ATLANTA — A citizen’s disclosure Monday that he overheard other prospective jurors discussing their opinions on the Justin Ross Harris case could possibly lead to a mistrial, according to one legal observer, The Atlanta Journal-Constitution reported Monday.

Juror 22 said he overheard other jurors expressing their belief that Harris, accused of intentionally leaving his son inside a hot car to die, was guilty. That’s a clear violation of the court’s instructions not to “consult, confer or talk with any other person” while completing the questionnaire.

COBB COUNTY, GA (CBS46) - Day 12: CBS46's Vince Sims is in the courtroom as potential jurors are questioned for the trial of Justin Ross Harris.

Harris is on trial in the death of his son, Cooper Harris.

Harris told investigators he forgot 22-month-old Cooper was in his car when he went to work on June 18, 2014. Cooper was found dead more than seven hours later.

This is the third week of jury selection in the case. The number of qualified potential jurors is at 31. They need between 40 to 60 people so they can start selecting a jury of 12 and alternates.

Tuesday morning attorneys found their first juror that knew nothing about the case before being called for jury duty.

"You are telling us you don't know literally don't know anything about this case," Defense attorney Maddox Kilgore asked.

"The first time I heard about this case is when I set in the jury room and it was read off," the juror answered.

But things have not gone so smoothly with the rest of the jurors.

"What is an opinion you've probably formed," Prosecutor Jesse Evans asked.

"A child died in a car that's not an opinion," a female juror answered.

That same juror wrote her beliefs on her questionnaire.

COBB COUNTY, GA (CBS46) - A judge said the trial of a man accused of leaving his child to die in a hot car will moved to a different venue at the request of his defense attorney.

Judge Mary Staley said Monday that the trial of Justin Ross Harris will be moved out of Cobb County, which is just northwest of Atlanta.

"To say the juror questionnaires show a pervasive knowledge and extreme opinion that are negative to the defendant is frankly an understatement," Staley said.

Criminal defense attorney and Wild About Trial Chief Legal Correspondent Ryan Kerns has been watching this trial. He says moving a trial is not easy.

"You are moving the judge, you are moving the attorneys, you may even be moving some of the bailiffs themselves," Kerns said. "The expense and difficulty it is to then go and find a new pool of jurors, go through an entire new jury selection process, the expense to the county, the expense of time and resources to everybody involved is tremendous."

Cobb County District Attorney Vic Reynolds released the following statement after the judge's ruling:

“While we’re certainly disappointed, we understand and respect the court’s ruling," said Cobb County District Attorney Vic Reynolds. "Whenever and wherever this case is set for trial, the state will be ready.”

From reading the article, it sounds like they are questioning the actual search warrant as not establishing probable cause.  So I think it's the particular circumstance of this search warrant that caused the evidence to be thrown out.  I don't think it's a generalization that all Internet searches are not admitted as evidence.

That was my thinking. too. Everything has gotten so weird I was expressing my hope this did not become a routine pattern for dismissal of evidence.

Potential jurors were hit with the hard questions on Thursday as the Ross Harris jury selection continued. The potential jurors were asked about their opinions on pornography and the death of children.

Harris is accused of intentionally leaving his son, Cooper, in a hot car.

His trial was moved to Glynn County, Ga. after lawmakers struggled to find an impartial jury in Cobb County.

The process is not to the point where prospective jurors are being called in one-on-one to answer questions they weren't comfortable answering in a group - everything from prior legal troubles to personal tragedies.

Among them was a teacher who said as part of the job she has had to make reports to the Division of Family and Children Services.

"Sometimes you have children who come in and they are covered in bruises," she said. "I had a child who couldn't sit down because she'd been beaten down."

BRUNSWICK — As jury selection resumes today in the Justin Ross Harris murder trial, some clues have emerged as to how the court will qualify — and disqualify — people in the large pool of Glynn County citizens summoned for jury duty.

Half of the 12 prospective jurors questioned by lawyers Wednesday were dismissed by Superior Court Judge Mary Staley Clark. Here are three reasons:

1. They believe Harris is guilty

Three jurors — a self-described “retired housewife,” a high school English teacher from St. Simons and a mother of three from Brunswick — said they could not put aside their belief that Harris was guilty. Juror No. 4, who was dismissed for cause, said, “I don’t think there’s any excuse for leaving a child in a car. There’s no excuse for that. … That’s murder.”

Justin Ross Harris hot-car murder trial on Thursday, potential jurors shared painful stories of personal trauma they and their families suffered.

Lawyers for the defense and prosecution questioned 11 jurors. Here are some of the heart-wrenching stories they told.

1. The death of children

One man said he may have a hard time sitting as a juror in the case because his wife has had three stillborn babies. His voice quavering, he said he can’t watch TV shows that deal with children who have medical issues because of his personal heartache. Cobb County prosecutor Jesse Evans, however, later questioned the juror as to whether he thought he could put those thoughts aside and sit as a fair and impartial juror. “I would do my best if I was chosen,” he said. He was declared eligible to serve.

BRUNSWICK, Ga. (WIAT) — Six potential jurors advanced through the selection process for the trial of an Alabama native accused of leaving his toddler son to die in a hot car.

Justin Ross Harris faces several charges in the death of 22-month-old Cooper Harris. Prosecutors say the Tuscaloosa native left Cooper in his SUV for seven hours in June 2014.

The Atlanta-Journal Constitution says 23 jurors have qualified in the trial against Harris. The minimum jurors to be selected are 42.
