Dylan Redwine’s father files for dismissal of case against him

ALBUQUERQUE (KRQE) – A man named as a person of interest in his son’s death has filed for dismissal of a lawsuit filed against him by his ex-wife.

According to the complaint, Elaine Hatfield Hall said her son disappeared when he was visiting his father, breaching the duty as a parent when it resulted Dylan’s death.

Three years after his son Dylan Redwine’s disappearance, Mark Redwine has filed for dismissal of a lawsuit filed June 29 against him by his ex-wife, Elaine Hatfield Hall, for the wrongful death and loss of their son.

In a filing in District Court on Wednesday, Redwine’s attorney, Stuart Morse of Greenwood Village, said the statute of limitations had expired six days before Hall filed her lawsuit.

That is based on the fact that Dylan Redwine’s remains were found on June 23, 2013, and that is when the state of Colorado certified Dylan’s death, according to the motion.

“Plaintiff did not file her complaint until June 29, 2015, six days after the expiration of the statute of limitations,” the motion stated.

Redwine filed a motion to dismiss on July 22, as well.

The La Plata County Sheriff’s Office said they are also frustrated that they have not made any progress in the case but have not forgotten about Dylan and never will. At least they found enough to confirm that Dylan is not simply "missing."  No matter how horrible the outcome, at least it offered something solid to hold onto.

This case reminds me of the Hailey Dunn case.  I thought once they found their remains there would be charges; but, nope--it hasn't happened in either case.

The mothers of three children who went missing or were killed in unsolved Colorado cases spoke in favor of a bill last week that would create harsher penalties for those convicted of tampering with dead bodies in an effort to hide evidence.

Elaine Hall, the mother of Dylan Redwine, who went missing when he was 13 years old from his father's house outside of Durango, urged members of the Senate Judiciary Committee to approve Senate Bill 34.

"We continue to search for the rest of Dylan's remains," Hall said, describing how just a few of Dylan's remains were found scattered all over Middle Mountain a few miles from his father's house. "While a person of interest, his father, has been named we continue to fight for justice for Dylan and hope at some point the district attorney in Durango will actually do something to bring justice in Dylan's case."

Bill would make tampering with a body a felony


"....DENVER – State lawmakers on Monday advanced a measure that would make tampering with a body a felony – an effort strongly supported and advocated for by the mother of Dylan Redwine.

The bipartisan bill is being pushed by prosecutors and the families of murder victims, who say tampering with a body should carry a stricter penalty than tampering with evidence.

“This has devastated our family, but it also has made us aware of the laws that need to change to protect the victims rather than the criminals,” Elaine Hatfield Hall, Dylan Redwine’s mother, explained Monday with tears in her eyes.

Dylan had been on a court-ordered visit with his father, Mark Redwine, on Nov. 18, 2012, when he disappeared. Dylan was 13 at the time.

In June 2013, some of Dylan’s remains were found about three miles from his father’s home in Vallecito.

In August, the La Plata County Sheriff’s Office announced it had identified Mark Redwine as a person of interest in the case and that Dylan’s cause of death had been changed from “unknown” to “homicide.”

The case remains unsolved.

In the wake of the incident, as well as similar cases throughout the state, lawmakers have worked to address the issue of tampering with bodies....."

LA PLATA COUNTY, Colo. -- Teams searching for clues about what happened to Dylan Redwine found “items of interest” during a new search, officials said Monday.

...Investigators called the latest search a success.

“Items of interest were recovered,” the sheriff’s office said. "They will be tested and added to other evidence collected during the 3 1/2 year investigation.”

DURANGO, Colo. -- Mark Redwine waived his challenge to extradition Tuesday and will be returning to Colorado soon to face charges in the death of his son, Dylan, in 2012.

La Plata County officials confirmed the information Tuesday evening. An official said the sheriff's office was making arrangements to bring Redwine back to the southwest Colorado county.

Mark Redwine, accused of killing his 13-year-old son Dylan Redwine, was booked into the La Plata County Jail at 4:56 p.m. Monday, Aug. 14, 2017, following extradition from Whatcom County, Wash., where he was arrested.

Mark Redwine, accused of killing his 13-year-old son Dylan, was booked into La Plata County Jail Monday afternoon after being extradited from Washington State.

La Plata County Sheriff’s investigators took custody of Redwine in Whatcom County, Wash., Monday morning and flew back to Durango with him on a chartered plane.

DURANGO, Colo. -- Mark Redwine made his first court appearance late Tuesday in La Plata County for the death of his son, Dylan, in 2012.

Redwine is charged with second-degree murder and child abuse resulting in death.

Redwine was arrested in Bellingham, Washington, after a grand jury issued an indictment in the case on July 22.

The arrest came almost five years after Dylan, who was 13 years old at the time, disappeared while visiting his dad at his home in the Durango area.

The La Plata County Sheriff's Office brought Redwine back to Colorado on Monday.

Dylan's mother and brother spoke to the judge about Redwine's behavior.

DURANGO — A judge has lowered the bond for a man charged with killing his 13-year-old son Dylan in southwestern Colorado in 2012.

Bond had been set at $1 million cash for Mark Redwine after he was arrested in Washington state last month. The Durango Herald reports Judge Jeffrey Wilson lowered it to $750,000 and allowed Redwine to post it with the help of a bail bondsman on Tuesday during his first court appearance in Durango since being returned to the state.

One of Redwine’s lawyers, John Moran, said he has been falsely accused and has “endured hatred” from his community.

He said Redwine lives mostly in Phoenix now and, as a long haul trucker, he doesn’t have strong ties to anywhere, making him a flight risk.

DURANGO, Colo. -- Mark Redwine, the man accused in the 2013 disappearance and death of his 13-year-old son, Dylan Redwine, was back in the La Plata County Courthouse Friday. Standing before Judge Jeffery R. Wilson, Redwine's defense team brought forth nine motions for consideration.

Within those nine motions, there were three main focus points -- one being that the defense asked for the protection and conservation of all evidence that will be used in the trial. That means if there is a small amount of evidence that needs to be subjected to testing by the prosecution, that enough of the evidence is preserved for the defense to run tests of their own.

Elaine Hall, Dylan's mother and Redwine's ex-wife was also present at the hearing.

"I'm just glad we are here, you know? I obviously wish Dylan could come back," Hall said. "And you know, while we've been fighting for justice, it doesn't bring him back. But at least we are one step closer to getting justice for my sweet 13-year-old son."

Redwine’s defense team will be back in court on Dec. 15 for a check-in with the judge before proceeding to arraignment. Redwine has yet to enter a plea.

Colorado public defender John Moran has been reappointed to a team of lawyers defending Mark Redwine, a Vallecito man accused of killing his son, Dylan. Moran was dismissed from working the case after his arrest on accusations of domestic violence and his nonappearance at two scheduled court hearings. Prosecutors have since dropped the state’s case against Moran, citing insufficient evidence.

Mark Redwine, 59, was convicted by a unanimous jury on Friday and was found guilty on charges of second-degree murder and child abuse resulting in the 2012 death of his son Dylan Redwine.

He faces up to 48 years in prison for the murder conviction and his sentencing hearing has been set for 9 a.m. on October 8.
