The wrongful death civil suits filed against Hemy Neuman and Andrea Sneiderman following the death of Russell “Rusty” Sneiderman were finally officially settled in two orders by a Fulton County Superior Court judge on December 31 and through an earlier “settlement agreement.”

However, the full resolution of the case, and who will get the $2 million plus in life insurance payments, may never be publicly revealed.

Those rulings were handed down on December 31, effectively fully resolving the civil cases against Andrea Sneiderman and Hemy Neuman, with one remaining caveat. It is still unclear whether the insurance money has been released directly to Andrea Sneiderman.

Andrea Sneiderman turns to appeals court in quest for bond

DEKALB COUNTY, Ga. — Andrea Sneiderman is hoping Georgia’s court of appeals will help her get out of prison while she fights for a new trial.

Last month, a judge denied Sneiderman’s request to be released from prison on bond, so now she is hoping an appeals court judge will grant her request.

Sneiderman is serving a 5-year sentence for lying to police during the investigation of her husband’s murder and lying on the stand during Hemy Neuman’s murder trial.

Dunwoody day care killer Hemy Neuman’s bid for a new trial was denied Monday by the same judge who sentenced him two years ago to life in prison.

Lawyers for Neuman, who acknowledged fatally shooting local businessman Rusty Sneiderman, had argued their client deserved a new hearing because he was convicted in part by perjured testimony from Sneiderman’s widow.

DECATUR, Ga. -- Georgia's State Board of Pardons and Paroles has decided to extend Andrea Sneiderman's parole eligibility another 2 months. She was eligible for consideration April 22, after serving one-third of her sentence. The board ruled today that Sneiderman be granted a tentative parole month of June.

Well, Justice failed, and she got away with being held complicit in the murder of her husband.  The guy she conned into pulling the trigger should be entitled to a new trial, since she set him up.   where is Karma?

I'm still trying to find out if she ever collected the insurance money.  Does anyone know?

I'm still waiting for Karma to catch up to Casey Anthony, as well.  I'm hoping that it will catch up with them in due time.

The terms of that settlement agreement have not been made public and all parties associated with the court action have been sworn not to disclose the terms of the agreement. But that left a couple of issues unsettled for Fulton Superior Court Judge Doris L. Downs to rule on.

Those rulings were handed down on December 31, effectively fully resolving the civil cases against Andrea Sneiderman and Hemy Neuman, with one remaining caveat. It is still unclear whether the insurance money has been released directly to Andrea Sneiderman.

All material allegations against Neuman were accepted but the court did not accept allegations that Neuman “conspired with or engaged in a common design with Mrs. Sneiderman to murder Rusty Sneiderman or engaged in an illicit or inappropriate relationship of intimacy and deceit with Mrs. Sneiderman.”

The court’s order goes on to state: “Given that all claims against Mrs. Sneiderman have been dismissed with prejudice” (presumably as part of the earlier settlement agreement) “the court specifically does not adopt any allegation of the complaint regarding Mrs. Sneiderman.”

One interesting note in this order by the court is the final paragraph, which states: “The court recognizes the estate has transferred full and unilateral ownership and control of any assets remaining in the estate to Mrs. Sneiderman,” including its claims against Neuman.

Andrea Sneiderman, the widow of a man murdered outside a Dunwoody day care has been released from prison.

Sneiderman was convicted in 2013 of lying about an affair with her husband’s killer, Hemy Neuman. Neuman, her former boss, was convicted last August on nine of 13 felony counts, including perjury, making false statements to investigators and hindering the apprehension of a criminal.

Sneiderman was sentenced to 60 months in state prison, but the state parole board decided she should serve 22 months. She was released early Monday morning, according to the state department of corrections.

ATLANTA – Georgia officials say a woman convicted of lying during the investigation of her husband's killing outside an Atlanta-area preschool has been released from prison.

DUNWOODY, Ga. – The Georgia Supreme Court will hear an appeal from Hemy Neuman.

Neuman is serving a life sentence after being found guilty but insane in the Nov. 2010 shooting death of Rusty Sneiderman outside of a Dunwoody daycare.

During the trial, Neuman's attorneys contended that his affair with Sneiderman's wife, Andrea, drove him to madness. Neuman was Andrea Sneiderman's boss at GE Energy.

In a separate trial, Andrea Sneiderman was convicted of perjury and sentenced to five years in prison. She was released in June 2014 after serving 22 months. She is serving out the remainder of her sentence under paroled supervision.

The last we heard was that there was no word on whether or not the insurance money was ever paid out. And whatever settled she reached with Rusty's family is confidential, so we may never know.

I agree; I think she got off easy, and would be stupid to open this up again.

At a hearing on Tuesday, Steel asked Judge Gregory Adams for a new trial, saying that perjury requires more than just lying under oath.

"Just because a person testifies falsely under oath doesn't mean it's material," says Steel.

He argued that Sneiderman's testimony was not needed to convict Neuman.

"The motive for the killing remains undisturbed by Andrea Sneiderman's perjury conviction," Steel told the court.

But Assistant District Attorney Anna Cross says Sneiderman's testimony did matter, and even though the state showed her to be a liar, she still lied under oath.

"Just because she was effectively impeached doesn't make the false statements any less material," says Cross.

Neuman is asking for a new trial and has appealed to the state Supreme Court, claiming that his conviction was partly based on Andrea Sneiderman's perjured testimony.  Cross argued before the Georgia Supreme Court that her testimony did not matter to get a conviction.  But Tuesday she argued that her testimony was relevant.

DEKALB COUNTY, Ga. -- The Supreme Court of Georgia announced Monday it has reversed Hemy Neuman's conviction.

Neuman was found guilty but mentally ill of gunning down Rusty Sneiderman outside a Dunwoody daycare center in 2010.

In a 6-to-1 decision, the high court ruled the trial judge erred by allowing the notes and records of two mental health experts who examined Neuman before trial to be entered as evidence.

"Because the trial court erred in admitting evidence, which was protected by the attorney-client privilege, we now reverse," the opinion said.[/b]

"We conclude that the trial court erred in disclosing to the State Dr. Rand Dorney's and Dr. Thomas' notes and records concerning Neuman," the high court's opinion says. "This evidence was not harmless, and therefore, we must reverse Neuman's conviction."

Neuman is now likely to be re-tried by the DeKalb County District Attorney. For now, the case reverts to its pre-trial posture, with Neuman being held as a suspect in the fatal shooting of Sneiderman.

“The families of the victims of Hemy will handle this setback as they have every other in this painful saga, with dignity and grace,” said attorney Esther Panitch, who represented Neuman’s former wife Reli and, later, Rusty Sneiderman’s parents and brother.

Neuman co-counsel Bob Rubin was in Israel on vacation when he received the news from an Atlanta Journal-Constitution reporter.

“That’s unbelievable,” said Rubin by phone from the shores of the Sea of Galilee. “I thought (DeKalb County Superior Court) Judge (Gregory C.) Adams was pushed into some bad decisions by the prosecution.”

“He may finally realize he was played,” Panitch said.

Good. IMO, he took the brunt of the punishment and she reaped the financial rewards of this murder. I don''t think he deserved the indefinite sentencing of mentally ill... I realize the legal challenges on are based upon improprieties.

ATLANTA (AP) — Prosecutors and defense lawyers must now chart a new course through a sea of legal questions after Georgia's highest court reversed the murder conviction of a man accused of killing a father who had just dropped off his son at preschool.

Monday's 6-1 ruling by the Georgia Supreme Court renews a complicated criminal case that prosecutors said stemmed from a deadly love-triangle.

Hemy Neuman was sentenced to life in prison without chance of parole for the November 2010 killing of Russell "Rusty" Sneiderman. A jury in March 2012 found Neuman guilty but mentally ill of malice murder in Sneiderman's death.

Prosecutors "will be prepared to retry the case," Erik Burton, a spokesman for the DeKalb County District Attorney's Office said in a statement.

But it's not clear whether the case would go to trial or end with some type of plea agreement. Neuman's lawyer, Doug Peters, told reporters after the ruling that he's open to pursuing "any fair resolution" of a case.

That's the question some are asking following the Georgia Supreme Court's announcement Monday that it had reversed the conviction of Hemy Neuman.

Neuman, Sneiderman's former boss, was found guilty but mentally ill in 2012 of the 2010 shooting death of Sneiderman's husband, Rusty.

The retrial "is going to be the Andrea show all over again," Esther Panitch told the AJC's Christian Boone. Panitch represented Neuman’s former wife, Reli ,and, later, Rusty Sneiderman’s parents and brother.

"....A medical expert who testified for the State at the 2012 trial said he believed Neuman was malingering, or faking symptoms of mental illness. Another prosecution witness said Neuman showed no signs of mental illness or delusions after killing Sneiderman.

“The families of the victims of Hemy and Andrea will handle this setback as they have every other in this painful saga -- with dignity and grace.”

Despite objections from Neuman's defense team, State attorneys sought the records from Rand Dorney's and Thomas' meetings with Neuman. After two hearings, a judge ordered the defense to turn over all the doctors' notes and records to the State.

"We conclude that the trial court erred in disclosing to the State Dr. Rand Dorney's and Dr. Thomas' notes and records concerning Neuman," the high court's opinion says. "This evidence was not harmless, and therefore, we must reverse Neuman's conviction."

The State argued the doctors' communications with Neuman are neither confidential nor protected by attorney-client privilege. The Georgia Supreme Court rejected that claim, saying that before meeting with Rand Dorney and Thomas, Neuman signed a form that stated their examinations were not confidential and anything discussed could be admitted in court....."

Hemy Neuman says he can’t afford attorneys; granted public defender

...Hemy Neuman, whose conviction was overturned in June, told a judge during a status hearing Thursday he can no longer afford to retain Doug Peters and Bob Rubin, the two defense attorneys he hired after his arrest. He’ll now be appointed public defenders.

...The public defender’s office will take about two weeks to appoint attorneys. A date for the re-trial has not yet been set.

"...The Georgia Court of Appeals on Friday rejected Andrea Sneiderman’s appeal of her 2013 conviction for hindering the apprehension of her husband’s killer.

Sneiderman was found guilty of destroying evidence and lying to Dunwoody Police during the investigation into the 2010 shooting death of her husband, Rusty Sneiderman. Jurors determined she also made false statements from the witness stand about her relationship with the accused killer, Hemy Neuman, who admitted he had an affair with her.

Sneiderman’s appeal attacked her conviction on several technical grounds, among them alleging that prosecutors failed to prove her statements were material to the murder investigation...."


".....Sneiderman had failed in her appeal last year before the DeKalb County Superior Court. She served 10 months in prison for perjury and was released in June of 2014; she will be on parole through August 2017.

Neuman pled not guilty by reason of insanity on the murder charge and was found guilty but mentally ill. But the Georgia Supreme Court reversed the conviction on the basis that the trial court admitted evidence protected by the attorney-client privilege.

Neuman is set to have a retrial in the fall. ..."
