Judge grants husband of missing Miramar woman more time with kids

The husband of Miramar mother Vilet Torrez, who is missing, was granted extended visitation rights Thursday with their three children.

Cid Torrez's attorney, Richard Della Fera, filed a petition to have the children returned to their father, but Broward Circuit Judge Susan Lebow delayed a decision until later this month.

However, the magistrate judge allowed Torrez additional supervised time with his kids, including for two of their birthdays on May 18 and May 20.

MIRAMAR—
Authorities on Wednesday were searching another waterway in the case of Vilet Torrez, a mother of three who vanished in March.

Members of a multi-agency search task force have scoured several lakes in western Broward since Torrez, 38, was reported missing.

Wednesday morning, divers from the Miramar Police Department were preparing to search the lake directly behind Torrez's home along the 12900 block of Southwest 28th Court.

Dispute over missing Miramar woman's children goes through weekend

MIRAMAR—

On Wednesday, it will be two months since Vilet Torrez disappeared. A week after the Miramar mother of three vanished, her estranged husband Cid Torrez temporarily lost custody of the children, and he has sought their return ever since.

On April 6, a judge ordered that the Torrez children — Vilet, 13, Cid, 8, and Marcus, 5 — live with their maternal grandmother after the Department of Children & Families reported an allegation that Torrez said he was going to get a gun and end it all because of the stress of his wife's disappearance, according to testimony.

Late Friday, the Florida Attorney General's Office dismissed its custody case.

But the family on Saturday declined the DCF's request to return the children to their father, Vilet Torrez's sister Nayiva Blanco said.

The family wants a court order before they comply, she said Sunday.

Cid Torrez's lawyer Richard Della Fera said Sunday that the Blanco family was acting "in defiance of lawful process. But if I have to get a court order to return the children to their father, I will."

The three children of missing Florida woman Vilet Torrez have been removed from their father’s home by a judge after a call to authorities indicated they may be in danger.

The Florida Department of Children and Families received a call last week from a family member of the missing woman, indicating her estranged husband, Cid Torrez, had made statements about “getting a gun and ending it all,” allegedly including the lives of himself and his children.

Although (Cid) Torrez has not been named a suspect in his estranged wife’s disappearance, those close to his wife are concerned he may have been involved.

A South Florida judge ruled Thursday morning that the three children of missing Miramar mom Vilet Torrez will remain with their maternal grandparents for now, denying custody to the estranged husband police are calling a person of interest in her disappearance.

The children are "actually doing pretty well," Vilet Torrez's brother Javier Blanco told HuffPost Miami after squaring off in court with their father, Cid Torrez. "Being at home with my mother I think they feel at home. They know their mother is missing, but they seem to have a very childlike faith that she'll be back."

You were reading my mind, that's exactly where I was going, thank you for putting it into perspective.

I totally agree, it is a big mistake to give the father custody of the children, especially after he has threatened not only to kill himself, but also killing the children "to end it all".

We don't want a Josh Powell repeat, I am horrified by the thought.

CBS4 cameras captured investigators photographing strange marks on bricks surrounding a flower bed. The marks were so concerning, police decided to take the bricks for further examination. On the front door, you can also see faint stains or smears.

"We are going on record," Miramar Police spokesperson Tania Rues confirmed. "Foul play is suspected."

Police have already searched Torrez's Toyota Sienna, a 2009 Jaguar registered to husband Cid Torrez, and the family's Miramar townhouse. A fourth warrant has been filed allowing investigators to obtain DNA and fingerprints from Cid Torrez, who picked up the couple's three children the afternoon of March 30 and then reported his wife missing three days later.

Recent court documents obtained by the South Florida Sun-Sentinel show police removed several items from Torrez's home, including bathroom towels and ladies shorts with what may be blood stains. Detectives were previously spotted inspecting and then removing and bagging bricks from around her front door on April 5.

"[Vilet Torrez] did not leave on her own free will, and we believe foul play is suspected," Rues said. She declined to name other possible angles or people who had been questioned but said Cid Torrez had fully cooperated.

Vilet Torrez had dinner plans with a male friend on March 30, Cid Torrez told ABCNews.com shortly after her disappearance. Torrez said his wife had a new boyfriend whom he had met and had been "around" since she was reported missing. The missing mother's siblings said they hadn't heard of a new boyfriend in Torrez's life and said Cid Torrez had a history of being "jealous" to the point they worried about their sister's safety.

"We had been fearing for her life for about a year already," her brother, Javier Blanco, told ABCNews.com. "Her family had been warning her, friends, marriage counselors. We were all urging her to get out, and she was [finally] transitioning her life."

A Florida judge gave Dale Smith full custody of Michelle Parker's children after he was officially named a suspect in her disappearance. The children where living with Michelle at her mother's house, they were removed by CPS from Dale because Michelle dropped them off and immediately after, she went missing. There was a custody hearing shortly after, Michelle's mother pleaded with the judge, the police told the judge that they believed that it was to the best interest of the children to remain with their grandmother while they investigated Michelle's disappearance, CPS agreed with the police. Dale has a history of violence, but still, the judge granted him custody.

We have already seen what happened to Susan Powell's children. The prosecutor, the judge, the police, and CPS failed them. That was a horrible tragedy. Many children have been killed by one of their parents after they gained custody or visitation. I wonder when is the system going to start to take the children's rights and their safety into account.

Probably in most cases, not all, I don't see a problem with leaving the children with the grandparents, or another suitable family member, while everything is being investigated.

This here is nuts!

I hope we're not all writing Rest in Peace to these kids sometime in the future.

No, custody and guardianship issues are dealt with at the family court, the family court judge is the one who has discretion to make a ruling in the case, if any of the parties disagree with the judge's ruling, they can file a motion with the court of appeals.

I don't know why the AG office is involved with the custody of Vilet Torrez' children.

I think that Vilet's family need to hire a lawyer to help them with the process, or contact an agency that advocates for children's rights. I hope they can find someone who can help them, if they can't afford to hire a lawyer to represent the interests of the children.

Honestly I think that once a POI or suspect in a disappearance, assault or homicide. custodial parenting rights should be revoked or restricted to supervised at a secured location until cleared by the investigation or trial.

MIRAMAR (CBS4) – The family of a missing Miramar mother says they are not surprised the woman’s estranged husband has been named as a ‘person of interest’ in her disappearance.

Vilet Torrez, 38, vanished on March 30th shortly after arriving at her Miramar home, according to police.

Her husband Cid Torrez has been named a person of interest. CBS4 News broke the story Tuesday that Miramar police obtained search warrants and took DNA samples, hair samples and fingerprints from Cid Torrez on April 11th.

A Florida judge gave Dale Smith full custody of Michelle Parker's children after he was officially named a suspect in her disappearance. The children where living with Michelle at her mother's house, they were removed by CPS from Dale because Michelle dropped them off and immediately after, she went missing. There was a custody hearing shortly after, Michelle's mother pleaded with the judge, the police told the judge that they believed that it was to the best interest of the children to remain with their grandmother while they investigated Michelle's disappearance, CPS agreed with the police. Dale has a history of violence, but still, the judge granted him custody.

We have already seen what happened to Susan Powell's children. The prosecutor, the judge, the police, and CPS failed them. That was a horrible tragedy. Many children have been killed by one of their parents after they gained custody or visitation. I wonder when is the system going to start to take the children's rights and their safety into account.

Well I'm beginning to wonder who has jurisdiction over the investigation into her disappearance. Who is running this show? It sort of sounds like LE is not.

We have a missing woman, a named suspect who is an estranged husband who is allegedly jealous, controlling and suicidal through testimony of witnesses (direct evidence) concerns for past conditions that could have escalated to domestic abuse, inferring a high risk environment for thee young children suffering from the loss of their mother...then to remove them from the other adults whom they are most used to caring for them?!

I mean is there some serious grey areas between statutes here interfering with protective action?

And who is looking into these?

I hope they do get some serious, effective counsel immediately because it's quite clear that the State is not considering the well being of the children.

Family Of Missing Miramar Woman Outraged Over Custody Decision

MIRAMAR (CBSMiami) – It’s been nearly two months since Vilet Torrez went missing. As the investigation continues, Vilet’s family said they are outraged the state of Florida is allowing Cid Torrez to have custody of the couple’s three children.

“I think it’s appalling,” said Javier Blanco. “I think it’s horrible and I think the state comes off as a joke.

Javier Blanco said his sister suffered abuse at the hands of Cid and was in the process of trying to divorce him when she went missing. The Blanco family told CBS4 the children are happy with their maternal grandmother and do not want to leave.

-A Broward County circuit judge said Tuesday that a man authorities consider a "person of interest" in the disappearance of his wife must be reunited with his three children — outraging the man's in-laws, who are fighting for custody of the children.


-On Tuesday, Judge Susan Lebow explained she no longer has "jurisdiction" in the Torrez children's case after the Florida Attorney General's Office dismissed its custody case Friday. Lebow said the dismissal of the case, or "shelter petition," means that a prior court ruling — which mandated that the children be in the care of their maternal grandmother — no longer was in effect.


Vilet Torrez's relatives said they declined because no court order was instructing them to turn over the children. Lebow said she planned to sign paperwork indicating Cid Torrez is legally entitled to have his children back.

Custody Battle Over Children of Missing Miramar Mother Officially Dismissed

"Child protective investigators with the Broward Sheriff's Office, the Office of the Attorney General and Miramar Police Department have ongoing concerns about the Torrez children's safety. In an abundance of caution, the children were sheltered and a dependency action initiated. Since the initial shelter of the Torrez children, our collective investigation has not produced competent evidence to support a continued dependency action," the Department of Children and Families said in an email statement.

Judge Lebow wrote Tuesday that because of the state's voluntary dismissal, the shelter order was effectively dissolved. She thus ordered the three children returned to Cid Torrez, as the law requires, she wrote.

You are correct, the dismissal of the custody case. That's even worse, because the family of the victim was not allowed to argue the issues that concern the wellbeing and safety of the children.

Alessandra, thanks for this topic, I have been catching up on the comments, I was not familiar with the case.

OMG, I, like everyone else have so much fear for these children I am sick to my stomach. At the very least imo, they need a Guardian Ad Litem for the children although they weren't able to help Charlie & Braden Powell, had they not been murdered, I think they would have helped the children to be taken away from Josh permanently. Chuck Cox was able to secure the Guadian A.L. for his grandkids. Of course when an A Hole is determined to murder his children like Josh, I don't know, unless the POI is behind bars, the kids can be kept safe.

May I ask if they were seperated? It sounded like her family said she was "transitioning," I assumed that meant getting away from the scumbag. NG/psychologist on her show say repeatedly "this is the most dangerous time for a woman when she wants to leave." Val would say, "another mother erased."

It makes me so sad to see the men lined up to search the water for mom. Bless her heart, I pray LE gets enough evidence to arrest the scumbag & he gets no notice. Josh P had notice that he had to take a psychosexual eval he couldn't pass, he knew he was going to lose his boy's so he premediated their murder.

I pray this doesn't happen in this case.

The estranged husband of a Florida mother of three who vanished nearly a week ago called her disappearance "unusual" after she did not pick up their children from him at the scheduled time.

Vilet Torrez, 38, seemed to have vanished without a trace, police said. The Miramar, Fla., woman's car was found in her driveway. None of her personal belongings were inside.

Torrez's husband, whom she separated from two months ago after 15 years of marriage, said he had the couple's three children for the weekend.

Change.org has had many quite successful ones, and this judge's ruling cannot be taken lightly by the general public. MIRAMAR, FLORIDA – Police say the last time anyone saw missing mother of three, Vilet Torrez alive was on Friday, March 30, when she met a co-worker that night for dinner. Police say Vilet Torrez’s husband called 911 on April 2 to report his wife missing, three days after she was last seen. Her husband was watching their three children that weekend and called police after he couldn’t reach his wife, according to investigators.

Authorities say the missing mother failed to show up for weekend appointments at a bathroom remodeling company where she worked. Her company car was found at her townhouse, according to police.

The couple, who had been married for 13 years, had recently been living apart, according to Vilet Torrez’s family. In the three months before she went missing, Cid Torrez was staying with family members in Miami.

On this day in 2005, a family court judge arrested my (now ex-) husband for spousal and child abuse after he fled the scene and failed to appear for months. He showed up to court wearing the exact same clothes he wore the day he battered and bruised me and my 18 month old daughter. We were both under the impression that if he showed up to the hearing, he would be awarded visitation. The family courts here in The City are very "pro-father" even if they are abusive. For whatever reason, the Judge that day defied the odds in my favor. I was awarded full physical and legal custody with NO visitation. My daughter and I were lucky to escape with our lives. I stayed far too long, and I'm still dealing with that; but I never gave him the chance to hurt my baby girl twice.

I pray to God that Vilet is found. Everything about the husband reeks! I hope her children are reunited with their mother and cid is prosecuted to the fullest extent of the law. In the meanwhile, it is total BS that he is allowed custody. Look what supervised visitation got Charlie and Braden Powell! The system is broken. Our children deserve to be protected. Major FAIL Florida!!!!

It seems Vilet's family isn't hopeful for a reunion with her alive. That saddens me beyond belief, especially for her beautiful children.

I work in cleanrooms for a biotech company. We process donor blood to create chemotherapy treatments for cancer patients. I can attest to the fact that the cleaning agents we use to process human blood products are beyond powerful. My mind is racing with the possibilities of what cid could have done, the options he had in his arsenal, if you will.

He didn`t honor the attorney general`s dismissal of the petition when he refused to return the children by operation of law.

So, what I`m confident of is that the detectives are going to do their jobs and they are going to continue that investigation and we should see where that investigation leads instead of jumping to conclusions and pointing fingers, we should let law enforcement do its job.

She goes to dinner with a friend, then vanishes without a trace. As search and dive teams bring in cadaver dogs, has blood evidence been seized? And is it linked to the missing mom of three?

Now in a stunning development, the children`s father lawyers up, refuses to talk about the case, as a judge strips custody from the grandparents even though cops say Daddy is a person of interest in Mommy`s disappearance.

I really want to find this out.

I also would like to know why this custody issue didn't go through the appropriate channels of the family court system and the AG's office was the agency that dismissed the case against Sid Torrez.

LALAMA: But Alex Sanchez, also a defense attorney, you know, if there is a history of mental instability, if threats and allegations that have been rumored to have happened are true, then doesn`t the government end up with blood on its hands? I mean, I know the elephant in the room is everyone`s thinking about the Susan and Josh Powell case. You know, what if something happens? Then what?

ALEX SANCHEZ, DEFENSE ATTORNEY: You know, look, if the government was notified in advance that this guys was a dangerous character and they still allowed him to have custody of the children, they got hurt, you know, they could be held liable.

But right now, if the police have information that somehow, he`s involved in the disappearance of his wife, let them go to family court. Let them join forces with the family to make an application to have those children removed.

But you would have to come in and make statements and affirmations in court that you have certain information, provide that to the court and then let -- make the court make a decision in this matter.

LALAMA: Ramani Durvasula, clinical psychologist, thanks for joining us. I can`t stop thinking about what`s going through these little ones` minds. Just try to paint a picture for us of children torn by their mother missing -- and she is missing at this point. Their father is only a person of interest. Yet they`re being carted back and forth between grandparents and parents. My heavens, what must be happening to them psychologically?

RAMANI DURVASULA, CLINICAL PSYCHOLOGIST: It`s terror and it`s chaos. For any child to not have a mom is frightening. It`s been months. They don`t know where she is. And it`s been an unstable situation for them.

Kids go to a really dark fantasy place. They often blame themselves. They wonder what they`ve had to do with it. They wonder if she`s coming back. And these kids are at a wide age range, so they -- they need to be sort of talked with in a different way.

But this is a time of terror, and it makes the world seem like a really scary place, especially when they don`t have a stable place to live. So all of this is combining to -- somebody really needs to talk with these kids.

MIRAMAR (CBSMiami) – A new clue in the disappearance in the Miramar mother.

Police have released video surveillance which shows 38-year old Vilet Torrez’s vehicle enter her residential community on Saturday, March 31, at 5:16 a.m.

Originally, police had said the last time anyone could remember seeing Torrez, a mother of three, was on the Friday, March 30th inside her home at 12915 SW 28th Court. Her husband, Cid Torrez, reported her missing on the following Monday, April 2nd.

I wonder if this will take Cid off the person of interest list? It says in the article that he was at home with the children (so he says) at the same time she is seen on video coming home.

In the article it does not say she had trouble accessing her parking lot. It says this;
Torrez's minivan can be seen moving between entrances to Harbour Lake and she eventually uses the visitor's gate to get inside, Rues said.

i think it illustrates that Cid's story does not match up:
The video clearly shows Vilet entering her community and intending to go home.
SOmething happened to her in between getting out of her car and heading to home.

The video appears to show Vilet attempt to enter through the residents’ lane into the gated community. Unable to gain access, the vehicle then enters through the visitors’ lane. Detectives believe she disappeared shortly thereafter. Her vehicle, a 2006 silver Toyota Sienna, remained parked within the community until police removed it.

What I don't understand is why is this video just coming out and how long have police had it?
