher case

A lawyer for a Melbourne man charged with murdering ABC staffer Jill Meagher has applied to suppress his image.

Lawyer Helen Spowart told the Melbourne Magistrates Court on Wednesday there was material on social media websites that expressed hatred towards her client Adrian Ernest Bayley and speculated about him.

'It is clear from this material that the accused is a target of intense and almost unprecedented attention, scrutiny and speculation as to his background,' she told the court.

A LAWYER for the suspect in the Jill Meagher murder case yesterday made a pioneering application to gag aspects of social media coverage.

Victoria Legal Aid lawyers acting for the man accused of raping and murdering Ms Meagher applied in court to ban material about him being featured on the internet.

A magistrate has adjourned a decision to today on whether to suppress the publication of images of Ms Meagher's accused rapist and murderer, Adrian Ernest Bayley, in any forum.

A magistrate has granted a suppression order on information about the background of Jill Meagher's alleged killer.

But the magistrate refused an application for an order suppressing the image of Adrian Ernest Bayley.

Deputy Chief Magistrate Felicity Broughton said on the information before her, identity was not an issue in the case.

A legal academic has slammed claims that widespread social media coverage of Jill Meagher’s death will prevent her alleged killer from getting a fair trial – pointing to America’s jury selection process as a way to weed out juror bias.

Hugh Selby, an associate professor specialising in advocacy and court craft at Australian National University, told Lawyers Weekly that there is no evidence to support the claim that social media is influencing jurors “to such an extent that they can’t bring an open mind to court”. While he admitted that common law has not yet caught up with social media, he said that blaming social media for juror bias is “bullshit”.

JILL Meagher's accused murderer was tipped off by a public official that he was under investigation as police closed in.

Adrian Ernest Bayley, 41, was told he was a suspect in a serious crime in the hours before he was arrested and while under surveillance.

Police will allege Ms Meagher was raped and strangled in a Brunswick laneway soon after she was filmed on CCTV.

Prosecutors will also allege her killer then left the scene and returned later to dispose of her body in Gisborne South.

As part of routine procedure, Mr Bayley's DNA is being cross-referenced with samples taken from numerous sexual assault victims across the state.

Police considered a review into whether the tip-off by the public official, which had the potential to obstruct the investigation, amounted to a serious breach. But after inquiries they decided not to take the matter further.

Night rally wants to reclaim road

ORGANISERS of Reclaim the Night want to march down streets in the city instead of footpaths as participatory numbers swell following Jill Meagher's death.

Kate O'Brien, of the University of Sydney's Reclaim the Night organising committee, expected a record turnout for the protest against rape and sexual violence on Sunday, October 28.

''We've already got more than 800 people saying they will march on Facebook,'' Ms O'Brien said. ''That's unprecedented.''

She said the spontaneous reaction by more than 30,000 Melburnians on September 30, who walked down Sydney Road in Brunswick to mourn Ms Meagher, showed how deep the issue ran through society.

No authority has denied that the prime suspect in the Meagher murder case had been tipped off before he was arrested. But why did police authorities decide to not look further? Who are they protecting?

I suspect your reaction was similar to mine: How the hell could that happen? And the immediate follow-up question: Who was it? Who did it? And why?

Who in their right mind would tell a person that he was a suspect over the abduction and murder of Jill Meagher while he was under Police surveillance?

For legal reasons, which will become apparent after this trial is over, I have to withhold some details but I can tell you that this person works for the Justice Department.

I would hope that the Premier of this state and the Police Commissioner and the Police Minister have been asking a lot of pertinent questions since this story broke.

I would hope the employee involved has at least been stood down pending a full investigation.

A PROPOSAL to plant a memorial tree at the site Jill Meagher's body was discovered has divided the close-knit Gisborne South community.

Backers say a flowering tree would be a fitting tribute to Ms Meagher's memory, but opponents fear a permanent memorial would draw too much traffic to the area. The local council said last night it would only allow the proposed memorial to proceed if Ms Meagher's Perth-based parents were in favour of it.

Diggers Rest man caring for Jill Meagher site

A DIGGERS Rest man has visited the roadside site where Jill Meagher’s body was found every day, vowing to keep the memorial in order.

Bruce Wood, who does not have a personal connection with Ms Meagher or her family, said he could not explain why her death had hit him so hard.

"I'm here every day, keeping the site tidy," he said.

"Right from the start I just felt like I should look after the place."

And now Mr Wood wants to plant a tree as a lasting memorial to Ms Meagher at the Toolern Vale site.

Neil Mitchell has again attacked the accountability of American social media giant Facebook after discovering a hate page celebrating the violent death of ABC employee Jill Meagher.

The disgusting page contains offensive statements such as:

"Thinking about my life, I deserved to die, I was a horrible b**ch anyway."

Dozens of complaints have been sent to Facebook, but the company refuse to act upon anything that doesn't breach their terms and conditions.

Facebook typically responds with an automated message: "We do not remove distasteful content," it says.

I DON'T think I'd be alone in saying that the aftermath of the Jill Meagher rape and murder has left a deep impression on me that I feel sure won't fade for a long time. If ever.

There are few of us women who haven't had the conversation recently about "that could have been me" or "that could have been you".

Anyone who's been out late, had a few drinks and then made their own way home without a friendly escort has felt the shudder of what-ifs?

Although we all wish from the very core of our hearts that Jill Meagher was still alive, the way to really honour this young woman violently robbed of her life is to forever remember her "what-ifs" so we protect ourselves from our own.

Around 5000 people have marched against "victim blaming" in a Reclaim the Night rally, following the alleged abduction and murder of Melbourne woman Jill Meagher.

Protesters gathered on the corner of Barkly Street in Brunswick at 7pm tonight.

Organiser Natalie Pestana told The Age she wanted to counter the notion that women bear some responsibility for preventing harassment and sexual assault.

"Women grow up with a different set of rules," she said.

"We're taught to keep a key between our fingers in case we're attacked and check the back seat of our car. These are things that guys just aren't made to do.

"We're pissed off and annoyed that women are being blamed when they're the victim of an assault."

Violent death prompts restraining order rethink

Last month, around the same time Australians were horrified by the murder of Melbourne woman Jill Meagher, another woman was also killed in the city.

But her death went largely unnoticed.

Sargun Ragi, 23, appeared in court shortly before her death to extend a restraining order against her husband, Avjit Singh.

She was initially too scared to be in the same courtroom as him.

Magistrate John O'Callaghan expressed his concern at the time.

"I'm a bit concerned that she's not in court. I mean, I can understand people being scared of someone, but we've got police protection here," he said.

Mr Singh had been banned from any contact with his wife but had breached the restraining order eight times in three weeks.

Violence against women: our hidden shame

Public grief for Jill Meagher was real and raw, but our action on violence against women is haphazard, erratically funded and all but entirely ignored, writes Katie O'Byrne.

On September 25, 2012, barely two days before Jill Meagher's body was discovered in its lonely resting place, it was announced that all Australian governments had finally agreed to an implementation plan for the first stage of the National Plan to Reduce Violence against Women and their Children 2010-2022.

Amidst the public anguish for a young woman snatched savagely away, there was virtually no coverage of this announcement in the mainstream media. As politicians squabble about sexism in modern Australia, we should be reminded that action on violence against women - the most insidious form of misogyny and gender discrimination - must be more visible and better-coordinated.

Jill Meagher accused treated for self-inflicted wounds

A MAN charged with the rape and murder in Australia last month of Irishwoman Jill Meagher is believed to have tried to take his own life in prison and has undergone emergency surgery for self-inflicted wounds.

Adrian Ernest Bayley (41) was taken by ambulance yesterday morning from Melbourne Assessment Prison in Victoria.

He was brought to St Vincent’s Hospital in Fitzroy, Melbourne, where he has undergone emergency surgery and was recovering in hospital today.

The Australian department of justice confirmed a prisoner had been taken from the prison for treatment but the nature of the injuries was not stated.

Mr Bayley, from Coburg in Melbourne, was being held in custody at the maximum-security prison where he was found bleeding from extensive wounds on Sunday morning local time.

Adrian Ernest Bayley was rushed to a Melbourne hospital yesterday after reportedly attempting suicide.

THE accused killer of Jill Meagher, Adrian Bayley, cut himself after being told by his girlfriend she no longer wanted to see him, it has emerged.

Mr Bayley, who has been remanded in a protection unit of the Melbourne Assessment Prison in Spencer St, had been lying prone overnight after he cut his wrist, elbow and ankle.

Staff found him unconscious in his cell during morning muster.

It is believed Mr Bayley had been trying to convince his girlfriend to stand by him as he faces murder and rape charges.

A stone memorial to honour Jill Meagher has been removed from the remote roadside where her body was found.

LORD Mayor Robert Doyle says he had hoped part of a street art tribute to murdered Melbourne woman Jill Meagher would be kept as a permanent memorial.

Graffiti artists painted over the memorial over the past few days.

In memory of Jill Meagher, The Sharon Shannon Band will perform 2 Benefit Concerts at The Spotted Mallard Brunswick, Melbourne on Friday 11th and Saturday 12th January 2013. App new weapon against assaults

A FREE app, inspired by the death of Jill Meagher, that uses GPS technology to report sexual assaults will be up and running within months, according to the state's leading body against abuse.

The Centre Against Sexual Assault expects the app will help lower barriers for assaulted women who do not want to report incidents.

The head of the south-east branch of CASA, Carolyn Worth, said the agency was developing the app - the first of its kind in Australia - to record patterns of crime against women. The idea for the app came after the death of 29-year-old Irish national Jillian Meagher in September.

Jill Meagher benefit concert

Irish musician Sharon Shannon and her band are to play two benefit gigs in Melbourne in memory of Jill Meagher. Sharon will perform at The Spotted Mallard, in Brunswick, on Friday 11 and Saturday 12, January.

A third of all proceeds from both performances will be donated to the Centre Against Sexual Assault (CASA).

For those who are not familiar with her, Sharon Shannon is an Irish musician that is best known for her work with the accordion and her trademark infectious smile. Sharon has had huge success with traditional Irish folk music, started playing the accordion when she was 11 and is one of Ireland’s most internationally successful artists.

The Melbourne man accused of murdering Jill Meagher is contesting his case and will face a committal hearing in March.

Adrian Ernest Bayley, 41, who is charged with murdering and raping the Irish national, will face the Melbourne Magistrates Court later on Friday.

A morning callover of cases before Deputy Chief Magistrate Felicity Broughton was told an application by Bayley to cross examine witnesses at the committal hearing would not be opposed.

There will also be an unopposed application to extend a suppression order, the court heard.

Coburg man Adrian Earnest Bayley, 41, has appeared via video link to the Melbourne Magistrate’s Court today and will contest the charges of the rape and murder of Brunswick woman Jill Meagher. mojo’s Georgie Moore was in court.

ADRIAN Earnest Bayley, charged with the rape and murder of Brunwick woman Jill Meagher, sat slightly hunched in a dark coloured shirt that contrasted against his pale skin and reddish hair, and stared blankly past the camera.

Asked if he could hear Magistrate Felicity Broughton, he answered flatly, “Yes I can.”

Bayley, 41, from Coburg, appeared via video link from the Melbourne Assessment Prison at 12pm for today’s committal mention in the Melbourne Magistrates Court. He will contest the charges of the rape and murder of Jill Meagher in September last year.

COMMITAL HEARINGS

A committal hearing is a preliminary hearing held in the Magistrates Court to determine whether there is sufficient evidence for an accused person to stand trial in a higher court on a serious (“indictable”) offence.

The committal hearing is the most common procedure by which criminal cases are transferred from the Magistrates Court (where all cases start) to the appropriate higher court (the District Court or Supreme Court, as the case may be). It is not always the case that people charged with indictable offences go through a committal hearing however. For example, an accused person can elect to bypass a committal hearing and proceed straight to the higher court by requesting an “ex-officio indictment” from the prosecuting authorities. (Such a course is usually only adopted though where the person charged wishes to plead guilty without challenging the prosecution allegations.)

Most cases however proceed through the Magistrates Court and into the higher courts by way of a committal hearing. A committal can generally take two forms, either a “full hand up” committal or a committal involving evidence from some or all prosecution witnesses. Either way, the matter proceeds before a Magistrate acting alone.
