So, another unsolved mystery? Now that the mother has lawyered up, there will be no answers forthcoming. Our legal system guarantees that you can "lose a child" and not have to answer to it. Nowadays, they all hide behind defense attorneys.

Sunday marked day eight of the search for three year-old Aliayah Lunsford, and police say the search is still being considered a rescue mission.

Investigators say the cold weather and rain caused them to scale back their search efforts over the weekend, using mostly law enforcement based search teams. They say the search will resume on Monday in the same place that they left off at on Friday.

The Appalachian Search and Rescue Team is set to be back out as well.

UPDATE: Disappearance Considered Crime

WAJR-FM Radio News - Morgantown, WV

Weston, WV

The search for three-year-old Aliayah Lunsford in Lewis County is over from a volunteer perspective. Federal authorities say they now consider her Sept. 24 disappearance a crime.

FBI Special Agent Jeff Killeen said during a media briefing Monday afternoon they are no longer considering the possibility that the young girl walked away from her home.

Killeen says Lunsford was either a victim of a homicide, abduction or a possible concealment.

Killeen says investigators have a "small universe" of persons of interest.

WESTON -- The silence in the Bendale area said it all, as hope fades and thoughts turn grim, for missing Aliayah Lunsford, 3.
"It's taken a huge toll. This is not something that happens in our community," Weston resident Tammy Raines said.

"It's been an atrocious situation," Lewis County Sheriff Mike Gissy said.

Last week, the Bendale area was the site of a bustling search effort to find Aliayah. But Monday, the FBI announced it considered her disappearance a crime. It considers considering homicide, abduction and concealment as possibilities, Special Agent Jeff Killeen said.

Investigators had been looking at the possibility that 3-year-old Aliayah Lunsford may have wandered away from her home last Saturday but that's no longer the case. After 10 days of searching, investigators don't believe she walked away from her Dennison Street home alone, and they say someone has to know where she is.

The disappearance of Aliayah is now being looked at as a a crime.

"We believe that there are three potential crimes here that may be committed. One's a homicide, the second is an abduction and a third may be a concealment," says FBI Special Agent Jeff Killeen.

A small group of persons of interest are being looked at by about 50 local, state and federal officers.

Deputies practice tracking down fugitives

CHARLESTON, W.Va. -- Broken twigs, compressed grass, fresh footprints -- members of the Kanawha County Sheriff's Department analyzed them all on Monday during training exercises to track fugitives and missing persons.

Experts from the state Division of Natural Resources and the U.S. Fish and Wildlife Service trained about 20 members of the Sheriff's Department's SWAT team and the Kanawha County Ambulance Authority. The men followed tracks along trails at Camp Virgil Tate, trying to locate two deputies posing as fugitives.

Federal investigators say the disappearance of a 3-year-old West Virginia girl is now considered a crime, the Charleston Daily Mail reports.

FBI Special Agent Jeff Killeen told media outlets Monday that investigators no longer believe Aliayah Lunsford just walked away from her Bendale, W.Va., home Sept 24. Lena Lunsford told police her daughter was in bed that morning at 6:30, but there's been no sign of the child since.

She does sound upset. But something is off here if there was no indication of trouble noted by the neighbor who was outside at the time she left to look for her daughter. She didn't even ask him if he saw her.

Cali, I agree with you. Things (background) are slowly coming out about Aliayah's mother, the stepfather and the guy that Lena mentioned in her 911 call as being Aliayah's father.

I think Lena knows what happened to Aliayah. I wonder why she would lawyer up! Oh, well. . . .

The criminal investigation of Aliayah Lunsford, 3, is still going strong 11 days after she was last seen.

Investigators said it could be a murder, an abduction or a concealment; however, they wouldn't name a suspect. There's supposedly a small list of persons of interest but investigators wouldn't release any names.

A lot of folks question parental involvement, but so far, investigators simply said they have been talking to the family and neighbors simply because they know Aliayah the best.

Both Aliayah's mother, Lena Lunsford, and stepfather, Ralph Lunsford, have a list of criminal charges in Gilmer, Lewis and Braxton counties.

We've learned Aliayah's stepfather Ralph Lunsford is related to two women who went missing from Lewis County in 1999. To this day, they still haven't been found

You are right, its odd. Scary. He doesn't seem to like women much.

Following a Freedom of Information Act request, 5 News has received a copy of the first two phone calls that prompted a massive search to find a missing 3-year-old in Lewis County.

Thursday is the 13th day since Aliayah Lunsford was last seen by her family. What follows is an edited version of the first two calls made by Lena Lunsford, Aliayah's mother, that brought thousands to the Bendale area.

911: What's your emergency?

LENA: My baby's missing!

That's how the 911 call started the Saturday morning Lena Lunsford reported her daughter Aliayah missing. She explains the last time she saw the girl.

LENA: This morning, real early, I went in and checked on her because she's been sick with the flu.

On September 28, 2011, a friend, whom I consider a reputable source, e-mailed me several articles about the two women who went missing in Lewis County and have not been seen since 1999.

These two women are suppose to be Ralph Lunsford's grandmother and aunt.

My source could not verify the info on Sept. 28.

These articles are for info purposes only. I am making no implication that Ralph Lunsford has a thing to do with these ladies' disappearance.

On Wednesday night, December 1, 1999, Mary Geneva Friend and Marcus Maxine Stalnaker disappeared from their residence near Jane Lew, Lewis County, West Virginia. Friend’s vehicle was recovered abandoned in Clarksburg, Harrison County, West Virginia, on Monday, December 6, 1999.

Sherry, you did not imply that Ralph Lunsford had anything to do with the two missing women.

You merely pointed it out in an article by a West Virginia tv station.

Had I copied the third paragraph, I would have copied/pasted about 75% of the article which is in violation of copyright laws.

It's been 13 days since Aliayah Lunsford, 3, disappeared from her Bendale home in Lewis County. FBI Agents say the little girl is the victim of a crime. Now, a Clarksburg attorney claims he has information that suggests she could be still be alive.

Earlier this week, Tom Dyer offered his services for free to anyone who had information about Aliayah's disappearance.

He says that on Sunday, a woman he had represented in the past called him with what he calls "very credible information." The woman suggests that Aliayah has been taken and the man responsible has some sort of prior relationship with the Lunsford family.

IT appears that this poor little child had nobody to protect her. No wonder she looked so sad on those missing posters. I don't believe she is "missing" and I don't believe she is alive. Poor innocent helpless little child.

I've been directly to the majority of the media sites in West Virginia (google & yahoo do not always list articles from all media sources).

No updates or new info on Aliayah.

I think Lena Lunsford knows what happened to Aliayah and is the key to solving this case.

It is so odd that a family member is not in front of the local media cameras begging for the safe return of Aliayah!

It’s been more than two weeks since Aliayah Lunsford went missing form her family’s Dennison Street home in Weston in the early morning hours of September 24. In the passing two weeks the media has made every effort to cover this story to the best of our abilities. It has not been easy.

There has been limited cooperation from law enforcement. Actually, law enforcement officials have stonewalled at times, which seems very odd to me given they are looking for a missing three-year-old. There has been little or limited cooperation and communications from the family, which is, again, very strange for a missing child case. I am sure law enforcement encouraged the family not to speak with media. I also expect they had no desire to talk to the media either.

It seems like LE would want to have all the info they could out there to generate leads......normally. In this case, I think they have a pretty good lead and are working to solidify it without fear of outside factors. Hence the stonewalling. At least i hope that is what's going on here.

Thanks for pointing that out. Neither LE nor the family is distributing photos, etc. Sadly, that speaks volumes and I can't help wondering if LE has something concrete to indicate that Aliayah is dead.

Does anyone know if the mother has had the twins yet? I read somewhere that they didn't do a LDT with her because she was pregnant so I'm wondering if they'll ask her to do one after she's given birth. I'm also wondering if CPS will remove the newborns from her care as well.

Hi, Gia!

There have been no mainstream media reports of Lena Lunsford giving birth to the twins yet.

I am not educated regarding the West Virginia Department of Health and Human Resources - CPS criteria for removing a child (in this case twins) at birth.

Being that the other children have been removed from the home, it is my opinion that the twins will be taken into custody by WVDHHR - CPS.

If this was in Texas, the child (twins) would be taken into the custody of CPS since other children in the home were removed from the custody of the mother. Obviously, criteria would be met already.

It is true that LE did not do a Polygraph on Lena Lunsford due to her pregnancy.

In a Texas case, it was several weeks after birth that LE would do a Polygraph on a mother after she gave birth.

I think it is very odd that the family or a spokesperson for the family is not speaking to the media and keeping Aliayah's name in the news. It speaks volumes.

There have been no recent pleas by the family or a spokesperson for the family for the safe return of Aliayah.

In the Skelton boys' case, the mother had a spokesperson, on behalf of the family, make pleas for the safe return of Andrew, Alexander and Tanner. To this day, the spokesperson still speaks on behalf of the family.

There is definitely something Hinky in this case. Lena's story does not add up.

Aliayah Lunsford's disappearance has triggered folks across the state to team up and try to create a new law that would help missing children. It's called "Aliayah's Law".

When children go missing there are really only three things that can be done. 911 can be called, an Amber Alert can be issued, or Project Lifesaver can be used.

In Aliayah's case the Amber Alert couldn't be issued because there was no vehicle description or license plate number to share. Project Lifesaver is mainly used for Alzheimer's or memory loss patients.

The "Aliayah's Law" Facebook group was created in hopes to petition for a new law that would help protect and find missing children.
