Is it just me or is Nurmi's flying by the seat of his pants? So he didn't think far enough ahead to have an actual witness on tap, ready to go when Juan was finished with his case in chief? Is he letting his witnesses dictate when they feel like testifying? Or is he just too busy raising multiple objections, having double digit sidebars daily and filing frivolous motions. Poor, poor jurors. What a total cluster.

He got nuttin', IMO. Which is why he keeps jumping from one half baked scheme to another. A Bishop being told he may be a liar? Oh, my! Insulting Deanna. Then yelling at DeMarte? He keeps throwing the bs out there and trying ever so hard to make it sound like IT IS IMPORTANT for saving JA's life... He is wearing out his audience. (Rule of acting: Know your audience and play to them...) Nurmi is spinning in circles because he does not know where to go next. Bad lawyer, IMO. He yells, insults with words and pictures, and he only talks SEX. That is NOT part of this case... He is not defending a sexual predator....

That is exactly what I thought when I heard that yesterday. Gosh, this is SO unfair to this jury---And hells bells, can you imagine having to hear more of the same crap from those two over and over, with a liberal sprinkling of sex talk and let's-trash-Travis from Nurmi???

You know, I feel that Jodi Arias has gotten MORE than a fair trial. The costs for this one prosecution and defense have run over 3 million dollars already, and all borne by taxpayers. I watched the entire trial so far, and I see that she has been given every advantage, chance, etc., and MORE than I think A LOT of defendants out there are getting. I hear a lot about protecting the verdict against appeals but my God, this is truly ridiculous!
This cold blooded killer got a more than fair trial, with little expense spared. The judge (to my disgust at times) has bent over backwards to give Jodi concessions, some that are debatable in my opinion.
I am sick of this--- sick of JW's shrill screeching of FRIVOLOUS objections, of Nurmi's incessant cry-baby motions, and of this court generally going overboard in it's efforts to give the defendant a "fair trial".
Enough is enough. I do wish JSS would just get those two hired guns for the defense on the phone and order them to court---Geez, this jury has rights too! If those two Dr. GooFees are 'inconvenienced', oh well, too damn bad---$250. an hour or whatever their extravagant compensation can make up for a lot...I wish that she would put some limits on the time they can testify. After all, this is now a SURREBUTTAL. I can't even imagine what the heck could take Hired Gun Geff 2 more whole days to say after the ridiculous ass he made of himself the first time around, and we all know that Juan's cross will probably be about 30 minutes of that, and that's only because of the constant objections and sidebars initiated by the defense.
Not only all of the above, but I also have not seen much 'MITIGATION' in this 'mitigation phase'. This trial has gone completely off the rails and it is time to put the brakes on and for JSS to rein it in a bit.
I don't think insisting Nurmi get his witnesses here in a timely manner and that he start having some consideration for all parties involved in this, as well as putting some kind of time limits at this point on how long this 'surrebuttal' can go on would in any way be denying Jodi a fair and thorough trial/defense!
UNLIKE THE PROSECUTION, NOTHING these last defense witnesses are going to say is going to come as a suprise to this jury, and is only going to cause stress for some due to delays, and more repetition and mind-numbing boredom, and for nothing! There is no mitigation happening here, people!

I wonder if they can see that this penalty phase has disintegrated into nothing more than a desperate attempt by Jodi and her 'team' to trash Travis Alexander THE VICTIM, even to pointless minutae accusing him of viewing supposed porn or dating sites. I wonder too if the jury, like so many of us, see NO MITIGATION HAPPENING IN THE PROCEEDINGS---No remorse from the killer, no witnesses to testify on Jodi's behalf (only nutballs who came out of the woodwork with more lies about the victim)---no apologies or pleas from Jodi herself, nothing.

Jodi Arias: So Was There Any Porn?
Yes and no. Mostly no.

This week in the Jodi Arias trial we revisit the porn question for about the millionth time. I think though that with the latest computer expert Robert Brown for the state, the porn question is put to rest (I know, sounds very naive, doesn't it?).

Here's why the whole porn issue was made out to be the big deal it was. In Jodi's highly convoluted story of what happened on June 4, 2008, she said that part of her fear of Travis's brutality had to do with her discovering his addiction to both child porn and his voracious appetite for conventional male/female porn. She claimed to two of her expert witnesses that the child porn was a single image of a child she caught Travis masturbating to while on his computer. During testimony, that computer image was changed to a paper image that fell "in that chaotic way paper falls" from Travis's bed to the floor, upright at Jodi's feet. While there is no evidence in text messages, emails, journals or for that matter Jodi's own behavior and reactions, to suggest there's any truth to this claim, Jodi claimed that Travis was so afraid of her spilling the beans, it turned him into an enraged brutal monster who was willing to kill her over a camera dropped on the ground from what amounted to a couple of inches.

Let me back up here for just a minute and let's ask ourselves just what kind of hot-head Travis was–

   December 2007—Travis believed Jodi was responsible for slashing all 4 of his tires one night. And then the next night he believes she's responsible for slashing all 4 of his tires once again. Eight tires in about 24 hours.

         Travis's response—He gets his tires repaired both times and then does NOTHING to Jodi.

   April 2008—Jodi destroys the BMW she just purchased from Travis. The damage would be in the thousands of dollars and wouldn't be covered by insurance.

         Travis's response—Rather than sue Jodi or show rage he merely asks that she pay him the
         paltry sum of $100 per month until the car is paid in full. At that rate is will be several years
         before Jodi will have paid off her car debt. In addition he has given her a sweetheart deal on
         the car, most likely losing quite a bit of money to give her the best price and terms possible.

        Jodi's response–Jodi missed the first payment in April 2008. She missed the May 2008
        payment. She also missed the June 2008 payment. In June she finally delivered a check to
        cover April and May, but is still missing June.  

       Travis's response—a terse request for payment almost 2 months after the due date.

   Early 2008—Travis discovers a diamond engagement ring intended for another woman is missing from its place in his dresser. He asks Jodi if she knows what happened to it. Jodi immediately lied and said 'what diamond ring?' and then came clean and admitted she had it and also admitted she knew it was stressing him out. So not only does she steal it, but she lies to him about it and then finally admits she has it.

        Travis's response—"it's ok, I'm not mad"

Anyone noticing a pattern yet? Big things of Travis's are destroyed or stolen and rather than react in a violent manner, Travis is upset but in control of his temper and even extends the courtesy of helping Jodi further.

In light of these situations, how do we make the leap from mild-mannered guy to raging maniac over a camera that was fumbled a few inches?

Jodi had several opportunities to see the very worst of Travis's behavior, and yet he never exhibited anything most of us would view as rage as a reaction. Jodi needs Travis to be a raging maniac to give her the excuse to savagely murder him though. She needs him to have a reason to be that maniac when none of his past behavior points in that direction, so she invented a reason and that reason was suppose to be on his computer.

Let's look at that computer for a minute, actually let's look at both Jodi's and Travis's computers for a minute. After Jodi killed Travis she sought to destroy his hard-drive. While she was successful to a point, there was still enough that was salvageable that much of Travis's activity was preserved. Jodi destroyed her own laptop so completely before she was arrested, that to my knowledge nothing of any evidentiary value was ever recovered. Why did Jodi destroy both their computers? Jodi likes to talk about everyone else destroying evidence, but the fact remains, Jodi herself destroyed more evidence that anyone. Jodi destroyed her own computer because it's very likely she didn't want it discovered that she had her own porn files and history. She may not have wanted it brought up that her search history showed a definite plan for the murder. She may have even wanted to hide her long history of logging in to Travis's accounts, which would serve to show just how obsessed she was.

Jodi came up with the computer porn and by extension the child porn, as a way to bolster her claims that Travis had a reason to be angry enough at her to want to kill her. From the way these claims were presented, it's obvious that part of her defense was that even if child porn can't be found, the hard drive was so damaged, it's possible, even probable that the porn is within those broken parts, never to be recovered.

Juan Martinez called her out last year as a liar, claiming no child porn, or any other kind of porn was found on Travis's computer. Jodi then hired a private investigator in Fall 2014 and brought in a computer expert who claimed to have found thousands of porn files on Travis's computer. Nurmi read off the names of several of those porn sites and savvy trial watchers soon learned that those links were part of a widespread Trojan program. Nurmi fought tooth and nail to cast doubt on the veracity of that fact and he likely had the jury very confused. Most people would assume that porn on a young man's computer is a given, and the fact that there appears to be so much was far more believable than if he had none.

Fast forward to this week when expert Robert Brown revealed that the porn files were part of SpyBot Search and Destroy blacklist. Spybot curated the top 1000 or more virus Trojan, malware and spam links and then added their names to the blacklist directory. A blacklist directory is simply a block list—if you're on Facebook and Twitter and you block annoying people, you're doing essentially the same thing—you're creating a blacklist of blocked names and Facebook and Twitter react by not allowing those usernames to view your accounts or interact with you, and furthermore, you're shielded from them as well.

Spybot created a similar directory that for the most part is behind the scenes and not available to the user unless the user goes looking for it.  If I was to break out the code on my Facebook account I would see a lot of gibberish, and among this gibberish I'd see the directories. I'd see my Friend directory which is all the people who I have a mutual friendship with. There would also be a Follow directory of all the people I follow and then another of all the people who follow me. Another directory would be the Blocked directory. If you took all those directories and just viewed all the usernames, without checking which directory they resided in, you'd say 'hey Brad, I thought you didn't like so-and-so, why do you have them on your Facebook account?" That's what happened with the Spybot on Travis's computer—Jodi's experts disregarded the directories those files were in and made it seem that Travis had visited those sites.

But what do you say to all the people who are convinced Travis actually visited those sites—that he keyed them in? Well, I'd ask how he could do that? If he has Spybot installed and Spybot blocks girlsgonewild, well no matter how many times Travis keys in 'girlsgonewild' he will be redirected to an error page. He would never ever be able to view that page.  Furthermore there are millions of porn sites, malware, Trojan and virus sites—what are the chances that Travis would spend several days visiting or attempting to visit only those sites that Spybot had already blocked?

But Brad there were Tweets yesterday that reported Robert Brown claimed Spybot was responsible for putting porn popups on Travis's computer and we know that's not true. That's right, that's not true, and we can't rely on 140-character tweets to convey that totality of Mr. Brown's explanation and must assume the Tweeters didn't catch the intention of his statement or he wasn't quite clear in his explanation.

I still don't believe you Brad. Why would Spybot put 1000s of porn files on Travis's computer, that makes no sense? Spybot didn't put porn files on his computer, it added the url's of those sites to a block list—this is a great succinct paragraph form a spybot employee that answers the question definitively (this information courtesy of my buddy Mike, I'm happy to credit his name in its entirety if he'd like me to edit it in)—

The customer is appalled when he notices thousands of porn files in his directory and the Spybot employee assures him that the files are part of the block list and they instruct the program to restrict access to those sites.

But what about the child porn? Jodi said there was child porn and there has to be child porn because Jodi would never lie. Well she did lie. There was no child porn found on the computer by this expert, nor was there any found by Jodi's experts. The only child porn sites were those urls put into the blocked directory by Spybot.

Ok, so what about the 45 minutes of porn Travis viewed on June 1, 2008, and the 4 photos found on his computer, one of which was a depiction of oral sex! Really perverted, right? That proves he was addicted to porn, the bastard! Actually viewing 45 minutes of porn in the week before he was killed and having 3 pictures of scantily clad women and one picture of a sexual act is hardly the stuff of a porn addict—my grandmother probably views more porn in a weekend than Travis accessed in over a week. The amount of porn discovered was so little that even with our most imaginative and far-reaching definition, it would never amount to an addiction by anyone's standards. If there's no addiction to porn and no child porn, that gives Jodi less of an excuse to fear the 'wrath of Travis" and feel she was in a deadly battle for her life.

What about that McGee guy? He said there was child porn on the Bishop's computer and Travis confessed to him—the dirty pedophile! Anyone who has been paying attention to McGee's posts over the last 2 years have seen his post start off with claiming Travis had a porn addiction but had "never put his hands on a woman", to Travis had a child porn addiction and roughed up Deanna. The Bishop had no reason at all to lie for Travis. If the Bishop was going to lie, he would have saved himself and others a lot of humiliation and headache by letting the dead guy take the rap—say it was Travis who had been viewing porn, instead of a guy named Jake who was accused at the time and now 15 years later his name is attached to this embarrassing revelation. If he has since married, this revelation could be harmful to his marriage, to his job, and perhaps even to his standing in the church. Why throw a guy who has so much to lose under the bus to protect a guy who is dead? Why subject yourself to the hassle and headache of being flown out to Arizona and dealing with an aggressive defense attorney who only seeks to discredit you? It doesn't make sense!

I still don't agree with you! Juan is obviously running scared that's why he's bringing up the porn once again, he trying to save his job! Nope. He's showing the jury that Jodi's team has been pulling the wool over their eyes. The defense makes a lot of claims of misconduct, but in the end they continue to flog the victim and have yet to offer up one lick of proof that any of Jodi's many stories have any truth to them. Supporters get really pissed off when Juan seeks to impeach defense witnesses. They don't want him cross examining Jodi's experts, they don't want him cross-examining Jodi'd other witnesses, and they don't want him bringing in any witnesses of his own. They want Jodi's witnesses to take the stand, testify and Juan to say 'no questions for the witness" after each person and then at the end his closing argument would be "you heard the defense witnesses and the State wants you to make up your mind based on the defense putting on a case and the State just sitting there". That's not how it works—and that's the best thing in the world for all of us.

In the end we have scant evidence of any real porn, we have no evidence of a porn addiction, no evidence of child child porn, no evidence of pedophilia, overwhelming evidence of a young healthy man with an interest in women, and absolutely no evidence that Jodi Arias killed in self-defense. That's the truth."

PHOENIX (CBS5) - Testimony will continue Thursday morning in the Jodi Arias sentencing retrial while the judge launches an investigation and possible hearing into allegations that three members of the public racially taunted a member of the Arias defense team.

Defense attorney Kirk Nurmi on Wednesday told Maricopa County Superior Court Judge Sherry Stephens the three people directed the comments to a member of his team on Monday.

Stephens then set the investigation in motion.

The prosecution has taken center stage in the recent days of testimony.

Recent testimony has focused on pornographic images found on a computer owned by Alexander, and the defense has tried to portray Arias as a victim of abuse at the hands of Alexander, while the prosecution has tried to paint her as a cold, manipulative killer.

Members of the current jury, which was selected from more than 400 potential jurors over several weeks, have been shown graphic photos of the crime scene, listened to interrogation tapes in which Arias produced a number of lies and had a juror dismissed for asking a woman journalist in attendance if she was TV journalist Nancy Grace, since the retrial began Oct. 21.

As for the trial itself,  two computer experts from the Mesa police department were on the witness stand talking about pornographic images found on the computer of the man Arias murdered, Travis Alexander.

The defense team has spent months trying to prove that Alexander frequently visited x-rated sites and had an interest in child porn, but that has not be proven.

In fact, the computer experts said most of the porn sites found on the computer were caused by a virus.

"Detective Brown said most of it was generated from the Spybot program that was put on there to fight off pop-up ads," said Jen Wood, of Jen's Trial Diaries. "The defense's claim that there was an aircraft carrier worth of porn on there - it's not so." Legal experts we spoke to believe - the jury may be getting tired of all the testimony about computer porn.

Legal Expert Beth Karas said the jury may be getting tired of all the testimony about computer porn.

I think the jury is suffering from a little bit of porn fatigue," said Karas. "Enough already."
