This time delay angers me.
There was NO reason for this, IMO.
A jury should have been selected and seated within weeks rather than this prolonged delay.... that the defense HAD asked for and WAS denied. Oddly, it is working out exactly like they wanted, isn't it?
I wonder IF we will see a new jury before January....

Yup! Not that we can trust much of what HLN reports but this AM they said they are going to have a settlement conference on Oct 24th.
I gotta tell you that, that makes me mad too cuz they had better not give her a sweet deal.

I SURE HOPE THAT THE STATE DOES NOT SETTLE WITH JODI AT THIS POINT. ESPECIALLY AFTER SEEING THE ABOVE VIDEO REFRESHING THE MEMORY OF CERTAIN EVENTS, AND NOW THAT THE DEFENSE HAS ALREADY PROLONGED THE PENALTY PHASE THIS LONG WITH THEIR INCESSANT GAMES, WHAT IS A FEW MORE MONTHS? I WANT TO SEE THIS EVIL WOMAN GET THE DEATH PENALTY, AND I AM SURE TRAVIS' FAMILY AND FRIENDS FEEL THE SAME. I HOPE THAT JUAN WILL PERSEVERE AND GET A NEW (SMARTER) JURY, AND SEE THIS TO THE END, EVEN IF IT MEANS MORE TIME----JMO.

Approx. 65% of cases go to such conferences.

It does not mean Arias has or will be offered a plea. It is merely a chance to reach a mutually agreeable resolution without going to trial and was possibly initiated by the court.

Convicted killer Jodi Arias may get the chance to save herself from the death penalty when she sits down with Arizona state prosecutors for a settlement conference on October 24 to discuss a possible plea deal in her case, HLN has learned.

A plea deal would allow Arias to avoid a retrial of the penalty phase of her case, proceedings made necessary because the initial penalty phase of her trial ended in a hung jury. Her first-degree murder conviction from May 8 still stands, and so does the jurors' finding that Arias murdered her former boyfriend Travis Alexander in a "cruel manner."

Judge Sherry Stephens, who presided over Arias' trial, will not handle the settlement conference. Instead, Judge James Keppel will preside over the meeting that could decide Arias' fate.

For the penalty phase retrial, a new jury would be selected, and those jurors would decide only whether Arias will be sentenced to death via lethal injection or life in prison.

However, at this time, the intentions of both sides -- the prosecution and the defense -- are unclear. Jerry Cobb, the public information officer for the Maricopa County Attorney's Office, told HLN that neither side has presented an outline of an agreement or an official position on a settlement. Cobb also says prosecutors have not withdrawn the death penalty.

On Friday, Arias and her attorneys will have a closed door evidentiary hearing before Stephens. Cameras will not be allowed to record the proceedings, but the judge is expected to hear arguments concerning a potential expert witness for the defense. There is also a hearing scheduled for October 4, but it is not clear, in light of the settlement conference on October 24, whether that hearing will be held.

From what I have read, she is a valid and old fashioned "foot" journalist covering crime stories.
She was in the court for the trial.
She did conduct her own interviews.
She pulled records and did a lot of research of the Yreka area.
IMO, from comments I have read of hers, she is valid and even.  
HLN often interviewed her or had her a a guest.

Oh, boy. Big disappointment. I really liked Dave Hall.
Turns out Hall was part of the three person "team" destroying property by toppling the boulder in the national park. What a bummer!

DON'T BUY THIS BOOK, IT'S AWFUL!

I am so sorry I wasted my money on this book. I watched every day of this trial and know the case intimately. This book is so poorly researched and written. The author relies on JODI'S WORDS, AND PARROTS HER with regard to information on the nature of her relationship and on Travis himself!
Obviously she was hoping to cash in on the case, which wouldn't have been terrible if she had written an informative and meticulously researched book!
This is garbage, and although the author condemns Jodi, she also gives credence to her lies!
THIS BOOK IS A REAL STINKER, AND A TOTAL WASTE OF TIME. THERE IS MUCH MISINFORMATION, AND IT'S SO OBVIOUS SHE JUST WROTE SOMETHING QUICKLY TO MAKE A BUCK OFF THE CASE.
Please don't waste your time or money on this ridiculous, immaturely written book.

Arias said in a 12-page handwritten narrative that her lead attorney, Kirk Nurmi, had not seen her since May 23, the day the jury reached an impasse on whether to sentence her to life or death. She claimed that she attempted to fire him in June as well, but Judge Sherry Stephens did not grant her request.
 
LOL he's probably jumping for joy! Hodi says Kurt has an utter poverty of people skills (meaning he doesn't buy her B.S.)

IMO, it means he told her to back off the sexual advances she was putting on him...Judge will again say no... This last part is relatively short so I wish they would just do it. As it is, def got what they wanted and the end won't be heard probably until next year! Ridiculous and dangerous... Some of the witnesses may not be available and Dave Hall is busying screwing up his own credibility.

The parties have agreed the settlement conference scheduled for October 24, 2013 should be closed to the public and the media. The settlement conference was scheduled by agreement of the parties and is subject to the provisions of Rule 17.4, Arizona Rules of Criminal Procedure, and Rule 410, Arizona Rules of Evidence.

The court finds an open proceeding for the settlement conference presents a clear and present threat to the due administration of justice, specifically, the right of the parties to a fair penalty phase trial by an impartial jury. See Rule 9.3, Arizona Rules of Criminal Procedure. The court finds there is a compelling interest that overcomes the right of public access. Specifically, there is a substantial probability that publication of information provided during this settlement conference could taint the jury pool and significantly impact the parties’ ability to effectively present matters at trial. In addition, the presence of the public or media may inhibit the free flow of information, including statements by the victims and/or the defendant. This is especially important here since the only issue for the jury will be penalty. The court also finds that, in light of the intense media coverage of this case, there is no less restrictive means to achieve these compelling interests. Good cause appearing,

IT IS ORDERED closing the settlement conference scheduled for October 24, 2013 to the public and the media.

Arias was in court today for a settlement conference before retired Maricopa County Superior Court Judge James Keppel. A court spokesperson relayed the message that no agreement had been reached and that Keppel was referring the case back to Stephens.

I just read her handwritten note on the Justice for Travis Facebook page. What a load of crap, excuse the French.  She starts off by saying he hasn't seen her for 5 months, but later on she says he's tried to see her twice and she refused to see him. Which is it?  It's the same old, same old Jodi BS.  I did have to laugh when she brought how much money he's been paid. I think this is just another stall tactic on her part, delaying the retrial and hoping the delay hurts the Alexander's even more and they will give up, cause she's still talking about Travis' pedophile tendencies. I wish this would end, but I know old judge Stephens, without even a kiss or lubricant will bend over and let the Hodi screw everyone again.

Also shows she is competent to participate in her own self defense issues...

These actions of hers may very well come back to bite her in the butt.
Much as I did not like slimy Nurmi, he IS doing his best to represent her. As she complains of lack of attention from him, she states she has turned him away several times when he has gone to visit her at the jail. Not his doing, JA! Further, how many times is she "pestering" him at his phone number? She understands that when this is over, she will be in PRISON for either the REST OF HER LIFE or a VERY, VERY LONG TIME and it will be in ISOLATION.

Had JA not killed Travis, BRUTALLY SLAYED HIM, the State of Arizona would be in a better financial situation. And so would The Arias clan.
Any financial woes they have they can blame on their OWN actions and how they chose to support their dau when SHE was at trial... and they were NOT. Further, Dad Arias? According to the family, he was fighting diabetes, cancer, respiratory problems so it is HIS situation when led him to bankruptcy and NOT the costs of HER attys... which the state of Arizona has paid handsomely for.

When it comes to attys, the state of AZ has paid for ALL her legal crap. Since they are paying and have contracts with said attys, JA can't now call the shots. Hoping to delay the final pronouncement, JA is wanting to switch horses in midstream in hopes she may languish in the Hilton Jailhouse rather than face prison...Sadly, JA, you will NOT be forgotten!

Just waiting and watching....

Sure would be interesting to see Kirk Nurmi address each of JA's "points" from his perspective. I'm sure he would tell a much different story. I only wish he had not made the "9 out of 10 days I don't like Jodi" comment at trial. I think that single comment is going to be a big deal in the appeals process. I hope not.

OMG, guys, what a laugh! I just read that rambling handwritten letter Jodi wrote to JSS! Doesn't this idiot realize that she is only making herself look WORSE and WORSE?! What a whacko she is! I can only hope when sentencing finally happens, this latest diatribe can be used against her.
THE TRIAL FOR GUILT OR INNOCENCE IS OVER. If she showed remorse instead of continually harping on the 'jury's wrong decision' and 'Travis' pedophilia', she might actually help herself to a life sentence instead of death!
This latest 15 pages or so of sheer crap only reinforces that this woman is a devious lying nutball of epic proportions!

I wish we could find out what happened at the settlement conference last week. I suspect it was an 'ordered' formality, and that the prosecution had and has no intention of backing off from a penalty phase retrial, and requesting the death penalty.
I am disgusted however, that this judge is letting this phase go for now almost 6 months, with no end in site. SO UNFAIR TO THE VICTIM AND THE ALEXANDER FAMILY.

ariastrialI apologize for the topic of this posting but I am compelled to voice my concerns.  As a former prosecutor and now white-collar defense attorney, it is painful to watch a criminal trial which is out of control.  ( I know that watching this trial is akin to admitting that I like to watch soap operas but my trial curiosity got the better of me).

There are two significant lessons learned from watching the trial.  First, a trial judge has a responsibility to regulate the actions of the parties in a trial.  As one federal judge confided in me – “The courtroom is my kingdom and I am the ruler of what occurs inside these four walls.”

The tone of a criminal trial is set by the trial judge and the expectations of the trial judge.  Commentators can criticize the behavior of the parties – the defense counsel, or the prosecutor – and even the witnesses.  In the end, the trial judge has to take control, has a responsibility to the jury, the victim and his family, and to the system to move the pace of a trial and confine the parties to efficient questioning and behavior.

Instead, what the American public is witnessing is a trial which is out of control.  The defendant testified for a total of eighteen days.  There is not one federal judge in this country who has ever allowed a defendant or any witness to testify for that long.  The extent of repetitive and improper questioning by both sides is so frustrating that trial lawyers everywhere are cringing at the trial judge’s passive approach to controlling the trial.  I can name 20 federal judges who would have finished the trial by now and would have demonstrated how to conduct a fair and efficient trial.
A trial judge has a responsibility to preserve and promote our system of justice.  Moreover, the trial judge has to demonstrate sensitivity to the victim of this horrific crime and move the trial to a conclusion.

A trial judge has to show the American public (and the world) why we adhere to standards of proof and constitutional protections when attempting to take the life or liberty of a defendant.  Unfortunately, what we have here is another travesty (much like Judge ito’s failure to contain the parties in the OJ Simpson criminal trial).  It is sad to watch from a trial lawyer’s perspective.

The second lesson learned – which partly is the result of my first point – is the behavior of witnesses on the stand.  When a supposed expert witness, like Alyce LaViolette , becomes a fierce advocate for a party they  lose their ability to persuade a jury.

Expert witnesses have to maintain their objective approach to a case, despite the fact they have been retained or called by one side to testify.  When presented with obvious contradictions or assumptions which would change their opinion or analysis, they have to acknowledge that their opinion  would change.  The failure to demonstrate flexibility of analysis can only be explained by inexperience and bias.  Witnesses can sometimes learn what not to do by watching other witnesses.  The Arias trial has given us plenty of examples of what not to do."
