Re: Jodi Arias--Trial for the murder of Travis Alexander #24
FROM USA TODAY:
"PHOENIX -- Jodi Arias, who has been convicted of first-degree murder in the 2008 death of her boyfriend, Travis Alexander, but has not yet been sentenced, filed motions in Maricopa County Superior Court this week to fire her main defense attorney.
Arias said Tuesday in a 12-page handwritten narrative that her lead attorney, Kirk Nurmi, had not seen her since May 23, the day the jury reached an impasse on whether to sentence her to life or death. She claimed that she attempted to fire him in June, as well, but Judge Sherry Stephens did not grant her request.
Arias writes that Nurmi has an "utter poverty of people skills" and "has little to no tolerance for my emotional and psychological shortcomings." She offered, as an example, her emotional reaction when the defense played in open court a lurid recording of a phone call between Arias and Alexander. Arias said she wanted the tape to be played in a closed courtroom only to the jury and not to the general public.
Nurmi could not immediately be reached for comment on Arias' motion.
Arias, however, speaks kindly of her second-chair attorney, Jennifer Willmott, who she said has borne the brunt of the work in the case.
Arias was in court Thursday for a settlement conference before retired Superior Court Judge James Keppel. A court representative relayed the message that no agreement had been reached and that Keppel was referring the case back to Stephens.
The lack of a deal was not surprising, given that there is not much room for negotiation. Arias is already convicted of first-degree murder, which carries the options of a death sentence, natural-life sentence or life with a chance of release after 25 years.
A death sentence can be imposed only by a jury, so the only discussion points would have been whether the County Attorney's Office would drop the intent to seek the death penalty and whether Arias would waive further appeals.
Earlier, Nurmi declined to comment on the settlement conference, as did County Attorney Bill Montgomery.
In his regular news conference Wednesday, Montgomery explained that he did not attend the settlement conference as he had intended because the "case is no different than any other case," he said.
"I don't see it as an important enough case to where I have to be personally involved to where I can't have the prosecutor who's responsible for the case take care of it himself," he said.
Arias, 33, was convicted of first-degree murder for killing Alexander in June 2008. Alexander, 30, was found dead in the shower of his Mesa home. His throat was slit, he had been shot in the head and there were nearly 30 stab wounds on his body. Arias admitted killing him but claimed she acted in self-defense.
Because the jury could not reach agreement on whether to sentence her to life or death, Arias faces a sentencing retrial.
Arias has another court hearing scheduled for next Friday."

Inside the crime lab that analyzed the Jodi Arias case
Posted on November 8, 2013 at 8:25 PM Updated yesterday at 8:40 PM
PHOENIX -- A bloody crime scene. A murdered man. And a mystery that caught the nation’s attention.
The pictures told the story of Travis Alexander’s final hours after he was stabbed and shot by Jodi Arias.
“It came down to, at that crime scene, documenting that scene. You don’t know what’s important. But visually, it’s your one chance to see what’s in the scene,” said Kimberly Fiorucci, Administrator of Mesa Forensic Services.

Wow!
I know I'm a smart-aleck, but seriously now she's changed her religion again? Someone she has come to know practices Tibetan Buddhism? She's a chameleon who changes to suit whoever it is she's hanging out with. I have to wonder what physical changes we will see when she reappears to finish out the rest of her trial with this new religion she is wearing.

In light of JA wanting to "fire" council I don't know if there will still be a hearing on the 15th, but we shall see. Maybe we'll get to see her whine about not getting enough attention from Nurmi. Good gosh, I hope she cannot win an appeal on his comment to the jury during his closing on not liking her 9 out of 10 days. Heavy sigh!

One-
IF JA feels she is not "getting enough attention" now wait a year or two when family gets on with their lives, attys have moved on, media has other cases, HLN is not interested... and she only hears the slam of the bars as the guards walk away. Think her "book club" will be fulfilling then? Will she be "witty" with her twitters or will the twitter=helper have fallen away, too?
She is clueless. Lives in lala.
Maybe the Violet will run to visit her or Dr. Dicky... IF they are interested in her, the case and have visitation....
Yeah. One is a lonely number....

BTW, One, many other attys have used that comment of not liking their client. I was surprised and wondered if that was said for appeals but was told it is not an unusual statement for the Def Atty to make; it helps to align jury members to the def by letting them know, while she IS despicable in many ways, it does not mean she is guilty...as the def atty has argued.
I have not heard of any cases being appealed on this.
JA is grasping at straws. Closing arguments are not evidence but simply opinion. Jurors are to consider the evidence only and not the opinions. IF opinions had that much weight, when the def atty said his client is NOT GUILTY, would that not bias a jury? Same for when the state atty said the def IS GUILTY, would that not bias a jury? Bias or give undue influence... tired so my words are twisted...

LOL Freckles. Don't you know she will be the warden of any prison she graces on the very day she arrives???, LOL.
Also thanks for the reminder of who and what is and isn't allowed in appeals.
Get some rest and we shall fight for justice again tomorrow.

Since the judge denied her request to fire Nurmi, I doubt it will have any effect on any upcoming hearings. Sounds like she's stuck with him through the bitter end. Well, Judge Stephens ineptness has struck again, ruling that there will be no cameras allowed in the retrial of the sentencing phase. It was all fun and games when Hodi, thought she could BS her way to an acquittal, but things got serious when she came out on the short end of the stick and was found guilty. No fun and games now that her pathetic life is on the line.

Judge bans live TV in Arias penalty phase retrial
November 15, 2013 5:24 PM
PHOENIX (AP) — Live television coverage of Jodi Arias' penalty phase retrial will be banned and the case will remain in Phoenix despite defense arguments that intense publicity will make it difficult to find impartial jurors, a judge ruled this week.

odi Arias prosecutor Juan Martinez has at least one private-sector job offer waiting for him after the high-profile murder trial is over. “I will make him an offer,” said Jordan Rose, managing partner of Rose Law Group in Scottsdale wrote:

I am confident the reporters will be filing stories at every break, every lunch, and after court each day.
JA is having her last little "illogical" temper-tantrum/fling.
No biggee.
We will hear at least 3 times a day.
And no matter what, she is toast!
IMO, JA probably does not want the cameras in the court because... drum roll....
she will be sporting her stripes! She does not want anyone to see her in jail house rock gear.
Doesn't matter. She is toast. Just get the show on the road!

"She said that if she was given the death sentence.. she wanted to get her revenge... she knows inmates on the outs to do a mafia bow tie.. yeah. Cut his throat.." Does she think Arias was threatening Martinez's life? "Yes, I do. I really think she would try to hurt someone." But at the same time, Cassandra says Arias had a strange curiosity about Martinez. "She asked me questions like why doesn't Juan Martinez love me? And I'm like, love you? He's your prosecutor.. he's there to prosecute you for a crime.. and I'm like why doesn't he love you?" Maricopa County, Arizona, Sheriff Joe Arpaio has planned a particularly economical meal for the roughly 7,500 to 10,000 inmates in his jail system this Thanksgiving. The meal comes in at a cost of just 56 cents per inmate, and its main entrée will be 24-cent vegetarian turkey soy casserole. Arpaio tweeted the Thanksgiving menu Wednesday morning. “Hope the inmates give thanks for this special meal being served in the jails tomorrow," Arpaio's tweet said. wrote:

Jodi Arias Fades From View As Case Unfolds In Shroud Of Secrecy
Published December 01, 2013
Published December 01, 2013
http://latino.foxnews.com/latino/news/2013/12/01/jodi-arias-fades-from-view-as-case-unfolds-in-shroud-secrecy/She has denied each request, but quietly with orders released days after the secret hearings as the case languishes without public scrutiny even as Arias' legal tab is being picked up by taxpayers at a cost exceeding $1.7 million. Meanwhile, in yet another element of secrecy, Maricopa County Attorney Bill Montgomery has refused to provide a tally of how much it has cost to prosecute the case, including paying for expert witnesses throughout the five-month trial. Stephens allowed virtually unfettered access to the first trial, which was broadcast live and became to fans like a real-life soap opera as they traveled from around the country to get in the courtroom. She now says the hearing closures are intended to protect Arias' right to an impartial jury, but Bondey says the judge has gone to the extreme, often simply locking the courtroom doors without issuing an order as to why, in violation of the Constitution.
"The public is deprived of its First Amendment right to attend criminal proceedings," Bodney said. "The public has a right to be heard before they're just locked out."
Even arguments by attorneys over media access to proceedings in the case have been closed to the media. wrote:

Why stop at Twitter handles. How about Facebook, LinkedIn, Pinterest, MySpace (yes it is still around and used by millions), Wikipedia, Disqus, Blogger, Wordpress, Tumblr, etc. Heck even their home phone and cell phone numbers as they might talk to someone about it. Take away their pen and paper because they might write about it while you are at it. This is nonsense and an over-reach into personal lives, even if those jurors may share some life details online. They have "other" reasons for wanting access to the social media profiles and accounts. "

Jodi Arias’ sentencing phase retrial will remain in Phoenix after a judge denied a second motion from defense attorneys to move the case because of intense publicity.
...Judge Sherry Stephens has denied both motions, noting Arias has failed to meet the burden showing media coverage of her case will inhibit her ability to get an impartial jury and a fair trial.

Travis Alexander’s family is still searching for justice from convicted killer Jodi Arias, and his brother has revealed that the sentencing trial for the woman he calls a ”monster that haunts us” will begin in February 2014.
...“Letting everybody know the trial isn’t due to start until mid February,” he wrote on Facebook, shared by the Justice for Travis page.
“We believe this is a tactic to try and get us to throw in the towel,” he said about the situation, but vowed that the family, who were in the courtroom every day during the trial, would continue to seek the death penalty for Arias.
“We will not! I say it again it won’t happen. Our family will come together and see it through until it is finished.”

I wonder if the penalty phase trial really WILL happen in February or if there will only be more delays and hystrionics from Jodi and her team... I hope for the sake of Travis' memory and the Alexander family that this is done once and for all in Feb.

Defense is dragging feet looking for loop holes to magically appear.
I am concerned with an appeal if this is delayed much longer.
Then again, IF that is what the defense has called for...?
Well, if JA states her attys were NOT acting in her accord AND the courts were notified... could be a whole new ball game.
I do NOT want a new game.
Shiver me timbers but I really don't care to sit thru 18 days of JA dribbling on and on about some sexual fantasy of hers.
The only point is sitting thru that would be to find the lies she crafted. Can she spin the same lie more than once? I dunno. She bores me tremendously. A little person with littler contributions.

MCSO: Arias wanted Milke as a neighbor in jail

Arias found out about that and made efforts to get Milke in the cell right next to her. Milke was on Arizona's death row for over two decades. Arias may soon be headed there, so maybe it's not that surprising to learn that when Milke was going through new court hearings this year and was briefly put in the Maricopa County Jail, Arias sent a request to jail administrators, according to the sheriff's office. That request: Would they put Milke in the cell right next to her? It's as close as you can get in this unit where women are housed one to a cell and the only way to speak is through a small metal grate in the door. The request was refused. A sheriff's office spokesperson releasing a statement saying simply, "We don't allow inmates to pick their cellies.. this isn't a hotel." wrote:
Both Arias and Milke will appear in court Friday. And both are crucial hearings. We may find out if that questionable confession of Milke's will come into a new trial and we may finally have a trial date for Arias' penalty phase. wrote:

Her sense of entitlement just astonishes me! Why on earth does she think she has any rights to ask something like this?

Jodi Arias Trial Update Today HLN: Next Hearing Date Set for Jan. 3
Transcripts Show TV Didn’t Catch All The Drama; Key Witness Never Took the Stand

Recently unsealed transcripts show the Jodi Arias trial had everything, screaming matches, harsh interrogations and examinations. But some of the most exciting aspects of the Jodi Arias trial didn't happen when the cameras were rolling.
...The transcripts show that Patricia Womack never testified because she was supposedly under death threats. Womack refused to appear on the last day of court. Patricia Womack was a key final witness for Arias. The transcripts show that Martinez told the Judge that she had a drug problem and was skipping her trial date because she was afraid she could be found guilty of violating welfare regulations. Martinez is also heard saying that Womack was hiding money she made from pictures she had sold to a TV station.
Kirk Nurmi, one of Jodi Arias' attorneys, pleaded to Judge Stephens that the case should be thrown out, and that Arias should be retried because Womack refused to testify because she received "threats on her life if she were to testify on Ms. Arias' behalf."

Will Jodi Arias get life - or death - in 2014?
First in a series: Crimesider's cases to watch in 2014
By/Stephanie Slifer/ CBS News/ December 26, 2013, 8: 11 AM
One of the most closely-watched murder cases of 2013 will be making headlines again in 2014, as Jodi Arias is expected to return to court for sentencing.
On May 8, Arias was convicted of first-degree murder in the June 2008 death of her one-time boyfriend Travis Alexander. But when it came time for sentencing the jury failed to reach a unanimous decision on whether she should get life in prison or the death penalty. Her fate has since been in limbo.

Jodi Arias Wanted to Kill Prosecutor If She Got the Death Penalty: Former Cell Mate
[quote=" Jodi Arias wanted to kill prosecutor Juan Martinez if she got the death penalty in her trial, her former cell mate says. The first phase of the trial ended without a definite sentence, prompting a second phase that begins on Friday. Arias could still get sentenced to death.
Arias “is very dangerous,” Cassandra Collins, the former cell mate, told Fox News. Collins said that Arias vowed revenge if Martinez succeeded in getting the death sentence. “She said that if she was given the death sentence, she wanted to get her revenge,” Collins said. “She knows inmates on the outs to do a mafia bow tie, cut his throat.” Collins said that Arias underwent a prison-wide campaign to convince the other inmates of her innocence. “She’ll try to suffocate you with her version and her side,” Collins said, adding that it was a form of manipulation. In addition, Arias seemed to have a strange fascination with Martinez. ....
The next hearing in the trial is scheduled for January 3, according to Steven Alexander, the brother of Travis Alexander, who Arias murdered. However, the actual trial isn’t due to start until mid-February, he said.
“We believe this is a tactic to try and get us to throw in the towel. We will not! I say again it won’t happen,” he said via the “Justice for Travis Alexander” Facebook page. “Our family will come together and see it through until it is finished. There is a monster that haunts us, but once the correct sentence is given, it’s her who will be haunted until the most the most humane punishment comes to her. Nothing compared to the sentence she gave to a good man. Anyhow, the entire Alexander family thanks all of you. Thank you for having our backs.” "][/quote]

Jodi Arias Trial Update: Friday Hearing Yields No Re-trial Date; Next Argument Set for Jan 19
January 3, 2014

A hearing in the Jodi Arias trial on Friday, January 3 yielded no re-trial date.
The closed door hearing–the public and media have been barred from the trial since late last year–did not end in a set date for which to re-start the trial.
The next oral argument regarding the set date is scheduled for January 13 at 9:30 a.m., according to the blog Court Chatter.
“As parties emerged from the courtroom, prosecutor Juan Martinez looked pleased while [Arias attorneys] Kirk Nurmi and Jennifer Wilmott did not,” the blog said.

She often uses the social media platform to solicit donations and promote her original drawings. However, a few days after Christmas, she tweeted what seems to be her frustration with not being able to directly control her blogs from her jail cell.
"The problem w/ blogging from jail is that I am completely reliant upon the person whom I've entrusted to post my entries," wrote the 33-year-old on Dec. 29.
"So when that person takes liberties w/ my blog and posts things I didn't authorize (or author), there's not much I can do about it other than hope the one pulling the strings removes it--then blame self 4 lacking discernment w/ whom I entrusted control over my blog," she continued.

Gee whiz, how long is this going to be dragged out? It's a re-try of the penalty phase for gosh sakes! This judge is ridiculous for letting this go on for more than 8 months beyond the LAST penalty phase. I am damn sick and tired about hearing about "Jodi's rights". At this point her rights have been more than honored and protected! It is time for justice for Travis and for the entire Alexander family.
If her attorneys are so desperate to be rid of her why are they constantly dragging this out longer and longer?!!!
