Oscar Trial: Pistorius should receive 3 years correctional supervision
South Africa
Monday 13 October 2014 - 1:03pm
by Gill Gifford
PRETORIA – Oscar Pistorius should be sentenced to three years of correctional supervision and required to do 16 hours of community service each month as a fitting punishment for killing Reeva Steenkamp.
This was the finding of Correctional Services Department official Mashaba Maringa, the social worker who drew up the sentencing recommendations for the North Gauteng High Court.
Maringa said he was aware that Pistorius had lost out on career opportinuties after he shot his girlfriend on 14 February 2013 and was currently living off his savings.
Maringa said if Pistorius was given house arrest rather than a prison sentence, he would be able to correct his conduct with the resources available to him.

At Oscar Pistorius’s Sentencing Hearing, Descriptions of a ‘Broken Man’

LONDON — Oscar Pistorius, the disabled South African athlete found guilty a month ago of killing his girlfriend, returned to a Pretoria courtroom on Monday as his lawyers began a new struggle with prosecutors over the severity of the sentence he should face.
Seeking leniency from Judge Thokozile Matilda Masipa, Mr. Pistorius’s defense team called witnesses who described him as “a broken man” and said his punishment should be limited to house arrest and community service — penalties described by the prosecution as “shockingly inappropriate.”
And, as throughout the trial, the latest hearings revolved around the dual persona depicted by the defense and the prosecution: on one hand, a remorseful, contrite figure traumatized by his own actions; on the other, an egotist who snuffed out an innocent life.

Oscar Pistorius community service call angers prosecutor (Video)
South African athlete Oscar Pistorius should not go to jail over the killing of his girlfriend, Reeva Steenkamp, his sentencing hearing has been told.
A probation officer appearing for the defence said Pistorius should serve house arrest and community service.
Prosecutor Gerrie Nel described the suggestion as "shockingly inappropriate".
Pistorius was found guilty of the culpable homicide of Ms Steenkamp last month - but was cleared of murder.
The decision was criticised by the victim's family.

Oscar Pistorius: defence calls for three years' house arrest instead of jail
State correctional officer recommends that Oscar Pistorius be sentenced to house arrest and 16 hours' community service a month for killing Reeva Steenkamp
By Erin Conway-Smith, Pretoria
1:07PM BST 13 Oct 2014
Oscar Pistorius should be sentenced to three years' house arrest and community service, rather than going to jail, a correctional services officer has recommended during sentencing proceedings for the South African double-amputee sprinter.
Joel Maringa, who appeared as a witness for the defence, said Pistorius should perform two eight-hour shifts of community service per month, which would involve cleaning a museum and other tasks. Mr Maringa told the court: "What we are doing is to reform him to make a suitable, responsible citizen."
~Snipped~
Prosecutor Gerrie Nel, who argued with Mr Maringa over the details of Judge Thokozile Masipa's judgment and the facts of the case, called the recommended sentence "shockingly inappropriate".
"You have not applied your mind to the seriousness of the crime at all," Mr Nel said.

Oscar Pistorius a 'Broken Man,' Psychologist Testifies
ABCNews LIEZL THOM
Updated 17 mins ago
PRETORIA, SOUTH AFRICA -- The charges against Oscar Pistorius - and the relentless media attention - have robbed the double-amputee sprinter of the opportunity to mourn the death of girlfriend Reeva Steenkamp, his personal psychologist testified as the sentencing phase of his trial began.
~Snipped~
Dr. Lre Hartzenberg says Pistorius has still not been able to reach a stage of acceptance and healing following the 2013 shooting.
"We are left with a broken man who has lost everything. He's lost his relationship with Reeva Steenkamp, he's lost his moral and professional reputation. He's lost his friends. He's lost his career," Hartzenberg said. "On an emotional level, his self-perception and self-worth have been damaged."
When Hartzenberg called Pistorius a "broken man," the Olympian became tearful in court.
Prosecutor Gerrie Nel countered by asking the psychologist about Steenkamp's relatives.
"Would you not expect a broken family?" Nel asked.

NPA aims for 'harshest punishment' for Oscar
SOUTH AFRICA | Monday 13 October 2014 - 12:10pm | by Lenyaro Sello

PRETORIA - The National Prosecuting Authority (NPA) says it will argue for the harshest sentencing for Oscar Pistorius this week.
“Our duty is to make sure that when we ask for sentence that we ask for the harshest sentence possible – and we will certainly do the same in this matter,” said NPA spokesperson Nathi Mncube.
“It will be a sentence that will be befitting the crime – the severity of the offence and we know that he was convicted of culpable homicide but still someone lost her life in a very gruesome manner and we think that obviously deserves the harshest sentence possible,” he added.
Sentencing week has begun in the North Gauteng High Court with Pistorius’ therapist already testifying in his defence.
Reeva Steenkamp’s parents, June and Barry, are in court as well as members of the African National Congress Women’s League (ANCWL) members who have been supporting the family through the trial.

Oscar Pistorius sentencing: RECAP after Blade Runner appeared in court facing jail for killing Reeva Steenkamp
Oct 13, 2014 13:29 | By Sam Adams
Pistorius appeared at the High Court in Pretoria for the first day of sentencing. A judge will decide whether he is jailed for culpable homicide or be allowed to walk free
That's it for today. Court has been stood down until tomorrow. The sentencing is due to restart at 8.30am UK time.
To recap on today's events in court:
Oscar Pistorius arrived at Pretoria High Court this morning for a sentencing hearing that will determine whether he serves jail time for the negligent killing of his girlfriend, or walks out a free man.
A stony-faced Pistorius stared straight ahead as police officers escorted him into the court building.
Psychotherapist says Pistorius wept during their sessions
Pistorius psychologist says athlete is a "broken man" as sentencing hearing begins
He declined to answer questions from the scrum of reporters but greeted his family inside the court with smiles and hugs.
After a six-month, on-off trial that captivated South Africa and millions more around the world who admired Pistorius as a symbol of triumph over physical adversity, opinion is starkly divided on the eventual outcome.
A non-custodial sentence would be likely to spark public anger, fuelling a perception among black South Africans that, 20 years after the end of apartheid, wealthy whites can still secure preferential justice.

The third witness of the day was Pistorius' former manager Peet van Zyl, who talked about the athlete's charitable work and that the likes of Sebastian Coe, Sir Bobby Charlton had asked for his help in the past.
He produced a document reported to be more than a 100 pages long on Pistorius' charity work, which led to the prosecution requesting to stand the matter down so that they had time to study the report.
Judge Masipa assented and court was adjourned until 9.30am (South Africa time) on Tuesday.
Earlier Hartzenberg's testimony - characterised by the chief prosecutor as unbalanced - was part of an effort by the runner's legal team to persuade Judge Thokozile Masipa that Pistorius was remorseful and had suffered emotionally and materially for what he said was an accident.

Dr Hartzenberg, who described herself as an expert in trauma counselling, said she first met Pistorius on February 25 last year, 11 days after the death of Ms Steenkamp, and had been counselling him since.
But prosecutor Gerrie Nel criticised her findings, saying Pistorius would likely have the chance to rebuild his life.
Responding to Dr Hartzenberg's description of a broken man, Mr Nel asked the psychologist about Ms Steenkamp's family.
'Would you not expect a broken family?' he asked, saying her father Barry had suffered a stroke as a result of the killing of his daughter.
Mr Nel said Pistorius also had the opportunity to return to his life and his track career. 'We are now dealing with a broken man, but he is still alive,' the prosecutor said.

Oscar Pistorius arrives in court in Pretoria, South Africa for sentencing over the death of Reeva Steenkamp

Oscar Pistorius’ sentencing starts as the defense witnesses are cross-examined, pushing for community service rather than jail time
13 Oct, 2014
by Gerhard Jacobs in NEWS
Gerrie Nel back in full swing as he lays into Barry Roux’s witnesses like only he can.
As day one of Oscar’s sentencing gets underway, it’s clear that Roux’s team is buttering Judge Masipa, so as to rule on their preferred outcome; community service.
Witnesses called in defense of Oscar Pistorius seem to be his biggest fans right now. Painting a picture of a kind, victimised and broken man with a burning desire to be involved in charitable work. That’s how Dr. Lore Hartzenberg and Oscar’s manager Peet van Zyl portrayed the convicted criminal. The third defense witness Joel Maringa of the department of social services, seems to believe that house arrest and community service would be sufficient punishment for a man convicted of culpable homicide.
While the defense chucked out one pro-Oscar witness after the other, Gerrie Nel, true to form, batted and badgered them to the point of where some could hardly answer his questions. The sentencing will continue tomorrow.

The reported "charity" work from OP:
This is inappropriate for "punishment" as it is also self serving for OP by keeping his face out in the public; he is being rewarded.
How much of the charity work OP did in the past were TERMS OF CONTRACT for ENDORSEMENT and repayment by assorted endorsing companies???? You can say, for example, Miss America showed up at a charity benefit for abused women but the truth is it was WRITTEN INTO HER CONTRACT for her to be as assigned charity benefits.
IMO, OP has the same design.
He was prepaid with endorsements for doing community or charity services....
Nel needed to nail OP on this and he failed to!

IF he gets off, can OP counter-sue the State or/and Reeva's family for destruction of his career?

Hi Freckles,
I don't believe so, he killed Reeva and he was found guilty of culpable homicide. There is no mandatory sentence for manslaughter in South Africa, the judge has total discretion regarding the punishment that will be imposed. He did that to himself, he destroyed his career when he killed Reeva in a fit of rage. I don't believe the intruder scenario, it looks like the judge bought it, hook, line and sinker. She is either very naïve or the SA's judicial system is very corrupt. Pistorius should be counting his "lucky stars", the judge has been "extremely lenient" and "very tolerant" of his theatrical tantrums.

'Shockingly inappropriate' sentence suggested for Oscar Pistorius after culpable homicide conviction
A social worker suggested a sentence for the Blade Runner — who was found guilty of culpable homicide in the Valentine's Day 2013 shooting death of his girlfriend Reeva Steenkamp — should be janitorial work for two days a month for three years. But prosecutor Gerrie Nel said the 'destroyed' athlete needs to have a punishment that better reflects the seriousness of his crime.
BY BRENDEN NEL / NEW YORK DAILY NEWS / Monday, October 13, 2014, 10:36 AM
Oscar Pistorius should mop floors two days a month for the next three years to pay for killing his girlfriend Reeva Steenkamp, a state official testifying for the defense recommended Monday.

'Pistorius Lives To Love Again. Reeva Is Dead'
The athlete is reminded that while he claims to have "lost everything", he still has his life - unlike Reeva Steenkamp.

The cliche "what a difference a day makes" could not be more apt than when describing the dramatic reversal of fortune for Oscar Pistorius.
Twenty-four hours before shooting girlfriend Reeva Steenkamp, the athlete had sponsorship deals worth millions, with many more in the pipeline and was revered around the globe.
His agent said that to call his future bright then "would be an understatement" and he was guaranteed financial security up to his planned sporting retirement.
A day later, his girlfriend was dead, his reputation was in tatters, he was arrested for murder and a return to his sporting career and therefore his livelihood was uncertain.
Now, his agent told the Pretoria court on the first day of Pistorius' sentencing hearing, he had no sponsorship deals at all.

Oscar’s manager faces grilling
October 14 2014 at 04:13am
Johannesburg -
State prosecutor Gerrie Nel will continue to cross-examine Oscar Pistorius's manager, Petrus van Zyl, on Tuesday in the athlete's sentencing proceedings.
Van Zyl told the North Gauteng High Court in Pretoria on Monday about Pistorius's involvement with various charities and that the athlete was planning to retire in 2017. He said Pistorius lost all his endorsements after the shooting.
Van Zyl said he was negotiating new contracts for Pistorius up until 2017 and the last talks were on February 7, 2013 - a week before the athlete shot his girlfriend, Reeva Steenkamp.
Nel asked for an early adjournment to go over the documents Van Zyl handed to the court.

Sorry but I was raised in that those who have much have much to give back. Until the 1900s, it was understood in America the wealthy had a DUTY to help provide for the less fortunate who made the wealthy what they were !!! So he gave to charity? Well, shout it down an empty well and keep your mouth shut. You did what you were SUPPOSED to do and the rest is between you and God. Shame to use it to feed your ego!!!!
