Re: Ryan Widmer - Bathtub Murder Trial of Bride of 4 Months, Sarah Widmer
Melissa Waller, online supporter of Ryan that testified this morning. From the blog, she came across as very credible and stable. She said the Dateline episode touched her due to her sister-in-law's death. She said her sister in law died suddenly after her wedding. Her brother found her, it was emotionally devastating to him. She talked to Ryan on the phone the same night (and sounded like around the same time) that Jennifer Crew said Ryan gave her a drunken confession. Melissa testified Ryan wasn't drunk or upset.
Dr. Chandler Phillips, biomedical engineering professor, Wright State University

Another witness who testified Friday morning is Dr. Chandler Phillips. Phillips is an biomechanical engineer who has previously examined the bathroom where Sarah Widmer died and testified that there was no way Ryan Widmer could have forcibly drowned his wife within the space available.
Phillips said during the second trial that the injuries on Sarah Widmer did not match injuries that should have occurred in such a small space, like broken fingernails or injuries to her feet.
He repeated much of that testimony Friday, including the statement that "Ryan Widmer did not forcibly drown Sarah Widmer."

Below is what has always stood out in my mind in this case, the natural reaction to fight for your life:
~Snipped~
The defense rested its case after the jury heard several hours of testimony from human factor engineer and medical doctor Dr. Chandler Phillips.
Phillips said he has studied beer kegs falling on people, frisbees hitting heads, basic accidents and injuries. He has testified in 24 cases, he said.
Phillips testified in the 2010 Widmer trial that ended with a deadlocked jury.
“Ryan Widmer did not forcibly drown Sarah Widmer,” he said. “Based on the human environment, I would have expected to see more injury on her and injury to Ryan if a struggle ensued.”
Phillips, who specializes in Human Factors Engineering, said defensive injuries should have shown on Sarah Widmer’s manicured hands, feet, knees, toes and other parts of her body, had her husband tried to drown her in the bathtub.
Using a plethora of information from the first trial and “anthropometry,” the measurements of both Sarah and Ryan Widmers’ bodies and the dimensions of the bathroom.
Phillips testified that had Widmer forced his wife’s head in the tub, there would have been injuries to her feet because they would have been jammed up against the vanity.
Had Widmer attacked her from the front and strangled her, she would have gouged his eyes, he said, and had he used a stranglehold from the rear, her French manicured nails would have gouged his forearms, he said.
No defensive wounds were found on either Widmer.
Phillips said there is a chemical reaction in humans, called “sympathetic alarm reaction,” that would have kicked in once Sarah Widmer knew she was under attack. It gives people strength beyond the norm, he said.
“It’s a fight-or-flight response,” he said. “There is massive purpose that greatly enhances muscular activity way beyond what you can normally do. The threat in this case, flight, is not an option, so fight is all that’s left.”
Widmer stood a full foot taller than his wife and weighed 50 pounds or more, but Phillips said she still would have done some damage to him during an attack.

It was said that Ryan did not once ask for help-well, why else does a person call 911?

Sherry, the dispatcher was found to be asleep when Ryan called and that wasn't the first time he had fallen asleep... He kept asking Ryan if he was Sara's mother... Ryan to me doesn't sound like a woman..

Sherry, it's certainly not rehashing old news! I keep going back to prior testimony and articles myself. That 911 call was made out to be a piece of key evidence in Ryan's guilt. They felt it was staged. Mel, I don't think Ryan sounded like a woman at all either. Also, in some of the prosecution witness testimony a few of the EMT's said Ryan didn't offer to help. If I called 911, I think I would step back and let them do their job, I don't know what I could possibly do to help with a roomful of emergency personnel present. Just my opinion. Ryan attempted CPR before they arrived, but he never had CPR training.

I'm reading old news on this case to get a feel for it now. I also want to see if there is anything that would make me change my mind about his innocence-I'm finding just the opposite, so far. In fact, after reading that Hutzel considered that Ryan's visit to an adult "porn" site gives motive to murder, I've been getting the idea that Ryan is being railroaded! This is just too sad.
My prayers are with Ryan. Thing is, this will be the first time I have ever thought a verdict was wrong in the case of murder if Ryan is found guilty.

They investigated Ron Kronenberger, the dispatcher. Then another dispatcher, Shawn Mason, was suspended for three days for sleeping on the job in a separate case after the Kronenberger allegations surfaced. Cameras are now installed in the call center, and commissioners have said they want to hire a separate firm to analyze the county’s emergency operations center.
Frank Young, the EMA director, resigned after the sleeping allegations surfaced. Ron Kronenberger did not give Ryan instructions on how to perform CPR, he also stated in the first trial that Ryan was calm during the 911 call. If you listen to the call, I can't say that Ryan was calm. The call was badly handled, the dispatcher was in a fog and seemed to ask inappropriate questions. Other dispatchers admitted to sleeping but this independent company they hired cleared him. I have my doubts about their findings.
Here's a story about the dispatcher investigation:
Report clears Warren 911 dispatcher in Ryan Widmer case
2:35 PM, Dec. 22, 2009
LEBANON - The 911 dispatcher accused of sleeping moments before he answered the call when Ryan Widmer reported his wife drowned in their bathtub was not dozing and there is no evidence he handled the call improperly, according to an independent report released Tuesday.
Warren County commissioners asked for the review after dispatch logs disputed an internal investigation that accused Ron Kronenberger of waking from a sound sleep before he took the August 2008 call.

Funny how the dispatcher asks Ryan if he is her mother after Ryan tells him that he found his wife in the tub...
I have more problems with the dispatcher not giving instructions and also asking Ryan to repeat himself a few times than with how Ryan sounds. This guy does not sound like he is on top of it at all. Ryan sounds very upset but trying to stay calm to answer questions. That jurist, Diss, from the first trial said that he felt Ryan was faking the CPR because he could hear the puffing. Thing is, that's what happens when the airway is blocked-when the lungs are full of water, you will hear that sound because no air is getting in the lungs but coming out of the victim's nose. And it sure doesn't sound like its staged, that's for sure.

Legal experts doubtful of acquittal for Widmer
By Denise G. Callahan, Staff Writer Updated 9:05 PM Saturday, February 12, 2011
LEBANON — Legal experts are doubtful Ryan Widmer will be acquitted and some of their justification is based more on the location of the trial than if there is reasonable doubt in the case.
Both sides rested Friday in Widmer’s third murder trial, ending 13 days of testimony from 44 witnesses.
Closing statements will begin Monday morning and the jury will deliberate the fate of Widmer, who is accused of killing his wife, Sarah Widmer, at their Warren County home in 2008.
Thaddeus Hoffmeister, a jury expert and professor at the University of Dayton law school, says although he believes there is plenty of reasonable doubt in the case, he is predicting a hung jury.
“Warren County is a community that wants to believe that the government is right,” he said. “You are asking them to say that the police officers are wrong, the prosecutors are mistaken and that’s hard for some people to accept. To question the system they believe in and use everyday, that’s hard for them to do.”

I don't know which way this verdict will go, but if it is a hung jury again, perhaps the courts will grant a change of venue for the next trial...I'm praying that this one will be the one to set him free and clear...It would be a shame if there has to be another trial...I don't see what either side could add to their case...Maybe the state should just drop it...I can see Sarah's parents suing in civil court, just as the Goldmans did in the OJ case...

I agree, Estee, though I'd hate to see Ryan being sued.
I hope there is a "not guilty" but if not that, I'll take a hung jury.
To think, Ryan could pay for a crime he didn't commit just because the citizens of Warren County don't want to believe their government made a mistake.
{sigh}

I agree with all of you... Ryan should not have this held over his head for the rest of his life... Hopefully with Rachael Hutzel out as prosecutor, the new prosecutor will have more common sense.. I just don't know how 12 people could find him guilty... I see another hung jury... I don't know how 12 people could find him guilty, I can see how one or 2 people could find him guilty.. Hopefully the people for not guilty will not be swayed to vote guilty!

Widmer’s fate in hands of jurors as murder trial nears end
Updated 7:23 PM Sunday, February 13, 2011
LEBANON — Having heard from 44 witnesses and watching video in which murder suspect Ryan Widmer said he did not harm his wife, a jury will likely begin deliberations Monday after closing arguments.
Widmer is accused of drowning Sarah Widmer in the bathtub of their Hamilton Twp. home Aug. 11, 2008.
In 2009, Widmer was found not guilty of aggravated murder, but guilty of murder. That verdict was tossed out because of juror misconduct.
In 2010, a second trial ended with a deadlocked jury.
Each of the three trials in Warren County Common Pleas Court with Judge Neal Bronson differed despite having many of the same witnesses.
A new witness, Jennifer Crew of Iowa, remained unnamed until the start of the trial. She watched a Sept. 2009 episode of “Dateline NBC” that featured Widmer’s case, and she reached out to him online via freeryanwidmer.com. Crew said on Oct. 26, 2009, an inebriated Widmer told her he fought with Sarah Widmer, punched her in the chest, and then blacked out.
When he awakened, she was unresponsive on the floor of the bathroom with wet hair, Crew said.
The fight was over an alleged affair he had, his watching porn online, and smoking and drinking, Crew testified. She said Sarah Widmer threatened to leave her husband — the first time an alleged motive was presented in a Widmer trial.
Crew’s testimony conflicts with that of other witnesses and forensic evidence showing bruises on the front of Sarah Widmer’s neck, but none on her chest.
Widmer’s friend Chris Kist testified he was at the Widmer home the night of the alleged confession call to Crew, and his friend was not drinking.
Another “Dateline” viewer and user of the website who had a phone relationship with Widmer, Melissa Waller of Washington, testified she spoke with him minutes before the call to Crew, and he wasn’t drunk or upset.
New testimony also came from Ruth Ann Steward, Sarah’s mother. The couple would say “hateful” things to each other, words she said she would not repeat in court. Other character witnesses described them as a perfect, loving couple.

Good morning! I was watching a local news channel and they had a guy on there (not sure who he was, didn't catch it) that was saying that it was quite shocking to him that Ryan was this supposedly happily married man yet was carrying on all of these relationships with these other women that he met through social media. And that he thinks Ryan will be found guilty.
Ryan wasn't talking to these women when Sarah was alive, this was well over a year after she died when they reached out to him through freeryanwidmer.com after the September 2009 Dateline episode aired.

Involuntary manslaughter is now included in the prosecutions motion, it was filed with the court at 9am this morning...not sure yet if the judge ruled on it.

I think there were a lot of oopsies from the beginning! The lead detective, Jeff Braley, sat at the prosecution table in the other two trials. Braley was in with Uptegrove during the autopsy, but it wasn't noted. Notice Braley is MIA in this trial, except for his short testimony. It was found he lied about many things on his application and information that is in his personnel file. I posted information about him a few threads back. Judge ruled defense couldn't bring this up. I wonder if Braley will be terminated when this trial is over.

Clark says the judge will explain something about a lesser included offense of manslaughter. "Ryan is not guilty of that, either."
Apparently the judge allowed the lesser offense....I am surprised.

If jurors find that state proved all the essential elements of murder, then they must convict.
If they determine that the state did not prove this, then they must continue deliberating whether the state proved all the elements of involuntary manslaughter.
The defendant need not have intended to cause death but did cause death in the commission of an assault.
State says Ryan intended to cause harm to Sarah on Aug. 11, 2008.
If state did not prove manslaughter, then verdict is not guilty.
Jury may not consider lesser charge when considering murder. Must decide on murder and then, if applicable, involuntary manslaughter.

Jury may not consider lesser charge when considering murder. Must decide on murder and then, if applicable, involuntary manslaughter.

Jury begins deliberations in Widmer trial
Updated 1:57 PM Monday, February 14, 2011
LEBANON — The fate of Ryan Widmer is in the hands of a jury of his peers for the third time in Warren County Common Pleas Court.
For the first time in all three trials, the jury can consider convicting Widmer of involuntary manslaughter if they don’t believe he intended to kill his wife, Sarah Widmer, on the night of Aug. 11, 2008. The jury will first consider the murder charge.
The prosecution asked the court today to allow the jury to consider the lesser charge, “alleging the death of Sarah Widmer occurred in a sudden fit of rage.” Asking for the consideration of a lower charge is usually done when the state doesn’t believe it made its case for murder, law experts say.

A brave 'new media' world for courts?
Ryan Widmer murder trial draws far-flung witnesses through Internet
6:24 AM, Feb. 14, 2011
Because of "new media," two women in distant states became entangled in Warren County's most publicized murder case.
Both women, Jennifer Crew of Iowa and Melissa Waller of Washington state, watched an episode of "Dateline NBC" about the Ryan Widmer murder case in September 2009.
Then, with a few keystrokes on their computers, they reached Widmer via the Internet. And they established ties with him that ultimately landed both of them on the witness stand.
"Ten years ago, this would have been unheard of," said Thomas S. Hodson, an Ohio University journalism professor who also spent 20 years as a lawyer and 10 years as a judge.
Crew testified that Widmer called her one night and blurted out a murder confession, while drunk or at least very upset. But Waller cast doubt on the alleged confession, testifying that Widmer wasn't upset or drunk when her call ended with him six minutes before his call to Crew began Oct. 26, 2009.
"Here we have people who are witnesses about an alleged crime in Warren County from Iowa and Washington state - that's just a strange dynamic in general," said Joe Mooney, a Northern Kentucky University law student.
"This is the first case in this part of the country where these complicated media communication issues have come up," Krumbein said. "This clearly won't be the last time. But this is a real doozy of an introduction to the age of instantaneous communication colliding with criminal law."

I'm praying that the jury goes into this with clear heads and is able to discern fact from fiction...There are still unanswered questions on my part but I do have reasonable explanations to support my answers...Guess we'll have to stay plugged into Travis' blog to find out the outcome...

That is the problem Piper is people on the new channel saying stupid things like that.. They obviously don't know the history of the case!!!! Let's hope that the jury sees that the prosecutor is grasping for straws!!!!!

Poor Mel! I did return to work today, but still feeling a little rough and very mad at myself for not being able to go to the courthouse on Friday! I pretty much stayed in bed and sipped Theraflu and slept, it seemed to help. I hope you get to feeling better soon!!
When the jury buzzes they are ready, I wouldn't have time to get to the courthouse, I don't think. I can't remember how much time they give everyone (Ryan, attorney's, etc) to get there.
This is such a terrible nightmare for all of the family. To lose a daughter at the age of 24, well any age, would be surreal. I'm like you, Estee, so many questions that were not answered by the prosecution. I know in the state of Ohio you don't have to prove motive, but I just don't see a motive here. No insurance money, no girlfriend/boyfriend issue, most young couples have some financial issues, no defense wounds on Sarah or wounds on Ryan. A lot of reasonable doubt, IMO. The coroner didn't wait for toxicology reports before labeling manner of death a homicide......and it's now in the hands of a jury, again. We'll see what tomorrow brings.......

Widmer Jury To Consider Involuntary Manslaughter Charge
Jury Deliberations Begin In Widmer Case
UPDATED: 6:32 pm EST February 14, 2011
LEBANON -- For a third time, a jury began deliberating the fate of Ryan Widmer, who is charged in the death of his wife in 2008.
Jurors in Warren County got the case of 30-year-old Ryan Widmer following closing arguments Monday afternoon at the murder trial.
Testimony in Widmer's third trial ended Friday. His guilty verdict from the first trial was thrown out by a judge because of juror misconduct. The second trial ended in a hung jury.
On Monday, prosecutors asked Judge Neal Bronson to allow the jury to consider a charge of involuntary manslaughter in addition to the murder charge. Defense attorney Jay Clark told the jury during his closing argument that the jury would be given that charge as an option, but he said Widmer isn't guilty of that, either.

Affair? money? drinking? what is the motive.by Leslie at 2/14/2011 5:52:43 PM11:52 AM
That Sarah was going to leave him in a dispute over all of those issues, according to the prosecutors.

I know the State doesn't have to prove motive but they didn't prove what they set forth as one.

I have not followed this case from day one and I may be way off base.
I've been reading some of the articles on the previous pages. It appears the State did not prove their case.
I find it hard to believe that Ryan would get on the phone and "confess" to Crew!
This has nothing to do with this trial but Crew looks so much older than Ryan. Is she in her 40's?
Maybe there will be a verdict later today.
Piper and mel, you are both from the area and probably watched this case as it unfolded a long time ago. Do you think Ryan is innocent?

Mel, hope you get to feeling better today!
Ann, I remember when Sarah died, it was quite a shock. Then when Ryan was arrested for her murder, it was even more shocking. They had only been married 4 months, they had lived together for a little while before that. I feel there is too much reasonable doubt to be able to convict Ryan of Sarah's murder. Many things just don't add up to murder in my opinion.

I watched the Live Wire for a few minutes. Someone just told Travis that Dateline will air the episode about this trial in mid March.
Travis said Sarah's mother is waiting in the Prosecutor's office.
Travis said Dateline has the camera privilege and Travis's station will be recording off of their feed.
Someone said they hope Ryan is shown while the verdict is read. Travis said it probably will be shown.
The live wire with Travis is really cool! I bet the folks at work appreciate it. I know I would.
Thanks for the Link, Piper! Otherwise, I would have to go to previous pages to try to find it!
