Michael Dunn attorney files appeal saying client should have been acquitted in Jordan Davis death

After a long wait and three deadline extensions, Michael Dunn’s attorney appealed the Brevard County man’s convictions for murder and attempted murder by saying, among other things, the judge should’ve acquitted Dunn.

...Roberts made nine lengthy arguments in the document. Ordered from what he said was the most important to the least, he argued:

■ Judge Russell Healey should’ve acquitted Dunn because the State Attorney’s Office didn’t sufficiently rebut Dunn’s self-defense claims, Roberts wrote.

■ No evidence showed Dunn intended to harm the other three men in the Dodge Durango with Jordan Davis, Roberts wrote.

I first met Ron Davis when he appeared on my talk show in February 2014. Just days before, 47-year-old Michael Dunn had been convicted of three counts of attempted murder in what had come to be known as the “loud music trial.” The jury had failed to reach a verdict on the first-degree-murder charge in the death of Ron’s son, 17-year-old Jordan.

Ron and his ex-wife and Jordan’s mother, Lucia McBath, spoke with me about their son, a popular, athletic, fun-loving teenager who died Nov. 23, 2012, after Dunn fired 10 rounds at Jordan and his three friends following a fight about loud music coming from their SUV in a Jacksonville, Fla., parking lot.  The incident ignited public debate over Florida’s controversial “stand your ground” law after Dunn claimed self-defense, asserting he felt his life was in danger.

Documentary about murder of Jordan Davis makes list of final 15 for Academy Awards

A documentary about the 2012 murder of 17-year-old Jacksonville teen Jordan Davis and the arrest and conviction of Michael Dunn for that crime has been selected as one of 15 finalists in the 88th Academy Awards in the of Documentary Feature.

(This documentary, "3 1/2 Minutes, 10 Bullets" was on HBO last weekend. I thought it was well done.)

Man appeals conviction for killing black teen over loud music outside Jacksonville gas station

JACKSONVILLE — A man convicted of killing a teenage boy after an argument over loud music outside a gas station wants a third trial.

The Florida Times-Union reports an attorney for 49-year-old Michael Dunn of Satellite Beach asked an appeals court Tuesday to throw out his murder conviction and life sentence ( tbtim.es/124v).

Attorney Terry Roberts argued for a new trial, saying prosecutors didn't refute Dunn's claim that Davis had threatened to kill him before the shooting.

Dunn testified at both trials, claiming he acted in self-defense. Dunn, who is white, told jurors that he saw Davis roll down the window and flash what he believed to be a gun after the two exchanged words.

Lawyers ask for new trial for Michael Dunn in 17-year-old's shooting death in dispute about loud music

With a focus on a perceived death threat and that a medical examiner exceeded her area of expertise, an attorney representing Michael David Dunn asked the 1st District Court of Appeal in Tallahassee to throw out his conviction in the death of 17-year-old Jordan Davis.

Attorney Terry Roberts argued Tuesday that the convictions and life sentence should be thrown out because prosecutors did not successfully rebut Dunn’s statement that Davis threatened to kill him minutes before the shooting. Roberts also said forensic pathologist Stacey Simons shouldn’t have testified about whether Davis had opened the vehicle’s door because she is not an accident scene reconstructionist.

Throughout the second trial, prosecutors portrayed Dunn as a cold-blooded killer. He never called 911 after firing into the SUV, and afterward he went back to his hotel, made a drink, ordered pizza, walked his dog and went to sleep.
