George Zimmerman's attorneys today acknowledged they have a long, hard fight ahead as they pursue FBI records into the shooting of Trayvon Martin but also admitted they may not get them in time.

In a blog post, Zimmerman's attorneys wrote that they have long believed they would have to ask a federal judge for a subpoena to get the records. That would mean going to a different court than the one handling their client's second-degree murder case.

That's not happened yet. So far, they have convinced the Sanford judge presiding over Zimmerman's criminal case to order the FBI to release the records.

On Monday, lawyers for the FBI filed paperwork with that judge, Debra S. Nelson, asking her to withdraw her Feb. 5 order.

They argue that she does not have the authority to order the FBI to release its case file and that defense attorney Mark O'Mara knows the steps he needs to take to make a formal request.

I know that there is protocol to be followed... but wondering why if these files were so important ... MOM would not have done this so long ago... perhaps he knows GZ is going to spend a long time in the clink and is trying to finds ways to stall and of course make some more $$ for himself in the process! I am really disgusted by the blatant begging for funds to support GZ and MOM.... JMOO

He is complaining because he wants this trial in the fall, not in June. If he doesn't have the records ASAP, he can claim he did not have time to prepare for trial. And that is what he is going for. Move the trial date or ask for a mistrial as there was not adequate time to prepare.

He is full of himself as usual.

The pity trolling is disgusting, imo. MOM's 'spin' to make it sound like he's not getting the much needed information (that is not even relevant to this case) is just another way of playing to the sympathy of the uninformed and the potential jury pool. He 'knew' the formality of requesting the information, but played it this way, imo, just to make it seem like things are being held up beyond their control.

I'm starting to think the prosecution should revisit the possibility of a gag order, but it doesn't look like that will be happening again at this next hearing, as it should have been filed by last Friday to be considered at Tuesday's hearing. Oh well. Hopefully, BDLR has something good to shut him up for a few like he did before...One can only wish!

George Zimmerman's attorneys stunned court observers Tuesday when they waived their client's right to a "Stand Your Ground" hearing slated for April that might have led to a dismissal of the charges in the shooting death of unarmed teenager Trayvon Martin a year ago.

However, the defense lawyers didn't say whether they would waive the immunity hearing outright. They left open the possibility for that hearing to be rolled into Zimmerman's second degree murder trial. Zimmerman, a former neighborhood watch captain in his Florida subdivision, shot and killed the teen, who was visiting a house in the area.

The move allows the defense more time to prepare for the trial this summer, but also raises the stakes.

Estee I agree, I think we all have told "little white lies" about things that are serious so that we can avoid something... I think my neighbour must have had 15 grandmothers... to get out of going to work...
and just because she (Dee-Dee) used an excuse she thought would not be questioned does not make her a liar. IMO It just makes her human. I know that I have had my fair share of "I'm not feeling well so I didn't have to talk with someone too long" So witness 8 in my book is still gold!

I don't know why anyone would be 'stunned'. We know darn well why he's waiving his right to that - for one, he knows it won't work. And two, he'd be "on the record" which the prosecution can use for the 2nd degree murder trial.

Have any of you girls seen an up-to-date picture of Trayvon? I saw one in an e-mail from a friend in FL and forwarded it to fysty and J4a to see if they could post it here, cuz I don't know how. He is about 6'4", weighs about 175 or 180 pounds, has lot of tattoos and gold teeth. I would have been scared of him if I ran into him in the dark, but not with a hoodie on, because you couldn't see the tats or the teeth.

I would really like to see a photo taken from the surveillance video from the convenience store on the night in question... that would be the most telling of the photos... there should be something from behind the cashier that would show his face...

I heard there were some bogus pictures going around in e-mails lately.
I wonder if that is what you received?
They were claiming that Trayvon was 6'4", 180 pounds, which is untrue if you look at the autopsy reports.
The autopsy has him listed as 71" or 5'11" and 158 pounds.

I will try and post the video from the 7-11 if I can find it. He looks older than the Hollister picture, but if you see the pictures from his mom's birthday, which IIRC, was about 9 days before his death; he didn't look 'thuggish' as many would like everyone to believe. He had a Reeces or Reeces pieces(?) shirt on!

Zimmerman renews request to depose Trayvon Martin family attorney

George Zimmerman's defense team on Monday asked Circuit Judge Debra Nelson to reconsider their request to question Benjamin Crump, an attorney for Trayvon Martin's family, in an under-oath deposition.

At a hearing last month, Nelson rejected the Zimmerman attorneys' previous request for a deposition of Crump, who in March conducted an interview with "Witness 8," the key state witness who says she was on the phone with the 17-year-old in the moments before his fatal encounter with Zimmerman.

The new motion is based on a recent revelation that the witness falsely claimed she was hospitalized after the shooting. The defense now argues that her credibility is in question, so learning what Crump knows is all the more important.

Zimmerman attorneys depose Trayvon Martin's girlfriend

George Zimmerman's attorneys were in South Florida late last week, deposing Trayvon Martin's girlfriend, dad, mom and brother, according to newly-filed case records.

On Wednesday, Mark O'Mara took the sworn account of Trayvon's girlfriend, the state's most important witness, at a Miami office of the Florida Department of Law Enforcement.

Shortly after Trayvon's death, she told authorities that she was on the phone with him a few moments before he was shot by Zimmerman, a Neighborhood Watch volunteer who had called Sanford police a few minutes earlier, describing the unarmed 17-year-old as suspicious.

All the Defense has to do is file a waiver of appearance for Zimmerman. He will be there if he wants to be.

Well, if I remember correctly, wasn't KC ordered to appear in court for all hearings, per the judge? I thought if the judge ordered it, the defense could not refuse.

SANFORD - Attorneys for George Zimmerman have filed a new defense witness list, and it includes more than 130 people. Among them: Trayvon Martin's mother and father, their attorney Benjamin Crump, former Sanford police Chief Bill Lee Jr. and former State Attorney Norm Wolfinger.

It also includes Sanford City Manager Norton Bonaparte and several other members of Trayvon's family, including his step-brother and the Oviedo cousin with whom he'd spent the night the evening before he was fatally shot.

Attorneys seldom call all the witnesses they list, still the list placed in the official court file Monday is extraordinary for its length.

It includes many people who clearly have no direct connection to the shooting or what happened Feb. 26, the night Zimmerman killed Trayvon, 17.

Piers Morgan Confronts Robert Zimmerman, Jr. Over Controversial Tweets In Heated Interview


Morgan found it shocking that he would link this “gruesome” case of a teenager allegedly killing an infant to Martin, who was unarmed when he was shot. Zimmerman told Morgan he was misinterpreting his views, telling him that Martin “chose to portray himself in a certain way.” Morgan interrupted him and told him to explain that point.

Zimmerman said the media never showed any questionable pictures of Martin. Morgan found it amazing how he could think “a stupid picture of his Facebook” was important, and told Zimmerman that “you cannot make that analogy without people saying you’re a racist.” Zimmerman shot back that all sorts of negative pictures about his brother were all over the media, but Martin’s social media was “off-limits.”

"I made a mistake," Robert Zimmerman Jr. said during an appearance on CNN's Piers Morgan Live. "It unfortunately may not have helped George."

George Zimmerman was charged with second-degree murder for killing Martin, who was 17, after an altercation in a residential neighborhood in Sanford, Florida.

Prosecutors contend George Zimmerman, then a neighborhood watch captain, racially profiled Martin, then pursued and shot him while Martin was returning from a convenience store to a townhouse where he was staying with his father.

Robert Zimmerman this week posted side-by-side photos of Martin and one of two teenagers arrested last week in a fatal shooting of a 13-month-old boy as his mother was pushing his stroller down the street in a coastal Georgia town.

The separate photos showed Martin and the teenager posing while making an obscene gesture.

Robert Zimmerman wrote in a tweet, "a picture is worth a thousand words ... any questions?" In another tweet, he said, "Lib media shld ask if what these2 black teens did 2 a woman&baby is the reason ppl think blacks mightB risky."

Morgan, in his interview with Zimmerman, called the tweets "incendiary" and "bordering on outright racism."

"I understand this was controversial and I apologize," Robert Zimmerman said.

Mark O'Mara, George Zimmerman's lawyer, has criticized Robert Zimmerman's tweets.

George Zimmerman's trial is set to start in June.

ORLANDO, Fla. – For a second time, a judge is denying a request by George Zimmerman's attorney to depose a lawyer for the family of Trayvon Martin.

Circuit Judge Debra Nelson issued the denial on Thursday.

Zimmerman's attorney, Mark O'Mara, wanted to depose Ben Crump, claiming he could provide testimony that shows a key witness for prosecutors had lied.

Crump interviewed the teen known as "Witness 8" shortly after Martin's shooting death in February 2012.

Prosecutors say Witness 8 was on the phone with Martin moments before he died.

Martin was fatally shot by Zimmerman during a confrontation at a gated community in Sanford, an Orlando suburb. Zimmerman is pleading not guilty to second-degree murder, claiming self-defense. His trial is set for June.

A month-and-a-half delay in Zimmerman's arrest led to nationwide protests.

Attached to a state filing in the case against George Zimmerman on Thursday was a newly public piece of evidence from the young woman who says she was on the phone with Trayvon Martin just before his death.

Prosecutor Bernie de la Rionda's pleading included as an exhibit a letter, apparently written by the young woman dubbed "Witness 8," to Trayvon's parents less than a month after he was shot Feb. 26, 2012.

Trayvon Martin's parents have settled a wrongful death claim for an amount believed to be more than $1 million against a Florida homeowners association where their teen son was killed, Fox News confirms.

Trayvon was shot and killed by Neighborhood Watch volunteer George Zimmerman in Sanford, Fla., on Feb. 26, 2012.

Zimmerman has been charged with second-degree murder, but he says he fired in self defense after the 17-year-old attacked him.

In paperwork made public, both parties specified that they would keep the settlement amount confidential, The Orlando Sentinel reported.

“It is understood and agreed that the payment made herein is not to be construed as an admission of any liability by or on behalf of the releasing parties; but instead the monies being paid hereunder is consideration for avoiding litigation, the uncertainties stemming from litigation as well as to protect and secure the good name and good will of the released parties,” the settlement said.

Benjamin Crump, the Martins' attorney, had “no comment on that subject," he told The Orlando Sentinel.

The document released from the settlement has eliminated the specific amount of the settlement, as well as the names of the parties and people making payment.

The homeowners association president did not return the newspaper’s calls seeking comment on the amount.

Zimmerman’s attorney Mark O’Mara said the teen’s parents tried to settle through mediation and the association had offered $1 million, but they had reportedly rejected this amount, OrlandoSentinel.com reported.

A hearing in which Zimmerman will argue he was acting in self-defense is scheduled for April. The judge has said that hearing will be at least 45 days before the trial. The settlement will not affect the criminal case.

Trayvon Martin's dad on losing his "heart and soul"

Ahead of the trial of George Zimmerman, Trayvon Martin's father, Tracy Martin, told CBSNews.com that he wouldn't have lost his "heart and soul" had Zimmerman not pursued his son.

"Had he just simply obeyed what the dispatcher was telling him, I wouldn't be here today, Trayvon would be getting ready for graduation," said Tracy Martin.

"Trayvon was just going to the store, going back home," said Tracy Martin. "It's extremely tough when you look at the thought process of another individual. And his thought process is, 'here's a young African-American male, he has a hoodie on, he's up to no good.' And that's troublesome. That is very troubling to know there are people that have that thought process."

Together with Trayvon Martin's mother, Sybrina Fulton, Tracy Martin has been lobbying in Florida for the "Trayvon Martin Amendment," which would revise "Stand Your Ground" laws to make it harder to justify deadly force.
