The sentencing process for Colorado theater shooter James Holmes will continue after a jury kept the death penalty option.
Holmes was found guilty last month of a 2012 mass shooting inside an Aurora, Colorado, movie theater — 12 people were killed and more than 70 were wounded.

The jury had previously determined Holmes' crimes made him eligible for the death penalty. However, all 12 jurors had to stand by that decision after they were presented with mitigating factors.

Those factors included new testimony from Holmes' parents.
"Schizophrenia chose him; he didn't choose it. And I still love my son," Arlene Holmes, James Holmes' mother, told the court.

Like most of the trial, the sentencing focused on Holmes' mental health. The defense argued Holmes' mental illness should mitigate his sentence, while prosecutors said Holmes' mental state shouldn't shield him from the death penalty.

"....With their quick verdict Monday, jurors decided that nothing about James Holmes' life was sufficient to outweigh the horror of his crime.

When the verdicts were announced, Holmes' father, Robert, put his arm around his wife, Arlene, as she bowed her head and softly cried in the gallery. Victims' families also cried and held each others' hands.

The defendant kept his hands in his pockets as he stood to listen to Judge Carlos Samour Jr. read the verdicts. One of his attorneys, Kristen Nelson, clutched his arm firmly....."

COSTS: Pre-Trial Expenses Exceed $5 Million in Aurora Death Penatly Case

Trial preparations in the death penalty prosecution of James Holmes in Colorado have already cost the state about $5.5 million, and the trial and likely appeals will add significantly more. Holmes is accused of the mass shooting in a movie theater in Aurora. Most of the costs - $4.5 million - have come from the salaries of personnel working on the case, including the prosecutors, defense attorneys, the judge, investigators, and victims' advocates. Additional court security for hearings in the case has cost $463,000. Experts hired by the prosecution have been paid $220,000, and the defense team has likely spent a similar amount. Holmes has pleaded not guilty by reason of insanity. He offered to waive his right to a trial in exchange for receiving a sentence of life without parole. Colorado Governor John Hickenlooper called off a recently scheduled execution, describing the death penalty system as flawed and inequitable, essentially putting all executions on hold.

Aurora theater shooting trial: Court enters third phase of death penalty case

The trial will continue into another phase during which prosecutors are expected to call several of the victims’ relatives to testify.

AURORA | After just a few hours of deliberation, jurors in the Aurora theater shooting trial unanimously decided James Holmes will proceed to a third and final sentencing phase — where an ultimate decision on the death penalty will be made.

The jury’s quick deliberation and verdict meant they rejected the defense’s argument that the mitigation evidence outweighed the four aggravating factors proven during the first phase of sentencing. Jurors deliberated for about an hour last week and 90 minutes this morning before reaching their verdict.

As Samour read the verdicts, Holmes’ parents, Bob and Arlene Holmes, held hands. About 10 minutes in — as Samour read the charges connected to Gordon Cowden, who was at the theater that night with his teen daughters when he was killed — Bob Holmes put his arm around his wife.

On the other side of the gallery, Sandy Phillips, whose daughter, Jessica Ghawi was killed in the theater, took off her glasses to dab away tears as Samour finished reading.

Last week, Holmes’ lawyers pleaded with jurors to sentence him to life in prison instead of death, arguing that his mental illness caused the July 2012 attack.

“But for this mental illness, that shooting would not have occurred,” public defender Tamara Brady told the jury, noting that every doctor who examined Holmes said he was seriously mentally ill.

Brauchler said prosecutors will call several more relatives Wednesday and hope to wrap their case then. After that, Brauchler said, prosecutors hope the jury sentences Holmes to death.

AURORA | Jurors in the Aurora theater shooting trial heard gut-wrenching testimony Tuesday from the relatives of five of the 12 people killed in the July 2012 shooting.

District Attorney George Brauchler told the jury during brief opening arguments in this final phase of James Holmes’ trial that the testimony would offer them some insight into the lives of those gunned down in the theater.

“To give you a glimpse as to who those people are in the pictures, the ones he shot to death,” he said. “And you will get just the faintest of whiffs of the impacts on those who are left behind.”
