Reason for the appeal: Star Chamber

"....The concept of a public trial came directly out of a medieval court called the Court of Star Chamber. It was a court that began with good intentions, to make nobles equal to peasants under the law. But it was flawed. The court was secret, deliberations were secret and judgments were final. There was no oversight. The court eventually became a political weapon. Disagreeing with your appointed lawyer was considered a confession.

The Star Chamber was one of the reasons the Puritans left England for America. And it was directly responsible for the concept of a public trial being written into the U.S. Constitution. The framers of the Constitution didn't want courts like that to exist again. No one trusted their judgment or their justice.

And all it takes to erode confidence in courtroom 5C of the Maricopa County Superior Court is to let this ruling stand.

We've been accused of "whining" about our access being cut off. This isn't about us. You're barred from this trial, too. You can walk into almost any courtroom in the country right now and see justice done ... except this one.

Judge Stephens was right about one thing in her reasoning (I wish I could tell you she was right about more than that but she has sealed her ruling and her reasons as well, I suppose believing that we will simply trust her judgment). This is a death-penalty trial and it deserves a higher level of caution and justice than any other. Which is why every aspect of this trial should be public. ..."

Tuesday to discuss the implications of Monday's Arizona Court of Appeals ruling barring secret testimony until an appeal by the media is decided by the higher court.

The upshot of the hearing, which the jury did not attend, is that there will be no testimony at all until next Wednesday at the earliest.

Last Thursday, Maricopa County Superior Court Judge Sherry Stephens cleared the courtroom as the first of Arias' witnesses took the stand.

The media, including The Arizona Republic and 12 News, immediately contacted attorneys and asked Stephens to stop the secret testimony until its side of the story was presented to the Court of Appeals. Stephens refused. But on Monday, a three-judge panel issued a stay on closed-session testimony pending consideration of the media "special action," which is an expedited appeal conducted while trials are in progress.

After the ruling Monday afternoon, Stephens huddled with prosecutor Juan Martinez and defense attorneys Kirk Nurmi and Jennifer Willmott and then announced that they had a difference of opinion. On Tuesday morning, they discussed the "difference" in Stephens' courtroom.

Nurmi said the "media interference thrust upon" Arias was unconstitutional. He told Stephens that he did not want to call any witnesses until the matter was decided by the Court of Appeals....."

PHOENIX (CBS5) - There won't be any witness testimony in the sentencing re-trial of convicted murderer Jodi Arias until Nov. 12.

The delay is the result of an Arizona appeals court ruling that stays a decision by Superior Court Judge Sherry Stephens to ban media and the public from the courtroom for testimony from the first witness called by Arias' defense.

Attorneys on both sides continue to meet with Stephens to determine how to move forward after the three-member appeals court decision.

Lawyers for three Phoenix TV stations and the Arizona Republic wanted the testimony halted while they appealed Stephens' earlier ruling that would have allowed the unidentified defense witness to testify in private.

The Arizona Court of Appeals' panel Monday placed that ruling on hold.

He is trying for a mistrial not due to jury error but due to the judge...hoping to get both the conviction and potential sentencing tossed out....She needs to crack down and take control NOW. She has allowed too much latitude for the defense and as they say, "Give the rat a cookie and he will ask for a glass of milk..."

WHY would EACH of the witnesses take TEN or TWENTY days on the stand?

This is NOT the body of the trial but simply the housekeeping of sentencing....

Judge wanted them back in court ASAP.

well Hodi if she is the secret witness knows that will take her at least 18 days to win some sympathy… methinks that should she take the stand and muster all of her psycho acting abilities and cry and babble on instead of prattling like she usually does could swing it much more effectively without showing her twisted chewed on lady bits and actually appear to be beyond remorseful this jury would then give the life sentence.. however, I do hope that she plays it her way and disgusts those on the jury into saying enough DP for you.. do not pass go and do not collect anymore donations.. as if anyone really donates to that fund… omg how the thought of that irritates me! thankfully I do not live there as I would boil at the thought of my hard earned $$ in taxes go to put on the sideshow that is the Arias trial.
