They are not required to state his intentions but only to state, upon evaluation, his comments were not believable.

"In overturning the trial ruling, Supreme Court of Appeal Justice Lorimer Eric Leach unpacked exactly how the court interprets dolus eventualis. To prove dolus, the state had to prove that the perpetrator committed the act that led to the victim’s death with the intention to kill. Under South African law, there are two forms of dolus — directus and eventualis. Simpler to understand, directus describes the direct intention to kill.

The principle of eventualis rests on the idea that the perpetrator may have foreseen that someone would be killed by their actions, and went ahead.

Pistorius seeks to appeal against murder conviction

"...His lawyers say the appeals court made fundamental errors, claiming in appeal papers that the court "acted unlawfully and unconstitutionally when it rejected the factual finding of the Trial Court and replaced it with a contrary factual finding of its own".

Pistorius's lawyer, Andrew Fawcett, says the appeal is now in the hands of the director of public prosecutions, who must decide whether there are grounds for appeal. If so, the case will go before the Constitutional Court.

The South African made history by becoming the first amputee sprinter to compete at the Olympics, in London in 2012. He competed in the 400m, wearing carbon-fibre blades to run against able-bodied athletes...."

The Blade Runner is facing a minimum of 15 years behind bars after South Africa's highest court rejected his murder conviction appeal.

He is due to be sentenced for the crime between June 13 and 17, Sky News reports.

Dates Set For Pistorius Murder Sentence

Five days are set aside for the sentencing of the 29-year-old athlete who faces a minimum of 15 years behind bars.

A court in South Africa has finalised the dates for the sentencing of former Olympic sprinter Oscar Pistorius for murder.

The sentencing will begin on 13 June and will be heard until 17 June, High Court Judge Aubrey Ledwaba said.

The disgraced Olympic and Paralympic gold medallist made a brief appearance in court to hear the judge's decision.

He faces a minimum of 15 years behind bars for the killing of his girlfriend Reeva Steenkamp in 2013.

FRESH mystery has been sparked into the death of Oscar Pistorius’s girlfriend Reeva Steenkamp after new evidence claims bin bags and tape were found close to her body.

Disgraced Paralympian Pistorius is due to be sentenced later this year for Ms Steenkamp’s murder on Valentines Day 2013.

But gruesome photos of the scene of Ms Steenkamp’s death have been revealed by investigators which has prompted new mystery around her murder.

Experts Calvin and Thomas Mollett analysed various pieces of evidence for their book ‘Oscar vs The Truth’ - including CCTV stills of the young model as she drove into Pistorius’s estate.

They claim the top she was wearing as she drove in was the same as when her body was found, but that the bullet holes do no match up with her wounds.

The brothers have alleged that the Paralympian redressed his partner following the murder.

Thomas Mollett said: “It can only have been put on afterwards. We can’t say when or why he decided to put it on her, we can only say it was certainly not worn at the time she died.

"There is absolutely no sign of any hole in the vest resulting from the bullet wound to her hip – and the vest is a long one.

"There is no sign of the bullet that struck her chest. And there is very little blood on the vest and it would have been really soaked with blood if she’d been wearing it at the time of the shooting."

LONDON — Content Media has picked up the international sales rights to an Oscar Pistorius documentary feature, which will be introduced to distributors in Cannes next week. The film, titled “Pistorius,” follows the rise and fall of the inspiring, Olympic hero turned convicted murderer.

Vaughan Sivell (“Mr. Calzaghe”) is directing the movie, which is in production, and is producing with Sean Richard for Western Edge Pictures, and the Gennaker Group. “Pistorius” is described as “Making a Murderer” meets “Senna” — “a riveting true-crime story about a beloved sports icon.”

New claims that Oscar Pistorius assaulted girlfriend Reeva Steenkamp before shooting her have been dismissed as absurd by the Paralympian's family.

Pistorius has always maintained that he believed there was a dangerous intruder in his toilet cubicle when he fired into its door and killed Steenkamp, a version of events accepted by original trial judge, Thokozile Masipa.

However, in their book, Oscar vs the Truth, amateur investigators Thomas and Calvin Mollett claim there is evidence to suggest Pistorius battered his girlfriend with a cricket bat and shot her with an air gun before killing her with a revolver.

Pistorius has been living under comfortable house arrest behind high walls at his uncle Arnold's sprawling villa since he was released from jail in October last year. He has not been seen in public since his last brief court appearance in April.

Last month, a new book presented fresh evidence in the case after an analysis of crime scene photographs and post mortem results which had not been put before the original trial.

Investigator Thomas Mollett highlighted a bullet wound on Reeva's body which was compatible with a bullet fired by Pistorius' air gun. A similar projectile was found in the door of the bedroom where neighbours claimed they had heard a violent row between the pair.

A cricket bat, which the sprinter claimed had only been used to break down the locked door behind which Reeva was dying from four gun shot wounds, had also been used to attack the reality TV star....."

IMO, he does not want to take the stand because he can't recall his earlier statements, does not know what new info the State has against him, and he is out of crying tissues and vomit buckets. He has got nothing. And he knows it! So he has others sitting in the court blubbering for him... like he is the victim!
