Attorneys in the trial of Andrea Sneiderman settled on a jury Thursday, selecting six men and nine women to serve either on the 12-member panel or as alternates.

Opening statements will commence Monday morning in the high-profile case that still attracts national attention despite the absence of murder charges, withdrawn last week by DeKalb County District Attorney Robert James.

DECATUR, Ga. (WXIA) -- Lawyers selected a jury Thursday for the perjury trial of Andrea Sneiderman.

Judge Adams said opening statements will be on Monday and the trial should take three weeks.

Jury selection began Monday and a pool of 42 was chosen before the final 12 jurors and 3 alternates were chosen.

The jury consists of nine women and six men. There are 13 African Americans, 2 Caucasians and one Hispanic.

DEKALB COUNTY, Ga. - Attorney Kellie Hill wrapped the prosecution's biting opening statements, depicting a secret romance between Andrea Sneiderman and her former boss, Hemy Neuman, that turned deadly.

The prosecution spoke for about 40 minutes, finishing just after 10 a.m. Monday. Reporting from day one of opening statements at the DeKalb County Courthouse, FOX 5 Atlanta's Portia Bruner said the prosecution told jurors that evidence will show that Ms. Sneiderman and Neuman shared dinner and hotel rooms on business trips.

Defense: Ga. Woman Crushed by Husband's Death

A defense attorney says the Georgia woman accused of hindering the investigation into her husband's shooting death was married to the love of her life and was crushed when he was killed.

DECATUR, Ga. -- Opening statements are complete and witness testimony is beginning in the trial of Andrea Sneiderman.

The prosecution presented its opening statements Monday morning saying "other than the shooter, there was one other person who knew why the shooter wanted Rusty dead."

The Assistant District Attorney said "she kept the police from figuring out who shot her husband in cold blood outside her son's daycare".

The defense told jurors there is no evidence Sneiderman did anything wrong. Her layer said "make no mistake, folks, no matter what state will try to infer, Rusty was the love of her life. They were inseparable."

As her defense team started talking about what would have been her 10th Anniversary, Sneiderman got emotional and started to cry.

Sneiderman trial begins with focus on timeline

Prosecutors spent much of the day pitting Sneiderman against herself, replaying for the jury video clips from her sometimes contentious testimony from the Neuman trial. Without that testimony, prosecutors have previously said, Sneiderman would likely not have been charged.

With the murder charges dropped, the trial now hinges on the Dunwoody widow’s veracity, particularly as it pertains to the prosecutors’ allegations that she had an affair with Neuman. She faces 13 felony counts alleging that she misled police and jurors about that relationship which prosecutors say hindered the investigation into the shooting.

In her opening statement, DeKalb County Assistant District Attorney Kellie Hill said the 37-year-old mother of two was engaged in a “forbidden romance that ended in murder.”

Sneiderman, she said, told her friends one thing and police another in the days following her husband’s murder.

“She didn’t tell police about the relationship (with Neuman),” Hill said. “She didn’t tell police about the trips they took together. She didn’t tell police he wanted to marry her. She didn’t tell police she sent him close to 200 pics of her children after he said he wanted to raise them.”

DEKALB COUNTY, Ga. - Day two of the Andrea Sneiderman perjury trial opened with defense attorneys presenting a note from convicted murderer Hemy Neuman to Sneiderman, his former employee. The note was left at a hotel and read: "You're the most beautiful woman in the world...peaceful sleep knowing you are always in my dreams."

The note is part of testimony from a Longmont, Colorado, hotel employee who is sharing details about the room Ms. Sneiderman booked with Neuman during a 2010 business trip.

Just as he did during the trial of the man eventually convicted of fatally shooting his son Rusty, Don Sneiderman took the stand Tuesday to testify about a much-discussed phone call.

The retired accountant said his daughter-in-law Andrea Sneiderman — on trial on charges of perjury, making false statements and hindering the apprehension of a criminal — called and said Rusty had been shot before she is alleged to have known details of the crime. Sneiderman’s former boss, Hemy Neuman, was sentenced to life in prison after being convicted last year in the fatal shooting in November 2010 in the parking lot of a Dunwoody day care.

Prosecutors replayed portions of her testimony from the Neuman trial in which she said: “I didn’t know what happened to Rusty until I got to the emergency room. No one told me what happened to Rusty.”

The prosecution introduced dozens of correspondences they allege prove Sneiderman was having an affair with Neuman. Many of the 13 felony counts against Sneiderman are connected to previous statements she made about that relationship.

One email Sneiderman sent to Neuman after a business trip the GE Energy colleagues took to Greenville, S.C., speaks of a “betrayal.” In another, she writes: “I feel I have to repent. I don’t know how to live with this.”

Andrea Sneiderman said she did not learn that her husband had been shot until she arrived at the hospital.

However, Don Sneiderman told jurors he clearly remembers Andrea Sneiderman telling him that her husband had been shot before she arrived at the hospital.

"She called, she was very excited, her voice was very high pitched," Donald Sneiderman said. "She said Rusty had been shot, she was so, so sorry and she was going to Dunwoody Prep to see what had happened."

Donald Sneiderman was asked why he was so sure about remembering his phone call with Andrea Sneiderman when he couldn't remember other details surrounding Rusty Sneiderman's murder.

"There are some calls you never forget, and that one was one of them," Donald Sneiderman said.

On Tuesday morning, prosecutors called to the stand a former friend of Neuman.

Melanie White, the Dunwoody realtor who helped Neuman and his former wife buy a home in 2006, testified that beginning in July of 2010, Neuman confided in her that he had left his wife and was he was having an affair with a co-worker named Andrea, a married woman with two children. White would later learn that the woman's last name was Sneiderman.

White said that Neuman told her about a business trip he and Andrea Sneiderman had taken to Greenville, SC, during which the two had decided that they were "soul mates." She said that Neuman began keeping her informed of how his affair was progressing, sometimes forwarding to White email exchanges between Neuman and Andrea Sneiderman to elicit White's advice.

"I told him to leave her alone," White recalled.

White said that after Neuman's business trip to London with Andrea Sneiderman, he told White that he and Andrea Sneiderman got really close and that Andrea Sneiderman "gave in."

If I understand correctly, the tape is from Nov. 18, the day after Rusty S was murdered. The detectives went to the home to interview AS and to serve a search warrant. Upon advice by her atty, AS had turned them away on the evening of Nov 17.

The tape shows how noisy the background is with her children, friends, family and neighbors stopping in and staying. Amazing how unfettered AS is! Amazing how she puts everyone's name out there EXCEPT that of Hemy N.

Hemy has had his day in court and was declared mentally incompetent...
we know he pulled the trigger, had traveled to other cities with AS, exchanged lengthy text messages, etc..
AS never spoke of her affair to anyone; Hemy, on the other hand, spoke OPENLY to others and even sent them messages documenting the progress of the relationship.

As boring as this is to listen to, it has to be presented in its original text to the court as it is evidence.
I am confident the attys will be arguing info from this tape.
I wish it had been presented in text format as it is hard to listen to.
Still, it shows AS' demeanor within 24 hours of the murder of her husband...
keep in mind, she "collapsed" in the parking lot according to the vid tapes that were presented...

Judge denies motion to dismiss case against Sneiderman

DEKALB COUNTY, Ga. — A judge has denied a defense motion to dismiss the case against Andrea Sneiderman.

Andrea Sneiderman’s defense argued Tuesday the state had “utterly and completely” failed to make its case that the Dunwoody widow had an affair with Hemy Neuman, the man later convicted of killing her husband, and of lying about it to the police and on the stand.

“They have failed to prove their case beyond a reasonable doubt and we ask you to dismiss it,” Doug Chalmers argued.

Assistant District Attorney Anna Cross countered that the evidence is sufficient to bring the case to a jury, and that they are the “finders of fact” who should make the determination.

“There was kissing, dancing, rubbing,” she said of the contact between Sneiderman and Neuman.  “It was emotional.”

Chalmers implored the judge to dismiss the perjury charges because he said the law requires her statements to have been material to the case and that contradictory testimony from one other person isn’t sufficient to convict someone of that charge.

Cross argued her statements were material to the case.

“Any statement she said that supported Hemy Neuman's defense and undercut motive...is material.”

Sneiderman to judge: I haven't decided if I will testify

DEKALB COUNTY, Ga. - Defense attorneys in the Andrea Sneiderman perjury trial took center stage Tuesday, presenting its case by reading line-by-line from the 13-count indictment and explaining why each count should be dismissed.

The defense attorney also said the court was not given a precise definition of what it means to be "romantically involved." The prosecuting attorney followed by presenting a definition; in part to hopefully keep the presiding judge from dropping the related count or counts from the indictment.

Afterward, the judge asked Ms. Sneiderman if she will testify in her own trial. She said she hadn't decided and needed more time to consider that with her legal team. The judge said he would allow it and reminded her to make her decision soon.

Actually, the judge gave the defense time to decide whether or not their client will testify on her own behalf. The defense will let the judge know if Andrea Sneirdeman will take the stand at the end of their case, they asked the judge to allow them to present other witnesses testimonies before they make that decision, the judge agreed.

Andrea Sneiderman, who is accused of conspiring to kill her husband, Rusty, has been silent except for a contentious day on the witness stand earlier this year.

Who puts there young children down by 7=7:30 PM?
--AS stated the children were in bed when HN stopped by the house;
--AS stated HN had never met her children.

Who sends 200 pics of her children to a "stalker"?
--AS introduced her children to HN thru the pics.

Who goes on this many trips with a stalking boss, dances with him, shares drinks, has an adjoining room with him?
--AS is burning the candle at both ends.

AS said she dropped the phone and ran out of the office.
---Was the call to the work number or her cell phone?
We know she used the cell phone while in her car.
She called her parents, Rusty's Dad...AS said she did NOT tell Rusty's Dad he had been shot....
She says it was "very normal" for her to call HN to tell him she had  left the office....
Said she was beside herself... was on the phone the entire time to the hospital....
she had "no time to call Rusty!"

I thought it was an oxygen mask at first, too. I think it's repeating and recording, as I haven't seen the typical typing recorder.
