Judge Pullan told the jury that they can consider Dr. MacNeill’s affair as a motive for murder — but it cannot be used as a “character trait.” He also allowed the jury to decide whether or not Dr. MacNeill intended to kill his wife, seriously harm her or engage in what’s known as “depraved indifference” — meaning he would just let her die.

“The jury is not required to unanimously agree (on that),” Judge Pullan said.

The jury question is:

Is it Utah law that the surviving spouse inherits the estate regardless of what the will says?

Big dilemma. The judge wants to go by Utah law and say the law relevant to the case was contained in the instructions. Basically they are not answering the jury's question.

PROVO, Utah - A jury convicted a doctor of murder early Saturday in the death of his wife six years ago, bringing an end to a trial that became the nation's latest true-crime cable TV obsession with its tales of jailhouse snitches, forced plastic surgery, philandering and betrayal.

Martin MacNeill was accused of knocking out Michele MacNeill with drugs after cosmetic surgery, then leaving her to die in a tub like one that was displayed during the trial.

Prosecutors asserted that he may have held her underwater for good measure and that he did it to take up a new life with another woman.

Michele MacNeill's daughters and other relatives let out a loud yelp before dissolving in tears as the jury delivered its verdict to the tense, packed courtroom.

"We're just so happy he can't hurt anyone else," said Alexis Somers, one of his older daughters. "We miss our mom; we'll never see her again. But that courtroom was full of so many people who loved her."

Provo » It took a jury 11 hours to return a guilty verdict on Friday for Martin MacNeill, accused of killing his wife at their Pleasant Grove home six years ago.

This decision from the five-man, three-woman jury came after 13 days of testimony over four weeks, where prosecutors tried to build their case alleging MacNeill gave his wife, 50-year-old Michele MacNeill, a fatal cocktail of prescription drugs, then drowned her in a bathtub in their Pleasant Grove home. The motive, they argued, was to continue an affair with 37-year-old Gypsy Jyll Willis.

As the guilty verdict was read at 1:10 a.m., Michele MacNeill’s supporters — including her sisters, her friends and two of her daughters — gasped loudly as the verdict was announced, and immediately began sobbing and hugging. Martin MacNeill showed little to no emotion.

He faces 15 years to life for first-degree murder when he is sentenced Jan. 7. He also was found guilty of obstruction of justice, which could add one to 15 years. MacNeill was led by deputies back to Utah County jail.

Randy Spencer, one of his attorneys, said he was disappointed before declining further comment.

The chief prosecutor, Chad Grunander, said the largely circumstantial case was the most difficult he had ever brought to trial and that many prosecutors wouldn't bother trying, especially with medical examiners unable to produce a finding of homicide.

I'm thrilled that this horrible excuse of a human being has been found guilty of 1st degree murder and obstruction. I hope that every day of the rest of his wretched life is a living hell for him day and night.

My hope for the remaining family members is a sense of peace knowing that their Mother and Brother can now rest in peace. May they be able to carry on and start on a healing journey that will never end but be able to make a new normal for themselves. I think their Mother would love to see them be able to smile and even laugh again when they think back to the times spent with her and their brother. Don't let the murderer control their every breath from here on out. They deserve to have a sense of peace within themselves.
